Meeting called by order of Coun-
cilmen Thompson and Mux•phy.
Mayor Wharton read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of discussing
The Airport Situation and acting on
any other business as may proper-
ly come before a regular meeting
of the City Council.
Councilman Van Duelman moved
that the rules be suspended for the
purpose of allowing any one present
in the Council Chanxber, who wishes
to do so, to address the Council.
Seconded by Councilman Thompson.

Mr. John A. Kerper, Secretary of
the Chamber of Commerce and
members of the Airport Committee
of the Chamber of Commerce, ad-
dressed the Council asking that the
City of Dubuque sponsor a W.P.A.
Project for the construction of an
airport to be located about eight
miles south of the City between
Highways Nos. 61 and 151. After a
lengthy discussion on the Airport
Project. Councilman Thompson
moved that the matter pertaining
to the construction of an Airport be
referred to the Cit3* Council for
their consideration and that the City
Solicitor be instructed to advise
Council of the necessary legal pro-
cedure. Seconded by Councilman
Van Duelman. Carried by the fol-
lowing vote:

Notice of Claim of Joseph P. Link
in the amount of $19.00 for injuries
sustained as the result of a fall on
account of a defective catch-basin
cover at the N. E. corner of Rush
and 13olly Streets presented and
read.
Councilman Van Dueiman moved
that the notice of claim be referred
to the City Solicitor for investiga-
tion and report. Seconded by Coun-
cilman Murphy. Carried by the fol-
lowing vote:

mitted a verbal recommendation

that the recommendation of City
Solicitor Kintzinger be approved
aucl that the City Auditor be in-
structed to draw a warrant in the
amount of $19.00 in favor of Joseph
P. Link as settlement in full of his
claim and that said warrant be de-
livered upon the receipt of a proper

missioner and Health Department
be instructed to cause an investiga-
tion to be made of this barn and to
submit a report of their findings for

Union, No. 228, requesting that they
be allowed time axid one-half for all
overtime worked over eight hours

the event an employee is called and
reports on any of the above men-
tioned days or evenings said em-
ployee is not to receive credit for
less than two hours, presented and
read.

and prescribing the conditions of
such permit
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF DU-
Bi7C,lUE:
Section 1. That Eag9es Building
Association, its successors and as-
signs, be, and it is hereby granted
the right and permission to construct
and maintain a loading platform in
the altey between Hain and Locust
Streets between 5th and 6th Streets
next adjoining its building on the
corner of 6tH and Locust Streets,
said platform to extend in the alley
not to exceed three (3) feet.
Section 2. That such loading plat-
form shall be constructed tinder the

supervision of the City 1\Ianager and
L-'uildiug Commissioner.
Section 3. It is understood and
provided that the right and permis-
sion to use and occupy such por-
tion of the alley for the purpose
herein stated is subject to the con-
tinuous control of the City Council
of this City, reserving the right to
said Council to impose restrictions
or conditions upon the enjoyment
thereof as may be reasonably neces-
sary for the protection of the pub-
lic interest, including the right to
revoke and rescind such right and
permission if at any time the pub-
lic should require such revocation.
Section 4. Asa further considera-
tion for the right and privilege here-
in granted, said Eagles Building
Association, its successors and as-
signs, shall assume all liability for
damages to persons and/or prop-
erty which might result from the
construction or maintenance of said
structure and said Eagles Building
Association, at its own expense,
agrees to defend ary and all claims
and actions which may be brougYt
against the City because of or ixa
connection with the structure herein
referred to, and should the City be
required to pay any amount for dam-
ages because of said structure, or
anything connected therewith, the
Eagles Building Association agrees
to reimburse the City therefor, and
hold the City harmless from anY
such damages
Section 5. Should the rights and
privileges herein granted be re-
scinded or revoked, said Eagles
Building Association, its successors
and assigns, .~t its own expense and
upon receipt of Thirty (30) days no-
tice, shall remove the structure
herein authorized and restore the
alley to as good condition as it was
before such structure was con-
structed.
Section G. This Ordinance shall
become effective upon its final
passage adoption and approval by
the City Council, publication as pro-
vided by law, and `lte rights here-
under shall accrue to Eagles Build-
ing Association, its successors and
assigns, when this Ordinance has
been accepted by said Association,
which acceptance shall be attached
hereto, and whe-, the cost of pub-
lishing the same has been paid by
said Association.

Gentlemen: Conservation of fuel
and physical property are important
parts of the total war effort. To fur-
thel° these ends it is necessary to
caulk the exterior window and door
frames of the City Hall and to paint
the exterior wood work. Bids for
furnishing the materials and per-
forming the work were solicited
from all the painting contractors.
Attached are the specifications
for the work together with the four
bids which were received. I recom-
mend that the contract in the
amount of X725.00 for caulking and
painting the exterior wood of the=
City Hal.[, exceptimg the cornice. be
awarded to J. O. Martin, his being
the lowest and best bid received.

The foregoing are proper persons
so to act in accordance with Sec-
tion 730, et seq. of Chapter 40, Code
of Iowa. Upon the closing of the
polls for said special election, said
Judges and Clerks shall file reports
of the results on said proposition
with the City Clerlc, in order that
such results may be canvassed and
officially declared by this Council.
Sectiou 6. That the City Clerk,
as Commissioner of Registration, is
hereby directed to revise and com-
plete the election registers as pro-
vided by Chapter 39.1 of the Code
of Iowa, and to deliver said elec-
tion registers as required by law to
the Judges of Election in each elec-
tion precinct on the day before the
day set for said special election.
Section 7. That this Council meet
on the next (secular) clay following
the day of said election, at the
Council Chamber of the City Hall
within said City, at 7:30 o'clock P.
M., to canvass the results of said
election.
Section 8. That all resolutions or
parts of resolutions in conflict here-
with be and the same are hereby
repealed.
Section 9. That this resolution be
in force and effect immediately up-
oxx its passage and approval.

Whereas, the Board of Dock
Commissioners is informed that
there is a possibility of having a
synthetic rubber manufacturing
plant established at Dubuque, pro-
vided the muncipality will furnish
to the Federal Government, free of
cost, the required site.
Whereas, from information at
hand it appears that the area known
as the old Standard Lumber Com-
pany property, now owned by the
City, is considered a suitable site
for the plant which the Govern-
ment, through the appropriate agen-
cy, proposes to build.
Whereas, the acquisition of such
an industry is of the greatest im-
portance to the future welfare of
this community and the fullest
cooperation with the Federal Gov-
ernment and the firm of Archer,
Daniels, Midland Company of Min-
neapolis is justified.
Now Therefm•e, inasmuch as the
property in question is under the
jurisdiction of the Board of Dock
Commissioners, this Board re-
spectfully recommends that the
City Council take appropriate steps
to traxxsfer title to this property to
the Federal Government for the
sum of $1.00, however, reserving to
the City the area ou which is lo-
cated the Old Shot Tower (approxi-
mately .46 acres) and the easterly
end of tlae same tract (approximate-
ly .68 acres).
It is further understood that the
city's or Dock Commission's right
to assess and collect wharfage fees
shall not be impaired by this trans-
fer of title.

Whereas, the Board of Dock
Commissioners has filed with 'the
City Council of the City of Dubuque
a resolution recommending that the
City Council take appropriate steps
to give to the Federal Government
an option to buy from the City for
$1.00, the real property known as
the Standard Lumber Company site
for the operation of a synthetic rub-
ber manufacturing plant thereon.
And Whereas, the City Council
has considered the resolution of
the Board of Dock Conuuissioners
of the City of Dubuque, Now, There-
fore,
Be it Resolved by the City Council
of the City of Dubuque:
That the Mayor of the City of
Dubuque be, and he is hereby au-
thorized and empowered to sign a
written statement to the Federal
Government stating that the City
of Dubuque is prepared and willing
to supply the site known as the
Standard Lumber Company proper=
ty, reserving to the City of Dubuque
the area on which is located the
Old Shot Tower (approximately .46
acres) and the easterly end of the
same tract (approximately .G3
acres) and reserving the city's or
Dock Commission's right to assess
and collect wharfage fees; this site
