Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the proposed use of the property.
Staff reviewed the surrounding zoning and land use. Planning staff noted that the RROD was
recently added to the City's Zoning Ordinance to provide flexibility to owners of agriculturally
zoned property.
There was one nearby property owner who spoke in support of the request.
The Zoning Advisory Commission discussed the request, noting that the request will not
adversely impact the adjacent property.
Recommendation
By a vote of 5 to 0 the Zoning Advisory Commission recommends that the City Council
approved the request.
A simple majority vote is needed for the City Council to approve the request.

ORDINANCE NO. 80-08
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT THE NORTHWEST CORNER OF MIDDLE
ROAD AND HEACOCK ROAD FROM AG AGRICULTURAL DISTRICT TO AG
AGRICULTURAL DISTRICT WITH AN RROD RURAL RESIDENTIAL DISTRICT
OVERLAY DISTRICT DESIGNATION.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassifying the hereinafter-described
property from AG Agricultural District to AG Agricultural District with an RROD Rural
Residential Overlay District Designation, to wit:
Lot 1 SE'/4 SE'/4 Section 19 T89N R2E, and to the centerline of the
adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Property History: The property has been under agricultural production since it was
originally subdivided. Anew single-family residence was built on the south portion of
the property along the Pennsylvania Avenue frontage in 1991. The property was
annexed to the City of Dubuque in 2004 and rezoned at that time to AG Agricultural
district.
Physical Characteristics: The property is a standard quarter quarter section
(approximately 40 acres) with frontage along both Radford Road and Pennsylvania
Avenue. There is a ridgeline running through the center of the property from north to
south. The property drops off to the east and to the west with approximately 50 feet of
local relief along two drainages.
Concurrence with Comprehensive Plan: The 2030 Future Land Use. map calls for
this area to be developed for mixed-use residential. Land Use and Urban Design Goals
recommend promoting a range of housing options throughout the community and
balancing open space and environmental preservation with the community's
development needs.

Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: The Iowa Department of Transportation 2006 Average
Daily Traffic Counts indicate 3,780 vehicle trips per day along Pennsylvania Avenue
just southeast of the subject properly and 1,800 vehicle trips along Heacock Road
along the property's eastern boundary.
Public Services: City sanitary sewer is available at the southwest corner of the
subject property and City water is stubbed approximately 800 feet east of the
subject property in the Pennsylvania Avenue right-of-way.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.
Adjacent Properties: Redevelopment of this property for single-family residential
development will have very limited impact on the adjacent properties. The
property to the north currently is being developed as a residential subdivision; the
property to the west serves as a large single-family lot; the property to the east is
currently vacant; and the property to the south consists of single-family homes and
a farmstead.
CIP Investments: None proposed
Staff Analysis: The applicant is proposing to rezone an existing quarter quarter
section from AG Agricultural to AG Agricultural with an RROD Rural Residential Overlay
district. The property is located at the northwest corner of Pennsylvania Avenue and
Heacock Road with approximately 1,300 feet of frontage along each right-of-way and
access only from Pennsylvania Avenue. Currently, the parcel accommodates asingle-
family home and out buildings on a small portion of the south side of the property and
the balance of the lot is under cultivation. The 58-acre parcel to the north currently is
being developed as a residential subdivision in the City of Asbury. The 40-acre parcel
to the east, across Heacock Road, is located in the City of Asbury and currently under
cultivation. The property to the west is a long narrow, single-family lot that
accommodates asingle-family home and a communications tower. The property to the
south has a farmstead and four single-family residences.
The subject property has a ridge that runs down its center from north to south and the
lot slopes to drainages both east and west of the ridge. There is approximately 50 feet
of elevation change between the ridge and the valleys. Sanitary sewer is available to
the southwest corner of the property and City water is available along Pennsylvania
Avenue approximately 800 feet east of the subject property.

The City of Dubuque Zoning Ordinance was recently amended to include a RROD Rural
Residential Overlay district. Properties that are currently zoned AG can apply for the
RROD Designation which allows properly owners the flexibility to continue to operate
their farms, but at some time in the future, be allowed to develop their property for a
single-family residential subdivision. The RROD would allow a property owner to
develop all or a portion of their property for R-1 Single-Family Residential development
upon approval of a final plat by the City of Dubuque. Currently, the 2030 Future Land
Use Map recommends that this area be redeveloped for mixed-use residential use.
If the applicant were to decide to redevelop the property for asingle-family residential
development, a subdivision plat would have to be submitted, reviewed and approved by
the Zoning Advisory Commission and City Council.
Staff recommends that the Zoning Advisory Commission review the criteria established
in Section 6-1.1 regarding reclassification of property.
