SUBJECT:Roadway Improvements at the Mines of Spain
Leisure Services Manager Gil Spence is recommending City Council approval of a State
Park and Institutional Road Agreement with the Iowa Department of Transportation that
will allow the IDOT to bid construction of the roadway to the Rip Row Valley
development that is a part of the Mines of Spain Recreation Area.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Roadway Improvements at the Mines of Spain
INTRODUCTION
The purpose of this memorandum is to request that the City Council authorize the
Mayor to sign State Park and Institutional Road Agreement with the Iowa Department of
Transportation.
DISCUSSION
The Iowa Department of Natural Resources will begin development of the old
wastewater retreatment plant site (Rip Row Valley) that we recently leased to them and
became a part of the Mines of Spain Recreation Area. IDOT will bid construction of the
roadway as shown on the drawing included in the agreement. Since IDNR leases the
property from the City, IDOT requires the agreement to be signed.
This will be phase I of the park development plans and will begin cleaning up the area
and making it available for public use. These improvements and the construction of
four softball fields by the Dubuque Girls' Independent League next to this site will
greatly improve the appearance of the area.
ACTION STEP
The action requested is that the City Council authorize the Mayor to sign the State Park
and Institutional Road Agreement.

IT IS AGREED between the State of Iowa, Iowa Department of Transportation (hereafter DOT),
the Iowa Department of Natural Resources (hereafter DNR) and the City of Dubuque, Iowa
(hereafter CITY) as follows:
DNR has programmed a project for roadway improvements at the Mines of Spain
recreation area which is located within the CITY. The proposed improvements are shown
on and further described in the October 1, 2002 project concept statement attached hereto
as Exhibit "A".
Any environmental, historical or jurisdictional clearances required for the project will be the
responsibility 0fthe DNR.

Any utility adjustments caused by construction will be the responsibility ofthe DNR. Utility
adjustment costs will not be eligible for Park and Institutional Roads (P/IR) Program
funding.
4. Design, letting, inspection and contract administration will be accomplished by the DNR.
The above described project has been included in the DOT's current Transportation
Improvement Program for P/IR construction. A total of $45,000 has been programmed in
2002 for construction of this improvement.
The eligible project costs (estimated at $26,700 for concepted items) will be funded from the
DNR's 2002 and subsequent allocations. Ineligible costs, currently estimated at
approximately $7,300, will be funded by the DNR from sources other than the P/IR Program.
Programming for succeeding funding periods will be adjusted with respect to actual
expenditures made.
7. When the project is completed, jurisdiction and control of the improvements, as constructed,
shall remain with the DNR pursuant to this agreement and Iowa Code sections 306.4(4)
(2001) without need for execution of any additional agreement.
8. Exhibit "A" attached hereto is considered to be a part of the Agreement.
9. If any section, provision, or part of this Agreemem (incinding Exhibit "A") shall be found to
be invalid or unconstitutional, such judgment shall not affect the validity of the Agreement as
a whole or any section, provision, or part thereof not found to be invalid or unconstitutional,
except to the extent that the original intent of the Agreement cannot be fulfilled.
10. This Agreement may be executed in two counterparts, each of which so executed shall be
deemed to be an original.
11. This Agreement as set forth in paragraphs 1 through 11 herein (inclusive) represents the
entire Agreement between the DNR and DOT concerning this project. Any subsequent
change or modification to the terms of this Agreement shall be in the form of a duly executed
Addendum to this Agreement.

I. STUDY AREA
A. Project Description
This project involves the HMA paving of an access road and parking for a proposed
recreational area at the Mines of Spain in Dubuque.
B. Present Facility--Need for Proiect
The area is currently a material waste/storage site along the Mississippi River. There is
approximately 300' of 14'+ wide PCC pavement. To the west of the proposed
recreation area, several girls' softball league fields are being constructed. Proposed
parking in the new recreation may also serve as Overflow parking for the softball fields.
C. Special Considerations
No excavation can take place towards the east of the existing pavement, towards the
proposed loop area. This is due to buried material at the site.
The land for the proposed project is currently owned by the City of Dubuque. It will
be leased to the DNR as an amendment to an existing long-term lease set to expire
June 30, 2032.
Access must be maintained to the railroad along the Mississippi River for City use.
Actual layout of roadway and parking areas shall be determined by the DNR.
II. PROJECT CONCEPT
A. Proposed Construction
Remove the existing 300'+ of PCC pavement and construct a new roadway and new
parking area. For the first 50'+, excavate 1' of existing material and place 18' wide, 6"
HMA over 6" modified subbase. For the remainder of the roadway and parking areas,
place 18' wide, 6" HMA over 6" modified subbase on top of the existing surface.
Place 3' wide earth fillets. Perform necessary clearing and grubbing. All work
associated with the roadway portion of this project will be paid for by P/IR Funds. All
other work will be paid for by Other Funds.

C. Detour Analysis
The park roads will be closed as required during construction.

D. Construction Sequence
It is anticipated that all work will be awarded to one prime contractor. The DNR will
design, let, and inspect this project.
E. Program Status
Site data has been developed by the Office of Design. This project is listed in the
2002-2006 Iowa Transportation Improvement Program with $45,000 programmed for
construction in 2002. Upon project approval, a schedule of events will be developed.
