Mayor Moffatt stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may pro-
perly come before the meeting.
Councilman Wharton moved that
the rules be suspenclecl for the pur-
pose of allowing anv one present iu
the Council Chamber, who wishes
to do so, to address the Council.

preciation for services rendered by
him as a member oY the Civil Ser-

The matter of filling the vacancy
on the Civil Service Commission
caused by the resignation of E. F.
Strueber was taken up by the Coun-
cil, some members of the Council
being in favor of postponing action
on this appointment until the next
meeting of the Council while other
members of the Council were in
favor of making this appointment
at this meeting. After a lengthy
discussion on this questitou, Coun-
cilman Wharton moved that Mr. E:
B. Lyons be appointed as a member
of the Civil Service Commission to
fill the unexpired term of E. F.
Strueber, said term expiring March
31, 1918. Seconded by Mayor Mof-
fatt. Motion lost by the following
vote:

Gentlemen: The above claim was
submitted to me for investigation
and report. From such investiga-
tion I find that on or about Feb-
ruary 16, 1944, Mrs. F. J. Rellihan
fell on a dangerous spot on the
e south sidewalk on East 15th Street

about 40 feet west of Washington
Street and broke her right arm, and
because thereof she was compelled
to incur medical expenses and oth-
er additional expenses to the
anxount of about $75.00. after dis-
cussing this matter with her, she
has agreed to accept $50.00 in full
settlement of her claim.
I recommend that a warrant be
drawn in the amount of $50.00, pay-
able to her order and the same be
cleliverecl to her upon delivery to
the City of a proper release exec-
uted by her.

Mayor Moffatt read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of consider-
ing applications filed for beer per-
mits and acting on any other busi-
ness as may properly come before
a regular meeting of the City
Council.
Notice of Public Hearing to be
held on June 1, 1914, at 516 U. S.
Court House and Custom House, St.
Louis, Missouri, to consider the ad-
visability of providing a clepenclable
12-foot-channel-depth in the Missis-
sippi River between Cairo, Illinois,
and Minneapolis, 1\Iinnesota, by or-
der of War Department Corps of
Engineers, Office of Division Eugi-
ueer, Upper Mississippi Valley Divi-
sion, presented and read.

quested to attend the hearing if it

Whereas, the Corps of Engineers
of the War Department of the
United States has been ordered by
resolution adopted by the Com-
mittee mi Rivers and Harbors of the
House of Representatives to inves-
tigate the advisability of providing
a dependable 12-foot channel depth
in the Mississippi River between
Cairo, Illinois, and Minneapolis,
Minnesota; and
Whereas, a public hearing will be
held at 10:00 o'clock A. M., Central
War Time, on June 1, 1944, at the
U. S. Court House and Custom
House in St. Louis, Missouri, at
which time and place consideration
of the effects which such a naviga-
tion improvement might have upon
existing and proposed improve-
ments for flood control, hydro-
electric power, domestic and indus-
trial water supply and drainage,
pollution control, and recreation
and wildlife resources, will be ex-
amined; Now, Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque, Iowa,
that because of the vital interest of
this conununity in water-borne com-
merce, the municipal investment in
river terminal facilities, and the
effect on proposed improvements to
the water front of this city, favor-
able action for the 12-foot channel
be urged at the hearing as follows:
1. Iu recognition of the possibil-
ities for iviclespread and substan-
tial benefits iu the way of lower
cost transportation and euhance-
ment of other public interests and
that if a channel of greater depth
than the present 9-foot channel is
to be provided in any part of the
Mississippi River System that a
channel of like increased minimum
depth be Provided throughout the
entire system in order to facilitate
through transportation and attain
maximum efficiency in operation.
2. That in connection `with cle-
terminiug whether the 12-foot chan-
cel is economical aucl feasible cota-
sideration be given to the interests
of navigation, conservation, flood
control anct all other public in-
terests affected, affording clue rec-
ognition to each class of interests
iu proportion to the related public
benefits; and
Be It Further Resolved that. a
copy of this resolution be present-
ed at the hearing.

routes.

Gentlemen: Ordinance No. 9-43
creating a Municipal Playground
and Recreation Commission and de-
fining its powers and duties pro-
vides in part: "Paragraph 959.
Commission Created. Section 1.
That there be and there is hereby
created a commission to be known
as "Municipal Playground and Re-
creation Commission," of nine mem-
bers consisting of the Mayor, Presi-
dent of the Board of Education, the
Superintendent of Public Schools,
the Superintendent of Parochial
Schools, the City Manager, one
member of the Park Board as the
sis ems-officio members, together

with three citizen members, at
least two of whom shall be women,
all of whom shall serve without
compensation."
It now develops that the duties of
the President of the Board of Edu-
cation prevent his serving on the
Commission. Acting on the advice
of the Board of Education, the Play-
ground and Recreation Commission,
at a meeting held May 25, 1944,
moved to recommend to the City
Council that Ordinance 9-43 be
amended by substituting the words
"a member" in lieu of the word
"President" in the phrase "Presi-
dent of the Board of Education" and
such action is hereby recommended.

Gentlemen:
Deficits exist in a number of spe-
cial assessment funds whose bonds
have matured and tivhose future col-
lections will consist of very limited
delinquent payments. These deficits
arise from several causes: First,
the sale of tax-delinquent property
by the County and the subsequent
issuance of Treasurer's deeds, which
operates to wipe out the unpaid
special assessments; second, the re-
dxxction of assessments by compro-
mise in the past without proper
provision for the payment of the re-
mitted portion and the interest
thereon; third, the shortage of in-
terest that is inevitable with the
same interest rate (5%) applying to
the partial payments as does to the
bonds, but the redemption of the
bonds and the termination of in-
terest on them dependent upon the
accumulation of enough payments
to retire bonds of rather large de-
nominations.

To correct this situation, I recom-
mend that in accordance with Sec-
tion 6211-3 of the Code of Iowa, to
meet the deficiencies in assess-
ments, that $4,312.39 be paid from
the Consolidated Fund to the Spe-
cial Assessment funds as follows:
$419.46 to Fund 944, Main Street
from West 13th to West 17th;
$552.90 to Fund 946, West 17th
Street from Central to West Lo-
cust; $1,341.61 to Fund 947, Roose-
velt Street from Rhomberg to the
North line of Lot 6 of Peil's Sub.;
$976.64 to Fund 948, Main Street,
Jones to West 13th; $1,021.78 to
Fund 949, Boulevard lights on Main
Street from Jones to West 13th
Street. The remainder of the deficit
in Fund 948 is to be cleared by
shifting the balances in funds prior
to 930, and in Funds 933, 934, 945,
950 and 952 totalling $1,239.74.
I further recommend that any col-
lections hereafter accruing to spe-
cial assessments funds prior to
Fund No. 952 be credited to the
Consolidated Fund.
