Van Milligen, City Manager SUBJECT: Acceptance of Public Improvements in Stone Brook Center Second Addition DATE: December 6, 2008 City Engineer Gus Psihoyos is recommending acceptance of the public improvements that the developer, NEZTROP, LLC, has recently completed in Stone Brook Center Second Addition, except the stormwater detention facilities. Since the subdivision is not 80% developed, the stormwater detention facilities are not required to be accepted. Maintenance of said improvements shall be the responsibility of the contractor, Portzen Construction, Inc. and the owner, NEZTROP, LLC, for a period of two years from the date of acceptance. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer - SUBJECT: Acceptance of Public Improvements in Stone Brook Center Second Addition DATE: December 2, 2008 INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements which the developer, NEZTROP, LLC has recently completed in Stone Brook Center Second Addition. BACKGROUND As a condition of subdivision plat approval through Resolution No. 61-04, the developer of Stone Brook Center Second Addition was required to install certain improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and a stormwater detention facility and to dedicate these improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On December 4, 2007, NEZTROP, LLC requested City's acceptance of the improvements in Stone Brook Center Second Addition. Upon inspection, it has been determined that the public improvements required by Resolution 61-04 have been substantially completed in accordance with plans approved by the City Council and in conformance with City specifications. However, since the subdivision is not 80% developed, the stormwater detention facilities are not required to be accepted. Maintenance of the detention facility would therefore remain with the developer, NEZTROP, LLC. RECOMMENDATION I would, therefore, recommend that the City Council accept the public improvements except the stormwater detention facilities. Maintenance of the remaining public improvements shall be the responsibility of the contractor, Portzen Construction, Inc., and the owner, NEZTROP, LLC, for a period of two (2) years from the date of acceptance by the City Council. The acceptance of the stormwater detention facilities and associated Lot D will be at a later date. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the public improvements in Stone Brook Center Second Addition. Prepared by Ronald Turner, PLS RESOLUTION NO. 426-08 ACCEPTING PUBLIC IMPROVEMENTS IN STONE BROOK CENTER SECOND ADDITION Whereas, pursuant to Resolution 61-04, certain public improvements including street paving with curb and gutter, sanitary sewer, watermain, storm sewer, catch basins, boulevard street lighting, and a stormwater detention facility were installed by the developer of the Stone Brook Center Second Addition. Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been substantially completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements, except the stormwater detention facilities, in the Stone Brook Center Second Addition be and the same is hereby accepted. Section 2. That maintenance of said public improvements shall be the responsibility of the owner for a period of two (2) years from the date of this resolution.
