The intent was that the City would take over ownership upon completion of the vehicle restoration. The restoration project is substantially complete and the ladder truck is back in Dubuque. Daniel Brown, Fire Chief SUBJECT: 1948 Antique Fire Truck DATE: November 18, 2008 The Antique Fire Club of Dubuque has owned the 1948 Seagraves Tiller Ladder Fire Truck since 1994. The club has raised funds to restore this truck for the purpose of display, education and to preserve a part of Dubuque history. The bulk of the restoration work has been completed leaving just a couple of small items that the club will finish up shortly. The truck has been returned to Dubuque and is operational. The Antique Fire Club wishes to donate this truck and transfer the title and registration to the City of Dubuque. The club still has an outstanding debt of $15,000 for the restoration. The club also wishes to have access and use of the truck for fund raising events. A letter of understanding between the Antique Fire Club and the City of Dubuque is attached. This antique fire truck has served the citizens of Dubuque for 44, years and operated at the Clarke College fire. This will be an exciting time for Dubuque to have this historical fire truck restored and returned for the citizens to enjoy. WHEREAS, Club is the owner of a 1948 Seagrave Tiller Fire Truck (Fire Truck); and WHEREAS, Club has restored the Fire Truck and desires to donate the Fire Truck to City; and WHEREAS, City is willing to accept the donation of the Fire Truck on the terms and conditions set forth herein. NOW THEREFORE, it is agreed by and between the parties as follows: SECTION 1. TITLE TO FIRE TRUCK. Club agrees to deliver title to the Fire Truck to City free and clear of all liens and encumbrances and City agrees to accept deliver of such title. SECTION 2. FUNDRAISING. Club has a balance due of $15,000 for the cost of restoration. City agrees that Club shall have access to and use of the Fire Truck for the purpose of fund raising in order to pay the balance of the restoration costs. Club shall provide City annually with a statement on July 1 of each year showing the revenue from all fundraising events for the prior year and the balance of the restoration costs. SECTION 3. PERMITTED FIRE TRUCK OPERATORS. Club agrees that it shall not allow any person to operate the Fire Truck other than employees of the City of Dubuque Fire Department and Club members. Club shall provide to City's Fire Chief a list of employees of the Fire Department and Club members who are authorized to operate the Fire Truck and shall keep the list current at all times. All operators must hold a valid Iowa Drivers' License. SECTION 4. INSURANCE. City shall provide for and maintain adequate insurance on the Fire Truck at all times while this Agreement is in effect. SECTION 5. TERM AND TERMINATION. This Agreement shall continue in effect until terminated as provided herein. This Agreement may be terminated by City at any time after the restoration costs referred to in Section 2 have been paid in full. This Agreement also may be terminated by City at any time in the sole discretion of the City Manager if the City Manager determines that the Fire Truck is unsafe for operation or if it is not being operated in a safe manner by anyone operating it on behalf of Club. JUSTIFICATION This truck was originally part of the Dubuque Fire Department until it was retired in 1982. It is possibly the only one like it in the country, and restoring it to original condition would have historical and educational value. The truck is currently owned by the Antique Fire Club in Dubuque and they are in the process of raising funds for the restoration. They plan to apply for a DRA Grant and also solicit funds from private contributors. The cost estimate for the restoration is $100,000. In the event the Antique Fire Club would dissolve, the bylaws provide for the truck to return to the City of Dubuque. When a new fire station is built on the west-end some time in the future, space to house this unit will be considered. The Club has raised $79,000 towards the renovation, but the project is still $6,000 short. The City is providing $33,000, and Fire Chief Dan Brown has identified a savings of $8,000 in the Fire Station No. 2 Roof Replacement Project that could be used to fill the $6,000 funding gap. The City of Dubuque will own the truck when it is restored. I respectfully recommend Mayor and City Council approval of the commitment of an additional $6,000 to this project. ~~!. .~~Z Michael C.
