90-Day Extension of Permit Moratorium for Off-Premise Signs
This memo transmits for C~3/Coundl review and approval, a proposed 90-day extension of the
odginal 90-day permit moratorium for off-premise signs approved 3anuary 15, 2001. This
moratorium request was prompted by the 3anuary 3, 2001 application of Lamar Outdoor
Advertising for a text amendment to the Zoning Ordinance to increase the minimum spadng
regulations for off-premise signs, and the subsequent City Coundl directive to the Zoning
Advisory Commission asldng the Commission to explore spadng alternatives.
Lamar's original text amendment asked to increase the minimum spacing between off-premise
signs from 100 feet to 750 feet. At Coundl's request, the Zoning Advisory Commission has
proposed alternative language and will hold a public hearing regarding this new amendment on
April 4, 2001. If the Commission acts on the text amendment on that date, then the
amendment would be considered by the City Council on April 16, 2001. The original permit
moratorium, however, will expire on April 15, 2001. This amendment would impact the
placement of off-premise signs, if enacted. Signs erected dudng the review of the text
amendment by the Zoning Advisory Commission and the C~y Coundl might conflict with greater
sparing requirements, if adopted. Therefore, Planning Services Staff recommend extension of
the odgifla190-day moratorium to enable the amended language to be reviewed at the Zoning
Advisory Commission public headng and by the City Coundl prior to issuance of new off-premise
sign permits. A moratorium seems prudent to prevent inadvertenUy creating non-conforming
off-premise signs. The 90-day extension allows both the Commission and the Council sufficient
time to consider the amendment.
The public headng process for review of the text amendment by the Zoning Advisory
Commission and the C3b/ Coundl should be accomplished within the proposed 90-day
moratorium extension. If the amended language issue is resolved pdor to the expiration of the
90-day extension on 3uly 14, 2001, the City Council can resdnd the moratorium,
! recommend that the City Council adopt the attached ordinance establishing a 90-day extension
to the existing permit moratorium extension for off-premise signs.

AN ORDINANCE AMENDING CHAPTER 3 (ADVERTISING) OF THE CITY OF DUBUQUE CODE
OF ORDINANCES BY AHENDZNG SECTION 3-43 (f), TO ESTABLISH A NINETY (90) DAY
EXTENSION OF THE EXISTING MORATORIUM ON THE ISSUANCE OF PERMITS FOR OFF-
PREMISE SIGNS.
Whereas, Lamar Outdoor Advertising has submitted an application for a text amendment to the
Zoning Ordinance regulations pertaining to increasing the minimum spacing of off-premise signs; and
Whereas, the ab/Coundl has asked the Zoning Advisory Commission to study alternatives to this
amendment; and
Whereas, the issuance of permits for off-premise signs during the review of this text amendment
could affect the community negatively.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBU(~UE, TOWA:
Section 1. Chapter 3 (Advertising) of the City of Dubuque Code of Ordinances is hereby amended by
amending Section 3-43 (f) as follows:

The building offidal shall not issue any permit for any new construction or substanUal enlargement,
alteration, repair or remodeling of an off-premise sign dudng the period of January 15, 200:[ to 3uly
