Regular Session, June 5th, 1944.
Council met at 7:30 P. M.
Present-Mayor Moffatt, Council-
men Murphy, Thompson, Van Duel-
man, Wharton, City Manager Rhom-
berg. 112ayor Moffatt stated that
this is the regular monthly meeting
of the City Council for the Purpose
of acting upon such business as may
properly come before the meeting.
Councilman Van Duelman moved
that the rules be suspended for the
purpose of allowing any one present
in the Council Chamber, who wishes
to do so, to address the Council. Sec-
onded by Councilman Wharton.
Carried by the following vote:

Mr. M. H. Czizek, Attorney, repre-
senting the Dubuque Packing Com-
pany, addressed the Council and
presented the petition. of the Du-
buque Packing Company for the
right and authority to use and oc-
cupy such portion of the westerly
twelve feet of Sycamore Street as
may be necessary for to build and
construct a stairway approximate-
ly five and otie-half feet in width
along the easterly wall of a building
located on Lot 418, East Dubuque
Addition No. 2, also to construct
and maintain atwo-story building
upon the westerly twelve feet of
Sycamore Street, beg'inning' about
14 feet north of the nm'th lice of
East Sixteenth Street, and extend-
ing northerly about 51.4 feet, also
to build and construct and maintain
a coal hopper under the existing
sidetrack on the westerly side of
Sycamore Street, and requested
that said petition be granted.
RESOLUTION NO. 42-44
Dubuque Packing Company has
petitioned the City Council of
the City of Dubuque for the right
and authority to use and occupy the
westerly twelve feet of Sycamore
Street, northerly from East Six-
teenth Street, for the purpose of
constructing certain improvements
thereon, and also to construct and
maintain a coal hopper beneath the
railroad side track on the westerly
side of Sycamore Street, and said
petition has been considered by this
Council and it is deemed advisable
to grant the same; Now, Therefore,
Be it Resolved by the City Coun-
cil of the City of Dubuque, as fol-
lows:
Section 1. That Dubuque Packing
Company, its successors and as-
signs, be and it is hereby granted
the right and authority to use and
occupy such portion of the westerly
twelve feet of Sycamore Street as
may be necessary for the following
purposes:
a. To build and construct a stair-
way approximately five and one-half
feet in width along• the easterly wall
of a building located upon Lot 418,
East Dubuque Addition No. 2, said
stairway to begin at the sidewalk
level on the north side of East Six-
teenth Street and to be used as an
entrance to and exit from the ad-
joining building.
b. To construct aucl maintain a
£wo-story building upon the wester-
ly twelve feet of Sycamore Street,
beginning about 14 feet north of the
north line of East Sixteenth Street
and extending northerly about 51.4
feet, the first floor of such building
to be used as auxiliary to the retail
store and employee's lunch room,
and the second floor for time clocks,
etiiployment department, and pass-
way for employees.
Section 2. That said Dubuque
Packing Company is further author-
ized to build, construct, and main-
tain acoal hopper under the exist-
ing sidetrack on the westerly side
of. Sycamore,Street, the dimensions
thereof to be approximately 20 feet
in length, 10 feet in width, and 10
feet in depth, and to begin about 62
feet north of the north line of East
Sixteenth Street, such coal hopper
to be constructed so as to furnish
adequate support for the railroad
tracks and cars using the same and
under the supervision of and with
the approval of Cl\'ISt.P&P Railroad
Company.
Section 3. That the foregoing im-
provements shall be constructed un-
der the supervision of the City Man-
ager.
Section 4. That the right to build
and maintain such structures, as
hereby authorized, shall be subject
to the continuous control of the
City Council, reserving the right to
said Council to impose restrictions
and conditions upon tl.e enjoyment
thereof as may be reasonably neces-
sary for the protection of the public
interests, including the right to re-
voke and rescind the grant hereby
made if, at any time, the public in-
terest should require such revoca-
tion.
Section 5. As a further considera-
tion for the rights hereby granted,
said Dubuque Packing Company,
its successors and assigns, shall as-

sume all liability for damages to
persons or property which might re-
sult from the construction and main-
tenance of the structures hereby au-
thorized, and said Dubuque Packing
Company, its successors and as-
signs, at its own expense, shall de-
fend any and all claims and actions
which may be made or brought
against the City of Dubuque because
of the structures herein referred to,
and should the said City be required
to pay any damages on account
thereof, said Dubuque Packing Com-
pany, its successors and assigns,
shall reimburse said City therefor
and shall hold said City harmless
from such damages.
Section 6. Should the rights and
privileges hereby granted be re-
scinded or revoked, Dubuque Pack-
ing Company, its successors and as-
signs, at its own expense and upon
reasonable notice, shall remove
such structures from the street and
restore the same to as good condi-
tion as it ivas before such struc-
tures were placed thereon.
Section 7. All Resolutions or
parts of Resolution in conflict here-
with be and the same are hereby
repealed.
Section 8. This Resolution shall
be in force and effect and the rights
hereunder shall accrue to said Du-
buque Packing Company, its suc-
cessors and assigns when it has
been accepted by said Dubuque
Packing Company, which accept-
ance shall be endorsed hereon.

Addition" to the City of Dubuque,
pursuant to Ordinance adopted De-
cember 20, and approved December
21, 1917.
Whereas, a request has been filed
with the City Council of the City of
Dubuque, Iowa, to execute a quit-
claim deed to half of the vacated
alley abutting Lots 1, 2, 3, 4 and 5,
Lot 1 of 6, Lot 1 of 7, Lot 1 of 8, and
Lot 1 of 9, all in Block 19, in "Du-
buque Harbor Improvement Co: s
Addition" to the City of Dubuque,
Iowa, according to the records plats
thereof, and which half of said va-
cated alley abutting said lots is des-
ignated as "Lot A" in said Block 19,
upon the plat thereof; to "The Na-
tional Refining Company," an Ohio
corporation duly qualified to do bus-
iness in Iowa, its successors, as-
signs and grantees, pursuant to an
Ordinance adopted on December
20th and approved December 21st,
1917, which reads as follows:
Section 1. That the alley in Block
19 in Dubuque Harbor Improvement
Company's Addition, running from
Seventh Street Extension to Cy
press Street between Pine' Street

hereby vacated and annulled and

tigated this claim and find that he
received damages because of the
hole iu the road referred to in his
claim. That the damages amount
to $5.50.
I recouunend that a warrant be

$5.50, and the same be delivered to
him upon delivery to the City of a
release properly executed by him.

Whereas, the said Dubuque Coun-
ty, Iowa, desires to sell the above
described real estate to Paul Fon-
dell for $50.00, and
Whereas, The sale of said proper-
ty by Dubuque County, Iowa, for a
sum less than the total amount stat-
ed in the tax certificate including
endorsements of subsequent general
taxes, interests, and costs requires
the written approval of a majority
of all tax-levying and tax-certifying
bodies having any interest in said
general taxes; Now, Therefore,
Be It Resolved by the City Coun-

dows all broken, floors sagging,
much of the Plaster missing, cracks
in the walls, wiring torn down and
general conditions that cause this
building to be a definite fire haz-
ard and menace to the adjoining
properties; the building at 551 East
Fifteenth Street with windows bro-
ken, siding rotten and missing, sag-
ging floors, defective wiring and
lack of any sanitary conveniences
constitutes a definite fire hazard
and menace to adjoining proper-
ties; the shed at the rear of 409
Loras Boulevard, due to lack of
maintenance and repair, is compos-
ed of rotten siding boards, the
floor is sunken and walls are with
out sufficient support and in addi-
tion to being unsightly to the
neighborhood, the structure is di-
lapidated beyond reasonable re-
pair.
We therefore recommend that a
condemnation committee be ap-
pointed by your Honorable Body to
inspect the above properties and
make a report and recommendation
according to law.

Routine maintenance of paved

BE IT RESOLVED by the City
Council of the City of Dubuque,
Iowa
1. That pursuant to the provis-
ions of Sections 4755.21 and 4755.27
of the Code of 1939, we hereby ap-
prove and consent to the mainten-
ance of all primary road extension
within said city of Dubuque by the
State Highway Conuuission, as
hereinafter set forth.
2. That the approval aucl consent
herein given for the maintenance
of said primary road extensions
within the city of Dubuque is bas-
ed on the assumption and under-
standing that said maintenance to
be done by the State Highway
Commission will be Paicl for by the
State Highjvay Commission out of
the primary road fund, and that no
charge will be made against the
City of Dubuque on account of such
maintenance performed or to be
performed by the State Highway
Commission on the said primary
road extension within the said City
of Dubuque.
3. That the maintenance to be
done by the State Highway Com-
mission on the primary road exten-
sions within the city of Dubuque
shall include the usual surface
maintenance, roadbed repairs, re-
pairs to bridges, culverts and guard
rail, and other maintenance usually
performed on primary roads outside
of cities and towns, That ou streets
or portions of streets which are
cttrbecl, the maintenance, except
scow removal, shall extend from
curb to curb. That the mainten-
ance of such primary road exten-
sions shall include plowing the
snow from the full width of the
pavement or other surfacing, pro-
victecl that if the pavement or other
surfacing is more than thirty feet
in width, then the Highway Com-
mission will plow the snow fi'om a
traveled way only about thirty feet
in width.
4. That the maintenance of such
primary road extensions by the
Highway Commission shall not in-
clude
(a) The loading and hauling away
of snow which is plowed off to
the side of the traveled portion of
the roadway.
(b) The sprinkling of the streets.
(c) The sweeping of streets.
(d) The maintenance or repair of
any sewers, water pipes or oth-
er services under the traveled
surface of the roadway or any
costs incident thereto.
5. That this resolution and the
terms thereof shall become effec-
tive upon the approval and accep-
tance thereof by the Iowa State
Highway Conunission and shall be
in effect until July 1, 1949, except
that the resolution array be rescind-
ed by the city at the end of any fis-
cal year, ending July 1st.

Sec;. 2. That Paragraph 609, Sec. 3,
Rule 93, be amended by adding to
Rule 9.3, the following:

"The following shall be the law-
ful speed, except as hereiubefore
or hereinafter modified, and any
speed in excess thereof shall Ue
unlawful.
1. 20 miles per hour in anY
business or school dis-
trict.
2. 25 miles per hour in any
residential district.
3. 40 miles per hour for any
motor vehicle drawing an-
other vehicle.
4. 45 miles per hour in any
suburban district.
Sec. 3. That the following inter-
sections are stop intersections:
Fourth and Main Streets; Ninth and
Iowa Streets; Seventeenth and
Main Streets; and Third and Bluff
Streets. Stop signs are to he erected
nn the Northwest and Southeast cor-
ner of the intersection at Fourth and
Main Streets and vehicles traveling
North and South on Main Street into
Fourth Street shall stop. Stop signs
are to be erected on the Southwest
and Northeast corner of the inter-
section at Ninth and Iowa Streets
and vehicles travelling east and west
on Ninth Street into Iowa Street
shall stop. Stop signs shall be erected
on the Southwest and Northeast cor-
ner of Seventeenth and -Iain Streets.
Vehicles traveling cast and west on
Seventeenth Street into Main Street
shall stop. A stop sign shall be
erected at the Northeast corner of
Third and Bluff Streets. Vehicles
travelling west on Third Street into
Bluff Street shall stop. Every ve-
hicle entering a stop intersection shall
stop at the stop sign before entering
said inter section.
Sec. 4. All Ordinances or parts of
Ordinances in conflict herewith are
hereby repealed.
Sec. 5. Any person violating any
provision of this Ordinance shall he
deemed guilty of a misdemeanor
and, upon conviction, shall be pun-
ished by a fine of not to etceed One
Huuch•ed 14100.00) Dollars or by im-
prisonntenf fir not more than thirty
days.
