Water Pollution Control Plant Manager Jonathan Brown is recommending acceptance of
the Cedar Street/Dog Track Pumping Station Improvements Project, as completed by
Portzen Construction, in the final amount of $1,441,581.41, which is an increase of
2.97% from the original contract of $1,400,000 due to increased work related to
pumping costs and changes in materials and additions to the project requested by the
City.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provide for the acceptance of the construction contract for the
Cedar Street/Dog Track Pumping Station Improvements
BACKGROUND
The City Council, at its August 7, 2006 meeting, approved the awarding of the Cedar
Street/Dog Track reconstruction contract to Portzen Construction for $1,400,000. The
improvements have been completed and the City is successfully operating the pumping
stations. WHKS & co. of Rochester MN, the engineering consultants for the project, has
recommended that the City accept the project and make final payment in the amount of
$10,000 to:

DISCUSSION
The Cedar Street/Dog Track Lift Station Improvements was completed by Portzen
Construction of Dubuque Iowa, in the final amount of $1,441,581.41 which is an
increase of 2.97% from the original contract of $1,400,000. Portzen Construction
requested and received a change order of $48,593.91 for work completed from March 6
through March 13 on the Cedar Street lift station related to increased work related to
pumping costs incurred. Additional change orders totaling $22,987.50 were incurred for
changes in materials and additions to the project requested by the City. A ($20,000)
decrease was given for a change in the exterior finish of the Cedar Street Station which
leaves a total increase of $41,581.41 from the original contract.
BUDGET IMPACT
The project cost summary for the Cedar Street/Dog Track Lift Station Improvements is
as follows:
Construction Contract $1,400,000.00
Change Orders $ 41,581.41
Total Construction Costs $1,441,581.41
The CIP for this project was developed by the combination of the Cedar Street CIP and
the Dog Track CIP into one larger project with the final CIP amount of $1,454,472.

RECOMMENDATION
I recommend that the City Council accept the improvements and establish the final
contract at $1,441,581.41 and authorize the final payment of $10,000 to Portzen
Constuction.
ACTION REQUESTED
The City Council is requested to adopt the attached resolutions accepting the
improvements and establishing the final construction cost for the Cedar Street/Dog
Track Pumping Station Improvements.

ACCEPTING THE CEDAR STREET/DOG TRACK PUMP STATION
IMPROVEMENTS AND AUTHORIZING THE PAYMENT OF THE CONTRACT
AMOUNT TO THE CONTRACTOR
Whereas, the Public Imporvement Contract for the Cedar Street/Dog
Track Pump Station Improvements has been completed and the Engineer has
examined the work stating the Project has been completed according to the
terms of the Public Improvement Contract and that the Water Pollution Control
Manager recommneds that the Project be accepted; and
NOW THEREFOREM BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. The recommendation of the Water Pollution Control Manager is
approved and the Project is hereby accepted with a final contract amount of
$1,441,581.41.
Section 2. The Finance Director is hereby directed to pay to the
Contractor from 7101291 73211 CIP for the contract amount of $10,000,00.
