Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the location of the property.
Staff reviewed the submitted plat noting that access to Lot 2 is by way of an access easement
through Lot 3. Staff reviewed that because of the terrain between Lot 2 and Kemp Road that a direct
access was not practical. Staff recommended that approval be subject to provision of a 20 foot wide
paved drive through Lot 3 to serve Lot 2 to ensure adequate emergency access.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that they are in agreement with
staff's recommended condition to require a 20 foot wide paved drive through Lot 3 to serve Lot 2.
Recommendation
By a vote of 6 to 0 the Zoning Advisory Commission recommends that the City Council approve the
request, subject to waiving Article IV Design and Improvement Standards for the City of Dubuque
Subdivision Regulations, except Section 42-19 Blocks & Lots and requiring that a minimum 20 foot
paved driveway access be provided through Lot 3 to serve Lot 2.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Final Plat of Conlan Place Subdivision, Dubuque County, Iowa
INTRODUCTION
The submitted minor final plat re-subdivides property located along Kemp Road south of
U.S. Highway 52 in Dubuque County. The subject property is located within two miles
of the City of Dubuque corporate limits, and the plat is being reviewed jointly between
the City and County of Dubuque.
DISCUSSION
The submitted final plat of Conlan Place re-subdivides approximately 50 acres of
property into four lots. Lot 1 is principally used for agricultural purposes. Lot 4 has an
existing residence located on it, and Lots 2 and 3 are newly platted lots for future
development of two single-family homes. Access to Lots 2 and 3 is from an access off
of Kemp Road. Lot 2 is only served by an access easement and has no frontage on a
public or private street.
This section of Kemp Road has several grade changes and curves that can limit
visibility along the roadway. The property between Lot 2 and Kemp Road is comprised
of a wooded hillside with rock outcroppings and a drainage way at the bottom. Planning
staff does not object to Lot 2 not having frontage on Kemp Road provided that the
owner agrees with having a minimum of 20-foot wide paved access to facilitate
emergency vehicle access when Lot 2 is developed.
RECOMMENDATION
Planning Services staff recommends the submitted final plat of Conlan Place be
approved subject to waiving Article IV -Design Improvement Standards for the City of
Dubuque Subdivision Regulations, except for Section 42-19, Blocks and Lots, and
requiring that a minimum 20-foot paved driveway access be provided through Lot 3 to
serve Lot 2.

RESOLUTION NO. 405 - 08
RESOLUTION APPROVING THE FINAL PLAT OF CONLAN PLACE IN
DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk the Final Plat of Conlan Place
in Dubuque County; and
Whereas, said plat provides 0 feet of frontage for Lot 2 where 50 feet is required
by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except for Section 42-19,
Blocks and Lots.
Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 2 to have 0 feet of frontage, where 50 feet is required, subject to construction
of a minimum 20-foot wide paved driveway through Lot 3 to serve Lot 2 once
construction of a residence commences on Lot 2.
Section 3. That the Final Plat of Conlan Place is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa, upon said final plat.
