City Engineer Gus Psihoyos is recommending acceptance of the remaining public
improvements that the developer, North Cascade Road Developers, LLC (NCR
Developers), has recently completed in Timber-Hyrst Estates. The bridge over Catfish
Wood Drive was accepted by Resolution 118-08 on April 21, 2008. Maintenance of said
improvements shall be the responsibility of the owner, NCR Developers, for a period of
two years from the date of acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed material provides for City Council acceptance of the public
improvements which the developer, North Cascade Road Developers, LLC (NCR
Developers), has recently completed in Timber-Hyrst Estates.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 167-06, the
developer of Timber-Hyrst Estates was required to install certain improvements
including street paving with curb, sanitary sewer main, watermain, storm sewers
and catch basins, boulevard street lighting, and a 156'6" by 30' continuous
concrete slab bridge on Creek Wood Drive over Catfish Creek and to dedicate
these improvements to the City upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
On August 6, 2006, NCR Developers requested City's acceptance of the
improvements in Timber-Hyrst Estates. Final inspection could not be completed,
however, until the final lift of asphalt had been placed. Upon recent inspection, it
has been determined that the public improvements required by Resolution 167-
06 have been completed in accordance with plans approved by the City Council
and in conformance with City specifications. The bridge over Catfish Wood Drive
was accepted by Resolution 118-08 on April 21, 2008.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the remaining public
improvements. Maintenance of said public improvements shall be the
responsibility of the owner, NCR Developers, for a period of two (2) years from
the date of this resolution.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
public improvements in Timber-Hyrst Estates (Phase I).

RESOLUTION NO. 425-08
ACCEPTING PUBLIC IMPROVEMENTS IN TIMBER-HYRST ESTATES
Whereas, pursuant to Resolution 167-06, certain public improvements
including street paving with curb and gutter, sanitary sewer, watermain, storm
sewer, catch basins, and street lighting were installed by the developer of the
Timber-Hyrst Estates.
Whereas, the improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City Council and in
conformance with City specifications, and has recommended that the
improvements be accepted by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said public improvements in the Timber-Hyrst Estates be and the same
is hereby accepted.
Section 2. That maintenance of said public improvements shall be the
responsibility of the owner for a period of two (2) years from the date of this
resolution.

Construction Permit No. 2008- 0295 -S previously issued on February 1, 2008 is hereby amended to include
construction of
426.9 linear feet of 8 -inch sanitary sewer as shown on the revised Sheet D.06 dated April 1,
2008, associated manholes, and all related appurtenances necessary to complete the project
in accordance with the approved plans and specifications.
As this letter refers to a modification of an official construction permit, it should be retained in your files.
The construction of the project shall be initiated within one year of issuance of this supplemental permit or
this permit is no longer valid. Within thirty days after completion of construction, the permit holder shall
submit a certification by a licensed professional engineer that the project was completed in accordance with
the approved project documents.
