The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request. He noted the plat will facilitate transfer of
lots between family members, and place a shed on one lot.
Staff reviewed resubdivision of this property complies with the City's subdivision
regulations, with a waiver of lot frontage requirements for Lots 1 and 2.
There were no public comments.
Recommendation
By a vote of 7 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving the lot frontage requirements for Lot 1 and Lot 2
A simple majority vote is needed for the City Council to approve the request.

Introduction
The submitted Plat of Survey Fountain Hill Subdivision No. 3 resubdivides two existing
parcels located north of Roosevelt Road at the north end of the City of Dubuque. The
total area of the Plat of Survey is 28.29 acres.
Discussion
The submitted Plat of Survey Fountain Hill Subdivision No. 3 resubdivides the replat of
Lot 5 of Fountain Hill Resubdivision and Lot 2 of Fountain Hill No. 2. The subject
property is located immediately north of Roosevelt Road and neither existing lot or, as
proposed to be replatted, have frontage on Roosevelt Road. The resubdivision
basically facilitates locating an existing shed on one parcel rather than being split
between the two existing parcels. Access to the property is by way of a 50 foot wide
access and utility easement from Roosevelt Road.
Recommendation
Planning Staff recommends that the Zoning Advisory Commission approve the
submitted Plat of Survey Fountain Hill Subdivision No. 3 as the proposed replatting will
not adversely impact adjacent properties and will not unnecessarily restrict future
development of adjacent property.
Planning Staff recommends that the Zoning Advisory Commission approve the
submitted Plat of Survey Fountain Hill Subdivision No. 3 subject to waiving the lot
frontage requirements for Lot 1 and Lot 2.

RESOLUTION NO. 361 -08
A RESOLUTION APPROVING THE PLAT OF SURVEY FOUNTAIN HILL
SUBDIVISION NO. 3 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey Fountain Hill
Subdivision No. 3 in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of lot frontage for Lot 1 and Lot 2,
where 50 feet of lot frontage is required by Section 42-19(b) of the Subdivision
Regulations; and
Whereas, the Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 and Lot 2 to have 0 feet of lot frontage, where 50 feet of lot frontage is required.
Section 2. That the Plat of Survey Fountain Hill Subdivision No. 3 is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Final Plat.
Passed, approved and adopted this 20th day of October, 2008.
