INTRODUCTION
This memo requests the City Council meet in special session to approve the attached
resolution authorizing emergency repairs to the retaining wall along St. Mary's Street.
DISCUSSION
The retaining wall at St. Mary's Street is failing along with the street pavement
supported by the wall. On October 3, 2008, the residents along St. Mary's Street were
notified of the City's plans for wall/street repair. (Note attachment.) On October 6, the
Engineering Department hired Tschiggfrie Excavating, Inc. to partially remove the wall
that was impacting public safety.
IIW Engineers & Surveyors, PC (IIW) has been retained to develop the plans and
specifications for this work and to provide assistance during the bid-letting and
construction phases of the project.
The Engineering Department continues to work with FEMA on possible federal
assistance for this repair.
BUDGET IMPACT
The City has an annual program for maintenance and repair of stone retaining wall
budgeted in the five-year capital improvement program (CIP 2501029). Since the City
is in need to repair six retaining walls in Fiscal 2009 ($1,806,100), the following Fiscal
Year 2009 CIP projects have been canceled and will be considered in the FY2010
budget process: Improvements to the 18t" Street Building ($665,526); Foye, Merchant,
and Gold Street Reconstruction ($554,000); Four Mounds Road Improvements
($164,000); and Cold Storage Building Mezzanine Project -Municipal Services Building
($20,700); and City Hall Window Washing ($15,000). The St. Mary's Street Retaining
Wall Project is currently estimated at $379,500.
ACTION T® BE TAKEN
The Engineering Department requests approval of the attached resolution by the City
Council so that emergency repairs can be made to the retaining wall and to St. Mary's
Street in the interest of public safety through adoption of the attached resolution.

RESOLUTION AUTHORIZING EMERGENCY REPAIRS TO THE RETAINING WALL
ALONG ST. MARY'S STREET AND THE ST. MARY'S STREET ROADWAY
PAVEMENT
Whereas, a retaining wall along St. Mary's Street is failing and threatening a private
residence; and
Whereas, Iowa Code § 384.103 provides that when emergency repair of a public
improvement is necessary and the delay of advertising and a public letting might cause serious
loss or injury to the city, the governing body shall, by resolution, make a finding of the necessity
to institute emergency proceedings and shall procure a certificate from a competent registered
professional engineer or architect, not in the regular employ of the city, certifying that
emergency repairs are necessary, and that in that event the governing body may contract for
emergency repairs without holding a public hearing and advertising for bids; and
Whereas, Iowa Code § 364.12(3)(c) provides that a city may require the removal, repair,
or dismantling of a dangerous structure and if the property owner does not perform the action, in
an emergency a city may perform the action and assess the costs to the property owner.
Whereas, the City Council finds that the condition of the retaining wall is a dangerous
structure and constitutes an emergency and that an emergency repair of the retaining wall and
adjoining public street supported by the retaining wall is necessary and the delay of advertising
and a public letting might cause serious loss or injury to the city; and
Whereas, the City has procured a certificate from a competent professional engineer
registered in the State of Iowa, not in the regular employ of the City, certifying that emergency
repairs to the retaining wall and street are necessary.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council finds that it is necessary to institute emergency proceedings
to repair the retaining wall along St. Mary's Street and the adjoining St. Mary's Street roadway
pavement.
Section 2. The City Manager is hereby authorized to proceed with instituting such
emergency repairs as provided by law.

The existing limestone retaining wall adjacent to St. Mary's Street, near West 3rd Street
is in a deteriorated condition; subsequently, the street pavement has settled due to the
lateral movement of the wall. In the interest of public safety, the retaining wall will be
repaired which will require a portion of the wall removal to be completed from the top of
St. Mary's Street and the remaining portion of the wall removal will be completed from
below the wall, with access from the parking lot of St. Raphael Cathedral Church. Also,
the street will be repaired after the wall reconstruction work in completed.
Therefore, beginning at 7 AM on Monday, October 6th, 2008, St. Mary's Street will be
closed at the intersection of St. Mary's and West 3rd Street. Traffic will be directed to
enter St. Mary's Street from Emmett Street.
With weather permitting, this work will take approximately 60 calendar days.
