ORDINANCE NO. 53-06
AN ORDINANCE AMENDING CHAPTER 11 (BUILDING REGULATIONS) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY AMENDING SECTION 11-4
DEMOLITION PERMITS IN CONSERVATION DISTRICTS TO PROHIBIT
DEMOLITION BY NEGLECT
Whereas, the Historic Preservation Commission has recommended an
amendment to Chapter 11 (Building Regulations) of the City of Dubuque Code of
Ordinances regarding prohibition of demolition of neglect in conservation districts; and
Whereas, the City of Dubuque has established conservation districts to allow for
the City Council's review of demolition permits that might impact buildings of historic or
architectural significance in these districts; and
Whereas, the City Council has appointed a Historic Preservation Commission to
review demolition permits in conservation districts, and provide recommendations to the
City Council; and
Whereas, the City Council finds that the recommended amendments to Chapter
11 are consistent with the goals and objectives of the City's Comprehensive Plan and
the purpose and intent of the City's Code of Ordinances.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. Section 11-4 of the City of Dubuque Code of Ordinances is hereby
amended by adding the following new subsection (h) as follows:
(h) Demolition By Neglect Prohibited: The owner of real property in any conservation
district shall preserve and keep from deterioration all buildings and structures located
on such real property. The owner shall repair the building or structure to correct any of
the following defects found by the city's designated enforcement officer:
(1) Deteriorated or ineffective waterproofing of exterior walls, roofs, foundations or
floors, including broken windows and doors;
(2) Defective or lack of weather protection for exterior wall coverings, foundations or
floors, including broken windows and doors;
(3) Any default, defect or condition in the structure which renders it structurally unsafe
or not properly watertight; or
(4) Deterioration of any exterior feature so as to create a hazardous condition which
could make demolition necessary for the public safety.
Section 2. This ordinance shall take effect immediately upon publication, as
provided by law.

demolition, or substantial enlargement, alteration, repair or remodeling of any
structure, building or sign in the Fourth Street peninsula ROD redevelopment
overlay district during the period from August 12, 2001, through May 31, 2002,
except where a vested right to the issuance of such permit accrued to any
person, firm or corporation as a matter of law prior to August 7, 2000.

Any person, firm or corporation so aggrieved by or adversely affected by the
building official's refusal to issue a permit pursuant to this moratorium shall
appeal therefrom to the city council. The city council may direct the building
official to issue a permit during this nine (9) month extension of the moratorium
for any work in the Fourth Street peninsula ROD redevelopment overlay district
which the city council believes would not negatively impact the master planning
process for the Fourth Street peninsula,_ upon a showing of good cause by the

Hi, again. here are a couple of more items having to do with one of the telephone questions of yesterday.
At the end of section 11-58, subsection (e). Within parentheses at the beginning of (e), it states: "(Rich to verify
this with Laura)". This subsection is another moratorium. Is that subsection correct as is, and is its placement
acceptable?
Just after the heading for section 11-59, "Fees", there is some wording that has been stricken, which states:
"Engineering has an ordinance that establishes a moratorium for th ee'Branch. Ask Ginny or Deron for a copy".
Is that, perhaps, the missing material which would comprise sectio 11-58.5

Every permit for the use of streets or public property shall expire on the last day
for which the permit was issued, as described on said permit, and shall be renewed
upon the payment of an additional fee to the building department, as,established by the
Citv Manager. Failure to renew the permit for the use of streets or public property shall
be considered as due cause for the building official to order all barricades or fences
removed and the public property returned to public availability and use.
(d) Suspension Or Revocation: The building official may, in writing, suspend
or revoke a permit issued under the provisions of this article whenever the permit is
issued in error, on the basis of incorrect information supplied, failure to comply with
permit conditions, or in violation of any ordinance. .
(e) (Rich to verify this with Laura) Moratorium: No building permits within a
proposed POS public open space district, as shown on the Freeway 61/151 corridor
plan's proposed land use maps, as on file in the office of the city clerk, shall be issued
by the building official from the date of publication of this section until six (6) months
from such date. The moratorium provided for herein shall not be construed to deprive
any person, firm or corporation of a vested right that such person, firm or corporation
may have acquired as a matter of law for the issuance of a building permit as of the
effective date of the adoption of this section. Any person, firm or corporation aggrieved
by or adversely affected by the building official's refusal to issue a building permit
pursuant to this moratorium shall appeal therefrom to the city council. (1976 Code, § 10-

BACKGROUND

In early 2006, City staff commenced studying options to create a more efficient printing,
copying, scanning and faxing environment. Some of items that were explored were:
• Reduction in total cost of ownership of printers, scanners, faxes and copiers
by:
• reducing the number of printing, faxing, scanning and copying devices
with high cost per copy;
• creating a standard printing, faxing, scanning and copying
environment;
■ moving to a "fax to the desktop" solution thereby eliminating 31
dedicated analog lines priced at $24.25 per month used for faxing and;
■ leveraging volume pricing for devices and supplies at a pre -determined
lock -in price.
• Offering high speed, quality scanning capabilities from the desktop to all
departments and making the use of Laserfiche document management
software available to all departments for archival of needed documents.
The initial assessments showed a move away from standalone printers, copier, faxes
and scanners to networked multifunction units that could provide all of these functions,
could provide a substantial annual savings.
In March 2007 a task force consisting of Steve Brown, Engineering; Kevin Firnstahl, City
Clerk's Office; Brenda Fuglsang, Personnel; Juanita Hilkin, City Manager's Office;
Denette Kellogg, Carnegie -Stout Public Library; Jenny Larson, City Manager's Office;
Deron Muehring, Engineering; Kay Munson, Planning; Dave Ness, Engineering;
Melinda Rettenberger, Planning; Lynn Schlueter, Engineering; Tony Steffen, Information
Services; Kathy Sturm Finance; Janet Walker, Housing and Community Development;
and myself began to discuss and study the proposed migration to networked
multifunction printer -copier -scanner -fax machines from stand-alone devices.
The group gathered and studied information and issues on the concept of moving to a
multi -function environment. The group also visited Cottingham and Butler to review
their implementation of multifunction devices in their organization.
On June 19, 2007, a proposal for multifunction printer -copier -scanner -fax devices was
issued. Proposals were sent to 11 vendors.
Based on the evaluation criteria of support, training and service, it was determined that SMG
of Bettendorf, IA, Advanced Systems of Dubuque, IA, and IKON of Davenport, IA, be
considered "short-list" vendors and merited further study.
Each of the short-listed vendors gave a presentation to the study group and was required to
place fully functioning multifunction devices in the following departments:
SMG — Housing/Community Development and Planning;
Advanced Systems — Information Services/Human Rights and E911 Dispatch;
IKON — City Manager's Office and Engineering.
Vendors were asked to install hardware and software for the LaserFiche interface. Training
and follow-up support were provided.
The vendors were evaluated on not only the final product installed at each location but
also on how skilled their technicians and trainers were at implementing the solution at
each site.
The evaluation units have been in the departments since late August. Users have had
the opportunity to print, scan and copy on these devices, along with testing the
integration to LaserFiche. All three vendors recommended the same LaserFiche and
fax integration software.
DISCUSSION
In creating the specifications for the RFP, information was gathered from previous
studies and staff input to determine features and functionality of devices by location.
The RFP was written as a "design -build" specification leaving some latitude for vendors
to propose what they determined as the best hardware and software configuration for
each site.
In evaluating the proposal responses, it has been discovered that it is virtually
impossible to get the information submitted by vendors compiled in an objective
comparison that accurately reflects the final costs for this project in an "apples to
apples" format. I have determined that we are in need of submitting to the short-listed
vendors a more specific listing of device requirements in a consistent response format. I
am therefore in need of your help and am asking for your assistance to review the
information on the attached documents.
I have compiled a spreadsheet of what was requested in the RFP for features and
functionality of devices by location. I have also attached a "Clarification of Device and
Feature Requirements" that will be submitted to vendors that outline requirements for
the submittals I will be requesting.
Based on your feedback and revisions, this information will be re -submitted to the three
short-listed vendors to clarify and potentially adjust their pricing and proposed
configuration. It should be noted that budget constraints may cause the final
configurations to vary from what is requested, but best efforts will be made to
accommodate your needs.
ACTION STEP
I would ask that you review and share the attached documents with your department or
groups of staff where a device is shared among several users for feedback on the
requirements of each device. I would ask that you concentrate primarily on the
spreadsheet showing "Specific Features by Location" for key features such as speed,
resolution and additional features.
I realize that some departments have been very close to this project and others have
had minimal exposure to it. Therefore, if you have questions about what you are being
asked to do in this memo or about the project or process, I will be available to discuss it
at the following dates and times:
