Mayor Wharton stated that this is
the regular monthly meeting of the
City Comicil for the purpose of act-
ing upon such business as may pro-
perly come before the meeting.
Proof of publication, certified to
by the publishers, of notice of a
public hearing upon a proposal to
amend and change the Zoning Map
and Zoning Ordinance by changing
from a "Two Family Residence Dis-
trict" to a "Light Industrial Dis-
trict" the area embraced within
Lots 247, 248, 249, 250, 251, 252, 253,
254, 255, 25G, 257 and 258, all in
Glendale Addition No. 3, presented
and read. No written objections
filed and no objectors present in
the Council Chamber.

change to "Light Industrial Dis-
trict" certain defined territory now
being delimited as "Two Family
Residence District," presented and
read.

Residents and property owners of
Gandolfo Street addressed the
Council making inquiry as to the
improving of said street, and also
residents and property owners of
St. Joseph Street addressed the
Council requesting' that action be
taken iu the matter of taking care
of the storm water on said street.
Councilman Schueller moved that
the matter of the improving of Gan-
dolfo Street and the matter of tak-
ing care of the storm water on said
street and the alley between Gan-
dolfo Street and South Algona
Street from St. Joseph Street to
Dodge Street be referred to the
Council to view the grounds. Sec-
onded by Councilman Van Duelman.

Dubuque, Iowa.
Gentlemen: At the session of the
City Council held May 4, 1942, the
communications of Mary L. Lee Ex.
and of Mary A. Lee Estate, by
James F. Lee, entering complaints
concerning the West Locust Street
Sanitary Sewer, was referred to the
City Manager with instructions to
make a thorough investigation of
the complaints and to submit a re-
port to the City Council at the next
regular meeting.
The conditions complained of have
been thoroughly investigated by
City fm•ces as well as by the State
Department of Health. Attached is
the report and recommendations of
A. L. Bennett, Public Health Engi-
neer.
The sanitary sewer has since
been thoroughly cleaned, the over-
flow connections from the storm
sewer have been permanently closed
and the other recommendations of
the State Health Department have
been complied with. Reasonable
care and regular maintenance of
this sewer should prevent any fur-
ther trouble.

City Auditor instructed to draw a
warrant in the amount of $69.49 on
the Improvement Fund to cover the

To the Honorable Mayor and City
Council of the City of Dubuque:
Gentlemen:
On September 24, 1920, the City
of Dubuque attempted to convey
Lot 1 of the Subdivision of Lot 7
in Smyth's Subdivision to the City
of Dubuque, according to the re-
corded plats thereof, the Sinope In-
vestment Corporation, for the con-
sideration of $650A0, and w h i c h
deed was filed October 5, 1920, and
recorded in Blc. 87, T. L. page 363,
records of Dubuque County, Iowa.
This deed was signed by the then
Mayor of the City of Dubuque and
the then Manager thereof. It was
defectively acknowledged, and the
Notary attempting to take the ac-
knowledgment was then also acting
as City Clerk, and the deed fails to
show a seal attached.
Under the provisions of Ordin-
ance 81 of the Revised Ordinances of
1919, deeds executed iu behalf of
the City must be signed by the
Mayor or Mayor pro tem, and at-
tested by the Recorder. This Or-
dinance was amended by Ordinance
No. 19 of the Ordinance of the year
1939, substituting the words "City
Clerk" for the word "Recorder."
Inasmuch as the City of Dubuque
', received full value for said prop-
, erty, and the failure to execute and
deliver proper deed to the then pur-
chaser seas a mere inadvertence and
clerical error, your petitioner re-
spectfully prays that your honor-
able hotly take proper action in the
adoption of a Resolution directing

Be It Resolved by the City Council
of the City of Dubuque, Iowa:
Whereas, it appears from a peti-
tion filed herein by L. A. Watch
that a deed was executed by the
City of Dubuque to Sinope Invest-
ment Corporation under date Sep-
tember 24, 1920, filed October 5,
1920, and recorded au Bk. 87, T. L.
page 3G3 of the records of Dubuque
County, Iowa, and that through in-
advertence and mistake said deed
was signed by the then Mayor and
by O. E. Carr, City Manager, and
that said deed should have been
executed by the Mayor and by the
then City Recorder, and it further
appears that the seal of the City
rues omitted from the said deed, all
as required by the provisions of
Ordinance 81 of the Revised Ordin-
ances of 1919 of said City, and
Whereas, it further appears that
the consideration paid for said
transfer was $650.00 and represent-
ed the then full value of the prop-
erty conveyed, and being Lot 1 of
the Subdivision of Lot 7 in Smyth's
Subdivision to the City of Dubuque,
according to the recorded plat
thereof; and, whereas, it now ap-
pears that the present owner of said
property, for the purpose of correc-
tion of title, deems it necessary and
aclvisa~le that a correction deed be
had from the City of Dubuque, Iowa,
to said owner, and it further ap-
pears that Possession of said prop-
erty has been had continuously
since the execution of said deed in
the then grantee and his successor
grantees, and that the City of Du-
buque has no further interests,
claims, or demands in relation to
said property or the use thereof,
and that actimi to quiet title would
probably result in the establish
went of title in the present owner,
but which action would involve ex-
pense and delay, and would not be
beneficial to said City.
Therefore, Be It Resolved, that
the Mayor of the City of Dubuque,
Iowa, be, and he is hereby author-
ized and directed to execute and de-
liver correction deed in form sub-
witted to this Council, and said
deed to be attested by the City
Clerk of the City of Dubuque, Iowa,
and to have the seal of the City
thereto affixed, conveying to L. A.
Watch the hereinbefore described
property, and that said deed be de-
livered to the said L. A. Watch.

The undersigned, Mona Walker,
has been until recently the owner
of the Northerly 32 feet of the West-
erly 45 feet of Lot 47 and the South
Half of vacated alley immediately
North of and adjoining said prop-
erty in Julia L. Langworthy's Addi-
tion in the City of Dubuque, Iowa.
That she sold the same two weeks
ago to Sherman T. Mayne and
Catharine Mayne, husband and wife
as joint tenants with right of sur-
vivorship and not as tenants in com-
mon, and objection has been made
to the title with respect to fhe
South Half of vacated alley imme-
diately North of and adjoining said
property. The reason for said ob-
jection is that said alley was va-
cated by the City of Dubuque in
1914, the ordinance providing, "and
the same is hereby vacated and an-
nulled and the permanent use of the
respective portions thereof adjoin-
ing the various lots abutting there-
on is hereby granted to the owners
and proprietors of said lots as con-
templated by statute in such cases."
However, no deed to the same by
the City of Dubuque by quit claim
or otherwise has ever been issued
to the owner of the real estate im-
mediately abutting thereon, and to
perfect the title at this time there-
fore, your Honorable Body is re-
spectfully petitioned to execute,
pursuant to said ordinance, a quit
claim deed to Sherman T. iVIayne

Gentlemen: At the session of the
City Council held May 4, 1942, the
petition of Mr. and 11Irs. George
Pleimling et al, requestiug the City
Council to cause the removal of the
several piles of old lumber from the
lot acljoiuiug the rear of 710 Merz
Street was referred to the City
Manager for investigation and re-
port.
I have investigated and find that
there were three piles of used di-
mension lumber belonging to An-
drew Fuerst piled on Lot 2 of 6 of
5 of Stafford's Add. which is owned
by Mrs. Margaret Fuerst. Two of
these piles have since been hauled
away. Mr. Fuerst has agreed to re•
move the remaining lumber during
his vacation in the near future.

City Council held May 4, 1942, the
petition of Mary M. Fuchs et al. re-
questing the curliing and guttering
of Lombard Avenue from the inter-
section of Fremont Avenue to the
enci of the Washington Junior High
School property was referred to the
Council to view the grounds.
The Council viewed the site on
May 26th and deeiclecl to order a
plat and schedule prepared and sug-
gested that because of the small
size of the job the Manager find out
it the work could not be financed
by the three property owners with-
out the levy of special assessment.

thereof in conflict herewith.
Be It Ordained by the City Council
of the City of Dubuque:
Section 1. That Section 1 of Ordi-
nance No, 10-40 is hereby amended
by striking out all of Section 1 in
said Ordinance and Uy inserting in
lieu thereof, the following:
"Section 1. Every person ~vho
owns and%or operates a bicycle
within the limits of the City of Du-
buque, Iowa, shall, during the month
of July of each year, commencing
with July, 1942, cause the ownership
thereoY to be registered at the of-
fice of the Chief of Police of said
City. Upon such registration tiie
Chief of Police shall issue to such
person a registration tag, plate or
other means of identification. Said
registration plate shall at all times
Ue securely fastened to the bicycle
fm' which it is issued so that the
said plate shall Ue readable at a
distance of at least seventy-five (75)
feet from the rear thez'eof. That
there shall be paid to the Chief of
Police for said tag or plate when
issued, twenty-five cents (25c)."
Section 2. That Section 4 of Ordi-
nance No. 10-40 shall be amended
by striping therefrom "ten cents
(10c)" and Uy inserting in lieu
thereof, "twenty-five cents (25c)."
Section 3. That any anti all Ordi-
nances, or Parts thereof, in conflict
herewith are herel3y repealed.
Section 4. This Ordinance shall
be in force and effect from and af-
ter its final passage, acloPtion and
approval by the City Council, and
publication as by law provided.

That stop signs be erected at 9th
and Iowa Streets to govern east and
west traffic.
That at the intersection of Loras
and University Avenue the stop
sign Ue changed to slop west bound
trafhc on Loras Boulevard.
At Asbury and University a slow
sign is suggested, and if a stop sign
were used it should Ue erected to
stop east Uound traffic on Univer-
sity. In spite of complaints of near
accidents on this location, none
have occurred.
Since the changing of Uus routes
it is suggested that East 14th Street
from Central Avenue to Elm be
made a boulevard, and thence Elm
Street from East 14th to East 20th
Streets Ue also designated a Uoule-
vard.
The results of traffic checks are
attached for your study.

Resolution and application for au-
thority to levy an emergency tax
for the City of Dubuque.
Whereas, the City Council of the
City of Dubuque has made a com-
pilation of the expenses which will
be incurred during the fiscal year
beginning April 1, 1943 and ending
March 31, 1944 including the pay-
ment of principal and interest up-
on outstanding inciebteclness, and
tax levies for the various funds and
purposes have been determined,
and
Whereas, A serious effort has
been matte to beep operating costs
as low as is consistent with good
government; and
Whereas, Iu the past bonds have
been issued in anticipation of some
of the taxes embraced in the con-
solidated tax levy and the revenues
derived from such taxes are pledged
to the payment of such hoods, as
to principal and interest; and
ZVhereas, Payment of $65,000.00
in principal, and of $8,900.00 in
interest are to be made during the
fiscal year beginning April 1, 1943
and ending March 31, 1944 from the
funds embraced in the consolidated
tax levy; and
Whereas, The inadequacy of the
revenues for ordinary purposes re-
maining after the payment of such
principal and interest constitutes an
emergency which requires the levy
of an emergency tax and this Coun-
cil considers the levy of an emer-
gency tax of five-eighths (5/$) mill
to be absolutely necessary:
Now, Therefore, Be It Resolved
by the City Council of the City of
Dubuque, that the State Comptrol-
ler be and he is hereby requested
to authorize and approve the levy
of an emergency tax of five-eighths
mill in the year 1942 to be approxi-
mately $22,215.00, the same to be
used in supplementing the funds re-
quired for debt service and in the
manner provided by law.
The foregoing resolution was
adopted at a special meeting of the
City Council of the City of Du-
buque on the 30th day of June,
1942.
