SUBJECT: Acceptance of Public Improvements in Eagle Valley Subdivision

City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, Fondell Excavating, Inc., has recently completed in Eagle Valley
Subdivision, except the stormwater detention facilities. Since the subdivision is not 80%
developed, the stormwater detention facilities are not required to be accepted.
Maintenance of said improvements shall be the responsibility of Fondell Excavating,
Inc., Morse Electric, Inc. and River City Paving, a Division of Mathy Construction Co.,
for a period of two years from the date of acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Public Improvements in Eagle Valley Subdivision
INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements
that the developer, Fondell Excavating, Inc., has recently completed in Eagle Valley
Subdivision in the City of Dubuque, Iowa.
BACKGROUND
As a condition of subdivision plat approval through Resolution Nos. 434-05, 479-04, and
293-03, the developer of Eagle Valley Subdivision was required to install certain
improvements including street paving with curb, sanitary sewer main, watermain, storm
sewer and catch basins, boulevard street lighting, and storm water detention facilities,
and to dedicate these improvements to the City upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
On August 18, 2008, Fondell Excavating, Inc: requested the City's acceptance of the
improvements in Eagle Valley Subdivision. Upon inspection by the City, it has been
determined that all of the public improvements required by Resolution Nos. 434-05,
479-04, and 293-03 have been substantially completed in accordance with plans
approved by the City Council and in conformance with City specifications. However,
since the subdivision is not 80% developed, the stormwater detention facilities are not
required to be accepted. Maintenance of the detention facility would therefore remain
with the developer, Fondell Excavating, Inc.
RECOMMENDATION
would, therefore, recommend that the City Council accept the public improvements
except for the stormwater detention facilities. Maintenance of the remaining public
improvements shall be the responsibility of Fondell Excavating, Inc., Morse Electric, Inc.
and River City Paving, A Division of Mathy Construction Co for a period of two years
from the date of this resolution. The acceptance of the stormwater detention facilities
will be at a later date.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the public
improvements in Eagle Valley Subdivision.

RESOLUTION NO. 427-08
ACCEPTING IMPROVEMENTS IN EAGLE VALLEY SUBDIVISION IN
THE CITY OF DUBUQUE, IOWA
Whereas, pursuant to 434-05, 479-04. and 293-03, certain public
improvements including street paving with curb, sanitary sewer main, watermain,
storm sewer and catch basins, boulevard street lighting, and stormwater
detention facilities were installed by the developer of Eagle Valley Subdivision in
the City of Dubuque, Iowa; and
Whereas, the improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City Council and in
conformance with City specifications, and has recommended that the
improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said public improvements, except the stormwater detention facilities, in
Eagle Valley Subdivision in the City of Dubuque, Iowa, be and the same is
hereby accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of Fondell Excavating, Inc., Morse Electric, Inc. and River City
Paving, A Division of Mathy Construction Co., for a period of two (2) years from
the date of this resolution.
