The city council wishes to assure that a fair cross section
of the residents of the city fully participate in the continuous
process of budgeting, developing, monitoring and evaluating

Sec. 111/2-12. Creation.
There is hereby created a community development
commission to have powers and responsibilities to the
extent of authority granted by the city council. (Ord. No.
79-79, § 1, 12-17-79)
Sec. 111/2-13. Responsibility generally; reliance on
neighborhood organization.
(a) The community development commission is charged
with the development of the community development
program based on identifiable community development
needs and objectives through the involvement of residents
likely to be affected by community development and housing
activities, the private sector, and local government, for
submission to the city council for their consideration.
(b) The neighborhood organization in the community
development organizational structure is the basic grassroots
structure for analyzing problems, recommending objectives
and suggesting program strategy. The community develop-
ment commission will rely heavily on the neighborhood
organization input when developing and evaluating the
total community development program.
(c) Additionally, the community development commission
is to perform certain functions relating to the conservation
and rehabilitation of the housing stock of the city; by
monitoring performance of the housing rehabilitation
program, by acting as an appeals board for program
applicants and contractors; and by reviewing qualifications
of contractors desiring to bid on rehabilitation work. (Ord.

Sec. 111/2-14. Membership, terms of office and commu-
nity representation; attendance at meet-
ings; vacancies in office; employment,
service restrictions; compensation.
(a) The community development commission shall have a
membership of nine (9) persons as described hereinafter who

(a) The community development commission may adopt
rules, bylaws and regulations governing its organizational
procedures as may be deemed necessary and which are not

in conflict with this document or any other resolutions and
ordinances of the city.
(b) All programs, projects and services to be formed by
members of the community development commission, either
singularly or as a commission, must conform to the policies
of the city and to applicable local, state and federal laws,
rules and regulations.
(c) The community development commission acknowl-
edges that sole responsibility and authority to make final
determination for the carrying out of any community
development activity or program rests with the city council,
and the city council does not require the concurrence of any
person or group of persons to make such a determination.
(d) Nothing in this organizational structure prohibits or
prevents any person, or group of persons, from formally or
informally petitioning the city council or the city adminis-
tration regarding the community development program.

Sec. 111/2-17. Staff.
(a) Meetings secretary. The community development
specialist for the city shall act as secretary of the regular
and special meetings of the community development
commission and shall record all votes, keep a record of all
proceedings of the commission and perform such other
duties incident to the office of secretary.
(b) Administrative head. The director of the department of
community development shall have general supervision of
the administration and affairs of the community develop-
ment commission, subject to the direction of the commis-
sion. The department shall maintain the records of the
commission and shall be charged with the overall manage -

ment, administration and operation of all community

Sec. 111/2-45. Purpose; responsibilities.
(a) The purpose of the rehabilitation commission of the
city is to perform and provide certain services in the field of
community development as it relates to the conservation,
preservation and rehabilitation of the housing stock of the
city.
(b) The rehabilitation commission is charged with the
development and operation of residential rehabilitation and
home improvement lending programs throughout the city
through the involvement of neighborhood residents, the

Sec. 111/2-46. Membership, terms of office and commu-
nity representation; filling vacancies;
attendance at meetings; employment
restrictions.
(a) The rehabilitation commission shall have a member-
ship of not less than thirteen (13) persons, and they shall be
appointed by the city council for terms of three (3) years. Six
(6) of the initial appointments shall be for a one-year term,
six (6) of such appointments shall be for a term of two (2)
years, and the balance of appointments shall be for a term
of three (3) years. Upon completion of their term of office,
members shall continue to serve in their full capacity until a
successor has been duly appointed and qualified as provided
herein.
(b) Membership on the rehabilitation commission shall be
limited to residents of or to persons who are employed in the
city.
(c) Membership on the rehabilitation commission shall at
all times, to the extent practicable, include the following
representation:
1. A real estate broker engaged in residential real estate;
2. A general contractor engaged in the production of
residential structures;
3. A remodeling contractor engaged primarily in the
rehabilitation, repair and/or renovation of residential
structures;
4. A building materials supplier;
5. A representative of a building trades labor organiza-
tion;
6. An architect or an engineer;
7. A representative of the city housing commission;
8. A representative from each of two (2) separately
identifiable neighborhood organizations;
9. Citizens -at -large selected as closely as possible from
each of the four (4) quadrants of the city.

(d) A vacancy caused by resignation or otherwise on the
rehabilitation commission shall be promptly filled by the
city council for the unexpired term of office.
(e) Members of the rehabilitation commission shall attend
at least two-thirds (2/3) of all regularly scheduled and held
meetings within any 12 -month period. If any member does
not attend the prescribed number of meetings, it shall
constitute grounds after hearing by the rehabilitation
commission, for the said commission to recommend to the
city council that said member be replaced. Attendance of all
members shall be entered on the minutes.
(f) No member of the rehabilitation commission may be
an employee of the city. (Ord. No. 90-79, § 1, 12-17-79)
Sec. 111/2-47. Compensation.
All members of the rehabilitation commission shall serve
without compensation, except for reimbursement of neces-
sary expenses, including travel expenses incurred in the
discharge of their duties. (Ord. No. 90-79, § 1, 12-17-79)
Sec. 111/2-48. Organization.
(a) The rehabilitation commission shall maintain the
following standing committees, each of which shall be
responsible for, but not limited to, the areas hereinafter
described:
(1) Financial and counseling committee:
Development of local and other resources to finance
rehabilitation loans and grants through the use of
community development block funds; general and
other forms of revenue sharing; private, public and
nonprofit foundations, Iowa housing and finance
authority, and other public and private sources.
Development of a special revolving fund for persons
considered to be high-risk borrowers.
Development of a management system to assure the
maximum and efficient use of funds.
Development of the terms and conditions under which
loans and grants are to be made, including, but not

limited to, determination of income and asset
limitations, periods of repayment, interest subsidies
and eligible costs.
[Serving as] review board for the approval or
disapproval of applicants for rehabilitation loans
and grants.
Development of special counseling services for persons
who are considered high-risk borrowers.
(2) Public information committee:
Development of a public informational brochure to
interpret the rehabilitation program to secure the
support of the total community, including, but not
limited to, neighborhood meetings, public media
presentations, maintenance of a speakers bureau
and the issuance of timely news releases.
Development of community improvement bulletins
and other means to secure participation by hom-
eowners in the rehabilitation program.
(3) Rehabilitation standards and technique committee:
Development of property rehabilitation standards
which are consistent with residential qualities,
physical characteristics and other evidences of
vitality to assure that rehabilitation activities will
restore neighborhoods to a long-term sound condi-
tion.
Review of neighborhood plans to ascertain that
blighting and deteriorating influences which adver-
sely affect housing conditions are identified and
appropriately addressed.
Development of techniques in the use of new materials
to accomplish rehabilitation at the least cost.
Development of "sweat equity" programs.
Development of a continuing program to maintain
rehabilitated individual properties.
(b) Each of the standing committees shall be composed of
not less than four (4) members to be appointed by the
chairperson of the rehabilitation commission from the
membership of the commission. The chairperson of each

standing committee shall be named by the chairperson of
the commission.
(c) There shall be an executive committee composed of the
officers and the chairpersons of the standing committees to
develop general program guides and coordination among the
standing committees.
(d) Each standing committee may appoint task forces as
necessary for the purpose of carrying out one-time, specific
specialized assignments of short durations. The chairperson
of such a task force shall be a member of that standing
committee. Appointments to such task forces are not limited
to members of the rehabilitation commission but remain
from the community at large.
(e) The rehabilitation commission may adopt rules,
bylaws and regulations governing its organization and
procedures as be deemed necessary which are not in conflict
with this document or any other resolutions or ordinances of
the city.
(f) All programs, projects and services to be performed by
members of the rehabilitation commission, either singularly
or as a commission, must conform to the policies of the city
and to all local, state and federal laws, rules and

Sec. 111/2-49. Meetings.
(a) The rehabilitation commission shall hold an organiza-
tional meeting on a date selected by the mayor of the city,
and a reorganizational meeting annually thereafter.
(b) The rehabilitation commission shall meet not less than
monthly on a regular basis.
(c) Each standing committee shall be appointed not more
than fourteen (14) days after the organization and/or
reorganization of the rehabilitation commission. Each
standing committee shall meet not less than monthly on a
regular basis.

(d) The rehabilitation commission shall file with the city
council a copy of the minutes of each regular and special
meeting of the commission within ten (10) working days
after each such meeting.
(e) The rehabilitation commission shall also file with the
city council from time to time, but not less than quarterly, a
narrative report of their activities including financial and
statistical data which may be necessary for the city council
to understand all undertakings of the commission.
(f) All meetings shall be held in conformance with the
provisions of the Iowa Open Meetings Law. (Ord. No. 90-79,

Sec. 111/2-50. Staff.
(a) The rehabilitation supervisor of the department of
community development for the city shall act as secretary to
the commission.
(b) The director of the department of community develop-
ment shall have general supervision of the administration
and affairs of the rehabilitation commission subject to the
direction of the commission. The director shall maintain the
records of the commission and shall be charged with the
overall management, administration and operation of all

Sec. 111/2-51. Applicable procedures for operations.

Sec. 111/2-61. Designation of "municipal housing
agency."
The city hereby elects to have its powers as defined in
chapter 403A of the 1979 Code of Iowa exercised by the city

Sec. 111/2-62. Housing program supervisor.
The supervisor of the housing program shall be appointed
by and serve at the pleasure of the city manager. The
housing commission shall serve as a personnel advisory
committee to the city manager in the selection of such a

(a) The housing commission shall undertake and carry
out studies and analyses of the housing needs and the

less than two (2) feet above the surface of the sidewalk
or street.

Sec. 24-27. Establishment of market stalls; issuance of per-
mits.
The city manager is authorized to establish spaces for stalls in the
Central Market as may be necessary and to issue permits for the use
of such stalls. The annual fee for such permits shall be twenty
dollars ($20.00) per stall, of which five dollars ($5.00) shall be dis-
bursed by the finance director to an authorized representative of
the Farmers' Market Advertising Committee to be used for promo-
tion of the Central Market. The fee shall be charged and collected at
the time of the issuance of the permit and paid to the city treasurer.

Sec. 24-28. Display permit restricted to Central Market area.
A market stall permit authorizes any person, firm or corpor-
ation to display foods or crafts only in the Central Market
area as provided in section 24-27. (Ord. No. 9-76, § 6, 3-29-76)
Sec. 24-29. Revocation of permit.
In any case where it is found that items displayed, offered
for sale or sold have not been raised, produced or crafted by
the vendor, or have been processed, manufactured or crafted
by the vendor in violation of any city ordinance or permit
agreement, the permit shall be revoked. (Ord. No. 9-76, § 8,

Sec. 24-30. Market master to be designated; duties generally.
The city manager is hereby authorized and directed to desig-
nate a market master, who shall establish and carry out such
procedures, policies and rules relating to the Central Market
and its operations as are necessary to provide for acceptable
sanitation and to protect the public health, safety and welfare.

Sec. 24-31. Traffic regulations.
It shall be the duty of the city manager or his designee
to restrict or regulate the sidewalk and street traffic in the
area of the Central Market as may be necessary to protect the
public health, safety and welfare. (Ord. No. 9-76, § 3, 3-29-76)
Sec. 24-32. Inspection of merchandise; confiscation of food
unfit for consumption.
All food or food products displayed, sold or offered for sale at
the Central Market shall be subject to inspection by the market
master, or by the health officer or his deputy. If any food
or food product is found to be unfit for human consumption,
the market master or health officer shall confiscate and
destroy the food, and the person displaying, offering for sale
or selling such food shall be guilty of a misdemeanor. (Ord.

Sec. 24-33. Weights and measures.
The weights and measures approved, standardized and adopted
by the state department of agriculture shall be the standard
weights and measures used for the sale of all merchandise re-
quired to be sold by weight or other measure at the Central
Market. All sales by weight shall be by avoirdupois weight, and
all sales of commodities by measure shall be by standard volume
containers, specifically, pint, quart, peck or bushel. (Ord. No.

Sec. 24-46. License required.
It shall be unlawful for any person to engage in the practice
of telling fortunes, palmistry, clairvoyance, phrenology or sim-
ilar art, without first obtaining a license therefor and paying
the license fee hereinafter . prescribed. (Ord. No. 57-55, § 1,
9-6-55)
Sec. 24-47. License application.
Applications for licenses under this article shall be filed in
duplicate with the city manager, on a form to be furnished by
him, which shall be signed by the applicant and give the
following information:
(1) Type of license applied for.
(2) Name of applicant.
(3) Address, both legal and local.
(4) The length of time the right to do business is desired.
(5) The applicant's fingerprints and a physician's certifi-
cate that the applicant is free from communicable
diseases.
(6) A statement of good moral character signed by the
chief of police of each place the applicant practiced

Sec. 24-48. License fees.
The license fee for the practice of fortune telling, palm-
istry, phrenology, clairvoyance, or similar profession or art
is hereby fixed at five dollars ($5.00) per day, twenty-five
dollars ($25.00) per week or fifty dollars ($50.00) per month.

ARTICLE IV. GOING -OUT -OF -BUSINESS SALES
Sec. 24-60. Definition.
As used in this article, "going -out -of -business sale," shall
mean and include any sale held out in such a manner as to
cause the public reasonably to believe that upon the disposal
of the stock of goods on hand the business will cease and be

Sec. 24-61. Permit—Required.
It shall be unlawful for any person to conduct a going -out -
of -business sale without first procuring a permit therefor

defined by Chapter 123 of the Code of Iowa or any type of wine
product is prohibited in any public park or park and recreation
facility including park roadways and parking lots.
(b) The consumption of beer on any park roadway or parking
lot or in cars is prohibited at all times.
(c) Where the use or consumption of beer is permitted, no beer
in containers commonly referred to as "keg beer" shall be per-
mitted at any time except by a licensed holder of a beer permit
who has obtained a park permit from the park and recreation
department authorizing the use of such container.
(d) The consumption or use of beer is prohibited in the follow-
ing named parks: Jackson Park, Grant Park, Washington Park,
Burden Playground, Madison Park, Allison -Henderson Park, Jef-
ferson Park, Hilltop Playground, Booth Tennis Court, Maus Con-
servation Park, Oakwood Park, Falk Playground, E. B. Lyons
Prairie/Woodland Preserve, Flat Iron Park, Peter Cooper Play-
ground, Municipal Pool, Comiskey Field, Gay Playground, Avon
Park, Caledonia Playground, Waller -Cooper Tot Lot, Cleveland

Sec. 27-50. Horse-drawn vehicles, riding of animals restricted.
Horse-drawn vehicles, riding horses or any other domesticated
animal used for such purposes shall be prohibited in any park
unless permission is granted by the park and recreation commis-

Sec. 27-51. Dogs, cats, etc.
No person shall be permitted to bring into any park any dog,
cat or other domestic animal, nor shall any person permit such
dog, cat or other domestic animal to run at large in any park.
Any unattended animal shall be impounded and its owner may
redeem the same upon paying the reasonable costs of such im-
poundment. (Ord. No. 24-69, § 5, 5-5-69)

Sec. 27-52. Damage to property—Generally.
No person shall cut, break, scratch, mark or in any way injure
or deface any park property, facility or any other feature upon or
within any park or parkway. (Ord. No. 24-69, § 6, 5-5-59)
Sec. 27-53. Same—Cutting plants, shrubs, etc.
No person shall pick or cut, break or in any way injure or
deface any tree, shrub or plant within the limits of any park or
parkway; nor carry within or out of any park or parkway any
wild flower, tree, shrub, plant, or any newly plucked branch or
portion thereof, or any soil or material of any kind. This section
shall not apply to officers or employees of the commission. (Ord.

Sec. 27-54. Same—Walking on grass.
No person shall go on foot or otherwise upon the grass or turf of
any park or parkway where any prohibitory sign is posted. (Ord.
