The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the change in the lot lines and
indicating that the homeowners' association will take over maintenance of Lot 2 along North
Cedar Court.
Staff reviewed the stafF report, noting that the Plat of Survey is being reviewed by the
Zoning Advisory Commission and City Council as Lot 1 will not have 50 feet of frontage.
Staff reviewed the Plat of Survey was otherwise compliant with the Unified Development
Code and recommended approval, subject to waiving the lot frontage requirement for Lot 1.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it appropriate.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving the lot frontage requirement for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey of Cedar Lake — East 12th Addition subdivides an existing
parcel of land into two lots to facilitate the dedication of property to the homeowners'
association for Cedar Lake Subdivision.
DISCUSSION
The submitted Plat of Survey of Cedar Lake — East 12�h Addition subdivides an
unusually shaped parcel of land currently owned by Theresa Doerr and facilitates the
sale of Lot 2 along the private road, North Cedar Court, to the homeowners' association.
The Plat of Survey is being reviewed by the Zoning Advisory Commission and City
Council as the resulting Lot 1 will not have the required lot frontage on a public or
approved private street.
RECOMMENDATION
The submitted Plat of Cedar Lake — East 12�h Addition is in compliance with the Unified
Development Code, subject to waiving the lot frontage requirement for Lot 1 . Planning
staff requests that the Zoning Advisory Commission review and recommend approval of
the submitted Plat of Survey.

RESOLUTION APPROVING THE PLAT OF SURVEY CEDAR LAKE - EAST 12TH
ADDITION IN CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey Cedar Lake —
East 12th Addition in the city of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 32.64 feet of frontage for Lot 1 on a public or
approved private street, where 50 feet of street frontage is required by Section 11-14 of
Title 16 of the City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City. of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 32.64 feet of frontage on a
public street or an approved private street for Lot 1.
Section 2. That the Plat of Survey Cedar Lake — East 12th Addition is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa upon said Plat of Survey.
