Sec. 7-37. Issuance.
The city manager shall cause to be issued dog and cat licenses
upon proper application and payment of the fee provided in this
division. (Ord. No. 11-82, § 1, 3-11-82)
Sec. 7-38. Tags not transferable.
A license issued for any dog or cat shall not be transferred to
another dog or cat. (Ord. No. 11-82, § 1, 3-11-82)
Sec. 7-39. Tag to be attached.
The applicant for a dog or cat license, upon procurement of the
license, shall securely attach the license tag to a collar or harness
and this collar or harness, with the tag attached shall at all times be
kept on the dog or cat. Any dog or cat found at large without a collar
or harness with license tag attached shall be deemed unlicensed and
shall be impounded. (Ord. No. 11-82, § 1, 3-11-82)
Sec. 7-40. Fee for duplicate.
The fee for a duplicate license for either a dog or cat shall be two
dollars and fifty cents ($2.50). (Ord. No. 11-82, § 1, 3-11-82)
Sec. 7-41. Consent implied from application and receipt.
The application for and the receipt of a license as required in this
division shall include an implied consent by the owner to permit an
inspection of both real and personal property under his control for
the purpose of carrying out the provisions of this article relating to
the harborage of vicious animals or to the control of rabies outbreak
or relating to the provisions of law relative to the prohibition of

DIVISION 3. RABIES CONTROL
Sec. 7-45. Vaccination required.
It shall be unlawful for the owner of any dog or cat six (6) months
of age or older to keep or maintain such animal unless such dog or

cat shall be vaccinated against rabies by a licensed veterinarian.
Such vaccine shall be approved by the U.S. Food and Drug Admin-
istration and administered at the following intervals:
(a) Dogs. Original or puppy immunization one (1) year and sub-
sequent immunization at three-year intervals.
(b) Cats. Annual immunization.
Written proof of such vaccination shall be a condition precedent to
the issuance of a license thereof. (Ord. No. 11-82, § 1, 3-11-82)
Sec. 7-46. Confinement authorized.
(a) The owner of any dog, cat or other animal which has con-
tracted rabies, or which has been subject to rabies or which has
bitten any person shall, at the discretion of the health officer and
upon his demand, produce and surrender up such dog, cat or other
animal to be held in confinement in a licensed veterinarian's animal
hospital under the supervision of a licensed veterinarian and in
quarantine for observation for a period determined by the health
officer at the expense of the owner of the animal.
(b) Any animal bitten or attacked by any known rabid animal
shall be quarantined under direction of the health officer by being
confined and in quarantine as provided above for a minimum of
ninety (90) days. (Ord. No. 11-82, § 1, 3-11-82)
Sec. 7-47. Reporting rabies; notice to health officer.
(a) It shall be the duty of the owner of any cat, dog or other
domesticated animal suspected of being rabid that has attacked,
bitten or caused any skin abrasion upon any person to report such
incident to the health officer.
(b) It shall be the duty of any physician or veterinarian immedi-
ately to transmit information to the health officer that may come to
him/her through his/her professional capacity with reference to any
person having been attacked, bitten or having skin abrasions by any

ARTICLE I. IN GENERAL
Sec. 11-1. Obedience to mayor's emergency proclamations re-
quired.
No person shall violate the provisions of any proclamation
issued by the mayor during times of public danger or emer-

ARTICLE II. COUNTY -MUNICIPAL CIVIL
DEFENSE AGENCYt
Sec. 11-16. Created.
There is hereby created the Dubuque County -Municipal Civil
Defense Agency to prevent, minimize, repair, and alleviate
injury or damage resulting from disaster caused by enemy
invasion or natural disaster. (Ord. No. 31-63, § 1, 12-23-63)
Sec. 11-17. Composition—Generally.
The Dubuque County -Municipal Civil Defense Agency shall
consist of the following:
(1) A joint administration consisting of a member of the
county board of supervisors and the mayor or his rep-
resentative of the participating cities or town within
the county.

(2) A county civil defense director appointed by and respon-
sible to the joint administration.
(3) A director of civil defense for each participating city
or town appointed by the city or town council of each
participating city or town. The director of civil defense
for the city shall also serve as an operations officer
for the joint administration. (Ord. No. 31-63, § 1,

Sec. 11-18. Same—Operational organization.
The operational civil defense organization of the Dubuque
County -Municipal Civil Defense Agency shall consist of the
director and such other personnel as he deems necessary,
including both compensated and volunteer personnel. (Ord. No.
31-63, § 4, 12-23-63)
Sec. 11-19. Organizational structure, terminology and titles.
The organizational structure, terminology, and titles of the
Dubuque County -Municipal Civil Defense Agency shall conform
to the standards as established and employed by the United
States Government and by the government of the state. (Ord.
No. 31-63, § 4, 12-23-63)
Sec. 11-20. Duties.
The Dubuque County -Municipal Civil Defense Agency shall
be the operating civil defense agency for the county. It shall
have the responsibility for the administration and coordina-
tion of all civil defense affairs throughout the county. The
duties of this agency shall further include the preparation of
a basic plan for county -wide civil defense and the implemen-
tation of that plan in the time of enemy invasion, natural
disasters or other emergencies which threaten lives and prop-
erty. The Dubuque County -Municipal Civil Defense Agency
shall also be empowered to improve the civil defense plan as

Sec. 11-21. Distribution of functions, duties.
The functions and duties of the Dubuque County -Municipal
Civil Defense Agency shall be distributed among such divi-
sions and units as the joint administration finds necessary to

Sec. 11-22. Director—Office created.
The city council hereby creates the office of director of
civil defense for the city. The city civil defense director shall
also have the power to act as the director of the Dubuque
County -Municipal Civil Defense Agency. (Ord. No. 31-63, § 3,
12-23-63)
Sec. 11-23. Same—Powers, duties.
Duties and responsibilities of the city civil defense director
shall include the following:
(1) The coordination and implementation of all emergency
recovery plans in the event of a natural disaster or
enemy attack.
(2) The control and direction of the actual or training
efforts of the Dubuque County -Municipal Civil Defense
Agency.
(3) The determination of all questions of authority and
responsibility pertaining to the civil defense office.
(4) The cooperation of the director's office with other civil
defense agencies, national, state, and local.
The dissemination of civil defense information and the
conduct of proper public relations for an effective civil
defense program for the Dubuque County -Municipal
Civil Defense Agency.
(6) The supervision of the necessary supplies, equipment,
and personnel in the event of foreign invasion or natural
disaster.

(8) The determination of the state of emergency.
(9) The power to put into force any and all operational
civil defense plans if the need arises.
(10) The publication of reasonable rules and regulations
which are essential to the civil defense effort and the
protection of lives and property.
(11) The procurement of the necessary agreements, upon
approval by legal counsel, for the use of public and
private property for the storage of civil defense equip-
ment, materials, and supplies; and for the use of public
and private property for shelter and other civil defense

Sec. 11-24. Appointees' oath.
Every person appointed to serve in any capacity in the
Dubuque County -Municipal Civil Defense Agency shall, before
entering upon his duties, subscribe to the following oath,
which shall be filed with the director.
"I, , of the Civil Defense Organization
of Dubuque, Iowa, do solemnly swear (or affirm) that I will
support and defend and bear true faith and allegiance to
the Constitution of the United States and the Constitution
of the State of Iowa, and the territory, institution and
facilities thereof, both public and private, against all enemies
foreign and domestic: that I take this obligation freely,
without any mental reservation or purpose of evasion: and
that I will well and faithfully discharge the duties upon
which I am about to enter, and I do further swear (or
affirm) that I do not advocate, nor am I, nor have I been
a member of any political party or organization that advo-
cates the overthrow of the government of the United States
or of this State by force or violence: and that during such
time as I am affiliated with the Civil Defense Organization,
I will not advocate nor become a member of any political
party or organization that advocates the overthrow of the
government of the United States or of this State by force

Sec. 11-25. Expenses.
The expenses incurred by the Dubuque County -Municipal
Civil Defense Agency shall be paid by the county treasurer
from funds deposited by the county board of supervisors and
the participating cities or towns. All provisions for the financ-
ing of the civil defense operation shall be in accord with the
state civil defense act, as amended. (Ord. No. 31-63, § 6,

the polling place for the Eighteenth Precinct of the city: Wahlert

Sec. 12-35. Nineteenth Precinct.
(a) Area encompassed. The Nineteenth Precinct of the city shall
consist of that territory bounded by a line as follows:
Beginning at the intersection of Asbury Road and Wilbricht
Lane, a point on the boundary of the Fifteenth Precinct; first
southeast then in a clockwise manner along the boundaries of the
Fifteenth and Fourteenth Precincts to a point on Dodge Street
lying due south of the intersection of Pennsylvania Avenue and
Van Buren Street; due north to said intersection; east along Penn-
sylvania Avenue to the west boundary of Flora Park; first north
then in a clockwise manner along said boundary to Wilbricht
Lane; east along Wilbricht Lane to the place of beginning, all of
which is a part of the Thirty-fifth Representative District.
(b) Polling place. The following place is hereby established as
the polling place for the Ninteenth Precinct of the city: Irving

Sec. 12-36. Twentieth Precinct.
(a) Area encompassed. The Twentieth Precinct of the city shall
consist of that territory bounded by a line as follows:
Beginning at the intersection of Churchill Drive and Pennsyl-
vania Avenue, a point on the boundary of the Nineteenth Pre-
cinct; north along Churchill Drive to St. Anne Drive; west along
St. Anne Drive to Carter Road; north along Carter Road to Hill-
crest Road; west along Hillcrest Road and Hillcrest Road South
to John F. Kennedy Road; north along John F. Kennedy Road to
Keyway Drive; southwest along Key Way Drive to West Way;
west along West Way to Graham Circle; southwest along Graham
Circle to St. John Drive; south along St. John Drive to Hillcrest

ARTICLE I. IN GENERAL
Sec. 14-1. Code—Adopted.
Except as hereinafter added to, deleted, modified or
amended, there is hereby adopted by the city council, for the
purpose of prescribing regulations governing conditions
hazardous to life and property from fire and explosion, that
certain code known as the Uniform Fire Code, 1979 Edition,
including the several appendices as prepared and edited by
the Western Fire Chiefs Association and the International
Conference of Building Officials of Whittier, California, and
the provisions of such Uniform Fire Code shall be
controlling within the corporate limits of the city. (Ord. No.

Sec. 14-2. Same—Specific amendments, modifica-
tions, additions and deletions.
The code adopted by section 14-1 of this chapter is hereby
amended as provided in this section:

Sec. 2.301. Section 2.301, "Alternate Materials and Meth-
ods," is hereby amended by repealing subsection (a) of such
section and replacing such subsection with a new subsection
in lieu thereof as follows:
Sec. 2.301. (a) The chief of the bureau of fire preven-
tion shall have power to modify any of the provisions of
the code adopted by section 14-1 of this chapter upon
application in writing by the owner or lessee, or his duly
authorized agent, when there are practical difficulties in
the way of carrying out the strict letter of the code,
provided that the spirit of the code shall be observed,
public safety secured, and substantial justice done. The
particulars of such modification when granted or allowed
and the decision of the chief of the fire prevention bureau
thereupon shall be entered upon the records of the
department and a signed copy shall be furnished the
applicant. (Ord. No. 69-79, § 2, 11-19-79)
Sec. 2.302. Section 2.302, "Board of Appeals," is hereby
amended by repealing such section and replacing such
section with a new section in lieu thereof as follows:

Sec. 2.302. Whenever the chief of the fire department
shall disapprove an application or refuse to grant a
permit applied for, or when it is claimed that the
provisions of the code adopted by section 14-1 of this
chapter do not apply or that the true intent and meaning
of the code have been misconstrued or wrongly inter-
preted, that applicant may appeal from the decision of the
chief of the fire department to the city council within ten
(10) days from the date of the decision appealed. Such
appeal to the city council shall be made in writing setting
forth the decision appealed from and the grounds for such

and such other members of the fire department as inspectors

Sec. 14-34. Annual report; recommendations.
A report of the bureau of fire prevention shall be made
annually and transmitted to the chief executive officer of the
city, which report shall contain all proceedings under the code
adopted by section 14-1 of this chapter, with such statistics
as the chief of the fire department may wish to include there-
in. The chief of the fire department shall also recommend
any amendments to the code which, in his judgment shall be

ARTICLE III. SERVICE STATIONS
AND TANK VEHICLES*
DIVISION 1. GENERALLY
Sec. 14-46. Definition.
For the purposes of this article the following term shall have
the meaning ascribed to such term in this section:
Service station shall mean that portion of a property where
flammable or combustible liquids used as motor fuels are stored
and dispensed from fixed equipment into fuel tanks of motor
vehicles or floating crafts. (Ord. No. 35-82, § 1, 7-6-82)

Sec. 14-47. Operation of service station during unloading
of tank vehicle restricted.
No service station shall conduct its regular business operations
while a tank vehicle is discharging Class I flammable liquid on
the premises if such tank vehicle is located in a position that will
interfere with the unrestricted flow of the normal business traffic
of the station. (Ord. No. 35-82, § 1, 7-6-82)
Sec. 1448. Hours of unloading tank vehicles restricted.
It shall be unlawful for any person to unload any Class I
flammable liquid from any tank vehicle between the hours of
10:00 p.m. and 6:00 a.m. in any local business district or resi-
dence district as established by the zoning ordinance of the city.

Sec. 14-49. Unloading of tank vehicles while on public
streets prohibited; exception.
No tank vehicle shall discharge or unload, or transfer Class I
flammable liquid while any portion thereof is standing on any
street, alley or public highway, except in the case of emergency.
In the event an emergency requires the discharge or unloading of
Class I flammable liquid from any tank vehicle on a public street
or highway, the chief shall be notified and such operation shall
not be commenced until such necessary safeguards as he or she

Sec. 14-56. Applications.
Applicants for a service station license shall file with the chief
an application showing:
(1) The name and address of the applicant;
(2) The location of the service station;
(3) The name and address of the owner of the premises on
which the service station is located;
(4) The name and address of the operator of the service sta-
tion; and
(5) The amount of Class I flammable liquid storage provided

Sec. 14-57. Fee.
Each applicant for a license required by this division shall pay
a fee therefor of twenty-five dollars ($25.00). (Ord. No. 36-82, § 1,
7-6-82)
Sec. 14-58. Expiration; renewal.
The license required by this division shall expire on the thirti-
eth day of June following the issuance thereof, and renewal fees
for such licenses shall be due July first of each year for the
ensuing year and shall become delinquent if unpaid by the tenth
day of July of each year. A penalty fee of ten dollars ($10.00) shall

Sec. 25-210. Stop intersections.
(a) The driver of a vehicle shall stop in obedience to a stop
sign as required in this chapter at an intersection where a
stop sign is erected at one or more entrances thereto
although not a part of a through street and shall proceed

cautiously, yielding to vehicles not so obliged to stop which
are within the intersection or approaching so closely as to
constitute a hazard, but may then proceed.
(b) Those intersections designated are hereby declared to
be "stop intersections" for all purposes of this section.

entering the designated intersection.

Sec. 25-211. Stop signs to be erected at entrances to
through streets and stop intersections;
stop required.
Stop signs shall be erected at entrances to through streets
and at one or more entrances to stop intersections. Every
driver of a vehicle shall stop at such sign or at a clearly
marked stop line before entering an intersection, except
when directed to proceed by a peace officer or traffic -control

§ 27-73 PARKS AND RECREATION § 27-87
Sec. 27-73. Removal of unattended vehicles left after dos-
ing hours.
Any motor vehicle left unattended in any of the parks after the
closing thereof, shall be deemed abandoned and the director of
parks and recreation or the park police shall cause the same to be
towed from such park and the same shall not be redeemed by the
owner or the person responsible therefor until the reasonable
towing charges and storage charges are paid. (Ord. No. 24-69, §

Sec. 27-74. Open season and hours generally.
(a) The open season or hours for parks and park and recreation
facilities shall be established by the park and recreation commis-
sion, subject to the concurrence of the city council.
(b) During the period of time other than the regular open park
season, no person shall enter or remain in any park or park and
recreation facility.
(c) During the period of time other than the regular open park
season, the park and recreation commission may designate the
hours for specific parks to be open for vehicular traffic.
(d) The city manager or authorized representative shall have
the authority to close any or all parks, park and recreation facili-
ties, park roadways and park parking lots before scheduled clos-
ing hours at times it is deemed necessary in the interest and

Sec. 27-88. E. B. Lyons Forest Preserve and Nature Center.
(a) The following described real estate is hereby placed under
the control of the jurisdiction and management of the park and
recreation commission of the city, to wit:
Lots 2 and 3 of the northeast one-quarter of the southeast
one-quarter of section 1, township 88 north, range 2 east of
fifth prime meridian; Lots 2 and 3 of the northwest one-quarter
of the southwest one-quarter, Lots 2 and 3 of the northeast
one-quarter of the southwest one-quarter, and Lot 2 of Lot 1 of
the southwest one-quarter of the southwest one-quarter; of sec-
tion 6, township 88 north, range 3 east of the fifth prime
meridian in Dubuque County, Iowa, according to the respective
recorded plats thereof.
(b) Such real estate shall be known, called and named as "The
E. B. Lyons Forest Preserve and Nature Center" and accordingly

DIVISION 2. EXEMPTIONS
Sec. 35-11. Partial exemption for agricultural lands.
(a) Scope. Land within the city which is laid off in lots of
more than ten (10) acres and which the city council finds is
in good faith occupied and used for agricultural or
horticultural purposes shall be exempt from the annual
levies made for any of the functional funds of the city;
except that such land shall be subject to a levy of one and
one-fourth (11/4) mills for street purposes.
(b) Application. Any owner or proprietor of real estate
who desires to obtain the benefits of the exemption provided
in paragraph (a) of this section shall, on or before July first
of each year, file application therefor in writing with the city
clerk, on forms prepared by the city manager, showing
sufficient information from which the city council may
determine whether the property is entitled to the exemption.
(c) Determination of eligibility. At the time of the adoption
of the annual budget, the city council shall meet and
determine what properties within the city are entitled to the
exemption provided in paragraph (a) of this section and
certify a list of such properties to the county auditor at the
time of the certification of the annual budget, which list
shall constitute the authority of the county auditor to relieve
the lands listed thereon from all municipal levies except an
annual tax of one and one-quarter (11/4) mills for street

Sec. 35-12. Partial exemption for value added to
industrial real estate by new construction
and acquisition or improvement to certain
machinery or equipment.
(a) Scope; applicability. This section provides for a partial
exemption from property taxation of the actual value added
to the industrial real estate by the new construction of
industrial real estate and the acquisition of or improvement
to machinery and equipment assessed as real estate
pursuant to section 427A.1, subsection (1), paragraph e, of
the 1979 Code of Iowa[, conditioned as follows:]
