Council met at 7:30 P.M.
Present-Mayor Kolb, Council-
men Austin, Kintzinger, Schueller,
Welu. City Manager Schiltz.
Mayor Kolb stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may
properly come before the meeting.
Proof of publication, certified to
by the publishers, of notice of time
and place of hearing on proposal
to dispose of real estate and con-
vey the same to the Dubuque Pack-
ing Company for the agreed price
of $10,500.00, the following describ-
ed real estate situated in the City
of Dubuque, Dubuque County,
Iowa:
Commencing at the southwest
corner of Lot 643, East Dubuque
No. 2 Addition; thence northerly
along westerly line of Lot 643 and
642, East Dubuque No. 2 Addition
a distance of 168 feet; thence north
69 degrees 08' east a distance of
78.5' to the east property line of
Lot 642, East Dubuque No. 2 Addi-
tion, which is point of beginning;
thence north 69 degrees 08' east a
distance of 583 feet more or less
along a line which lies north of
and parallel to the centerline of
East Sixteenth Street Extended;
thence north 12 degree 16' west
along a line which lies 200' west
of and parallel to the east edge
of levee top; thence north 57 de-
grees west a distance of 310' more
or less, along a line which lies 190'

RESOLUTION N0.775-52
Resolution authorizing sale of
real estate.
Whereas the Dubuque Packing
Company has offered to purchase
from the City of Dubuque, Iowa,
for the purchase price of Ten
Thousand, Five Hundred Dollars
($10,500) in cash, the real estate
hereinafter described, subject to
the easements hereinafter enum•
erated; and
Whereas the City Council of the
City of Dubuque has determined
that said property is not required
to serve any present or forseeable
public use; and
Whereas the reasonable value of
said property, subject to the rights
herein described, has been deter-
mined by a board of competent
appraisers to be $10,500;
Now Therefore, Be It Resolved
by the City Council of the City
of Dubuque, as follows:
Section 1. That the City of Du•
buque, Iowa does hereby grant and
convey unto the Dubuque Packing
Company, an Iowa corporation of
Dubuque, Iowa, for the agreed pur•
chase price of Ten Thousand, Five
Hundred Dollars ($10,500) all of its
right, title and interest in and to
the following described real estate
situated in the City of Dubuque,
Dubuque County, Iowa:
Commencing at the southwest
corner of Lot 643, East Dubuque
No. 2 Addition; thence northerly
along the westerly line of Lot 643
and 642, East Dubuque No. 2 Ad-
dition, a distance of 168 feet;
thence north 69° 08' east a dist-
ance of 78.5' to east property line

Addition, which is point of be-
ginning; thence north 69° OS' east
a distance of 583 feet more or less
along a line which lies north of

Subdivision, all of Wiltes Du-
buque, Railroad Addition, and East
Dubuque No. 2 Addition to point
of beginning subject to the follow-
ing easements:
(a) The right in the City of
Dubuque to use said property for
the temporary or permanent stor-
age of surface water, storm water,
or overflow sewage until such time
as the City Council shall by Reso-
lution declare such right is no
longer required.
(b) Easement of right of way
for all utilities or power lines now
in place.
(c) Easement in the City of Du-
buque to construct and maintain
such storm and sanitary sewers
across or under said property as
its needs may require;
(d) The right in the City of Du-
buque to use such portion of said
property as may be necessary for
a temporary dumping ground until
the access to the City's dumping
grounds on the City Island has
been restored.
Section 2. That the Mayor and
City Clerk are hereby authorized
and empowered to execute a Quit
Claim Deed in the name of the
City of Dubuque, conveying the
above described real estate and
to deliver the same to said pur-
chaser upon receipt of said pur-
chase price.

Resolution providing for the issu-
ance of Street Improvement bonds
for the purpose of providing for the
payment of the assessed cost of
Apple Street curb & gutter
Whereas the contract heretofore
entered into by the City of
Dubuque, Iowa, for the improve-
ment hereinafter described h a s
been completed and the City Man-
ager has certified the completion
thereof to the City Council and the
City Council has ascertained the
cost thereof and has determined
that $1,032.94 Dollars of the cost
thereof shall be assessed against
the property subject to assessment
therefor; and
Whereas public notice, as provid-
ed by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
for the purpose of providing for
the payment of the assessed cost of
said improvement and a public
hearing has been held, pursuant
to such notice and all objections
made thereto have been considered
and determined;
Now Therefore Be It Resolved
ly the City Council of the City of
Dubuque:
1. That to provide for the pay-
ment of the assessed cost of the
improvement of Apple Street with
curb & gutter from the North Prop-
erty Line of Cleveland Avenue to

The City of Dubuque in the State

in the State of Iowa. This bond is

der and by virtue of Chapter 39S
of the 1950 Code of Iowa, as amend-
ed, and the Resolution of said City
duly passed on the 9th day of De-
cember, 1952, being Resolution No.
792-52.
This Bond is one of a series of 11
bonds, 10 for $100.00 numbered
from 5451 to 5460 inclusive, and
one for $32.94 numbered 5461, all of
like tenor and date, and issued for
the purpose of improving Apple
Street with curb & gutter as de-
scribed in said Resolution, in said
City, which cost is payable by the
abutting and adjacent property
along said improvements and is
made by law a lien on all of said
property. It is payable only out of
the Special Assessment Fund No.
1071 created by the collection of
said special tax, and said fund can
be used for no other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, prece-
dent to and in issuing this series of
bonds, have been done, happened,
and performed, in regular and due
form, as required by law and said
Resolution, and for the assessment,
collection and payment hereon of
said special tax, the full faith and
diligence of said City of Dubuque
are hereby irrevocably pledged,

Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that

Whereas public notice, as pre-
vided by law, has been published

have waived all objections there-

Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared there-
for by the City Engineer which

expense of making said improve-
ment will be assessed upon and
against all privately owned proper-
ty lying within assessable distance
provided by law and in an amount
not to exceed the amount provided

by this Councii upon the petition
of property owners. All the work
shall be constructed in accordance
with the plans and specifications
heretofore adopted and now on
file in the office of the City Clerk.
Be it further resolved that the
cost and expense of the said im-
provements be paid for by levying
special assessments against the
privately owned property lying
within the assessable distance
from the improvements, whether
such property abut upon the same
or are adjacent thereto, according
to the area thereof and in propor-
tion to the special benefits con•
ferred, and any deficiency will be

to a point 124 feet west pursuant
to Resolution No. 790-52 and no-
tice to bidders published in a
newspaper published in said City
on November 17th, 1952, and No-
vember 18th, 1952, and
Whereas, said sealed proposals
were opened and read on Decem-
ber 9, 1952, and it has been deter-
mined that the bid of Larson Con•
struction Company of Dubuque,
Iowa, in the amount of $754.71 was
the lowest bid for the furnishing
of all labor and materials and per-
forming the work as provided for
in the plans and specifications;
now therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that
the contract for the above men-
tioned improvement be awarded to
Larson Construction Company and
the Manager be and he is hereby
directed to execute a contract on
behalf of the City of Dubuque for

After due investigation, it ap-
pears that Henry Street is an un-
improved street in the City of Du-
buque without the benefit of curb
and gutter. There appears on the
street some evidence of water
washing but such water washing is
confined to the north side of the
street far enough off the normal
travelled way so as to constitute
no impediment to normal traffic.
Under these circumstances, it is
the opinion of this office that the
City of Dubuque was guilty of no
negligence in the maintenance of
Henry Street so as to render it lia-
ble to claimant and therefore re-
spectfully recommends that t h e
claim be denied.

Gentlemen:
On September 12, 1952, the claim
of Maude Gongaware was f i l e d
with the City Clerk of the City of
Dubuque, claiming damages
against, the City in the sum of
$775.00 for personal injuries sus-
tained by her when she fell on an
allegedly defective sidewalk at
the corner of 5th and Bluff Streets,
in the City of Dubuque, Iowa. Said

practically impossible to keep

my opinion, be replaced with a
new type of surface which I will
be in a position to recommend af-
ter further investigation of the ori-
ginal cost and maintenance cost
during its service life.
West 6th, Central to Locust.
West 7th, Central to Bluff.
West 8th, Central fA Hill.
East 8th, Central to East End
of Street.
Hill Street, 8th Ave. to West 3rd
Street.
Ninth Street, Central to Bluff.
Eleventh, Central to Bluff.
Twelfth, Central to Main Street.
I recommend that the following
streets be paved with concretes:
Algona Street, University to
Grace.
Kirkwood Street, End of pave-
ment to end of street.
Any streets improvements that
have been petitioned and for which
the council has ordered plats and
schedules prepared, are not includ•
ed in this list.
There are also several street
improvement projects under con-
tract which will be completed as
soon as weather permits in 1953,
The program for protecting pres-
ent asphalt surfaces from breaking
up due to cracking and putting on
a wearing surface will continue
with the seal coating of forty-eight
streets. This program can be car-
ried out throughout the city on a
regular schedule when we use the
funds allocated for Maintenance
each year, instead of using it for
construction of new street surfaces.
Permanent type surfaces should be
a special assessment against the
benefited property.
The established policy of the
council if continued will permit
new construction to continue and
still permit good maintenance of
streets that are still serviceable.

ARCHITECT'S AGREEMENT
This Agreement, made and en-
tered into on the fifteenth day of
December, 1952, by and between
the City of Dubuque, Iowa, a Mu-
nicipal Corporation, herein called
the "Owner" and Paul Rossiter,
an Individual, of Dubuque, Iowa,
herein called the "Architect"
Witnesseth:
1. The Owner who desires to
erect a new Swimming Pool at an
estimated cost of Two Hundred
Thousand Dollars ($200,000.00) em-
ployes the Architect to prepare
preliminary sketches, w o r k i n g
drawings and specifications there-
for and to supervise the construc-
tion thereof as Architect to the
completion thereof, in accordance
with such plans and specifications.
2. The Architect agrees to un-
dertake and perform the forego-
ing services. Chemical and me-
chanical tests and surveys, when
required, are to be provided by
the Owner.
3. The Architect shall be paid
a basic fee equal to six percent
(6%) of the total cost of the work,
which total cost shall include fee
of the contractor, but shall not
include the fees of the Architect
or the cost of a Clerk-ofthe•aorks.
Payments to the Architect on ac•
count of the above fee shall be
made as his work progresses and
in the following manner:
Upon completion and delivery to
the Owner of ten (10) sets of
the- preliminary plans, one per-
cent of the estimated cost;
Upon completion and delivery
to the Owner of fifteen (15) sets
of working drawings and specifi•
cations, exclusive of taking of
bids, three percent of the esti-
mated cost.
The balance from time to time
as the Architect's services are per-
formed and in proportion to the
services rendered.
Until an actual bid is received
charges shall be based upon said
estimated cost of work and all
payments received credited to the
Owner on account of the total fee.
No deduction shall be made
from the Architect's fee on ac-
count of penalty, liquidated dam•
ages, or other sums withheld from
the contractor.
In no event shall the Arclritect
proceed with the preparation of
"preliminary plans" or "workings,
drawings and specifications" with-
out written authorization from the
Owner,
4. Upon completion of the
work, the Architect agrees to fur-
nish to the Owner two (2) sets
of "as built" plans.
5. If, after a definite plan has
been developed, changes in the
drawings, specifications, or other
documents are required by the
Owner, or if the Architect is put
to extra labor or expense by the
delinquency or insolvency of a con-
tractor, the Architect shall be re-
imbursed for such expense and
paid the reasonable value of such
additional services.
6. Due to fluctuations and un-
certainties of the labor and ma-
terial markets, the Architect does
not guarantee the accuracy of any
estimate of cost, or assume any
responsibility therefor.
7. The Architect may in any
emergency arising during the
course of construction, take such
action as he deems advisable for
the protection of the building and
in the interest of the Owner. The
Architect may also from time to
time authorize such changes in the
work as be considers benefiaal,
provided, however, that such
changes do not materially change
the plan or layout or the work or
materially add to the expenses
thereof.

8. This agreement is a personal
contract and may not be assigned
or sub contracted by the Archi-
tect without the legal consent of
the Owner. The Architect, for
himself, his successors, executors,
administrators, and assigns, agrees
that, in the event he is prevented
by death, disability or other cause,
from completing this agreement,
he will, at his own expenses, pro-
vide the services of a competent
Architect, acceptable to the Own-
er, to complete the agreement up•
on demand of the Owner.

The wage and salary structure
is based on an approximate eight
percent increase to all employees
effective from January 1, 1953.
The distribution is based on the
budget approved by the City Coun-
cil for levying taxes for 1953 and
has been discussed with depart-
ment heads so that they will know
the limits of their expenditures
and thereby facilitating proper de-
partmental budgeting throughout
the year.
I recommend this distribution as
outlined to the Council for adop-
tion. as a basis for making appro-

Be it resolved by the City Coun-
cil of the City of Dubuque that pur-
suant to a resolution of necessity
No, 788-52 which was duly passed
by this Council, for the construc-
tion of a six (6) inch vitrified file
sanitary sewer in Edith Street
from the existing manhole at in•
tersection of Edith Street and
Brunswick Street to a point 124
feet west be and the same are
hereby ordered and constructed by
this Council upon the petition of
property owners. All the work
shall be constructed in accordance
with the plans and specifications
heretofore adopted and now on file
in the office of the City Clerk,
Be it further resolved that the
cost and expense of the said im-
provements be paid for by levying
special assessments against the
privately owned property lying
within the assessable distance
from the improvements, whether
such property abut upon the same
or are adjacent thereto, according
to the area thereof and in propor-
tion to the special benefits con-
ferred, and any deficiency will be
paid out of the sewer funds of
the city. Payment will be made
to the contractor out of funds real-
ized from the sale of bonds to be
issued in anticipation of deferred
payments of assessments as pro-
vided by law after the work has
been completed and accepted by
the City Council.

RESOLUTION N0. 799-52
Whereas, sealed proposals have
been submitted by contractors for
the construction of a six (6) inch
vitrified rile sanitary sewer in and
along Edith Street from the exist•
ing manhole at intersection of
Edith Street and Brunswick Street
to a paint 124 feet west pursuant
to Resolution No. 790-52 and no-
tice to bidders published in a
newspaper published in said City
on November 17th, 1952, and No•
vember 18th, 1952, and
Whereas, said sealed proposals
were opened and read on Decem-
ber 9, 1952, and it has been de-
termined that the bid of Larson
Construction Company of Du•
buque, Iowa, in the amount of
$754.71 was the lowest bid for the
furnishing of all labor and ma-
terials and performing the work
as provided for in the plans and
specifications; now therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that the
contract for the above mentioned
improvement be awarded to Lar-
son Construction Company and the
Manager be and he is hereby di-
rected to execute a contract on be-
half of the City of Dubuque for the
complete performance of said
work.
Be it further resolved, that up-
on the signing of said contract and
the approval of the contractors
bond the City Treasurer is author•
ized and instructed to return the
bid deposits of the unsuccessful
bidders,
Approved and placed on file for
one week on December 9th, 1952.

Whereas, on September 2, 1952,
the City Council of the City of
Dubuque adopted Resolution No.
667-52 levying a special assess•
ment for paving Mt. Vernon Court;
and
Whereas, it appears that an er-
ror has been made in the schedule
of said assessments resulting in
some property being assessed too
little and some being assessed too
much; and
Whereas, under the provisions
of Section 391.86 of the 1950 Code
of Iowa the City Council is em-
powered to correct any such er-
roneous assessment and to relevy
the same;
Now therefore be it resolved by
the City Council of the City of
Dubuque:
Section 1, That said Resolution
No. 667-52 be and the same is
hereby repealed;
Section 2. That the City Engi-
neer is hereby directed to pre-
pare anew plat and schedule show-
ing the lots or parcels of real es-

rate subject to assessment for said
improvement and file the same in
the office of the Citq Clerk, sub-
ject to public inspection and said
Clerk, upon receipt of such new
plat and schedule, shall publish
the notice required by law of the
Council's intention to relevy spe-
cial assessments for said improve•
ments.
Section 3. This Resolution shall
be in full force and effective im-
mediately upon its final passage
and adoption.
