Council met at 7:30 P. M.
Present-Mayor Moffatt, Council-
men Murphy, Thompson, Van Duel-
man, Wharton, City Manager Rhom-
berg.
Mayor Moffatt stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may pro-
perly come before the meeting.
Notice of Claim of Chester
Nicholls in the amount of $1,500.00
for injuries sustained due to a de-
fective sidewalk on the west side-
walk at the corner of Twentieth
Street and Central Avenue, pre-
sented and read.
Councilman Van Duelman moved
that the Notice of Claim be referred
to the City Solicitor for investiga-
tion and report. Seconded by Coun-
cilman Wharton. Carried by the fol-

secution of the Civil Aeronautics
Administration project for develop-
ment of the Dubuque, Iowa, Airport,
Docket 904-13-9, was begun by award
of contracts dated June 26, 1944.
In accordance with Section 1 of
Resolution No. 16-44 adopted by
the City Council of Dubuque on
March 6, 1944, and subsequent sup-
plemental resolution, No. 17-44,
adopted March 16, 1944, said resolu-
tion is regarded as constituting an
effective agreement between the
City of Dubuque and the United
States.

have received Liability Policy No.
GL-87832 of the Massachusetts
Bonding and Insurance Company, in
connection with the War Chest Py-
lon erected at the center of the in-
tersection of 8th and Main Streets.
This policy covers bodily injury lia-
bility in tha amount of $25,000 for
each person and a $50,000 limit on
each accident. There is also in-
cluded in this policy an amount of
$5,000 property damage liability. An
endorsement has been attached to
this policy so that the City of Du-
buque is an additional insured under
same.

In re: Claim of Mrs. Louis J. Vogel.
Honorable Mayor and City Council,
Dubuque, Iowa.
Gentlemen: The claim of NIrs.
Vogel was filed herein on or about
February 21, 1944, and an Anxend-
ment filed on or about April 3, 1944,
claihxiug $750.00 damages for in-
juries sustained by her on a side-
walk covered with ice and snow in
front of the Louis Duggan property
at 517 Loral Blvd. She sustained
serious injuries, including a frac-
ture through the surgical neck of
the left humerus, with rotation of
the head of the bone with displace-
ment of the fragments, and other
injuries. She was compelled to wear
a cast for a long time. She has been
under the doctor's care ever since
said time and has incurred actual
expenses in the amount of $313.03.
From my investigation of the mat-
ter, I am of the opinion that there
is a liability, and that this claim
should be settled. After discussion
of the matter with her, they have
agreed to accept $275.00 in full set-
tlement.
I recommend that a warrant be
drawn payable to Mrs. Louis J.
Vogel in the sum of $275.00 and that
the same be delivered to her upon
delivery to the City of a proper
release.

the recommendation of City Solici-
tor I~intzinger be approved and,the
City Auditor instructed to draw a
warrant in the amount of $275.00 in
favor of Mrs. Louis J. Vogel, as set-
tlement in full of her claim, and
that said warrant be delivered upon
receipt by the City of Dubuque of
a properly executed release. Sec-
onded by Councilman Murphy. Car-
ried by the following vote:

Be It Resolved by the City Coun-
cil of the City of Dubuque that the

within said City and the Manager is
directed to issue such permit on be-
halY of said City.
