SECTION L
in consideration oP the faithful per-
ormance and observance oP the con-
litions and reservations hereinafter
pacified, the right is hereby granted
o the Interstate Power Cumpany, a
:urpora[ion organized under the laws
of the State oP Delaware, its success-
ara and assigns, hereinafter referred
to as the Company, the right to enact,
naintain, and operate its existing
±lectric generating, transmission, and
distribution facilities and additions
thereto, in, under, over, along, across,
and upon the streets, lanes, avenues,
sidewalks, alleys, bridges, parks,
highways, and other public places in
the City oP Dubuque and subsequent
additions thereto, far the purpose oY
producing and distributing electricity
for sale to said City and the inhabi-
Cants thereof, for light, heat, power,
and other purposes in accordance
with the laws of the State of Iowa
and the ordinances and regulations
of the City of Dubuque, for a period
of twenty-ffve (25) years following
ulfillment of Section RIV hereo[.
SECTION II.
The Company's transmission and
distribution system poles, wires, and
appurtenances shall be located, erect-
ed, and maintained so as to not en-
danger or interfere with the lives oP
persons or [o interfere with any im-
provements the City may deem proper
to make, or to unncessarily hinder ar
obstruct the free use of the streets,
alleys, bridges, or other public prop-
erty.
The City Council, under reasonable
regulations, reserves the right to
require the Company to place its con-
ductors underground and to desig-
nate the districts in wnrch such work
shall be performed, and also to order
the removal or relocation of poles,
wires and other appurtenances erect-
~d by the Company, whenever, in the
udgment of the City Council, such
action Is necessary in the public in-
erest, and the Company shall forth-
~rith comply with any and all instruc-
ions and directives In ouch matters
.t its own expense.
Construction and maintenance, of
he transmission and distribution sys-
em shall be in accordance with the
pecifications contained in the pub-
icatfon titled "Safety Rules for the
Installation of Electric Utilization
Equipment" prepared by [he United
States Bureau of Standards, in force
at the time of construction, and un-
der the supervision and subject to
he restrictions and control of the
City Council,
SECTION [II
In the maintenance and operation o1
is electric transmission and distribu-
.ion system in the streets, alleys, and
ether public places and in the course
rf any new construction or additions
o its facilities, the Company shall
rroceed so as to cause the least pos-
ible inconvenience to the general
rublic; any opening, or obstruction in
the streets or other public places,
made by the Company in the course
of its operations, shall be guarded and
protected at all times by the place-
ment of adequate barriers, fences, or
hoardings, the bounds of which dur•
Ing periods of dusk and darkness
shall be clearly designated by red
warning lights.
Whenever the Company shall take
np or disturb any pavement, side-
walk, or other improvement of any
street, avenue, alley, or other public
place, the same shall be replaced and
the surface restored in as good con-
dition as before entry within forty-
eight hours after completion of the
Company's work. L'pon the failure of
the Company to make such restora-
tion within such time, or to begin
such restoration within such time,
if the restoration cannot be made
within such time, or upon the Com•
pang's delay of more than 24 hours in
the continuation of a restoration be-
gun, the City may serve upon the
Company notice of the City's intent
to cause the restoration to be made
and, unless the Company within
twenty-four hours after receipt of
such notice begins or resumes the
restoration, [he City may cause the
proper restoration to be made, includ-
ing the removal of excess, dirt, and
the expense of same shall be paid by
the Company upon demand by the
City.

SECTION IX.
Should the City of Dubuque at any
time during the life of this Ordinance,
desire to acquire by purchase the
public transportation system of the
Company serving the City oY Du-
buque, It shall, on September first of
any year, give the Company ninety
days notice in aTiting of its inten-
tion, whereupon the Company and the
City shall each name one representa-
tive and the two so named will choose
a third party who shall be a com-
petent appraisal engineer, who with
them shall constitute a Board of Ap-
praisal which shall immediately pro-
ceed to determine the actual value of
the public transportation system of
the Company serving the City of Du-
buque, taking into consideration all
elements of value recognized by com-
petent authority and law, but with-
out including any value for the fran-
chise herein granted. Such value
when determined shall be binding
upon both parties subject only to the
approval of any duly constituted reg-
ulatory body or commission whose
approval is required by law.
Upon payment by the City of an
amount equal to the agreed value of
the transportation system, the Com•
pang, its successors and assigns, shall
deliver and convey to the City free
and clear of all incumbrances, all
rights, and title in and to said prop-
erty and al] rights, privileges and
franchises granted herein to the Com-
pany shall be terminated.
SECTION X.
The Company shall indemnify and
hold the City harmless at all times
during [he term of this grant, from
and against all claims Yor injury or
damage to persons or property, both
real and personal, caused by the op-
eration or maintenance of any struc-
ture or equipment authorized or used
pursuant to authority oP this Ordi-
nance.
The Company, upon receipt o!
due notice in writing from the City
shat] defend at its own expense, any
action or proceeding against the City
of Dubuque arising from the Com-
pany's activities in the operation of
its public transportation system.
Should a judgment be rendered
against the City in any such action,
the amount of such judgment and
costs shall be conclusive against the
Company in any action brought by
the City against the Company as to
the liability and the amount of dam-
ages.
SECTION xl.
Should any section, clause or pro-
vision of this Ordinance be declared
nvalid by a court oP record, same
shall not affect the validity of the
Ordinance as a whole or any part

age by the City Council, its approval
and ratification by the legal voters
of the City of Dubuque and the ac-
ceptance of its terms by the Grantee
or its ass[gns in writing and its pub-
ication in The Telegraph-Herald, the
official newspaper of the City of Du-
buque.
The question whether this ordinance
shall be approved and the foregoing
franchise take effect shall be sub-

Gentlemen: With reference to
the above claim, on January 25,
1946, claimant fell on an icy cross-
walk while crossing the alley at
12th Street at the rear of St. Luke's
Church fracturing his left ankle in
two places. This walk was covered
with dangerous ice. Mr. Hickey has
been laid up since said time and the
amount he claims is $32.00 being
the amount of his doctor bill.

I recommend that his claim be
allowed in the sum of $32.00 and
that a warrant be issued payable to
John Hickey for that amount and
delivered to him upon delivery to
the City of a release properly exe•
toted by him.

At the May 6th meeting of the coun-
cil the petition of Clarence Strub
et al requesting the grading and
improvement of West Third Street
from North Grandview Avenue to
Algona Street was referred to the
council to view the grounds. De-
velopment of this street to a width
of 50 feet necessitates the pur-
chase of three parcels of land on
the northerly Bide of the street at
which point the right-of-way is
presently only 25 feet in width.
The southerly 25 feet of Lot 2 of
30 of Ann O'I3are's Sub on the
Grandview Avenue end has been of-
fered the city far $1,000.00 through
H. R. Hanger, agent for Mrs. C. A.
Kearney. I have negotiated with
the owners of the 25 foot strips
needed from Lots 24 and 25 of Ann
O'Hare's Sub. Both owners agree
to sell for $350.00 each.

I recommend that the City Coun-
cil authorize the purchase of these
parcels by the passage of the at-
tached resolution and that a grade
be adopted for West Third Street
from North Garndview Avenue to
Algona Street.

ly come before a regular meeting
of the City Council.
Councilman Murphy moved that
the rules be suspended for the pur-
pose of allowing anyone present in
the Council Chamber, who wishes
to do so, to address the Council.

laid and adopted by ordinances
adopted tonight and the necessary
grading found to be 21,900 cu. yds.

Our investigation far the sanitary
sewers discloses that two projects
should be undertaken. The first is
the construction by fhe city of a
new trunk sewer beginning in
White Street at East 16th Street;
thence northerly in White Street
to East 22nd Street; thence wester-
ly in East 22nd Street and in Kauf-
man Avenue to the water level
property; thence southwesterly
along the water level property and
in the ravine between the Clarke
College property and the Bunker
Hill Golf Course to Seminary Street
at approximately the old corpora-
tion line and thence fn Seminary
Street to the Asbury Road,
The second project would consist
of lateral sewers in the various
streets of the subdivisions connect-
ing to a wet well, a pumping lift
station near the intersection of
Morningview and Hillcrest Roads,
a cast iron force line from the
pumping station to connect with
the proposed trunk sewer outlined
above at Asbury and Seminary
Streets.
The second project is one subject
to special assessment procedure
and I recommend that plans, speci-
fications and a plat and schedule
be prepared preliminary to the
adoption of a resolution of neces-
sity, The first or trunk sewer pro-
ject outlined is approximately
three miles in length through rath-
er difficult and rocky terrain and
will not only involve a hearing upon
plans and specifications, but a bond
issue to provide the construction
funds required.
The Iowa Development Company
is desirous of proceeding with all
possible speed in the erection of 91
units to Ihouse 104 families and
have requested that every effort
be made to expedite the project.

This Agreement made and enter-
ed into this 10th day of June, 1946,
by and between the City of Du•
buque, Iowa, a municipal corpora-
tion hereinafter called the "City,"
and the engineering firm of Con-
soer, Townsend & Associates, a
co-partnership, herinafter called
"Engineers."
Witnesseth:
Whereas, the City is contemplat-
ing the construction of new storm
relief sewers so as to provide re-
lief to existing inadequate storm
sewers, and
Whereas the engineers represent
themselves to be qualified and ex•

perienced in the design and super-
vision of construction of such mat-
ters as storm relief sewers and cap•
able of serving the City as consult-
ing engineers in such matters now,
therefore, and in consideration of
certain amounts hereinafter speci-
fied to be paid to the Engineers by
the City, the Engineers agree to do,
at their own cost and expense, all of
the engineering work to the satis-
faction of the City.
DIVISION A-Surveys, Detailed
Designs, Detailed Plans, Construc•
lion Drawings, and Specifications.
For the surveys and for the pre-
paration of complete designs, plans,
construction drawings, specifics~
lions, and contract documents, for
any work authorized to be done un-
der this contract by the City, Con-
soer, Townsend & Associates'
charges will be 3r/2% of the esti-
mated constriction cost of the
work,
Services to be rendered under
Division A are to be as follows:
(1) The Engineers shall make
all necessary additional field sur-
veys, and prepare complete designs,
plans, profiles, and specifications
for storm water relief sewers, to-
gether with all appurtenances.
The detailed work under this Di•
vision A shall be undertaken only
when the Iowa State Board of
Health and the City indicates their
approval of the general bases of
design covering sizes, location and
types of the sewers, together with
the necessary appurtenances.
(2) The Engineers shall pre-
pare detailed estimates, showing the
quantities and estimated construc•
lion cost of all work undertaken
under Division A,
(3) The Engineers shall pre-
pare complete specifications for
the various features of the work,in-
rluding proposal forms, contract
forms, bond Eorms, and all other
features essential to complete con•
tract documents.
(4) The Eugineers shall supply
copies of the final plans and speci-
fications to the State Department
of Health and obtain their approval
thereon.
(5) The Engineers shall pre-
pare all maps, and sketches, as-
semble necessary engineering in-
formation incidental to obtaining
from the State, County, Township,
Federal Government and/or others,
any permits or licenses that may be
necessary to the prosecution of the
work.
(6) The Engineers shall sup-
erintend the making of any neces-
sary test borings or test pits which
may be needed for the proper de-
sign of the various features of the
work. Labor and/or costs inciden-
tal to the making of such test bor-
ings or test pits are not to be in-
cluded in the Engineers' fees as
hereinafter set forth,
(7) The Engineers shall assist
the City in interesting experienced
and qualified contractors in bid-
ding on the work, canvas construc-
tion bids, and assist the City in the
award of the construction con-
tracts.
(8) The Engineers shall provide
all other engineering services that
may be required up to the time the
various features of the work are
placed under contract.
(9) The Engineers shall assist
the City in the preparation of a
financial structure, rate and secur-
ity schedule, type of security, for
the full and complete amortization
oP the investment in the contem•
plated improvements.
(10) The Engineers shall at all
time keep the City fully informed
as to the design features of the pro-
posed systems of storm relief sew-
ers.
The three and one half percent
(3~Z%) Engineers' charge for work
under Division A, will be due and
payable upon completion and de-
livery of detailed plans and speci-
fications to the City and shall, at
that time, be based upon the En-
gineers' estimated construction
cost of the work.
This estimate of Cost shall be
based upon the average costs for
1940, as established by the local
building or constructiou industries,
plus the per cent of increase in the
average cost indexes for such in-
dustries for the year in which the
Engineering work under Division A
is performed, over 1940, as estab-
lished by the Engineering News
Record, and shall also be subject
to approval by the City.

DIVISION B-Supervision of
Construction:
For the Supervlaion of Construc•
lion of any of the work included in
the Preliminary Plan, for which
complete plans are prepared under
Division A, Consoer, Townsend &
Associates' charge will be one and
one half percent (1~%) of the ac•
tual.construction cost of the work.
Services to be rendered under
Division B are as follows:
(1) To have a principal of the
firm visit the construction work at
least once a month, or as often as
may be necessary in the opinion of
the City, during the construction
period, to go over the work in de-
tail with the Resident Engineer,
with Contractors, with City Officials,
and to attend conferences relative
to the work when so requested.
(2) To carefully check and ap-
prove all equipment drawings,
working drawings, shop drawings,
layout drawings, plans for piping,
valves, and bar company drawings
of reinforcing steel, as submitted
for approval by contractors, sub•
contractors, and manufacturers.
(3) To adapt original plans to
conform to approve manufacturers
equipment and material.
(4) To carefully check and ap-
prove monthly and final estimates
of cost.
(5) To furnish complete consult-
ing service during the entire per-
iod of construction.
{6) To furnish the City final
costruction "as built" drawings.
The one and one half percent
{l~%) Engineers' charge for the
work under Division B will be due
and payable according to the ac-
tual progress of the construction
work, and shall be based upon the
monthly estimates for construction
work performed by the construc-
tion contractors.
DIVISION C-Resident engineers
and Inspectors:
The services under Division C
shall be Provided by the Engineers
only upon the specific direction of
a duly authorized official of the
City; it being understood that the
cost of such services is not includ-
ed in the engineering charges speci-
fied previously herein.
The Engineers will furnish at
cost to the City, Resident Engineer,
field staff and construction inspec-
tton personnel as may be needed,
to lay out and supervise the wn•
atruction work, Such personnel
may be furnished in whole or in
part by the City, but whether pro-

Whereas, the City Council of the
City of Dubuque, Iowa, has by Reso•
lutian No. 78.46 given its prelimin-
ary approval on the proposed plans,
specifications a.nd form of contract
and placed same on file in the office
of the City Clerk for public inspec-
tion, for the paving of Euclid Street
from the present pavement in Wind-
sor Avenue to approximately twen-
ty two feet west of the east proper- ,
ty line of Sheridan Street. Estimat-
ed cost $5,229.69 and
WHEREAS, the proposed Resolu-
tion of Necessity for said improve-
ment has been introduced and is
now on file in the City Clerk's of-
fice for public inspection,
BE IT THEREFORE RESOLVED
that on the 1st day of July, 1946, a
public hearing will be held at 7:30
oclock P. M. in the Council Chamber
in the City of Dubuque at which
time the owners of property subject
to assessment for the proposed im-
provement may appear and make
objection to the proposed plans and
specifications and proposed form of
contract and at the same time to
the boundaries of the proposed dis-
trict, to the cost of the improve-
ment, to the amoun~ proposed to be
assessed against any lot and to the
passage of the proposed Resolution
of Necessity and the City Clerk be
and he is hereby directed to cause
a notice of the time and place of
such hearing to be published in
some. newspaper published in the
City of Dubuque, the last of which
shall be not less than two (2) nor
more than four (4) weeks prior to
the day fixed for its consideration
and unless property owners at the
time of final consideration of said
resolution have on file with the
Clerk objections to the amount of
the proposed assessment, they
shall have been deemed to have
waived all objections thereto, at

stated that service thereof had
been duly made and that this meet-
ing is called for the purpose of con•
sidering an ordinance granting to
the Iowa Improvement Company
permission to construct a sanitary
sewer connecting with the City
sewer at its junction at Hillcrest
and Asbury Streets with various
laterals in the streets in Hillcrest
Park and Hillcrest Subdivision No.
2 with pumping lift station near
the intersection of Morningview
and Hillcrest Road and acting on
any other business as may proper-
ly come before a regular meeting
of the City Council,

An Ordinance granting to the
Iowa Improvement Company per-
mission to construct a sanitary
sewer connecting with the City sew-
er at its junction at Hillcrest and
Asbury Streets with various laterals
in the streets in Hillcrest Park and

Whereas, plans and specifications
have been duly presented to the
City Council for the clearing,
grubbing and grading of Avalon,
Broadlawn, Morningview, Chaney,
Ogilby, Mul]iu, Valleyview and Hill-
crest Roads in the City of Dubuque.
And Whereas, it appears that the
cost thereof will exceed the sum
of $5,000.00.
And Whereas, before any such
contract may be entered into the
City Council shall adopt proposed
plans and specifications and pro-
posed form of contract, and fix a
time and place for hearing there-
on.
Now. Tharafore Be It Resolved;
That the hearing on the question
of adopiing said proposed plans and
.specifications and the proposed
form of contract be and the same
is hereby fixed for 7:30 P. M. July
15, 1946, in the Council Chamber

Briggs, while driving on Seminary
Street, struck a hole in the street
which had apparently been refilled
in connection with the sewer line,
causing damage to the front end
of his car in the amount of $22.48.
It is my opinion that the City was
negligent in failing to take care of
this condition and that this damage
should be paid.
I recommend that the same be
paid in the amount of $22.48 and
that a warrant be issued to him for
that amount and delivered to him
upon delivery to the City of a prop-
er release.

Gentlemen: With reference to the
above claim, Mrs. Gertrude Zwack
fell on the sidewalk on the Ninth
Street side of the Bank & Insurance
Building at a place where the side-
walk was icy, injuring her left arm
and elbow. Her actual .expenses
amounted to $73.00. I have taken
the matter up with the Bank & In-
surance Building and they have
agreed to pay one-half thereof.
I recommend that the claim of
Mrs. Gertrude Zwack be allowed in
the sum of $36.50 and that a war-
rant be issued payable to her order
in that amount and delivered to her
upon delivery to the City of a pro-
perly executed release.
