CITY COUNCIL PROCEEDINGS

The Dubuque City Council met in special session at 5:30 p.m. on May 27, 2009 in
the Historic Federal Building.
Present: Mayor Buol, Council Members Braig, Connors, Jones, Resnick, Voetberg,
Assistant City Attorney O’Brien
Absent: Council Member Lynch
Mayor Buol read the call and stated this is a special session of the City Council to
discuss the Unified Development Code.

Discussion regarding the Unified Development Code
Planning Services Manager Laura Carstens introduced staff members Associate
Planner Kyle Kritz, Assistant Planner Guy Hemenway, and Assistant Planner Wally
Wernimont. Carstens then reviewed each of the Articles being presented to City
Council for their review noting changes and recommendations:

Rural/Residential Overlay District

Long-Standing Overlay Districts: restricted height overlay, Hwy 151/61

sign overlay, flood plain overlay
Newly Proposed: old town overlay, airport overlay

Carstens provided follow up information from the May 11 UDC work session.
Responding to questions from the City Council, Carstens explained the difference
between the City’s Zoning Advisory Commission and the Zoning Board of Adjustment
stating that the ZBA is a quasi-judicial board established by the State of Iowa Code,
which has the power to grant variances without review by City Council. The Zoning
Advisory Commission makes recommendations to the City Council, which then makes
the final determination.
During discussion City Council Members questioned words and phrases, noted
corrections, and offered their suggestions related to Articles 6-10 of the Unified
Development Code.
There being no further business, upon motion the City Council at 7:20 p.m.
