The Dubuque City Council met in regular session at 6:00 p.m. on October 2, 2017 in
the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Buol; Council Members Connors, Del Toro, Jones, Lynch, Resnick,
Rios; City Manager Van Milligen, City Attorney Brumwell
Mayor Buol read the call and stated this is a regular session of the City Council called
for the purpose of conducting such business that may properly come before the City
Council.
PLEDGE OF ALLEGIANCE
PRESENTATION(S)
Musical Performance: Prior to the meeting, the Arts and Cultural Affairs Advisory Com-
mission facilitated a brief musical performance in commemoration of Arts and Humanities
Month.
PROCLAMATION(S)
1. Arts and Humanities Month (October 2017) was accepted by Ellen Henkels, David
Schmitz, Gina Siegert, and Ali Levasseur of the Arts and Cultural Affairs Advisory Com-
mission.

the documents were received, filed, and referred to the City Attorney.
3. Disposition of Claims: City Attorney advising that the following claims have been
referred to Public Entity Risk Services of Iowa, the agent for the Iowa Communities As-
surance Pool: Heidi Goin for property damage, Sue Manternach for vehicle damage, Kelly
Merz for personal injury, Joseph Reisdorf for personal injury, Sydney Stewart for property
loss, Jade Wiegel for vehicle damage. Upon motion the documents were received, filed,
and concurred.
4. Bee Branch Healthy Homes Resiliency Program Brochure: City Manager transmit-
ting the public information brochure for the Bee Branch Healthy Homes Resiliency Pro-
gram that provides forgivable loans for housing repairs and renovations. Upon motion the
document was received and filed.
5. Adoption of South Port of Dubuque Brownfield Area Wide Use Plan: City Manager
recommending adoption of the South Port Area Wide Use Plan that is funded by an EPA
Brownfields Planning Grant. Upon motion the documents were received and filed and
Resolution No. 326-17 Adopting the South Port of Dubuque Brownfield Area Wide Use
Plan was adopted.

ADOPTING THE SOUTH PORT OF DUBUQUE BROWNFIELD AREA WIDE USE
PLAN
Whereas, the City of Dubuque recognizes that the remediation and redevelopment of
brownfields is an important part of protecting Iowa's resources and improving the local
economy; and
Whereas, the Brownfield Area Wide Use Plan for the South Port of Dubuque was
funded by a grant from the U.S. EPA's Brownfields Area -Wide Planning Program; and
Whereas, the plan summarizes previous planning efforts and sets the stage for moving
the City forward in redeveloping this key area of the city; and
Whereas, adoption of the plan will allow the City to fulfill the EPA's grant requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the South Port of Dubuque Brownfield Area Wide Use Plan, is hereby
adopted.

6. 2019 Iowa DOT ICAAP Application for STREETS Improvements: City Manager rec-
ommending approval to submit an application in partnership with Dubuque Metropolitan
Area Transportation Study (DMATS) for an Iowa Department of Transportation Iowa

Clean Air Attainment Program (ICAAP) application to assist with funding Smart Traffic
Routing with Efficient and Effective Traffic Signals (STREETS) improvements. Upon mo-
tion the documents were received and filed and Resolution No. 327-17 Authorizing the
filing of an Iowa Clean Air Attainment Program Application with the Iowa Department of
Transportation (IADOT) in partnership with Dubuque Metropolitan Area Transportation
Study (DMATS) to assist with the funding of Smart Traffic Routing with Efficient and Ef-
fective Traffic Signals (STREETS) Improvements was adopted.
RESOLUTION NO. 327-17
RESOLUTION AUTHORIZING THE FILING OF AN IOWA CLEAN AIR ATTAINMENT
PROGRAM APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION
(IADOT) IN PARTNERSHIP WITH DUBUQUE METROPOLITAN AREA TRANSPOR-
TATION STUDY (DMATS) TO ASSIST WITH THE FUNDING OF SMART TRAFFIC
ROUTING WITH EFFICIENT AND EFFECTIVE TRAFFIC SIGNALS (STREETS) IM-
PROVEMENTS
Whereas, the STREETS project is designed to improve traffic conditions throughout
the Dubuque metro area by distributing traffic more evenly on the region's major corridors.
The STREETS project will modify the signal timings through a seamless interface be-
tween a signal timing model and signals used in the field; and
Whereas, the City has determined that STREETS project will reduce congestion,
shorten travel times, improve air quality, and improve safety in the metro area. By rerout-
ing traffic on the roads with extra capacities dynamically, it is expected that the proposed
system will reduce traffic bottlenecks as recommended by the adopted East-West Corri-
dor Study; and
Whereas, the City in partnership with DMATS is requesting ICAAP funding in the
amount of $1,181,600 in Federal Fiscal Year (FFY) 2019 to assist with project implemen-
tation; and
Whereas, the City has sufficient funds available to cover the local funding in the amount
of $295,400; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA, THAT:
Section 1. The City hereby supports and authorizes the grant application submittal for
funding through the IADOT FFY 2019 ICAAP Program to assist with the funding
STREETS project implementation in Dubuque Metro area as part of the East-West Cor-
ridor Improvements.

7. Administrative Services Agreement - Wellmark Blue Cross and Blue Shield of Iowa
of Iowa: City Manager approval of an agreement with Wellmark BCBS of Iowa for medical
plan and stop loss insurance coverage effective July 1, 2017 through June 30, 2019, and
City Council authorization for the City Manager to sign the agreement. Upon motion the
documents were received, filed and approved.

8. Lead & Healthy Homes Contract with VNA and Dubuque County Board of Health:
City Manager recommending approval of a contract with the Dubuque County Board of
Health and the Iowa Department of Public Health for continued funding of the Childhood
Lead Poisoning Prevention Program, and a renewed agreement with the Visiting Nurse
Association for services related to the Childhood Lead Poisoning Prevention Program and
Healthy Homes Program. Upon motion the documents were received, filed and approved.
9. Water Main Utility Grant of Easement for Westside Water System Improvements
Project: City Manager recommending acceptance of a Grant of Easement for Water Main
Utility across the Jessica and Cory Kramer property located at 14561 Forest Ridge Drive
as part of the Westside Water System Improvements 2017: Contract C HWY 20 Water
Main Extension. Upon motion the documents were received and filed and Resolution No.
328-17 Accepting a grant of Easement for Water Main Utility through, over and across
part of Lot 1 of Forest Ridge Estates Third Addition, Dubuque County, Iowa was adopted.

OVER AND ACROSS PART OF LOT 1 OF FOREST RIDGE ESTATES THIRD ADDI-

Whereas, Jessica M. Kramer and Cory W. Kramer have executed a Grant of Easement
for Water Main Utility through, over and across part of Lot 1 of Forest Ridge Estates Third
Addition, Dubuque County, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of, accepts
and consents to the Grant of Easement for Water Main Utility through, over and across
Part of Lot 1 of Forest Ridge Estates Third Addition, Dubuque County, Iowa as shown on
the attached Grant of Easement for Water Main Utility and Exhibit A, from Jessica M.
Kramer and Cory W. Kramer, a copy of which is attached hereto.
Section 2. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 3. The City Clerk is hereby authorized to and directed to record this resolution
and Grant of Easement for Water Main Utility with the Dubuque County Recorder.

10. 2017 Asphalt Overlay Access Ramp Project Two Acceptance: City Manager rec-
ommending acceptance of the construction contract for the 2017 Asphalt Overlay Access
Ramp Project Two, as completed by Dan Arensdorf Construction. Upon motion the doc-
uments were received and filed and Resolution No. 329-17 Accepting the 2017 Asphalt
Overlay Access Ramps Project Two and Authorizing the payment of the contract amount
to the contractor was adopted.

ACCEPTING THE 2017 ASPHALT OVERLAY ACCESS RAMPS PROJECT TWO AND
AUTHORIZING THE PAYMENT OF THE CONTRACT AMOUNT TO THE CONTRAC-
TOR
Whereas, the Public Improvement Contract for the 2017 Asphalt Overlay Access
Ramps Project Two (the Project) has been completed and the City Engineer has exam-
ined the work and filed a certificate stating that the Project has been completed according
to the terms of the Public Improvement Contract and that the City Engineer recommends
that the Project be accepted; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved and the Project is
hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor from the
Curb Ramp Program appropriations and the sidewalk program appropriations for the con-
tract amount of $79,049.62, less any retained percentage provided for therein as provided
in Iowa Code chapter 573, and to pay such retainage only in accordance with the provi-
sions of Iowa Code chapter 573.

has inspected the 2017 Asphalt Overlay Access Ramps Project Two, that the Project has
been performed in compliance with the terms of the Public Improvement Contract, and
that the total cost of the completed work is $87,102.32.

Manager providing a letter of support for the Redevelopment of Rouse and Dean Foundry
Building located at 990 Washington Street. Upon motion the document was received and

12. Public Sidewalk Repair Assessment: City Manager recommending approval of a
Resolution establishing the final assessments for the sidewalk repairs in the City right-of-
way. Upon motion the documents were received and filed and Resolution No. 330-17
Adopting the Final Assessment Schedule - Sidewalk Repair was adopted.

ADOPTING THE FINAL ASSESSMENT SCHEDULE SIDEWALK REPAIR
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
After full consideration, the Final Schedule of Assessments as shown on the attached
sheet(s), Page 1 to Page 2 inclusive; is hereby approved for the sidewalk Repair — Right -
of -Way; whereas, Iowa State Code Section 364.12c states the abutting property owner
may be required by ordinance to maintain all property outside the lot and property lines.
City Code of Ordinance 10-1-2 B, C & D addresses the duties of the abutting owner to
maintain the sidewalk in the public right-of-way and the City's ability to make the neces-
sary repairs and assess the abutting property owner should the they fail do so.
There is hereby assessed and levied as a special tax against and upon each of the
benefited properties, the respective sums indicated. The amounts shown in said Final
Schedule of Assessments as deficiencies are found to be proper and levied conditionally
against the respective properties benefited by the improvements as shown in the Final
Schedule of Assessments, subject to the provisions of Iowa Code § 364.12. Said assess-
ments against said lots are hereby declared to be in proportion to the special benefits
conferred and not in excess of twenty-five percent of the value of same.
The City Clerk be and is hereby directed to certify the Final Schedule of Assessments
to the County Treasurer of Dubuque County, Iowa, and to publish notice of said certifica-
tion once each week for two consecutive weeks in the manner provided in Iowa Code §
362.3, the first publication of which shall be not more than fifteen days from the date of
filing of the Final Schedule of Assessments. On or before the date of the second publica-
tion of the notice, the City Clerk shall also mail a copy of said notice to property owners
whose property is subject to assessment, as provided in Iowa Code § 384.60.
The assessments may be paid in full or in part without interest at the City Treasurer's
Office, City Hall, 50 W. 13th Street, Dubuque, Iowa, at any time within 30 days after the
date of the first publication of the notice of the filing of the Schedule of Assessments with
the County Treasurer. After 30 days, unpaid assessments are payable at the County
Treasurer's Office, Dubuque County Courthouse, 720 Central Avenue, Dubuque, Iowa,
and charges shall be collected in the same manner as general property taxes against the
respective parcels of the property set forth on the schedule.

Whereas, Newt Marine Service (Newt) wants to apply for a grant from the Iowa Clean
Air Attainment Program (ICAAP) for Congestion Mitigation/Air Quality (CMAQ) to assist
with Repowering Newt Marine Towboats with new EPA Certified Engines (the "Project");
and
Whereas, the ICAAP CMAQ grant is managed by the Iowa Department of Transporta-
tion (IDOT) and requires sponsorship of the Project; and
Whereas, as sponsor the City is agreeing to many requirements which are a condition
of receiving the funding; and
Whereas, City is willing to sponsor the project upon the terms and conditions agreed
upon by the parties; and
Whereas, the Newt project would positively impact air quality in the community.

Mr. Henschel to 3 -year terms through July 1, 2020. Seconded by Resnick. Motion carried

PUBLIC HEARINGS
1. Residential Parking Permit Amendment District C and District E: Proof of publication
on notice of public hearing to consider an amendment to the Saint Ambrose Street Resi-
dential Parking Permit District C, which would add both sides of Saint Ambrose Street
from Clarke Drive to Sunnyview Drive, and an amendment to the Auburn Street Residen-
tial Parking Permit District E, which would add both sides of Auburn Street, from North
Grandview Avenue to Dexter Street and the City Manager recommending approval. Mo-
tion by Jones to receive and file the documents and that the requirement that a proposed
ordinance be considered and voted on for passage at two Council meetings prior to the
meeting at which it is to be passed be suspended. Seconded by Del Toro. Motion carried
7-0.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 9-14-321.735 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
9-14-321.735: RESIDENTIAL PARKING PERMIT DISTRICT C:
A. The following described area constitutes a residential parking permit district desig-
nated as residential parking permit district C:
Clarke Drive from the east property line of 1687 Clarke Drive to St. Ambrose Street.
Hoyt Street.
North Grandview Avenue, west side, from Rosedale Street to the north property line
of 2165 North Grandview Avenue, east side, from Clarke Drive to the north property
line of 2280 North Grandview Avenue.
Saint Ambrose Street, both sides, from Clarke Drive to Sunnyview Drive.
Sunnyview Drive, from North Grandview Avenue to St. Ambrose Street.
Ungs Street, south side.

B. No vehicles shall park curbside in residential parking permit district C during the
hours of seven thirty o'clock (7:30) a.m. to ten o'clock (10:00) p.m. daily, except Sundays
and holidays, without displaying a valid parking permit issued by the city.
Section 2. Section 9-14-321.737 of the City of Dubuque Code of Ordinances is hereby
amended to read as follows:
9-14-321.737: RESIDENTIAL PARKING PERMIT DISTRICT E:
A. The following described area constitutes a residential parking permit district desig-
nated as residential parking permit district E:
Algona Street, both sides, from North Grandview Avenue to Green Street.
Auburn Street, both sides, from North Grandview Avenue to Dexter Street.
Avoca Street, both sides, from Rosedale Avenue to Green Street.
Grandview Avenue, North, south side, from Avoca Street to Auburn Street.
Rosedale Avenue, north side, from Avoca Street to the west property line of 2095
Rosedale Avenue.
Rosedale Avenue, south side, from Avoca Street to the alley west of Avoca Street.
B. No vehicles shall park curbside in residential parking permit district E during the
hours of seven o'clock (7:00) a.m. to two thirty o'clock (2:30) p.m. daily, except Saturdays,
Sundays, and holidays without displaying a valid parking permit issued by the city.
Section 3. This Ordinance shall take effect upon publication.

ACTION ITEMS
1. Greater Dubuque Development Corporation - Quarterly Update: President and CEO
Rick Dickinson presented the quarterly update on the activities of the Greater Dubuque
Development Corporation. Topics included the recent groundbreaking for the new
Flexsteel Industries, Inc. facility; Director of Marketing Emily Graves receiving an award
for the 2020 Campaign brochure; Workforce Solutions Coordinator Mandi Mohr and Vice
President of Existing Businesses Dan McDonald presentation at a conference about soft-
ware that provides for contacting and connecting with businesses, Heartland Financial,
Inc.'s current buildout in the Roshek Building; work with existing business continues; pro-
gress on the Four Pillars of Action program; partnerships; and reconstituting the Wash-
ington Neighborhood Association as part of the True North Program. Mr. Dickinson
thanked the citizens and City staff for their support. Motion by Lynch to receive and file
the information. Seconded by Resnick. Motion carried 7-0.
2. Alliant Energy Smart Meters: Alliant Energy Key Account Manager Craig Clefisch
and Dubuque Operations Manager Ken Anthony gave a verbal report on Alliant Energy's
plans to upgrade residential and small business electric meters in Dubuque to smart me-
ters. Topics included the mailing of informational postcards to residents; door cards will
be distributed if contractors need to access the residence; meters will be changed out in
accordance with current meter reading routes; a pilot program of 250 meters changed out

will assist in verification of meter information; uninterrupted meter reading is expected
during the change out; the meter will alert for power outages and tampering; future cus-
tomer portals and adapting to rate structures. Alliant has coordinated with the Police De-
partment regarding contractors working in neighborhoods. Mr. Clefisch stated that resi-
dents should watch for appropriate identification and attire of legitimate contractors on
their property or approaching them. Responding to questions from the City Council re-
garding health concerns with exposure to the frequency output of the meters, the pre-
senters stated that data is transmitted once per hour and the exposure is less than that
of a cell phone according to a World Health Organization study. Motion by Lynch to re-
ceive and file the information. Seconded by Connors. Motion carried 6-1 with Del Toro
voting nay.
3. SRF Rate Reset and Reissuance for 2007 Water Revenue Capital Loan: City Man-
ager recommending approval of an amendment to the City Water Revenue Drinking Wa-
ter State Revolving Fund Loan Agreement entered into as of October 18, 2007. Motion
by Connors to receive and file the documents and adopt Resolution No. 333-17 Approving
and authorizing an Amendment to Loan and Disbursement Agreement by and between
the City of Dubuque and the Iowa Finance Authority, and Authorizing and providing for
the reissuance of the $571,000 Water Revenue Capital Loan Note, Series 2017 (2007 —
Rate Reset), of the City. Seconded by Lynch. Motion carried 7-0.
RESOLUTION NO: 333-17
APPROVING AND AUTHORIZING AN AMENDMENT TO LOAN AND DISBURSE-
MENT AGREEMENT BY AND BETWEEN THE CITY OF DUBUQUE AND THE IOWA
FINANCE AUTHORITY, AND AUTHORIZING AND PROVIDING FOR THE REIS-
SUANCE OF THE $571,000 WATER REVENUE CAPITAL LOAN NOTE, SERIES 2017
(2007 — RATE RESET), OF THE CITY
Whereas, the City of Dubuque (hereinafter the "Issuer") previously issued its Water
Revenue Capital Loan Note, Series 2007, dated October 18, 2007, in the amount of
$1,037,000 (hereinafter the "Notes") currently outstanding in the amount of $571,000,
pursuant to a Loan and Disbursement Agreement between Issuer, the Iowa Finance Au-
thority, the Iowa Department of Natural Resources and Wells Fargo Bank, N.A., dated of
like date (the "Agreement"), for the purpose of defraying the costs of the Project (as de-
fined in the resolution authorizing issuance of the same (hereinafter the "Resolution"));
and
Whereas, the Iowa Finance Authority, as Original Purchaser and current holder of the
Notes, has authorized a reduction in the interest rate on the Notes to 1.75%; and
Whereas, an Amendment to the Loan and Disbursement Agreement (hereinafter the
"Amendment") has been prepared to reflect said interest rate reduction, a copy of which
is attached hereto as Exhibit A; and
Whereas, pursuant to IRS regulations adoption of the Amendment constitutes a reis-
suance of the Notes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IN THE COUNTY OF DUBUQUE, STATE OF IOWA:

Section 1. That the Resolution is hereby amended to reflect the interest rate reduction
to 1.75% per annum on the outstanding principal amount from and after December 1,
2017 for the remainder of the life of the Notes.
Section 2. That the Amendment in substantially in the form attached to this Resolution
is hereby authorized to be executed and issued on behalf of the Issuer by the Mayor and
attested by the City Clerk.
Section 3. That the Supplemental Tax Certificate regarding the uses of proceeds and
the system is hereby approved. The City Clerk is directed to execute the same.
Section 4. Except as amended herein, all of the other terms and conditions of the Res-
olution and Agreement are in all respects ratified, confirmed and approved and shall re-
main in full effect.

4. Request for Work Session - Quarterly Sustainable Dubuque Work Session: The City
Manager recommending that the City Council schedule a Sustainable Dubuque Quarterly
Work Session for Monday, November 13, 2017, at 6:00 p.m. Motion by Connors to set
the work session as recommended. Seconded by Resnick. Motion carried 7-0.
5. Southwest Arterial Construction Update Video: Cable TV Division will show a video
of the recent progress of the Southwest Arterial Project. Motion by Lynch to receive and
file the information. Seconded by Jones. Motion carried 7-0.
COUNCIL MEMBER REPORTS
Council Member Connors reported on the recent Fireball Run event and its Dubuque
Team stating that she received very positive feedback about Dubuque from participants
and visitors associated with the event.
Council Member Jones added that Ms. Connors received kudos following presentation
of the proclamation commemorating the event. Mr. Jones referenced the mission of the
event to successfully locate missing children, and that he'll have a flag signed by the
event participants at the next Council meeting to be presented to the Convention and
Visitors Bureau.
There being no further business, upon motion the City Council adjourned at 6:57 p.m.
