Extension of Highway 20 Moratorium for Bridge Study
Pursuant to a request from the Department of Transportation, Planning Services Manager Laura
Carstens is requesting extension of the building permit moratorium on Highway 20 from Bluff
Street east to the city limits until May 1, 2002.
I concur with the recommendation and respectfully request Mayor and City Council approval.

TNTRODUCT~ON
This memo t~nsmits a request from the Department of Transportation ODOT) for the
City to extend the building permit moratorium on Highway 20, in connection with the
U.S. Mississippi River Crossing Study. A resolution and map are attached.
DTSCUSS[ON
On April 19, 1999, the (:'fo/Coundl established a building permit moratorium for 12
months, for Highway 20 east from Bluff Street to the city limits. This moratorium was
requested by the [DOT for the U.S. 20 Mississippi River Crossing Study. On April 3,
2000, the City Coundl extended this moratorium for another 12 months at [DOT's
request~
At this time, the [DOT has requested that the City extend the moratorium for Highway
20 from Bluff Street east to the city limits for another 12 months, to reduce impacts in
the study area.
RECOMMENDATTON
T recommend that the Oty Coundl extend the building permit moratorium for Highway
20 from Bluff Street east to the city limits for another 12 months, as requested by the
]:DOT in connection with the U.S. 20 Mississippi River Crossing Study. W*ith approval of
the attached resolution and map, the City Council will extend the moratorium from
Bluff Street east to the city limits until May 1, 2002.

ORDINANCE NO. 20-01
AN ORDINANCE AMENDING CHAPTER 11 (BUILDING AND BUILDING
REGULATIONS) OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY
AMENDING SECTION 11.589-1 BY ESTABLISHING A TWELVE MONTH
MORATORIUM ON THE ISSUANCE OF PERMITS FOR WORK IN THE U.S. 20
CORRIDOR.
Whereas, the Iowa and Illinois Departments of Transportation are conducting a
U.S. 20 Mississippi River Crossing Study; and
Whereas, the issuance of permits in the study corridor of U.S. 20 could
impact the study negatively.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. Chapter 11 (Buildings and Building Regulations) of the City of
Dubuque Code of Ordinances is hereby amended by amending Section 11-58.1 as
follows:
Section 11-58.1 Moratorium- for work in the U.S. 20 Corridor. The building
official shall not issue any permit for any new construction or substantial
enlargement, alteration, repair or remodeling of any structure, building or sign in
the U.S. 20 Corridor (Dodge Street), but not to include demolition, from the
eastern corporate limits of the City of Dubuque westerly to the intersection of U.S.
20 (Dodge Street) with Bluff Street, as shown on the maps on file in the Office of
the City Clerk, 50 W. 13t~ Street, Dubuque, Iowa, during the period of May 1,
2001 to May 1,2002, except where a vested right to the issuance of such permit
accrued prior to May 1, 1999.
Section 2. This ordinance shall take effect on May 1, 2001.

Dear Laura:
This is a follow-up to our March 19, 2001 telephone conversation in regards to Dubuque's
building permit moratorium in connection with the U.S. 20 Mississippi River Crossing Study
(Julien Dubuque Bridge). I am requesting the city extend the moratorium for another one-year
period in the area where the approach to a new Mississippi River bridge cross'rog on U.S. 20 ~511
be needed. A map of the bridge approach area footprint is enclosed. We are anticipating having a
much better idea within the next year of knowing when we expect to proceed with the acquisition
of property in the approach area
At this time we have no interest in the area covered by the moratorium being extended beyond the
current western limits.
If you require any additional information or explanation, please advise.
