Sec. 2-2. Powers and duties of council and officers generally.
The city council, the mayor, the city manager and other city
officers shall have such powers and shall perform such duties
as are authorized or required by state law and by the ordi-
nances, resolutions, rules and regulations of the city. (Ord.

Sec. 2-3. Fiscal year.
The first day of July of each year shall be and is hereby
fixed as the opening of the fiscal year, and all accounts,
records, statements and transactions of every kind or nature
shall be based or dated from July first of each year as the
fiscal year and all accounts, records, and transactions shall be
closed on the last day of June as the last day of the fiscal

Sec. 2-4. Bonds; approval.
Bonds of every character and description which are neces-
sary to be furnished the city by virtue of the provisions of
any ordinance thereof, except bonds required to be furnished
by public officials, may be approved by the city manager by
the endorsement of his approval thereon and filed in the office
of the city clerk and such approval shall have the same force
and effect as if they were approved by the city council. (Ord.

Sec. 2-5. Emergency location for city government.
(a) Whenever due to an emergency resulting from the ef-
fects of enemy attack, or the anticipated effects of a threat-
ened enemy attack, it becomes imprudent, inexpedient or
administration and enforcement of motor vehicles and traffic regulations,

impossible to conduct the affairs of the city at the regular or
usual place or places thereof, the city council may meet at
any place within or without the territorial limits of the city,
or at any place within or without the territorial limits of the

state, on the call of the mayor or on the call of any two
(2) councilmen.
(b) Alternate or substitute sites or places as the emergency
temporary location or locations of city government where all
or any part of the public business may be transacted and
conducted during the emergency may be established or des-
ignated by resolution or by proclamation.
(c) During the period when the public business is being
conducted at the temporary location or locations, the city
council and other officers of the city shall have and possess
and shall exercise, at such location or locations, all of the
executive, legislative and judicial powers and functions con-
ferred upon the city council and other officers of the city by
or under the laws of the state. Such powers and functions
may be exercised in the light of the exigencies of the emer-
gency situation without regard to or compliance with time-
consuming procedures and formalities prescribed by law and
pertaining thereto, and all acts of the city council and officers
of the city shall be as valid and binding as if performed within

Sec. 2-6. General special assessment fund.
(a) There is hereby established a special fund of the city
to be known as the "general special assessment fund."
(b) Whenever it shall appear that all indebtedness of any
special assessment fund has been discharged, that there is a
balance remaining in said fund, and that the necessity of
maintaining said fund has ceased, the city manager is author-
ized and directed to transfer such balance to the general
special assessment fund and report his action to the city
council for approval.
(c) Whenever the city council shall find such action to be
in the public interest, the city manager is authorized to
transfer moneys from the general special assessment fund
to such special assessment funds as he may find good busi-

Sec. 2-7. City seal.
(a) Established. The seal heretofore provided and used by
and for the city, having in the center the words "La Petite
Nuit," and around the edge "Seal of the City of Dubuque,
Iowa," is hereby established and declared to have been and
now to be the seal of the city.
(b) Custody. The seal of the city shall be and remain in
the custody of the city clerk of the city or his deputy, and
shall be affixed by him to all ordinances, passed by the coun-
cil, which require the signature of the mayor and city clerk,
or either of them; it shall also be affixed by the city clerk
to all such notices, certificates, and other authenticated papers
as shall be required to be issued by the city clerk, by law.

Sec. 2-8. Execution of contracts.
All deeds, releases, contracts, and conveyances on behalf of
the city shall be made in the name of the city, and shall be
signed by the mayor, or, in his absence, by the mayor pro tem,
and attested by the city clerk, and sealed with the corporate
seal of the city, and when required by law to be acknowledged,
the mayor or mayor pro tem shall acknowledge the same.

ARTICLE II. CITY COUNCIL
DIVISION 1. GENERALLY
Sec. 2-20. Composition; terms.
The city council consists of five (5) councilpersons elected at
large for a term of four (4) years. (Ord. No. 17-75, § 5,

Sec. 2-21. Compensation.
The compensation of the members of the city council shall
be two thousand dollars ($2,000.00) per annum, payable
monthly. (Ord. No. 35-51, § 4, 8-6-51; Ord. No. 18-60, § 1,

Sec. 2-22. Meetings—Date.
Regular meetings of the council shall be held on the first
Monday of each month and special meetings may be called
from time to time by the mayor or a majority of the members
of the council. (Ord. No. 35-51, § 5, 8-6-51)
Sec. 2-23. Same—Records.
(a) Preparation. Immediately after each regular or special
meeting of the council, the city clerk shall prepare a complete
record of the proceedings of such meeting, which shall con-
tain in full the motions and resolutions offered or adopted,
and all other action taken, or proceedings had at such meeting.
(b) Printing. The city clerk shall cause a condensed record
of such proceedings to be published in the official papers.
He shall also have the complete record printed on good paper
with pages of uniform size suitable for binding in permanent
form, which pages shall be numbered consecutively.
(c) Monthly record. Before the first meeting in each month,
the city clerk shall have printed proceedings of all meetings
held during the previous month, bound together in pamphlet
form, and shall furnish copies of the same to the mayor and
members of the council and to such other officers as the
council may direct. At the first regular meeting in each
month, the record of the proceedings included in such pam-
phlet shall be read, unless such reading shall be dispensed
with by the council. If objection to any part of the record
is raised by a member of the council, the same, if found to
be incorrect, shall be corrected, and when the record is cor-
rect, the same shall, by motion, be approved. When the record
has been so approved, the printed record . of each meeting
contained in said pamphlet shall be signed by the mayor and

attested by the city clerk, and shall then become the official
record of the proceedings contained therein.
(d) Permanent binding. After the last day of December of
each year, the city clerk shall have the printed pamphlets,
which constitute the official record for the preceding twelve
(12) months, bound together in book form, together with a
complete index by subjects of the contents thereof, and when
so bound said book shall constitute the permanent official
record for the year, and the same shall be filed and kept

Sec. 2-24. Annual appropriation ordinance.
On or before the first day of July of each year, the council
shall make an appropriation for all the expenditures of the
city government for the following year, commencing on the
first day of July. Such appropriation shall enumerate all the
departments, officers, objects, and purposes for which the
same is made and shall set forth the amount. (Ord. No. 34-51,

DIVISION 2. RULES OF PROCEDURE
Sec. 2-31. Rules to be strictly adhered to; temporary suspen-
sion.
The rules of procedure and order of business provided in
this division shall be strictly adhered to by the city council,
unless they shall be temporarily suspended by the consent of
three-fourths of the councilpersons present. (Res. No. 250-51,

Sec. 2-32. Date, time of meetings.
The city council shall meet regularly on the first Monday
of each month, at 7:30 p.m. (Res. No. 250-51, § 1 (Rule 2),

Sec. 2-33. Mayor to preside; limitation on debate participation.
The mayor, when present, shall preside at meetings of the
council. In order to preserve fairness on the part of the chair-
man, he shall not engage in debate unless he first relinquishes
the chair for purposes of debate. (Res. No. 250-51, § 1 (Rule

Sec. 2-34. Quorum.
At all meetings of the council three (3) members shall con-
stitute a quorum to do business, but a lesser number may
adjourn from day to day and compel the attendance of absent
members, by a fine of not to exceed ten dollars ($10.00), for

Sec. 2-35. Calling meeting to order; reading minutes; selection
of chairman.
At the hour of meeting, the members shall be called to
order by the mayor, or in his absence, by the clerk, who shall
proceed to call the roll, note the absentees, and announce
whether a quorum is present. If made necessary by the ab-
sence of the mayor, the members may elect one of their
number chairman for the occasion. (Res. No. 250-51, § 1 (Rule

Sec. 2-36. Order of business.
Upon the appearance of a quorum, and being duly organized,
the council shall proceed to the business before them, which
shall be conducted in the order following:
(1) Presentation of communications.
(2) Notice of claims.
(3) Ordinances.
(4) Petitions.

Sec. 2-37. Preservation of order and decorum.
(a) The mayor shall preserve order and decorum, and shall
decide questions of order, subject to appeal to the council.
(b) While the mayor is putting the question no member
shall walk across or out of the council room. (Res. No. 250-51,

Sec. 2-38. Members not to leave sittings of council without
leave of presiding officer.
No member shall leave the sittings of the council without
leave of the presiding officer. (Res. No. 250-51, § 1 (Rule 8),

Sec. 2-39. Requirements for nonmembers addressing council.
Persons other than members of the council shall not address
the council otherwise than in writing, which shall be on file
with the city clerk prior to noon of Friday preceding the

Sec. 2-40. Interrupting speakers.
While a member is speaking no member shall entertain
private discourse, or pass between him and the chair. (Res.
No. 250-51, § 1 (Rule 10), 7-16-51)
Sec. 2-41. Members required to vote on questions; exceptions.
Every member who is present when a question is stated
from the chair shall vote thereon, unless excused by the
council, or unless he is directly interested in the question, in
which case he shall not vote. (Res. No. 250-51, § 1 (Rule 11),

Sec. 2-42. Division of multiple issue questions.
If the question in debate contains several distinct proposi-
tions, any member may have the same divided. (Res. No.
250-51, § 1 (Rule 12), 7-16-51)

Sec. 2-74. Transfer of records and property to successor.
Each officer shall transfer to his successor in office all
books, papers, records, documents and property, together with
an invoice of the same, in his custody and appertaining to
his office.

DIVISION 2. MAYOR AND MAYOR PRO TEM
Sec. 2-81. Election; term.
The city council shall elect one (1) of its members as
mayor and one (1) of its members as mayor pro tem. Such
election shall be made at the first council meeting in
January of each year. The terms of both the mayor and
mayor pro tem shall be for one (1) year. (Ord. No. 17-75, § 6,

Sec. 2-82. Powers and duties of mayor generally.
The powers and duties of the mayor shall be as provided
in the Iowa Code.
Sec. 2-83. Mayor designated chief executive officer.
The mayor is the chief executive officer of the city and pre-
siding officer of the council. Except for the supervisory duties
which have been delegated by law to a city manager, the mayor
shall supervise all city officers and departments.
Sec. 2-84. Emergency powers of mayor.
The mayor may take command of the police and govern the
city by proclamation when he determines a time of emergency
or public danger exists. Within the city limits, he has all the
powers conferred upon a sheriff to suppress disorders.
Sec. 2-85. Powers and duties of mayor pro tem.
The mayor pro tem is vice-president of the council. When the
mayor is absent or unable to act, the mayor pro tem shall per -

form the mayor's duties, except that the mayor pro tem may
not appoint, employ or discharge officers or employees without
the approval of the council. Official actions of the mayor pro
tem when the mayor is absent or unable to act are legal and
binding to the same extent as if done by the mayor. The mayor
pro tem retains all his powers as a member of the council.

DIVISION 3. MANAGER
Sec. 2-103. Appointment; qualifications; oath; bond.
(a) It shall be the duty of the council to appoint some com-
petent person manager of the city, who shall be and act as the
administration head thereof, under the direction and super-
vision of the council, and shall hold office at its pleasure.
(b) The council, in appointing a manager, need not be in-
fluenced by the residence or nonresidence of the person se-
lected, having regard for his qualifications and fitness for
the position.
(c) During the absence of the manager by leave of the
council through sickness or other unavoidable causes, the
council may designate some properly qualified person to per-
form and execute the duties of his office.
(d) Before entering upon his duties, the manager shall take
an oath that he will support the Constitution of the United
States, the constitution of the state, and without fear or favor,
to the best of his ability, faithfully and honestly perform the
duties of his office.
(e) The manager shall execute a bond with a reliable surety
company as surety thereon, to be paid for by the city, in such
sum as the council may, by resolution, determine, which bond
shall be conditioned for the faithful performance of his duties

DIVISION 8. DIRECTOR OF COMMUNITY
DEVELOPMENT*
Sec. 2-172. Office created; responsibilities generally.
(a) Effective July 1, 1980, there is hereby created the office
of director of community development of the city.
(b) Said office shall have the responsibility for directing
the activities of several divisions comprising the community
development department, including:
(1) Building inspection services;
(2) Policy and program development;
(3) Community development block grant administration;
(4) Development administration;
(5) Health services;
(6) Housing services.

ARTICLE IV. CIVIL SERVICE COMMISSION'
Sec. 2-178. Applicability; provisions to comply with statutes.
The provisions of this article shall apply to those persons
enumerated in Iowa Code section 400.6 and shall be in accord-
ance with the laws of the state.

Sec. 2-179. Created.
A civil service commission is hereby created under and in
accordance with the provisions of chapter 365 of the Iowa Code
Annotated. (Ord. No. 104, § 1, 8-12-21)
Sec. 2-180. Qualifications generally.
The civil service commissioners shall be citizens of Iowa
and residents of the city for more than five (5) years next
preceding their appointment, and shall not, while on the com-
mission, hold or be a candidate for any office of public trust.

Sec. 2-181. Appointment; term.
The mayor, with the approval of the council, shall appoint
three (3) civil service commissioners who shall hold office,
one (1) until the first Monday in April of the second year,
one (1) until the first Monday in April of the fourth year,
and one (1) until the first Monday in April of the sixth year,
after such appointment, whose successors shall be appointed

Sec. 2-182. Compensation.
The civil service commissioners shall serve without com-

Sec. 6-63. Parades.
Circus parades shall be permitted only with the approval
of the city manager who shall prescribe the streets which
may be used. Circus vehicles, except in parades, shall not be
drawn over streets paved with soft top materials whenever

ARTICLE V. OPEN AIR SHOWS
Sec. 6-75. Definition.
As use in this article, "open air show" shall mean any
traveling show, exhibition or amusement conducted for profit
in the open air, or in any tent, or other temporary structure.

Sec. 6-76. License required.
No person shall conduct an open air show without first
obtaining a license therefor. (Ord. No. 52-55, § 1, 9-6-55)

Sec. 6-77. License fees.
The license fee for an open air show shall be seventy-five
dollars ($75.00) for the first day and twenty-five dollars
($25.00) for each succeeding day; provided that, where the
council shall find that the profits from such show are devoted
to civic, charitable, patriotic or other public purposes it may
remit the fee in whole or in part. (Ord. No. 52-55, § 4,

Sec. 6-78. Exemptions.
The city council may, upon proper application and showing,
exempt any disabled veteran, or crippled, disabled or indigent

ARTICLE VI. PUBLIC DANCES AND DANCE HALLS
Sec. 6-90. Definitions.
As used in this article, the following terms shall have the
meanings ascribed to them:
Public dance or public ball shall mean any dance to which
the public generally may gain admission with or without the
payment of a fee.
Public dance hall shall mean any room, place or space open
to the public where dancing is allowed with or without the
payment of a fee, notwithstanding the fact that food may be
served therein and a restaurant license held pursuant to state

Sec. 6-91. Dance hall to be licensed; manager to countersign
license; manager may refuse to countersign license
or revoke license; grounds.
(a) It shall be unlawful to hold any public dance or public
ball until the dance hall in which the dance or ball is to be
held shall have first been duly licensed for such purpose. The
license shall be issued by the clerk and countersigned by the
manager, and the fee therefor shall be paid at the time of the
issuance of the license.
(b) The manager may refuse to countersign the license or,
if it has been countersigned, may revoke the license for dis-
orderly or immoral conduct on the premises or for a violation
of any of the provisions of this Code, other ordinances of
the city and state laws governing or applying to public dance
halls or public dances.

ARTICLE I. IN GENERAL
Sec. 12-1. Definitions and rules of construction.
For the purposes of this chapter, unless the context
otherwise requires, the following definitions and rules of
construction shall be applied:
Points of the compass are approximate unless otherwise
stated.
All names, boundaries, lines, features and fixtures are to
be construed as they existed on the effective date of this
chapter.
Annexed territory means territory annexed to the city
after the effective date of this chapter.
City includes all territory within the corporate limits and
all annexed territories.
Commissioner of elections means the county auditor of
Dubuque County.
Corporate limits means the corporate limits of the city on
the effective date of this chapter. Corporate limits do not
embrace the annexed territories.
Frommelt's Bluff means a certain bluff which is east of
Pinard Street and west of Marquette Place.

Lake Peosta Channel means the waterway between the
major portion of the City of Dubuque and the island known
as Hamm Island or City Island.
Legislative district means a district represented by a
member of the House of Representatives of the General
Assembly of the State of Iowa, as established by the
Supreme Court of Iowa on March 31, 1972, in a supplemen-
tal opinion in cases numbered 55021, 55022, and 55023,
particularly in Sections 18, 19, 20 and 21 of "Appendix A"
thereof, as amended.
Street or similar language means the center line of the
right-of-way, and a straight extension of that center line.

Sec. 12-2. Correction of errors.
If this chapter fails to place any part of the city within a
precinct or ward established by this chapter, the commis-
sioner of elections shall assign the omitted area to an
adjacent precinct or ward within the same legislative
district. If this chapter places any part of the city in more
than one precinct or ward established by this chapter, the
commissioner of elections shall assign that territory to an
adjacent precinct or ward within the proper legislative
district. The commissioner of elections may also correct

Sec. 25-263. Loading and unloading in business districts to be
done in alley where possible.
Loading and unloading of merchandise, freight or materials
shall not be done from a street in the business district where

Sec. 25-264. Parking under fire escapes in alleys.
It shall be unlawful to park any vehicle in any alley under
any fire escape at any time. (Ord. No. 33-49, § 16.15, 9-6-49)
Sec. 25-265. Parking in parking lots.
It shall be unlawful for any motor vehicle to be parked in
any stall or space in any parking lot within the city without
first having secured the permission of the operator of any
parking lot in which stalls or spaces for parking cars are

Sec. 25-266. Backing for purposes of parking in business dis-
tricts.
In the business district the driver of a vehicle shall not back
the same between other vehicles then standing upon the street
in order to park his vehicle between such vehicles unless he
can do so without interfering with traffic and unless there is
sufficient space so that such vehicle when parked will be paral-
lel with the curb and will leave at least four (4) feet of clear
space between the vehicle in front and to the rear of such

Sec. 25-267. Parking vehicles for purposes of sale or storage
prohibited; special permits authorized.
(a) No person shall park or permit to be parked any vehicle
upon the streets or alleys merely for the purpose of displaying
it for sale or storing it while not in use.

(b) The chief of police may issue to any person a special
permit to park a vehicle on such streets or portions thereof
designated for such from time to time only for the purpose of
selling produce upon the public market and upon such condi-
tions as the chief shall prescribe. Such permit shall be either
in the possession of the operator or on the vehicle at the time
the vehicle is so parked. It shall be unlawful to violate any of

Sec. 25-268. Parking of advertising vehicles.
No person shall park any vehicle upon the streets which,
by loudspeakers or mechanical devices, is used to advertise

Sec. 25-271. Parking in alleys.
Unless actually engaged in taking on or discharging per-
sons, goods, or merchandise, no person shall stop or park a
vehicle in the alleys or portions of alleys designated as alleys
from time to time when parking or stopping is prohibited. All
vehicles stopped or parked in any of said alleys for the pur-
pose of taking on or discharging persons, goods, or merchan-
dise shall have a qualified operator in attendance at all times
being subject to movement upon request of a police or fire

officer. The provisions of this section shall not apply to ve-

Sec. 25-273. Parking on private property without consent of
owner.
No person shall drive, stop, stand or park a vehicle onto or
upon privately owned property, or an area developed as a pri-
vate off-street parking facility, without the consent of the
owner, lessee or person in charge of such privately owned

Sec. 25-274. Parking violations—Fines.
The owner or operator of any vehicle who shall receive no-
tice, either personally or by the attaching of such notice to
said vehicle, that said vehicle is parked in such manner, in
such a place or for such a time as to violate the provisions of
this chapter relating to the parking of vehicles may, within
seventy-two (72) hours from the time when such notice is
served upon him or attached to such vehicle, pay to the city
treasurer as a penalty for such violation the following sum:
(1) Overtime parking, double parking, illegal alley parking
and any other standing or parking violation. If paid
within seventy-two (72) hours from the time of viola-
tion as indicated on the notice, such fine shall be the
sum of two dollars ($2.00) ; if not paid within seventy-
two (72) hours, such fine shall be the sum of three
dollars ($3.00).

(2) Street storage. If paid within seventy-two (72) hours
from time of violation as indicated on the notice, such
fine shall be the sum of four dollars ($4.00); if not paid
within seventy-two (72) hours, such fine shall be the
sum of six dollars ($6.00) .
Parking in private lots. If paid within seventy-two (72)
hours from time of violation as indicated on the notice,
such fine shall be the sum of five dollars ($5.00) ; if
not paid within seventy-two (72) hours, such fine shall
be the sum of seven dollars ($7.00) .
(4) Parking in interference with snow or ice removal. If
paid within seventy-two (72) hours from the time of
violation as indicated in the notice, such fine will be in
the sum of five dollars ($5.00); if not paid within
seventy-two (72) hours, then such fine shall be in the
sum of seven dollars ($7.00).
(b) Payment of the above penalty, or fine, upon being
mailed to the city treasurer shall be deemed paid as of the

Sec. 25-275. Same—Posting bond.
Any person receiving such notice of violation and deem-
ing himself not guilty of such offense, or desiring to ap-
pear and defend against the same, shall within a twenty-four
(24) hour period appear at the police department and promise
to appear in the District Court of Dubuque County, Iowa for

Sec. 28-22. Procedure for setting fees when fees are con-
tended to be undue burden on interstate com-
merce.
(a) None of the license fees provided for by this chapter
shall be so applied as to occasion an undue burden upon inter-
state commerce. In any case where a license fee is believed by
a licensee or applicant for license to place an undue burden
upon such commerce, he may apply to the manager for an ad-
justment of the fee so that it shall not be discriminatory, un-
reasonable, or unfair as to such commerce.
(b) Such application may be made before, at, or within six
(6) months after payment of the prescribed license fee. The
applicant shall, by affidavit and supporting testimony, show
his method of business and the gross volume or estimated
gross volume of business and such other information as the
city manager may deem necessary in order to determine the
extent, if any, of such undue burden on such commerce.
(c) The city manager shall then conduct an investigation,
comparing applicant's business with other businesses of like
nature and shall make findings of fact from which he shall
determine whether the fee fixed by this chapter is unfair,
unreasonable or discriminatory as to applicant's business and
shall fix as the license fee for the applicant, an amount that
is fair, reasonable and nondiscriminatory, or if the fee has
already been paid, shall order a refund of the amount over and
above the fee so fixed. In fixing the fee to be charged, the
city manager shall have the power to base the fee upon a per-
centage of gross sales, or any other method which will assure
that the fee assessed shall be uniform with that assessed on
businesses of like nature, so long as the amount assessed does
not exceed the fees as prescribed by section 28-21. Should the
city manager determine the gross sales measure of the fee to
be the fair basis, he may require the applicant to submit,
either at the time of termination of applicant's business in
the city, or at the end of each three (3) month period, a sworn

statement of the gross sales and pay the amount of fee there-
for, provided that no additional fee during any one calendar
year shall be required after the licensee shall have paid an
amount equal to the annual license as prescribed in section

Sec. 28-23. Personal nature; transferability.
The transient merchant or peddler's license granted under
this article shall be personal to the applicant only and shall

Sec. 28-24. Report to police upon loss required.
In the event any license issued under this article shall be-
come lost or mislaid, the licensee shall report such fact to the

Sec. 28-25. Exhibition upon request required.
Peddlers or transient merchants are hereby required to ex-
hibit their licenses at the request of any citizen. (Ord. No.

Sec. 28-26. Milk and bakery peddlers exempted from certain
provisions of article; fees.
(a) Sections 28-18 through 28-22 of this article shall not
apply to holders of milk or bakery peddlers licenses.
(b) Persons selling milk or milk products or fruit juices
exclusively from house to house in the city shall first obtain a
milk peddlers license and pay an annual license fee of five dol-
lars ($5.00).
(c) Persons selling bakery goods exclusively from house to
house in the city shall first obtain a bakery peddlers license
and pay an annual fee of seventy-five dollars ($75.00). (Ord.

Section 4-112 C-1 Commercial district regulations
4-112.1 General Statement of Intent
The C-1 Commercial District is intended to provide for
small clusters of commercial establishments primarily
serving the daily needs of nearby residents. Commer-
cial uses which by virtue of their size or type of
service would tend to attract customers from a broader
area than the local neighborhood are not permitted in
this district.
To assure proper vehicular access and avoid the
penetration of residential areas by uses which may
adversely affect the residential environment, new C-1
Commercial Districts will generally be established
only along larger collector streets or arterial streets
bordering discrete residential neighborhoods. In older
areas of the city developed prior to the existence of
zoning regulations, the C-1 Commercial District may
be located within discrete residential neighborhoods,
particularly in locations where a long history of
commercial use and continued commercial viability is
present. However, in both older and newer areas of the
City, zoning policy will be directed towards gradually
encouraging the centralization and functional coales-
cence of businesses within this district and discourag-
ing the scattering throughout residential neighbor-
hoods of C-1 Districts to accommodate a single use,

developed local shopping centers which are in

commercial areas of the City, the C-2 District may
have some limited application to groups of commer-
cial uses which are spatially and/or functionally
integrated and which possess other characteristics
appropriate to the district.

retail convenience goods, but not including
department stores as defined in this ordinance
and not to include uses listed as permitted uses in

3) Private schools offering instruction in sports,
crafts, or fine arts.
4) Retail food stores.
5) Bars or taverns not exceeding two thousand two
hundred (2,200) square feet in gross floor area.
6) Barber shops, beauty shops, and similar personal
service establishments.

Section 4-116 C-5 Central business district regulations
4-116.1 General Statement of Intent
The C-5 Central Business District is created for specif-
ic application to the traditional downtown business core
of Dubuque and present Urban Renewal areas.
It is the intent of this ordinance to encourage the con-
tinued vitality and viability of the downtown areas
as the functional and symbolic center of urban activity
in Dubuque. To promote this purpose, liberal lot area,
building height, setback and off-street parking require-
ments are imposed to serve as incentives for the con-
tinued intensification of commercial use within the
District.
It is further the intent of this ordinance that the C-5
District and all zoning classification decisions relative
thereto should implement the Urban Renewal plan
(Iowa Project R-15) and related comprehensive plans
for the growth and redevelopment of downtown and
downtown -fringe areas.
4-116.2 Principal Permitted Uses
In the C-5 Commercial District, no building, structure,
or land shall be used, and no building or structure shall
be built or altered to be used in whole or in part, except
for the following purposes :
1) Retail merchandise sales
2) Food or drug stores
3) Barber or beauty shops and personal service estab-
lishments
4) Department stores
5) Professional office use
6) Photographic studios; schools offering instruction
in sports, crafts, or fine arts ; travel bureaus, and
similar service uses

4-116.3 Accessory Uses and Structures
Accessory uses and structures shall be permitted in the
C-5 Commercial District only in accordance with the
provisions and regulations of Article V of this ordi-
nance, entitled "Supplementary District Regulations".
4-116.4 The following Conditional Uses are permitted in the
C-5 Commercial District, but only in accordance with
the provisions of Article VI of this ordinance governing
the issuance of Conditional Use Permits :
1) Off-street parking lots, provided that the Board of
Adjustment finds that :
a. the proposed lot represents a maximum feas-
ible intensity of use for the land on which it
is located ; and
b. the proposed lot meets all requirements of the
Site Plan Review Provisions [See Section
5-103]
4-116.5 Additional C-5 Regulations

4-117.1 General Statement of Intent
The C-6 Planned Commercial District is intended to
accommodate larger, nucleated shopping centers serv-
ing the urban or regional market. These centers are
typified by one or more large multiple -line retail de -

partment stores associated with a number of related
supportive commercial uses, most often developed as
an integrated unit.
While it is recognized that large, integrated shopping
centers represent significant advantages in convenience
and efficiency over many traditional commercial de-
velopments, urban -regional centers by their size tend
to create quite substantial impacts upon the rest of the
community. In addition to the critical effects a large
shopping center may have upon the overall economic
welfare of commercial uses located elsewhere in the
City, such centers create a wide variety of direct and
indirect impacts upon their immediate environment
also. For this reason, proper planning analysis and
preparation is a necessary prerequisite to the estab-
lishment of new shopping centers of this type, and it
shall be the policy of the City that no new C-6 Districts
shall be hereafter created except as Planned Unit De-
velopments in conformance with the special require-
ments and provisions of this District. Similar plan re-
view and approval shall be required for any requested
expansion of an existing C-6 District or for substantial
"on-site" expansion of uses contained therein.
4-117.2 Principal Permitted Uses
In the C-6 Commercial District, no building, structure,
or land shall be used, and no building or structure shall
be built or altered to be used in whole or in part, except
for the following purposes:
1) Retail merchandise sales;
2) Department stores;
3) Professional office use;
4) Service uses;
5) Indoor restaurants or drive-in restaurants;

4-117.3 Accessory Uses
The following accessory uses shall be permitted in the
C-6 Commercial District:
1) All uses customarily incident to a principal per-
mitted use listed in section 4-117.2, except those
uses listed as Conditional Uses for this district

4-117.4 Conditional Uses
The following uses are permitted in the C-6 Commercial
District, but only in accordance with the provisions of
Article VI of this ordinance governing the issuance of
Conditional Use Permits:

Section 4-119 L -I Light industrial district regulations
4-119.1 General Statement of Intent
The L -I Light Industrial District is intended to provide
for industrial uses having a minimal impact upon the
surrounding physical environment and upon the appro-
priate use and enjoyment of adjacent properties. Such
uses are characterized by operations and activities
which produce little or no smoke, noise, vibration, odor,
or other potentially harmful emissions or by-products.
For this reason, L -I Light Industrial Districts may in
some cases border commercial or high-density resi-
dential districts, particularly where natural barriers
exist which reduce the visual and operational impacts
of the L -I Districts upon the adjacent uses. It is the
intent of this ordinance, however, that individual L -I
Districts should not be randomly located throughout
the City, but should be concentrated in larger con-
tiguous areas where transportation and utility, services
adequate to meet the needs of the district are present.
4-119.2 Principal Permitted Uses
In the L -I Light Industrial District, no building, struc-
ture, or land shall be used, and no public building or
structure shall be built or altered to be used in whole or
in part, except for the following purposes:
1) Repair, service, or storage of vehicles.
2) Storage, packaging, and processing of meat,dairy,
or food products, but not to include slaughter-
houses or stockyards.
3) Laundries and carpet or rug cleaning plants.
4) All uses listed as Principal Permitted Uses for the
C-4 General Commercial District except restau-
rants, bars or taverns [See Section 4-115.2 of this
ordinance].
5) Clubs, lodges, meeting halls, auditoriums, or places
of public assembly.

6) Compounding, processing, and packaging of chemi-
cal products, but not including flammable or ex-
plosive materials as defined in this ordinance.
7) Utility Stations; radio; television, or other com-
munication facilities; public or private facilities
for the transmission of electricity, sewage or wa-
ter; railroad facilities.
8) Rental, sales or storage of machinery, tools, heavy
construction equipment, or other similar equip-
ment.
9) Manufacture, assembly, repair or storage of elec-
trical and electronic products, components, or
equipment.
10) Printing, publishing, binding, and typesetting
plants.
11) Laboratories for research or engineering.
12) Warehousing, storage, or wholesale sales of any
product which may be manufactured in this dis-
trict.
13) Manufacture or assembly of musical instruments;
toys ; watches or clocks ; medical, dental, optical,
or similar scientific instruments ; orthopedic or
medical appliances ; signs or billboards.
14) Moving and storage companies.
15) Manufacturing, compounding, assembly or treat-
ment of articles or products from the following
substances : clothing or textiles ; rubber ; precious
or semi-precious stones or metals; wood; plastics;
paper; leather; fiber; glass; hair; wax; sheet
metal; feathers; fur; and cork, but not including
the manufacture of such raw substances as a prin-
cipal operation.

ores, scrap and waste materials, live animals,
explosives, flammable gases or liquids, and
petroleum and petroleum products.
b. Warehousing for commercial and industrial
uses.
3. Retail business uses
a. Automobile parts and supply sales.
b. Furniture and household appliance sales,
service and repair.
c. Lumber and other building material sales, but
not including sales of retail convenience
goods.
d. Musical instrument sales, service and repair.
4. Office uses
a. Professional office uses, but not including
offices of physicians, dentists, osteopathic
physicians, or other health practitioners.
5. Industrial uses, provided that the floor area
occupied does not exceed twenty thousand (20,000)
square feet and provided that such use can be
conducted without noise, vibration, odor, dust or
any other condition which might be disturbing to
occupants of adjacent properties:
a. Manufacture of ice.
b. Printing and publishing.
c. Processing or assembly.
d. Tool, die and pattern -making. (Ord. No.

4-122.3 Accessory Uses
Accessory uses and buildings are permitted in the C-7
Commercial District in accordance with the provisions
and regulations of Article V of this ordinance, entitled

"Supplementary District Regulations," and include in
addition to those subordinate uses which are clearly
and customarily incidental to the principal permitted
uses, the following:
1. Retail outlet store, for goods handled at wholesale
or products made by the principal use provided
that such retail sales shall be clearly incidental to
the operation of the principal use.
2. Office facilities.
3. Instruction on the use or operation of equipment
incidental to the principal use. (Ord. No. 54-80, §

4-122.4 Conditional Uses
The following conditional uses are permitted in the
C-7 Commercial District, but only in accordance with
the provisions of conditional use permits:
1. Similar and compatible uses to those allowed as
"principal permitted uses" in this district.
2. Cartage, express and parcel delivery.
3. Towing service.
4. Moving, storage and freight transfer.
5. Mini -warehousing on a parcel of land not less
than two (2) acres and not more than five (5)
acres.
6. Sales, rental, or storage of vehicles.
7. Sales, rental or storage of machinery, tools, heavy
construction equipment or other similar equip-

4-122.5 Prohibited Uses
The following uses are expressly prohibited in the C-7
Commercial District, and nothing in the provisions or
regulations for this district shall be interpreted or
construed to authorize the establishment of any such

Zoning Commission may be appealed to the Board of
Adjustment in the same manner as appeals from a
decision of an administrative officer.
Section 5-104 Off-street parking and loading space require-
ments for commercial and industrial districts
5-104.1 Application and Scope
The provisions of this Section shall apply to all uses
located within a commercial or industrial district, ex-
cept the C-5 and C-6 Commercial Districts. No such use
shall be expanded or enlarged in any manner unless
the off-street parking and loading spaces required by
5-104.4 of this Section are provided in full for such
addition or expansion. In addition, no such use which
is non -conforming at the effective date of this ordi-
nance in respect to the off-street parking and loading
requirements of this Section shall be hereafter ex-
panded or enlarged to an extent greater than twenty-
five per cent (25%) unless parking and loading spaces
are provided in full so as to bring the entire expanded
use into conformity with this Section.
5-104.2 Rules for Computation of Off -Street Parking and
Loading Requirements
The following rules shall govern the computation of re-
quired off-street parking and loading spaces :
1) Where computation of required off-street parking
spaces results in a fractional number, the required
spaces for the use shall be the next higher whole
number.
2) Where more than one use is established on a single
lot, the off-street parking and loading require-
ments for the lot shall be the sum of the separate
requirements for each use established on the lot.
3) No use or building shall be hereafter permitted to
be enlarged or altered except as the required off-
street parking and loading spaces for such use or
building are provided.

5-104.3 Location of Required Parking and Loading Spaces;
Joint Use
All off-street parking and loading spaces required by
this ordinance shall be located on the same lot as the
use for which such spaces are required, except that
where an increase in the number of off-street parking
spaces is required by an alteration or enlargement of a
use, or where such off-street parking spaces are pro-
vided or used jointly by uses contained in two or more
buildings, then the required off-street parking spaces
may be located not farther than three hundred (300)
feet from the use (s) served.
5-104.4 Schedule of Off -Street Parking and Loading Space
Requirements Adopted
Required off-street parking and loading spaces for
uses within a C-1, C-2, C-3, C-4, C-7, LI, HI or PI
District shall be as set forth in Schedule 5-104.4,
hereby adopted by reference and declared to be a part

Section 5-105 Sign regulations
5-105.1 General Statement of Intent
The provisions of this Section set forth the compre-
hensive regulations, conditions and limitations under
which signs may be permitted in the City of Dubuque.
It is intended by the Council that these provisions
shall be held to be the minimum regulations necessary
for the protection of the public welfare and shall be
narrowly construed and strictly applied in favor of
the public interest in maintaining a safe, healthy, and
attractive environment.
5-105.2 Schedule of Comprehensive Sign Regulations Adopt-
ed
No sign shall be maintained, erected, constructed or
altered except in conformance with the provisions and
regulations of Table 5-105.2, "Schedule of Comprehen-
sive Sign Regulations", hereby adopted by reference
and declared to be a part of this ordinance, and the
rules, definitions and further provisions of this Sec-
