Mayor Wharton stated that this
is the regular monthly meeting of
the City Council for the purpose of
acting upon such business as may
properly come before the meeting.
Communication of D u b u q u e
Trades and Labor Congress advis•
ing that they are of the opinion
that in the event that the City
Council is called upon to make a
decision on the question of Daylight
Saving Time that it be left in the
hands of the people to be decided
at an election tc be called far that
purpose, presented and read.
Councilman Murphy moved that

Communication of Willard C. Bot-
toms, Committeeman, submitting
letter on his own behalf and at the
request of other private citizens
from 27 towns and cities in the
State of Iowa who met in Des
Moines to discuss a very important
problem that is common to all of
our municipalities, the problem of
getting additional revenues with-
out increasing property taxes, pre-
sented and read.

As you know, the first assign-
ment given our planning consul-
taut was the matter of planning
the development of the Eastern
Industrial Area of the city, After
various studies extending over a
period of several months, Mr, Hart-
zog's recommendations have been
made to the Planning and Zoning
Commission in the attached report.
At a meeting held February 27,
1947 this report was approved by
the Commission and its acceptance
as an amendment to the Master
Plan of the City is hereby recom-
mended to your honorable body
as the basis for the future de-
velopment of the East Industrial
Area,

Gentlemen:
The attached petition of the Du-
buque Packing Company asking for
the vacation of certain streets and
alleys in the East Industrial Area
was referred to the Planning and
Zoning Commission for recommen-
dation and report. A great deal of
the time and attention of our con-
sultant, Justin Hartzog, has been
used in the study of the problem.
The Commission has devoted a
number of meetings to the subject
and several conferences have been

had with the representatives of the
Packing Company.
Agreement has not been reached
with the Packing Company repre-
sentatives. However the Commis-
sion has attempted to meet the
requirements of industry while at
the same time safeguard the public
interest. It is to be noted that the
Hartzog report and the attached
plan "B" contemplates the use of
a widened Ash Street instead of
Lynn Street, which was the first
choice for anorth-south thorough-
fare. This compiromise was made
in order to assist the Packing
Company development.
To implement the plan for the
development of the area, the Plan-
ning and Zoning Commission re-
spectfully recommends to your
honorable body the vacation of the
following:
1. East 17th Street as follows:
From the east line of Sycamore
Street to the west line of Lynn
Street; from the east line of Lynn
Street to a point 36 feet west of
the west line of Ash Street; from
the east line of Ash Street to the
easterly line of East Dubuque Sub-
division.
2. East 18th Street from the
east line of Lynn Street to a paint
36 feet west of the west line of Ash
Street and from the east line of
Ash Street to the east line of East
Dubuque Subdivision.
3. Lynn Street from the north
line of E 15th Street to the south
line of E. 16th Street,
4, The easterly 32 feet of Lynn

Laws. Realizing that under exist-
ing conditions the past few months
materials were not readily avail-
able to enable compliance in all
cases, the above applications are
being approved by this office to
give the owners a reasonable time
to acquire the necessary materials
and labor to install proper facilities
to give the occupants of these
buildings the protection and sense
of security they are certainly en•
titled to by law. We do and will
expect the o`vners of the above
buildings to have made a deter
mined eSPort to accomplish the
above mentioned improvements by
the time applications will be again
up for approval.

Mayor Wharton read the call and
stated that service thereof had been
duly made and that this meeting
is called for the purpose of con•
sidering an ordinance relating to
traffic and regulating the use of
public streets in the City of Du-
buque, Iowa; prescribing regula-
tions relative to the parking of
vehicles upon such streets; pro-
viding for purchase, rental, instal-
lation, operation, maintenance, su-
pervision, Regulation and control
of the use of parking meters; de•
fining and providing for the estab-
lishment of parking zones upon the
public streets and for an enforce-
ment thereof and providing penal-
ties for tho violation thereof and
acting on any other business as
may properly come before a regu-
lar meeting of the City Council,

round-trip flights daily but that it
was still uncertain when operations
on its feeder lines will begin as
only two cities on this route now
have available air fields and that
the CAB presumably will permit
start of operations on the Chicago-
Sioux City feeder lines as soon as
one more city provides adequate
landing facilities.

Service and the City of Dubuque,
Iowa, whereby said Vincent Kobida
d/b/a Grey's Motor Service con-
tracted and agreed to do the fol-
lowing work in said City, to-wit:

Whereas, The City Council on
February 24, 1947 by Resolution No,
12-47 granted an extension of time

Plymouth was parked between

Bluff, a City grader plowing snow,
threw some heavy chunks of pack-
ed ice which dented and scratched
the left rear fender of the car, and
the doors on the left side were
scratched causing Digman damage
in the sum of $12.00.
I recommend that the Claim be
paid, and a warrant be issued to
said Eldon B. Digman in the amount
of $12,00, and the same be delivered
to hfm upon delivery to the City
of a release properly executed.

Whereas, the increasing of per-
sonnel and of wages and salaries
will require an amendment of the
Budget Estimate of Expenditures
for the fiscal year beginning April

by changing the following esti-
mated expenditures:
Consolidated Fund from $548;
128.00 to $569,838,00,
Fire Maintenance Fund from
$156,70E.00 to $167,996.00, and
Whereas, the amounts of these
increases will be paid from the
municipality's share of the revenues
from state liquor store sales in the

Improvement Bonds in the amount

hands of the City Treasurer and
credited to the Water Works Gene-
ral Fund the sum of $137,882.04, and
Whereas, No water works bonds
are outstanding and therefore the
requirements of Section 397.35 of
the Code of Iowa have been fully
met; and
Whereas, In order to provide for
the payment of the obligations it
is necessary to make a transfer of
$15,000.00 from Water Works Gene-
ral Fund to the Consolidated Fund
which embraces the Improvement
Fund; and
Whereas, Before any transfer can
be made from the Water Works
General Fund to any other fund,
an application must be made to the
State Comptroller for authority to
make the transfer and his approval
secured thereon; Now Therefore

have investigated the field of avia-
tion consulting service on the fur-
ther development, operation and
maintenance of the municipal air-
port, Attached hereto is the pro-
posal of Aviation Services Company
of Minneapolis together with form
of contract for furnishing such con-
sulting service.
I recommend that the City of
Dubuque enter into the contract
with the above company. Hereto
attached are the necessary pro-
ceedings. Since the C.A.A. will
shortly contract for the lighting,
seeding and fencing of the airport
and thus provide for the completion
of the current program the need
for action in the matter is apparent,

AN ORDINANCE RELATING TO

THE USE OF PUBLIC STREETS
IN -THE CITY OF DUBUQUE,
IOWA; PRESCRIBING REGULA-
TIONS RELATIVE TO THE
PARKING OF VEHICLES UPON
SUCH STREETS; PROVIDING
FOR PURCHASE, RENTAL, IN-
STALLATION, OPERATION,
MAINTENANCE, SUPERVISION,
REGULATION AND CONTROL OF
THE USE OF PARKING METERS;
DEFINING AND PROVIDING FOR
THE ESTABLISHMENT OF
PARI{ING METER ZONES UPON
THE PUBLIC STREETS AND FOR
AN ENFORCEMENT THEROF
AND PROVIDING PENALTIES
FOR THE VIOLATION THEROF.
WHEREAS, because of traffic con-
ditions that have existed in certain
sections of the City of Dubuque, the
free movement of traffic in those
sections is, and has been, impeded
for a long period of time; and
WHEREAS, attempts to regulate
the parking in the said areas have
not been as successful as is desir-
able;
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY DU-
BUQUE, IOWA, that:
SECTION 1, Definitions. Whenever
the following terms are used in this
Ordinance they shall have the mean-
ing respectively ascribed to them
in this section:
STREET Every way set apart for
public ~ travel, except alleyways,
bridle paths, and foot paths.
ROADWAY. That portion of a street
between the regularly established
curb lines,
SIDEWALK. That portion of a
street between the cm~b lines and
the adjacent property lines.
VEHICLE. Any device by which any
Person or property may be trans-
ported upon a public highway, ex-
cept those operated upon rails and.
permanent tracks,
PARKING METER, A mechanical
device located upon a public street
or sidewalk in a place regularly de-
signed as a parking zone as herein
after defined, which device shalt
record a certain number of min-
utes by the use oP a clock mech-
anism determining the period of
time for which parking privileges
may be extended to the person so
depositing such coin,
PARKING METER ZONES. A cer-
tain designated and marked off sec-
tion of the public street within
the marked boundaries where the
vehicle may be temporarily parked

and allowed to remain for such per-
iod of time as the parking meter
attached thereto may indicate.
SECTION i?, The following portions
of Streets are hereby established as
parking meter zones:
Main Street, from the intersection
of P'ifth and Main streets, to 10th
and Main Streets,
Locust Street, on the easterly side
thereof from the intersection of
Fifth and Locust Street to 10th
and Locust Streets, and on the
west side thereof from the inter-
section at Seventh and Locust
Streets to Ninth and Locust
Streets.
Fifth Street, on the northerly side
thereof, from the alley between
Motu and Locust Streets to the al-
ley between Main and Iowa Streets,
Sixth Street, from Sixth and Lo-
cust Streets to Sixth and Iowa
Streets,
Seventh Street, from Seventh and
Locust Streets to Seventh and
Iowa.
Eighth Street, from Eighth and
Locust streets to Eighth and Iowa
streets.
Ninth Street, from Ninth and Lo-
cust streets to Ninth and Iowa
streets.
Tenth Street, on the southerly side
thereof, from Tenth and Locust
Streets to Tenth and Iowa streets.
SECTION 3, The City Manager is
hereby authorized and directed to
install parking meters in all parking
meter zones hereby established, or
hereinafter established, by the City
Council of the City of Dubuque,
Iowa for the purpose of, and in such
numbers, and at such places as may
be necessary to the regulation, con-
trol, and inspection of the parking
of vehicles therein including the res-
ervation of loading zones for com-
mercial vehicles.
SECTION 4. Parking meters instal-
led in parking meter zones shall be
installed upon the curb immediately
adjacent to the individual parking
spaces hereinafter described, and
each parking meter shall be so con-
structed and adjusted as to show,
when properly operated, a signal that
the space adjacent to which it is in-
stalled is or is not legally in use.
Each parking meter installed shall
indicate by a Proper legend the legal
parking time established by the City
and when operated shall indicate on
and by its dial and pointer the dura-
tion of the period of legal parking
and on the expiration of such period,
shall indicate illegal or over park-
ing,
SECTION 5, The City Manager
shall have lines or markings Painted
upon the curb or upon the street ad-
jacent to each parking meter desig-
nating the parking space for which
said meter is to be used, and each
vehicle parked adjacent to any park-
ing meter shall park within said
lines m• markings. It shall be unlaw-
ful to park any vehicle across any
such line or marking or to park said
vehicle in such position that the
same shall not be entirely within the
space designated by such lines m•
marking.
SECTION 6, It shall be unlawful
for any person to cause, allow, per-
mit, or suffer any vehicle registered
in his name, or operated or control-
led by him, to be upon any street
within a parking meter zone in any
space adjacent to which a parking
rneter is installed for the time dur-
ing which the meter is showing a
signal indicating that such space
is illegally in use, other than such
time as is necessary to operate the
meter to show legal parking, between
the hours of 9 o'clock A.M. and 6
o'clock P.11S. of any day, except Fri-
day, and on Friday the hours shall
be from 9 o'clock A.M. to 9 o'clock
P.M., Sundays and Holidays excepted,
SECTION 6a, It shall be unlawful
for any person to cause, allow or
permit any vehicle registered in his
name to be parked within a parking
meter zone in any one space for long-
er than one hour between 9:00 a.m.
and fi;00 P.M, of any clay except Fri-
day and on Friday the hours shall
be frmn 9 o'clock A.M. to 9 o'clock
P.NI. Sundays and Holidays except-
ed,
SECT10~1 7, Parking meters when
installed and properly operated, shall
be so adjusted as to show legal
parking during a period of twelve
minutes upon and after the de-
posit oT a United States one cent
coin, and sixty minutes -upon and
after the deposit therein of one Unit-
ed States five cent coin.
SECTION S. When any vehicle
shall be parked in any space adjacent
to which a parking meter is located
in accordance with the Provisions of
this ordinance, the operator oY said
vehicle shall, upon entering the said
parking space, immediately deposit
or cause to be deposited a one cent
coin or a five cent coin, as described
in Section i of this ordnance, of the
IInited States, in such parlting meter,
and put such meter in operation, and
failure to deposit such coin or coins
and put the meter ht operation shall
constitute a violation of this ordi-
nance, and shall subject such person
to the penalty hereinafter prescribed.
SECTION 9. It shall be unlawful
to iteposit or cause to be deposited
in any parking meter any slug, device,
or metallic substitute for a one cent
or a five cent coin of the United
States.
SECTIOAT 10. It shall be unlawful
for any unauthorized person to open,
or for any person to deface, injure,
tamper with, or willfully break, de-
stroy, or impair the usefulness of any
parking meter installed Pursuant to
this ordinance, or to hitch any ani-
mals thereto.
SECTION 11. It shall be the duty
of the police, under ±he direction of
the Chief oY Police to ]seep account
of all violations of this ordinance.
(a) He shall keep an account of
and report the number of each
parking' meter which indicates that
the vehicle occupying the parking
space adjacent to such parking me-
eter is or has been parked in vio-
lation of any of the provisions of
this ordinance, the date and hour
of such violation, the make and the
stets license number oY such vehicle,
and any other facts a knowledge of
which is necessary to a thorough
understanding oY the circumstances
attending such violation.
(b) He shall attach to such ve-
hicl~ aSummons card stating that
it has been parked in violation of
this ordinance, .and instructing the
owner or operator to report to the

not later than 8:00 o'clock A. M.,
the following morning in regard to
such violation.
SECTION 12. Any person violating
any provision of this ordinance shall
be deemed guilty of a misdemeanor,
and upon conviction thereof shall be
punishable by a Pine not exceeding
X100.00 and upon s"ailure to pay said
fine shall be imprisoned for a period
not exceeding thirty days.
SECTION 13. The amount of the
coins required to be deposited in
parking maters as provided herein is
hereby levied and assessed as a fee
to provide for the proper regulation,
control, and inspection of traffic upon
the public streets; said coins as col-
lected are to be paid into the Con-
solidated Fund of the City of llu-
buque.
SECTION 14. It shag be the duty
of the City Manager to designate
some person or persons to make reg-
ular collections of the money deposit-
ed in said parking meters, anfl deliver
the money to the City Treasurer, and
it shall also be the duty of the City
Treasurer, to count the money and
place it in a special fund to be known
as the "Parking Meter Fund," which
fund shall be used far the purposes
specified in Section 13. Such person
or persons making surh collections
shall be bonded in the sum of $1000.06
to insure the faithful performance of
his or their duties. The premium on
the bond shall be paid by the City.
SECTION 15. If any section, part
of section, sentence, clause, or phrase
of this ordinance shall be held to be
unconstitutional or invalid, the re-
maining provisions hereof shall never-
theless remain in full force anfl effect.
SECTION 10. All ordinances or
parts of ordinances or resolutions in
conflict with the provisions of this
ordinance are hereby repealed.
SECTION 17. This ordinance shall
be in force and effect ten days from
and after its final passage, adoption
and publication as by law provided.

Whereas, there is now in the
hands of the City Treasurer and
credited to the Water Works Gene-
ral Fund the sum of $137,882,04;
and
Whereas, No water works bonds
are outstanding and therefore the
requirements of Section 397.38 of
the Code of Iowa have been fully
met; and
Whereas, In order to provide for
the payment of the obligations it
is necessary to make transfer of
$15,000.00 from Water Works Gene-
ral Fund to the Consolidated Fund
which .embraces the Improvement
Fund: and
Whereas, Before any transfer can
be made from the Water Works
General Fund to any other fund,
an application must be made to the
State Comptroller for authority to
make the transfet• and his approval

hereby transferred from the Water

Gentlemen:
At the meeting of February 24,
1947, a proposed transmission line
easement grant by the City to the
Interstate Power Company was re-
ferred to the City Manager and
Solicitor for report and recommen-
dation.
We have looked into the matter,
examined the attached location
map and find that the location
shown would not interfere with the
proper use of public property. How-
ever, the easement as drawn is in
general terms as to location over
the various public properties.
Therefore, we recommend that an
easement in which the center line
location of the proposed tr~ansmis-
sion line is described by metes and
bounds as sloven on the attached
plat be granted to the Interstate
Power Company and further that
the Mayor and Clerk be authorized
to execute such easement.

of the Interstate Power Company
regarding the ire-routing of the
East Dubuque bus. Agreement was
reached that the East Dubuque bus
route be changed to the following:
"Commencing on Eighth Avenue
at Main Street; thence east on
Eighth Avenue to Central; thence
south on Central Avenue to Fourth
Street; thence west on Fourth
Street to Iowa Street; thence south
on Iowa Street to Second Street;
thence west on Second Street to
Locust Street; thence south on
Locust Street to the East Dubuque
Bridge; returning from East Du-
buque Bridge on Locust Street
north to Eighth Avenue; Hence
east on Eighth Avenue to Main
Street, the place of beginning."
It was further agreed that bus
stops in the congested area of Lo-
cust Street be designated as fol-
lows: On the south east cm~ner of
Locust and West Fourth Streets;
on the south east corner of Locust
and West Sixth Streets, and on the
south east corner of Locust Street
and Eighth Avenue,

Whereas, a detailed distribution
of proposed expenditures of the
City of Dubuque far the fiscal year
beginning April 1, 1947 and ending
March 31, 1948 has been duly pre-
pared by the City Manager and
submitted to this Council for ap-
proval; and
Whereas, this Council has ex-
amined the detailed distribution of
proposed expenditures, wherein es-
timates of the expenses of the de-
partments and purposes are shown,
including the estimates for which
the consolidated tax levy and all
other levies heretofore made, re-
ceipts from moneys and credits
and miscellaneous sources are to
be used, and said distribution
shows all of the proposed expeudi-
tm•es for the ensuing. fiscal year;
Now Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that said
detailed distribution of proposed
expenditures fos• the fiscal year
beginning April 1, 1947 and ending
March 31, 1948 as heretofore pre-

Section 2, General Miscellaneous Revenues. General
miscellaneous revenues which are collected during the
fiscal year shall be allocated to the funds and purposes
as provided for herein and shall be used far the payment

Section 3. Surplus. Any surplus not specifically
allocated for a definite purpose in the budget and which
may exist in either the Consolidated Fund or the misr
mellaneous revenues account shall be and the same is ,
hereby appropriated and set apart to be applied as con-
tingencies arise or may be used for such proper pur-
poses as the Council may determine upon, Any surplus.-
not specifically distributed in the budget and .remain-
ing~ in funds created by the levy of special taxes shall
be ana the same is hereby appropriated for any proper
purpose incident to such funds. Any surplus remaining
in any fund at the close of the fiscal year 1946-47
(except taxes which have been levied for special pur-
poses) shall be transferred into and become a part of
the Consolidated Fund, Nothing herein contained shall
authorize the transfer of funds realized for special
taxes to a fund or purpose Por which any special taa
levy has been made, except only with the approval of
the State Comptroller.
Section 4 Emergency Fttnd. Transfers of money may
be made from the Emergency Fund to any other' fund
for the purpose of meeting deficiencies in any such
fund arising from any cause; provided, however, that
no suoh transfer shal] be made except upon written
approval of the State Comptroller and then only when
such approval is unanimously requested by the City
Council,
Section 5. Delinquent Tax Collections. Delinquent
prior years' tax collections shall be allocated to the
respective funds entitled to the same when and as the
same are received by the City Treasurer,
Section 6, Distribution. That the distribution and
division of the within appropriatimts shall be made in
accm~dance with the detailed distribution adopted by
the City Council on March 21, 1947, which detailed dis-
tribution is made a part of this ordinance by reference
thereto and shall be so considered in connection with
the expenditures of said appropriations.
Section 7. Emergency Clause, This ordinance in the
interest of the preservation of public peace, health,
safety and the general welfare of the City of Dubuque
and the inhabitants thereof being deemed urgent and oP
immediate necessity shall be in Porce and effect from
and after its final passage, adoption and apprpval by
the City Council and Publication as provided by lacy,
and the appropriations herein provided shall be available
when transferred to their respective fends.

Sec. 5. That any and all ordinances

hereunder shall accrue when the cost
of publishing this Ordinance has been
paid by the Interstate Power Com-
pany.

tional 15,000 gallon tanks, south of
their large tank, for the purpose
of storing gasoline and fuel oil
presented to the Councih
Mr. John A. I{erper, President of
the Dock Board addressed the
Council in regard to request pre•
seated by the Hughes Oil Company.
Council advised the representative
of the 13ughes Oil Company that
the verbal request, asking for a
permit to erect two additional 15,-
000 gallon tanks, would be consid-
ered by the Council and action de-
ferred till the meeting of the Coun-
cil to be held April 7th, 1947,
Mr. Mark Gavin addressed the
Council in regard to the use of
Eagle Point Park for the holding
of free band concerts during the
summer months.

Meeting called for the purpose
of considering complaints on the
law butterfat content and the high
retail price of milk distributed in
the City of Dubuque,
Milk Inspector Chapman review-
ed the entire milk picture in the
City of Dubuque and after a lengthy
discussion of the milk situation Mr.
Geo. R. Murphy moved that Milk
Inspector Chapman be instructed
to notify City Manager Rhomberg
when butterfat and quality of milk
show a decrease approaching the
minimums required by ordinances,
the City Manager in turn to arrange
a meeting with the Board of Health
to cope with the problem. Second-
