Council met at 7:30 P. M.

Mayor Murphy stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may prop-
erly come before the meeting.
Notice of Claim of Margaret Sad-
ler, in the amount of $2,000.00 for in-
juries sustained in a fall on a de-
fective iron grating on the north
side of Sixth Street, between Main
and Iowa Streets, in front of the
property located at 115 Sixth Streei,
presented and read.
Councilman Van Duelman moved
that the Notice of Claim be referred
to the City Solicitor for investiga-
tion and report. Seconded by Coun-
cilman D4offatt. Carried by the fol•

Mr. C. E. Rhoades addressed the
Council requesting that the storm
sewer which is constructed in his
yard be checked and repaired for
leaks and also that the manhole
built in connection with the storm
sewer and which is also located in
his yard be either lowered to meet
the grade of his yard or else that his
yard be filled to meet the grade of
the manhole.
Councilman Van Duelman moved
that the City Manager be instructed
to make an investigation of the
storm sewer problem existing in the
yard of Mr. C. E. Rhoades and to
submit a report of his findings back
to the City Council. Seconded by
Councilman Thompson. Carried by
the following vote:

Fighters' Assn., requesting that rule
number fifty-nine of the Civil Serv
ice Code be suspended for the dura•
tion of the war to enable the off
shift firemen to work on their off
day if they so wish and further re•
questing that the firemen be given
the same protection while at work
in essential war industries as they
would receive while working as a
fireman, presented and read.

Gentlemen: With reference to
the above claim submitted to me
for investigation and report, claim-
ing $31.00 for damages to an auto- I,
mobile caused by claimant while
driving north on Jackson Street on
or about February 20, 1943, where
he ran into an oil drum full of oil
in the street. No one seems to
know where the barrel came from.
There is nothing to show that the
City had any notice so that the bar-
rel could have been removed before
the accident.
I am of the opinion that this
claim should be denied and so
recommend.

following described real estate:
The Southeast quarter of the
Northwest quarter; the Southwest
quarter of the Northeast quarter;
the Northwest quarter of the South-
east quarter, and Lot 2 of the sub-
divison of the Southwest quarter of
the Southeast quarter, all in Sec-
tion twenty-seven (27), Township
88 North, Range 2 East of the 5th
P. M., Dubuque County, Iowa, and
to convey the same by warranty
deed in the usual form, free from
every lien for the sum of one hun-
dred thirty-five dollars ($135.00}
per acre, and
Whereas, by contract and agree-
ment, the said owners of the above
described property have agreed to
waive any and all rights they have
to rents and consent to immediate
possession by the purchaser there-
of, Now, Therefore,

Gentlemen: The committee ap-
pointed by your honorable bodies
with instructions to appraise the
recreation program in this city
hereby submits its findings and
recommendations.
We find the present recreation
program inadequate and not suffic-
iently organized to meet the needs
that are continually arising and in-
creasing on account of war condi-
tions. A summer Playground pro-
gratu of sufficient size and scope to
absorb the leisure time of the youth
of the city is an immediate neces-
sity.
It is our recommendation that the
City Council by ordinance create a
Playground and Recreation Com•
mission to take immediate action to
provide a program of recreation in
all its phases, using such facilities
as are or can be made available
through the city. We suggest a
commission of nine members con•
listing of: The Mayor, President of
the Board of Education, the Super•
~.ntendent of Public Schools, the
Superintendent of P a r o c h i a l
Schools, the City Manager, a mem•

ber of the Park Board as ex-officio
members, together with three citi•
zen members, at least two of whom
should be women. We further sug-
gest that the Commission select an
advisory council aE the executives
of all organizations that are work•
ing with youth in order to provide
a coordinating medium and to make
for broad planning in the youth
problem.
Because of the urgency of the
matter it is our recommendation at
this time that the summer play
grounds be expanded to embrace
not less than ten or more than fif•
teen Playgrounds to be operated for
a two-month period from mica-June
to mid-August on asix-day-a-week
basis from 10:30 A. M. to 8:30 P. M.
VVe estimate the probable cost oY
such playground set-up to be about
$12,000.00. Of the $16,000.00 fund
appropriated by the City, $6,000.00
can be used for this purpose by
some adjustments of the Racrea•
tion Budget without curtailing the
swimming pool, ice skating, base-
ball and other athletic activities.
To provide the additional funds we
?'ecommend that the City Council
petition the Board of Education for
the use of their facilities and the
appropriation of $6,000.00 from
school funds to meet this expanded
playground program.

Section 1. That there be and there
is hereby created a commission to
be kuotan as "Municipal Playground
and Recreation Commission," of
nine members consisting of the
Mayor, President of the Board of
Education, the Superintendent of
Public Schools, the Superintendent
of Parochial Schools, the City Man-
ager, one member of the Park Board
as the six ex-officio members, to-
gether with tln•ee citizen members,
at least two of whom shall be wo-
men, all of whom shall serve with-
out compensation. The members
of the commission shall be appoint-
ed by the City Council and their
term of office shall be for a period
of three years. When a vacancy
occurs on such conunission it shall
be filled by the City Council, but
such member thus appointed shall
be appointed to fill only the unex-
pired term of the member in whose
place he has been appointed. The
City Manager shall be a member
of such commission by virtue of
his office and he shall exercise ail
duties with reference to playground
and recreation facilities as are by
law imposed upon him.
Par. 960. Organization. Section
2. That, after such couunission has
been appointed it shall organize by
the election of a chairman, vice-
chairman and secretary and the
terms of office of such officers shall
be for one year following their
election but they shall continue to
hold office until their successors are
duly elected.

Whereas, The citizens of the City
of Dubuque are vitally interested in
the scientific and successful man-
agement of playground and recrea-
tional activities to be provided for
by the City Council of said city

activities of the city and shall Con-
trol the equipment, maintenance
and conduct of the same. It may
appoint a suitable superintendent
and all necessary assistants, fix
their term of employment, salaries
and duties, It may adopt such rules
and regulations for the conduct and
operation of recreation facilities as
it may deem advisable.
Par. 962. Co-operate With School
Board. Section 4. That in the oper-
ation, conduct and maintenance of
playground and recreation activi-
ties, the City Council shall co-oper-
ate with the Board of Education of
the Independent School District of
Dubuque, the Superintendent of
Schools and all public spirited citi-
zens interested in child welfare and
in the advancement of physical and
social conditions generally and, to
this end, it shall annually levy such
a tax upon the taxable property of
said city as it may deem necessary
to defray its share of the expense
incident to the carrying on of such
activities, but all taxes thus levied
or money appropriated shall be ex-
pended only upon warrants drawn
upon the City Treasurer.
Par. 963. Certification of Needs.
Section 5. That, on or before the
15th day of July in each year, the
connnission shall certify to the City
Council the amount of money it will
need for all purposes for the ensu-
ing fiscal year, which statement
shall be used to determine the tax
levy for recreational activities and
as a basis for making an appropri-
ation. If a tax be levied the same
shall not exceed in any one year
one-half mill on the dollar.
Par. 964. Report. Section 6. That,
on or before the 10th day of April
iu each year said commission shall
rnalie a complete detailed report to
the City Council showing receipts
and disbursements for the year then
ended, which report shall be kept
as a part of the permanent records
of the city.
Section 7. This ordinance shall
be in force and effect ten days from
and after its final passage and adop-
tion by the City Council and publica-
tion as provided by law.

of the war to enable the off-shift
firemen to work on their day off if
they so wisix. All rules and regula-

Commission can be repealed only
by that Commission. The Council

With reference to the question of
protection of the firemen working in
other industries; protection is
granted firemen by the State Statute
and the Legislature is the proper
body to amend the Act. The Councii

sires and is in a position to act in

If so, it will be necessary that a
resolution in the form of that en•
closed be adopted by the governing
body of the City of Dubuque and
that two certified copies thereof be
forwarded to this office. However,
you will note that such a resolution
should not be adopted until the
City of Dubuque has acquired all
necessary property interests. This
office will be glad to advise as to
what property, and what interests
therein, will be sufficient.
Furthermore, it will be necessary,
in connection with the proposed de-
velopinent, that the City expressly
agree under Sec. 2-A of the AP-4
Resolution to effect the vacation of
any roads, if such is necessary; to
be responsible for the removal, re•
location, or lowering of any neces•
sary pole lines, on m' off the prop-
erty; to remove any objectionable
obstructimis off the property; to re•
move all buildings or other items
of existent improvements of value
which the City desires to salvage;
to obtain easements or other prop•
erty rights for any necessary drain'
age outlet ditches; to obtain drain•
age rights from adjacent property
owners, where pertinent; and to
obtain approval of the respective
state body, if necessary, covering
any possible diversion of drainage,
or of crossing of highways with
drainage and constructing drainage
structures across same. If possible,
these responsibilities will be indi•
vidually called to the attention of
the sponsor before adoption of the
AP-4 resolution in order that spe•
cific agreement to them may be
made in the AP-4. If, however, an
AP-4 agreement is ready for adop•
tion before plans have progressed
to the point that determination may
be made as to what will be required,
adoption of the resolution should
proceed, inserting blanket agree•
went as indicated above.

nautics, with the approval of a
Board composed of the Secretaries
of ~~Tar, Navy, and Commerce, has
designated as necessary for national
defense a Project for development
of the Dubuque -Iunicipal Airport,
Docket ATO. 904-13-9, and has tenta•
tively allocated for this Project the
sum of $600,000. No construction is
to be undertaken until 1944. As now
Proposed, this project contemplates
the following development:
"Clear, grub, grade, drain, seed
and fence landing area; Pave N/S
and NW/SE runways 150' x 5600'
each; construct apron and neces-
sary 50' taxiways; and grade 1000'
safety strips at each end of each
runway."
As a condition precedent to re-
lease and operation of this Project.
the Administrator requires that it
be sponsored by a Public agency
having title in fee simple, free of
all liens, leases, easements, and oth•
er encumbrances, to the lauding
area of the airport and all lands to
be improved under the project, or
such lesser property interests as are
sufficient, in the opinion of the Ad•

resolution. If the City of Dubuque
has no legal officer, an attorney ',

certificate of the Chief Legal Officer

comprising the present landing area
of the airport, which sketch is also

resolution as part of Exhibit A.
This sketch should be to scale and
should show sufficient section lines,
property lines, monuments, natural
features, existing airport facilities,
proposed improvements, and other
information to permit identification
of the exact lands in question. If
possible, it should be letter size. It
is suggested that this office be con-
sulted as to the sufficiency of this
sketch prior to adoption of the
resolution.
If for any reason it is impossible
to adopt a resolution exactly in the
form of that enclosed, this office
should be consulted in an effort ~o
reach an agreement as to a revision
or modification which would be sat-
isfactory to the Administrator.

Gentlemen: With reference to
the claim of J. I~. Coleman of $14.50
for damages to the spring on his
automobile on or about May 11,
1943, from my investigation I find
that there was a hole in the street
on LangworthY Avenue, that he ran
into the same in the night time
and caused damage to his car. I
am of the opinion that this claim
should be allowed and I therefore
recommend that a warrant be
drawn payable to his order in the
sutra of $14.50 and the same be de•
livered to him upon delivery to the
City of a proper release.
