Council met at 7:55 p.m.

Rlayor Van Duelman stated that
this is the regular monthly meeting
of the City Council for the purpose
of acting upon such business as
may properly come before the meet-
ing.
Councilman Wharton moved that
the rules be snspeucled for the pur-
pose of allowing a.ny one present in
the Council Chamber, who wishes
to do so, to address the Council.
Seconded by Councilman Thomp-
son. Carried by the following vote:

Carl Riley addressed the Council in
support of the Red Cross Day to be
held on Tuesday, January 20th
1942. Miss Ruth Lar?rbert, chairman
of the Gray Ladies committee of
the Dubuque County Red Cross
chapter adclressecl the Council and
requested that the Mayor issue a
Praclamation designating Tuesday,
January 20th 1942 as Red Cross
Day.
Proclamation
ZVhereas, it is an indisputable
fact that every man, woman, and
child in Dubuque County is eager
to contribute whole-heartedly to the
welfare of the brave men who are
now serving in the Armed Forces
of the United States; and
Whereas, the relief and rehabili-
tation of civilians and non-combat-
ants resulting froth enemy attacks
are matters of major concern to all
Americans; and
Whereas, the fourth clause of
the Congressional Charter under
tivhich the American Red Cross op-
erates the organization iu time of
war "to act in matters of voluntary
relief anti in accord with the mili-
tary and naval authorities as a
medium of conununication between
the people of the United States of
America and their Army and
Navy.'
Now therefore be it resolved that
Tuesday, January 20, 1942, is of-
ficially proclaimed in the City of
Dubuque as Red Cross Day and
every Dubuquer is urged to contri-
bute as generously as possible in
order that the Dubuque County
Chapter of fire American Red Cross
map collect $20,000-its propor-
tionate share of the 50 million dol-
lars being raised in the nation for
the humanitarian and essential war-
time work of the organization.

tion was consiclerecl at a joint ses-
sion of the Planning and Zoning
Commission and City Council on

the Dubuque Planning and Zon-
ing' Commission respectfully reports
that jvhereas the said jnuk yard is
in a Heavy Industr°ial District, and,
whereas, the Zoning Ordinance of
D-abuque, Iowa, does not prohibit
innk yards in Heavy Industrial
Districts, therefore the Planning

it has no jurisdiction in the matter,

Referring to attached petition of
Joseph C. Canxxn, et a.l, requesting
the rezoning to Two Family Resi-
dence classification of the Single
Family area. bounded on the east
by the center line of Irving and
Avoca Streets, on the north by the
center line of Decorah and Cherry
Streets, on the west by the east
line of the local business district
at Asbury Street and University
Avenue, and on the south by the
north line of local business district
on University Avenue between As-
bury and Irving Streets, the Plan-
ning and Zoning Commission re-
spectfully recommends the denial
of the petition.
A check of the individual lot
areas in the district involved shows
that but three pieces of property
out of fourteen have the prescrib-
ed area for two family residences
even if the ordinance were chang-
ed. Such a change would therefore
require endless adjustments a.nd
concessions by the Board of Adjust-
ment before two family residences
might be constructed and this pro-
ce.cture would undermine or cir-
cumvent the fundamental objects
and principles of the Zoning Or-
dinance.

In the past number of years such
crossing protection has been install-
ed with Federal Funds. I ant in re-
ceip± of advice from the Iowa State
Highway Commission that in view
of recent developments with re-
spect to Federal requirements there
is no prospect of including this
project in an early program unless
it is vital to National Defense,
'We will keep this matter in mind
and at the first opportunity do all
we can to secure necessary funds
to make the desired installation.

the right that all sewers, drains
and water mains located upon or
within the vacated area shall con-
tinue to be the Property and under
the supervision and control of the
City of Dubuque, its officers and
employees, and in the event any
repairs or replacements become
necessary in or upon such sewers
and tivater mains or services be-
cause of any action or conduct upon
the Part of the occupant thereof,
now Swift and Company, its agents
or employees, such sewers and
water mains and services shall be
repaired or rebuilt at the expense
of said Swift and Company.
Section 2. That the Clerk be and
he is hereby directed to file in the
office of Recorder of Dubuque
County, a certified copy of this Or-
dinance.
Section 3. That this Ordinance,
being deemed urgent and in the in-
terest pf the public welfare, shall
be in force and effect inunediately
upon its final Passage, adoption and
approval b3' the City Council and

the rights hereunder shall accrue
to Swift and Company, its succes-
sors and assigns, when this Ordi-

expense of the railroad company,
and the company shall have no
claim for damages against the City
by reason thereof.
Section 4. That said railroad conr-
pauy shall keep the space between
the rails on said traclc anti the end

biles or other vehicles may easilg~
cross over the same, and that when
required by the City Council, said
railroad company shall planl~ be-
t~veen the rails anti make suitable
approaches to enable vehicles to

Section 5. Said track shall be so

to dam up or obstruct the flow of

railroad company shall at its own

Section 6. It is further expressly
stipulated and provided that all rail-
road companies now operating
tracks in the city shall be entitled
at any time to have their cars trans-
ferred over said tracks, and all in-
termediate tracks of said company,
its successors and assigns, which
may be necessary to be used in
order to connect with the track here-
by authorized upon the payment of
such switching charges which may

and accepted as reasonable between
railroad companies operating within
the city.
Section 7. This Ordinance being
deemed urgent and of immediate
necessity, shall become effective up-
on its passage, adoption and ap-
proval by the City Council and pub-
lication as provided by law and the
rights herein granted shall accrue
to said railroad company when this
Ordinance has been accepted by
said railroad company, which ac-
ceptance shall be endorsed theron,
and when the costs a,nd expense of
publishing same have been paid by
said railroad company and when the
injuries and damage to property
abutting upon said streets have
been ascertained and compensated
for, or in lieu thereof, when the rec-
ord owners of such property and rec-
ord holders of liens and encumb-
rances thereon have filed with this
Council their consent to the con-
struction and operation of such
track and waivers and releases of
any damages which may be sustain-
ed by them on account of the con-
struction and operation of the same.
