Mayor Wharton stated that this
meeting is an adjourned meeting of
the regular meeting of January
2nd, 1950 Yor the purpose of acting
upon such business as may proper-
ly come before a regular meeting
of the City Council,
Proofs of publication, certified to
by the publishers, of notice of levy
of special assessment and intention
of the City Council to issue bonds
for the construction of sanitary
sewers and appurtenances in what
is known as the Cherry Green
Street Sewer District as delimited
by Ordinance No. 16.49.
The improvement shall consist of
the construction of an eight (8)
inch sanitary sewer, lift station
and six (6) inch cast iron force
main for the Cherry-Green Street
Sewer District. The eight (8) inch
sewer line begins at the lift ata-
tion located on the intersection of
the center lines of the alley at the
corporation limits and the alley be-
tween Cherry and Green Streets;
thence easterly along the center
line of the alley between Cherry
and Green Streets to a paint 5
feet westerly from the prolonga•
lion of the line between lots num-
bered 205 and 206 of Finley's Addi•
lion; thence southerly along a line
6 feet westerly of and parallel to
the easterly line of lot number 206
of Finley's Addition to the Center
of Cherry Street; thence easterly
along the center line of Cherry
Street to a point on the prolonga•
lion of the line between lots num•
bered 220 and 221 of Finley's Ad-
dition; also westerly along the cen-
terline of Cherry Street to a point
on the prolongation of the line be•
tween lots numbered 1 of 208 and
2 of 208 of Finley's Addition; also
from the intersection of the cen•
terlines of Cherry Street and Fin-
ley Street southerly along the cen-
terline of Finley Street to the cen•
terline of the alley 1st south of
Cherry Street; also an eight inch
vitrified file sanitary sewer begin-
ning at said lift station and run•

laid on a line beginning at the
lift station located on the inter-
section of the center lines of the
alley at the corporation limits and

at the corporation limits a distance
of 880 feet, and continuing north
from this point with an eight inch
vitrified the sewer main across As•
bury Street to the existing sani•
tary sewer manhole located at the
intersection of said alley a n d
the center line of Seminary Street,
presented and read. Councilman
Van Duelman moved that the
proofs of publication be received
and filed. Seconded by Councilman

opinion the assessment is quite a
bit more than it should be and
should be lowered, presented and

moved that the petition be receiv-

RESOLUTION N0. 2 - 50
Whereas, the contract heretofore
entered into by the City of Du-
buque for the construction of sani-
tary sewers and appurtenances in
what is known as the Cherry-Green
Street Sewer District hereinafter
described, has been completed
and said improvement has been
accepted by the City Council of
said City and the City Engineer
has computed the cost and expense
thereof to be $35,171.34
And Whereas, public notice as
provided by law, has been publish-~
ed by the City Clerk stating the
intention of the City Council to
issue bonds to pay the cost of
said improvement and a public
hearing has been held pursuant
thereto, and all objections filed
thereto have been considered and
determined:
Now, Therefore, Be It Resolved
by the City Council of the City of
Dubuque that to provide for the
cost of the construction of sani•
lacy sewers and appurtenances in
what is known as the Cherry-Green
Street Sewer District as delimited
by Ordinance No, 16-49.
The improvement shall consist of
the construction of an eight (8)
inch sanitary sewer, lilt station and
six (6) inch cast iron force main
for the Cherry-Green Street Sewer
District. The eight (8) inch sewer
line begins at the lift station local- '~
ed on the intersection of the cen•
ter lines of the alley at the cor-
poration limits and the alley be•
tween Cherry and Green Streets;
thence easterly along the center
line of the alley between Cherry
and Green Streets to a point 5
feet westerly from the prolonga-
tion of the line between lots num•
bared 205 and 206 of Finley's Addi-
tion; thence southerly along a line
5 feet westerly of and parallel to
the easterly line of lot number 206
of Finley's Addition to the center
of Cherry Street; thence easterly
along the center line of Cherry
Street to a point on the prolonga•
lion of the line between late num-
bered 220 and 221 of Finley's Addi•
lion; also westerly along the cen-
terline of Cherry Street to a point
on the prolongation of the line be-
tween lots numbered 1 of 208 and
2 of 208 of Finley's Addition; also
from the intersection of the cen-
terlines of Cherry Street and Fin-
e. ley Street southerly along the cen-
terline of Finley Street to the cen•
terline of the alley 1st south of
Cherry Street; also an eight inch
vitrified the sanitary sewer begin-
ning at said lift station and run-
ning north in the alley at the cor-
poration limits to the center line
of Green Street; thence easterly
along the center line of Green
Street to a point on the prolonga-
tion of the line between lots
numbered 197 and 2 of 198
of Fin 1 e y's Addition; also from
the intersection of the center lines
of Green and Finley Streets north-
erly along the center line of Fin-
ley Street to the intersection with
Foplar and Karrick Streets;
thence northerly along the cen-
ter line of Poplar Street to
a point on the prolongation oY the
line subdividing the northeast 102
feet and the southwest 65 feet-
9 inches of lot number 145 of Fin-
ley Addition; also westerly from
the intersection of Finley and
Poplar Street along a line 12 feet
southerly from and parallel to the
northerly line of Karrick Street to
a point on the prolongation of the
line between lots numbered 141 and
142 Finley Addition; A six inch
cast iron force main to be laid on
aline beginning at the lift station
located on the intersection of the
center lines of the alley at the
corporation limits and the alley be•
tween Cherry and Green Streets
and running north along the cen•
ter line of the alley at the corpora-
tion limits a distance of 880 Peet,
and continuing north from Chia
point with an eight inch vitrified
file sewer main across Asbury St,
to the existing sanitary sewer man-

of Seminary Street, there be issued
sewer bonds to the amount of 35,-

Said bonds shall be issued under
the provisions of Chapter 396 of
the Code of Iowa, 1946; shall bear
the date of the 2nd day of Febru-
ary, 1950, shall be in denominations
of $500.00, except that there shall
be one bond to the amount of
$171.34. They shall be numbered
from 4277 to 4347 inclusive and
shall be divided into ten series, of
which the bonds numbered 4277,
4278, 4279, 4280, 4281, 4282 and 42-
83 inclusive shall constitute the
first series and shall be payable
the first day of April, A. D. 1951,
the bonds numbered 4284, 4285, 42-
86, 4287, 4288, 4289 and 4290 in-
clusive shall constitute the sec-
ond series and shall be payable
the first day of April, A. D. 1952,
the bonds numbered 4291, 4292, 42-
93, 4294, 4295, 4296 and 4297 in-
clusive shall constitute the third
series and shall be payable the
first day of April, A. D. 1953, the
bonds numbered 4298, 4299, 4300,
4301, 4302, 4303 and 4304 inclusive
shall constitute the fourth series
and shall be payable the first
day of April, A. D. 1954, the bonds
numbered 4305, 4306, 4307, 4308, 43-
09, 4310 and 4311 inclusive shall
constitute the fifth series and
shall be payable the first day
of April, A. D. 1955, the bonds
numbered 4312, 4313, 4314, 4315,
4316, 4317 and 4318 inclusive
shall constitute the sixth series
and shall be payable the first day
of April, A. D. 1956, the bonds num-
bered 4319, 4320, 4321, 4322, 4323,
4324 and 4325 inclusive shall con-
stitute the seventh series and shall
be payable the first day of April,
A.D., 1957, the bonds numbered
4326, 4327, 4328, 4329, 4330, 4331
and 4332 inclusive shall constitute
the eighth series and shall be pay
able the first day of April, A. 1).
1958, the bonds numbered 4333, 43-
34, 4335, 4336, 4337, 4338 and 4339
inclusive shall constitute the ninth
series and shall be payable the
first day of April, A. D. 1959, the
bonds numbered 4340, 4341, 4342,
4343, 4344, 4345, 4346 and 4347 in•
elusive shall constitute the tenth
series and shall be payable the
first day of April, A. D. 1960.
Said bonds shall bear interest at
the rate of five per cent. per an-
num which interest shall be pay
able semi-annually, in accordance
with the terms of the coupons
thereto attached; and said bonds

ceeds of the special assessment
levied for said improvement.
Both principal and interest shall
be payable at the office of the City
Treasurer in the City of Dubuque.

able only out of the money derived
from the collection of said special
tax, and said money can be used
for no other purpose. And it is
hereby certified and recited that
all the acts and conditions and

happened and performed in regular
and due farm as required by said
law and resolution; and for the
assessments, collections and pay-
ment herepn of said special tax, the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.

Clerk objections to the amount of
the proposed assessments, t h e y
shall be deemed to have waived all
objections thereto.
Said improvement shall be con•
strutted and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Coun•
ci] and are now on file with the
City Clerk. That the cost and ex•
penes of making said improvement
will be assessed upon and against
all privately owned property lying
within assessable distance provided
by law and in an amount not to
exceed the amount provided by
law, property will be assessed
whether the same abuts thereon
or is adjacent thereto according to
area and in proportion to the spe•
cial benefits conferred thereby, and
any deficiency shall be paid out of
the general fund, improvement
funds or sewer funds, or partly out
of each of said funds. Bonds shall
be issued and sold in anticipation
of deferred payments of assess-
ments when a contract has been
performed and accepted and the
proceeds thereof used to pay the
contractor.

At the meeting of the Commis-
tion on December 6 they noted
your request for Highway Commis•
eiou approval of the placing of
regular atop and go signals at the
intersection of Fourth and Locust
Streets and of Fourth Street and
Central Avenue, which are loca-
tions where the relocated exten-
sions of several primary roads
make square turns.
This request was made in con•
nection with your request far the
change in location of the primary
road extensions which had bee n
approved at an earlier meeting of
the Commission.
I believe that both of these in-
tersections are within the business
district of Dubuque and hence do
not require formal approval by the
Commission bul nevertheless. the
Commission did act favorably on
them as requested.
They also took note of the fact
that you intend to move the pres-
ent signal at Fourth Street and
Main Street following which the
Main Street traffic will be requir•
ed to atop in favor of the Fourth
Street traffic following the prim-
ary road extension. When you are
ready to remove this signal, if you
will get in touch with our District
Engineer he will arrange to have
the regular stop signs put in so
that there need be no time lapse
between the time the signals are ~
removed and the signs are placed.

Dr. H. E: Lange that has been re-
ferred to me for investigation, on
November 23rd, 1949 at about 10:15
p.m., Dr. Lange while driving his
automobile ran into a huge rock 'i
in the rooter of the street on i
Chestnut St. It appears that this
rock had been there for more than
a day. His damages amounted to
$36.25. After consultation with him,
he has agreed to accept $18.10 in
full payment of hia damages. I rec•
ommend that his claim be allowed
in the sum of $18.10 and that a
warrant be issued payable to his
order for said amount and that the
same be delivered to him upon de•
livery to the City of a release
properly executed by him.

At the Council Meeting held Aug-
ust 29, 1949, the petition of O'Con-
nor, Thomas and O'Connor by E.
Marshall Thomas requesting favor-
able action on the application of
the Farley & Loetscher Mfg. Co.
for the right to construct, main-
tain and operate a loading dock
with a canopy over it on the south-
erly end of the East Sixth Street
warehouse on City Lot 364 was re-
ferred to the Council to view the
grounds.
The Council having viewed the
property decided to grant the re-
quest in a modified form and dir-
ected that a resolution be prepared
providing that trucks be required
to park parallel with the requested
loading structure. I recommend
that the decision of the Council be
confirmed and that the appropriate

ate, and maintain a loading dock
with canopy on E. Sixth Street in
the City of Dubuque, Iowa, adjoin-
ing the E. Sixth St., side of the
building located at the corner of
East Sixth Street and Jackson St.,
in the City of Dubuque, and
Whereas said petition was duly
referred to the City Council to view
the grounds, and
Whereas, the City Council of the
City of Dubuque has viewed the
grounds and is of the opinion that
said request should be granted up-
on certain terms and conditions.

Manufacturing Company be and it

authority to construct, operate and

foot wide leading dock with can-
opy along the East Sixth Street
side of the building located at the
corner of East Sixth Street anu
Jackson Street, connecting said
dock and canopy with the existing

son Street aide of said building,
said dock and canopy to be con-
structed in accordance with plans
and specifications now on file in
the Office of the Clerk of the City
of Dubuque, Iowa.
Sec. 2. That such construction
and operation be done under the
direction and supervision of t h e
City Manager and Building Inspec-
tor.
Sec. 3. That the right to con-
struct and operate and maintain
said loading dock as herein granted
shall be subject to the continuous
control of the City Council of the
City of Dubuque, reserving t h e
right to said City Council to im-
pose restrictions and conditions up•
on the use and enjoyment thereof
as may be reasonably necessary
for the protection of the public in-
terest, including the right to re•
yoke and rescind the grant hereby
made, if at any time the Council
determines that the public interest
so require.
Sec, 4. The Farley &Loetscher
Manufacturing Company as a con•
sideration of the rights and privi•
leges hereby granted agrees that
loading and unloading from the
platform herein referred to shall at
all times be from vehicles that are
parked so that the free flow of
traffic on Sixth Street shall not be
interfered with; any vehicle in ex•
cess of twenty feet in length shall
not at any time be parked at right
angles with said unloading plat-
form; upon failure to so comply
with the provisions herein, the City
Council of the City of Dubuque may
revoke the rights herein granted
and the applicant shall remove the
structure herein authorized and re•
store the street to the same condi•
tion it was in before the structure
was erected.
Sec. 5. As a further considers
tion of the rights and privilege
hereby granted, said Farley & Loet
scher Manufacturing Company, its
successors and assigns, assume any
and all liability for damages to per•
sons or property which may result
from the construction, operation
and maintenance of said unloading
platform, and said Farley & Loet-
scher Manufacturing Company, its
successors and assigns, at its own
expense agrees to defend any and
all claims or actions which may be
made or brought against the City
of Dubuque because of the con-
struction, operation and mainten•
ante of said loading dock, and
should the City be required to pay
any sum as damages, said Farley &
Loetscher Manufacturing Co., its
successors and assigns, agree to
fully reimburse the City therefor
and to hold said City of Dubuque
harmless from any such damages.
Sec. 6. Should the rights a n d
privileges herein granted be res•
cinded or revoked, said Farley &
Loetscher Manufacturing Company,
at its own expense and upon re-
ceipt of notice through the regular
United States mails, agrees that
within thirty (30) days after the
receipt of said notice, to remove
the structure herein authorized and
to restore the street in as good
condition as it was before the con-
struction of said structure.
Sec. 7. This Resolution shall be•
come effective and the rights here-
under shall accrue to Farley &
Loetscher Manufacturing Co., its
successors and assigns, when this
Resolution has been passed by the
City Council of the City of Dubuque
and accepted by Farley & Loet-
s c h e r Manufacturing Company,
which acceptance shall be endors-
ed hereon.

Gentlemen:
At the meeting of January 3,
1950 the petition of D. E. Breit-
haupt and others, requesting the
removal of the occupants of the
West Hill Chapel at 255 Pear Street
was referred to me for proper ac-
tion and report. The following day
a search warrant of the premises
was obtained from the Honorable
District Court Judge John G. Chal-
mers on the following grounds:
1) There was substantial reason
to believe that the occupants were
in illegal possession of the premis-
es under the pretense of conducting
a religious institution.
2) That undesirable and suspi-
cious characters were harbored at
this place.
3) That the occupancy was in
violation of the Sanitary, Fire,
Safety and Zoning regulations of
the City of Dubuque and as such, it
constituted a menace to the well-
being of the community.
Immediately thereafter I made a
search in company with Police
Chief Strub, Fire Chief Hickson
and Building Inspector Bandy. This
search definitely vindicated the
reasons cited in the application for
the search warrant.
On Saturday, January 7th, upon
her return to the city, I had a con-

the minister of the West Hill Chap•
el. She was persuaded to vacate
the premises along with the other
occupants by Tuesday, January 10.
This was accomplished as agreed.
The investigation disclosed fur-
ther that the City Assessor had
placed this property, described as
the North 40 feet of Lot 122 of
Union Addition, on the tax rolls
late last year upon the failure of
the group in possession to meet
the requirements of the law regard-
ing exemption from general taxa-
tion of religious holdings. The title
to the land is in the trustees of
the West Hill Chapel Association,
the membership of which is not
known to me since wholesale res-
ignations took place several years
ago.
The human aspects cited in the
complaint have now been resolved
but there remain the physical con•
ditions. I recommend that your
Honorable Body proceed to the
appointment of a condemnation
committee to investigate the prop-
erty described above and to report
its findings to you.
