NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Ordinance No. -08 Loras College Oaks Housing Project Page 2 Section 2. .That pursuant to Iowa Code Section 414.5(2003) and as an express condition of amending the Loras College ID Institutional District, the undersigned property owner(s) agree(s) to the following conditions, all of which the property owner(s) further agree(s) are reasonable and imposed to satisfy the public needs that are caused directly by the zoning reclassification: A. Use Regulations. The following regulations shall apply to all uses made of land in the above- described ID Institutional District: Principal permitted uses shall be limited to: a. Colleges and universities. b. Vocational schools. c. Seminaries. d. Offices for administrative personnel or other institutional .employees and affiliates. e. Churches, libraries and museums. Classrooms, laboratories, lecture halls, and similar places of institution. g. Off-street parking and loading. h. Recreational or athletic facilities for the primary use and benefit of the institutional residents or affiliates. Single-family, two-family, ormulti-family dwellings for the housing of institutional residents or affiliates. 2. Accessory Uses: The following uses shall be permitted as accessory uses in the above-described ID Institutional District: a. Located entirely within a principal building, bookstores or bars seating not more than seventy-five(75) persons at one time and located not closer than two hundred feet (200') from the nearest residential or office residential district. b. All uses customarily incidental and subordinate to the principal use it serves, but not to include commercial use outside the principal building. 3. No conditional uses shall be allowed. Lot and Bulk Regulations Development of land in the ID Institutional District shall be amended as follows: The proposed Athletic and Wellness Center shall be located in conformance with the attached campus development plan and all final site development plans are to be approved in accordance with provisions of the ID Institutional District regulations. C. Performance Standards The development and maintenance of uses in this ID Institutional District shall be established in conformance with Section 3-5.2 of the Zoning Ordinance and the following standards: 1. New outdoor lighting for the proposed Oaks Housing Project and new parking lot shall use 72-degree cut-off light fixtures. 2. Landscaping shall be provided in compliance with Section 4-4 of the Zoning Ordinance. 3. All utilities, including telephone and cable television, shall be installed underground. 4. Final site development plans shall be submitted in accordance with Section 4-4 of the Zoning Ordinance. D. Parking Requirements The off-street parking requirements for the principal permitted uses for the herein described ID Institutional District shall be regulated as follows: That thirty-two (32) parking spaces shall be provided in a new parking lot addition on the east side of the existing Byrne Oaks parking lot. 2. That the existing tennis courts at the northeast corner of 17t" and Cox Streets be converted to a 103-space parking lot with completion timed to coincide with the opening of the Oaks Housing project. 3. That the existing forty-eight (48) space parking lot adjacent to the San Jose Swimming Pool will be designated for use by the residents of the Oaks Housing Project. 4. A minimum of 1,190 off-street parking spaces shall be maintained for the Loras College Institutional District. 5. Any significant expansion or reduction in the number of off-street parking spaces must be reviewed by Planning Services staff for compliance with the adopted institutional district requirements. Open Space and Recreational Areas Those areas not designated on the conceptual development plan for the development shall be maintained as open space, as defined by Section 8 of the Zoning Ordinance by the property owner and/or association. F. Sign Regulations The sign regulations shall be the same as that which are allowed in the ID Institutional District as established in Section 4-3.11 of the Zoning Ordinance. G. Additional Standards That all previously approved campus development plans are hereby amended to allow for the attached development plan. H. Transfer of Ownership Transfer of ownership or lease of property in this ID Institutional District shall include the transfer or lease agreement a provision that the purchaser or lessee acknowledges awareness of the conditions authorizing the establishment of this district. Modifications Any modifications of this Ordinance must be approved by the City Council in accordance with zoning reclassification proceedings of Section 6 of the Zoning Ordinance. Section 3. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 4. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed Oaks Housing Project, noting that the Commission had tabled the request from the previous meeting to allow Loras College officials to reconsider parking arrangements on this portion of the campus. John McDermott, representing Loras College, indicated the existing tennis courts will be converted to a 103-space parking lot and access to the San Jose Pool building would be restricted to the Graber Center entrance. Staff reviewed the location of existing parking lots on the north side of campus, availability of off-street spaces in these lots and the availability of on-street parking along Kirkwood Street. There was one public comment in support of the request. There was one public comment regarding availability of on-street parking around Loras College campus and the impact on adjacent neighborhoods. The Zoning Advisory Commission discussed the request, noting that the applicant has addressed the concerns raised at the last meeting by converting the existing tennis courts to parking and assigning the 48-space lot next to San Jose Pool to the residents of Oaks Housing Project. Kritz, Associate Planner Dubuque ~ r 2007 August 25, 2008 SUBJECT: Amendment to Loras College ID Institutional District -Oaks Housing Project INTRODUCTION The Zoning Advisory Commission tabled Loras College's request to amend their Institutional District to allow construction of the Oaks Housing Project located on the north side of the campus. The Commission was concerned about the provision of off- street parking for the project; specifically, assigning the 48 spaces currently adjacent to the San Jose Pool building to the residents of the proposed Oaks Housing Project. The Zoning Advisory Commission requested that Loras College officials re-evaluate the proposed parking plan for the project. DISCUSSION The applicants have provided new information regarding the use of the San Jose Pool building parking area and have proposed additional off-street parking to be provided both at the existing Byrne Oaks parking lot north of the subject project and conversion of the existing tennis courts at the corner of Cox and 17t" Streets to a 103-space parking lot. Loras College officials indicate that access to the San Jose Pool building is planned to be restricted to access through the Graber Sports Center building. This change was planned as part of a general review of security issues on campus and that because access will be limited to the Graber Sports Center building, that the proposed 103- spaces at Cox and 17t" Street would be the closest available off-street parking for people accessing either Graber or San Jose Pool. RECOMMENDATION Planning staff recommends that the Zoning Advisory Commission review the additional information submitted by Loras College and make a recommendation on the proposed institutional district amendment to the City Council. Box 178 Dubuque, IA 52004-0178 (319) 588-7100 August 22, 2008 City of Dubuque Attn: Zoning Advisory Commission 50 W. 13th St. Dubuque, Iowa 52001 At the Zoning Advisory Commission Meeting on August 6, 2008 the request to amend the Loral College ID Institutional District to allow for the Construction of a 32 unit Oaks Housing project was tabled due to further evaluation of the proposed parking plan. Loras College's proposal addressed all the requirements that were set forth as it relates to a ratio of 1.5 spaces per unit and the requirement of 1190 spaces within the Institutional District. We believe that Loras has complied with the requirements. We will further elaborate on steps that have been taken to address the concerns of the Commission. After further evaluation, the proposed expansion of 32 spaces to the existing Byrne Oaks parking will increase that lot from 53 to 85.If these spaces were converted to an allowable amount of compact spaces, the total parking would increase to 95.. Loral believes further expansion of the lot to the west would compromise the available green space that we believe is important to provide gathering spaces for our students. An expansion to the east would get involved with the proposed detention area. The 48 spaces that are located west of San Jose, will be dedicated to the Oaks project. There was some concern at the Commission level about the need to maintain these spots as San Jose spaces. Loral maintains that we, as a College, have the option of assigning parking spaces on campus to the best benefit of the overall campus community. While we believe we are generous in allowing public venues to take place on our campus, it is first and foremost for the use of our students and the Loral Community at large. With that in mind, as we suggested at the meeting on the 6th when asked by Commissioner Smith, we purpose to convert the existing tennis courts to parking upon successful completion of the Oaks project. The parking capacity of this area will be 103 which exceeds the number of spots that are currently available to the west of San Jose. For those that are unfamiliar with the arrangement of Graber Sport Center and San Jose, they are connected and parallel to Cox Street. In an ongoing effort to control the access to these buildings we are proposing to have the point of entry be the south end of Graber which is diagonal to the proposed parking. We believe this change will decrease our internal liability by monitoring the pools access via a control station at the entrance to Graber. With these proposed changes, we respectfully ask that you approve our proposed amendment to the Institutional District to allow Loras to move forward with the Oaks Housing Project. Box 178 Dubuque, IA 52004-0178 (319) 588-7100 June 27, 2008 City of Dubuque 50 W. 13`h St. Dubuque,lA 52001 Dear Honorable Mayor and City Council Members, Following studies of the current and future student housing needs on campus, as well as the state of current facilities, Loras College has embarked on amulti-phased plan to upgrade and enhance the residential components of the campus. The initial phase of this plan involves the construction of a new facility, the Oaks Housing project on the north side of campus. Construction of this new campus building will allow for current facilities to be remodeled and upgraded without taking away from current campus bed totals. The proposed Oaks Housing project is a 36,700 sf, 128 bed facility. The 32 units will house 4 students each with a unit containing either two double occupancy rooms, or a double room and two single occupancy rooms. Additionally, each unit will contain a private bath, small kitchenette, an additional lavatory sink outside of the bathroom, and a living room area. A community commons area will also provide laundry facilities, a full kitchen and gathering space for students complete with a large screen television. The area coordinator who will provide supervision and guidance for the students, will also be housed at the facility in a fully functional two bedroom apartment. Sited on a sloped area just north of Rohlman Hall, west of the Graber Sports Complex and San Jose Swimming Pool, and south of the Byrne Oaks Housing Complex, the Oaks Housing project will begin the task of better connecting the Byrne Oaks facility to the upper parts of campus. With the slope of this internal campus site, the "L" shaped footprint of the project will step with the hill. The north leg of the "L"' will be 4 stories tall, while the southern leg will step up the hill and be three stories, with the south end being only two stories exposed above grade. Great care has been taken to minimize the impact on the surrounding landscape by careful placement of the building. The project will be constructed out of metal load bearing studs and wood floor joists and roof trusses. Masonry veneer will be used extensively as the exterior finish along with aluminum clad wood windows and an asphalt shingled roof. A geothermal heat pump system will be implemented, which will feed individual heat exchangers (furnaces) at each unit, and provide ducted forced air heating and cooling for each unit. The geothermal well field will be located in the existing parking lot just north of the San Jose Swimming Pool. The use of sustainable building materials with special consideration to energy conservation are consistent with Loras College's involvement with The American College and Universities Climate Commitment. In conjunction with the construction of the Oaks Housing project, 32 additional new parking stalls on the east end of the existing lot along Kirkwood Street will be added. The remainder of the parking will be accounted for by designating the existing 48 stalls at the San Jose Swimming Pool lot for the Oaks Housing project, bringing the total for the Oaks Housing project to 80 stalls. Those currently parking at the San Jose lot will be shifted to the new parking across Cox Street at the recently completed AWC parking lot. Loras College remains committed to providing its students with the finest in not only educational opportunities but also in terms of facilities as demonstrated by the Oaks Project. Property History: Loras College has amended its Institutional District three times since 2000, including the new academic resource center in 2000, the Garden Apartments at the end of Henion Street in 2001, and the athletic/wellness center along Cox Street in 2006. Physical Characteristics: The proposed location of the new Oaks Housing Apartments is south of the existing Byrne Oaks Apartments, which are adjacent to Kirkwood Street and north of Rohlman Hall. The property is sloped toward the northeast. The project also includes expansion of the existing parking lot serving the Byrne Oaks Apartments by 32 spaces and reassigning the 48 spaces adjacent to the San Jose Pool Building to residents of the new Oaks Housing project. PLANNED DISTRICT STAFF REPORT Page 2 Staff Analysis: Streets: The proposed site for the Oaks Housing project is not adjacent to any existing public street. Residents of the apartments will utilize either Kirkwood Street or Cox Street to access assigned parking. Sidewalks: The proposed Oaks Housing project will be tied in with the existing campus, pedestrian sidewalk system both to the north and south. Anew concrete sidewalk is proposed from the back of Rohlman Hall to the south entrance into the building. The western access also will be available from the 48 space parking area adjacent to San Jose, as well as sidewalk and steps coming up from the expanded parking lot adjacent to the Byrne Oaks housing project. Parking: The proposed project concludes the expansion of the Byrne Oaks parking lot by 32 spaces located adjacent to Kirkwood Street. In addition, the existing 48 spaces adjacent to San Jose pool will be assigned to residents of the new building. This parking lot will be totally reconstructed as part of this project as Loras College plans on utilizing a closed loop geothermal system and sinking the wells in the area now occupied by the existing parking lot adjacent to San Jose. The proposed parking for the Oaks Housing will total 80 off-street parking spaces. Lighting: New outdoor lighting will be required to be a cut-off designed to minimize adverse impact to the adjacent properties. Signage: Signage will be regulated as per the existing ID regulations. Bulk Regulations: The proposed Oak Housing site is located in an area between the existing Byrne Oaks apartments and Rohlman Hall. The proposed building will be located in substantial compliance with the attached conceptual plan. Permeable Area (%) & Location (Open Space): The proposed Oaks Housing project and expansion of the Byrne Oaks parking lot will reduce the amount of open space on this side of campus; however, as a whole, the Loras College campus will retain a substantial amount of green space and the new building and parking lot expansion will not significantly reduce the useable open space on the campus. Landscaping/Screening: The ground around the new Oaks Housing project and parking lot will be landscaped with trees and shrubs. Walkways will be constructed to connect the proposed building with the rest of the campus and the surrounding sidewalk system. Phasing of development: None. Impact of Request on: . ~ PLANNED DISTRICT STAFF REPORT Page 3 Utilities: Existing utilities are adequate to handle the proposed building. Traffic Patterns/Counts: Vehicle access to the proposed parking lots serving the Oaks Housing project will use either Kirkwood or Cox Streets. There are no vehicle counts available for either street. Public Services: Existing public services are adequate to serve the proposed new building. Environment: Planning Services staff does not anticipate any adverse impact to the environment provided adequate erosion control is practiced during all phases of construction. Loras College has submitted information on how they intend to handle storm water detention on the site for the proposed new project. The City's Engineering Department is reviewing the storm water information as part of the site plan submitted for the project. Adjacent Properties: The proposed Oaks Housing project and parking lot improvements will provide a positive investment to Loras College's north campus area. The proposed site is relatively removed from existing single-family residential housing which is on the north side of Kirkwood Street. Because of the expanded student housing and parking spaces, additional vehicle trips will likely be created on both Kirkwood and Cox Streets; however, the actual increase will be a small percentage of the existing vehicle trips currently utilizing both roadways. CIP Investments: None proposed. Staff Analysis: Loras College is proposing the construction of the new Oaks Housing to be located between the Byrne Oaks Apartments and Rohlman Hall. The proposed dwelling units will be located in a single building that will be four stories in height. The building will be built partially into the hillside that is above Byrne Oaks Apartments. The apartments will provide 32 units with 128 beds for Loras College students. In addition, the existing parking lot that now serves Byrne Oaks Apartments will be expanded with 32 additional spaces. The existing 48-space parking lot adjacent to San Jose Pool will be assigned to residents of the new apartments for a total of 80 spaces assigned to the Oaks Housing project. Amendments to Institutional Districts are required when either the physical boundaries of the campus are being expanded or a significant building expansion is taking place on campus. The current request involves the latter. Notices were sent all properties within 200 feet of the entire Loras College ID boundaries. The proposed Oaks Housing Apartments will provide 32 apartments with a total of 128 beds. Loras College has proposed that there will be a total of 80 parking spaces PLANNED DISTRICT STAFF REPORT Page 4 assigned to the new housing located in a 32-space expansion of the Byrne Oaks Apartments parking lot and reassigning the 48 spaces adjacent to the San Jose Pool. This works out to be approximately 1.6 beds per parking space. When the Byrne Oaks Apartments were developed in 1989 near Kirkwood Street, there were 103 beds and 55 parking spaces provided (1.87 beds per space). In 2001, when the Garden Apartments on Henion Street were developed, there were 32 parking spaces provided for the net increase of 60 beds (1.87 beds per space). The current request provides parking at a higher ratio than either of the two preceding housing projects on the Loras College campus. The proposed project includes utilizing the 48-space parking lot next to San Jose Pool as the well field for a closed loop geothermal system that will provide heating and cooling to the Oaks Housing project. In addition, a new storm water detention basin will be located at the southwest corner of Kirkwood and Cox Streets.
