The issues that stand are Arensdorf Excavating has been informed verbally by Deron Muehring that he will find us in default of the contract if the trench is not backfilled 100% by C.O.B. on 10-14-08. He goes on to state that the City Engineer and the City Attorney are in agreement. We find this difficult to believe as no written correspondence has been issued by the City regarding the delays caused by the City, and our claim for additional time and funding that Arensdorf Excavating has accrued on this project, as a result of the city's review of installed pipe, -that remains unaddressed. Additionally, there are no additional milestones that are present, with the exception of the finish date of 10-31-08. It should be noted that Deron Muehring has directed the City, on 10-10-08 to backfill ~ 40% of Arensdorf's work, to accommodate a commercial business owner, without any prior notice to Arensdorf Excavating. We find these threats to be inconsistent with City policy, the contract, and good business practices. We have stated to Mr. Muehring that should he direct us to backfill 100% we will do so, but will seek additional funding for removing the material, so that asphalt can be placed. He declines to place this in writing, and refuses to acknowledge the delay caused by the city in reviewing the installation of the pipe. We respectfully request a meeting with the City Manager, at his earliest convenience.
