Mayor Van Duelman stated that this
is the regular monthly meeting of the
City Council for the purpose of acting
upon such business as may properly
come before the meeting.
Petition of the City of Dubuque
Bridge Commission requesting the City
Council, pursuant to authority reserv-
ed in Franchise Ordinance granted by
the City of Dubuque, Iowa, to order,
direct and request the said Interstate
Power Company to remove and relo-
cate its lines, wires, poles, guy lines,
guy wires, guy poles, stay lines, stay
poles and all other lines, wires, poles
and equipment appurtenant thereto on
Dodge Street from Locust Street east
to the Mississippi River, not including
at this time, however, the transmission
high line near the intersection of
Dodge and Terminal Streets, as is
necessary to clear the way for the
construction of the proposed bridge
between the cities of Dubuque, Iowa,
and fast Dubuque, Illinois, to be built
by the City of Dubuque Bridge Com-
mission according to General Plan and
elevation Sheet No. 1 prepared by
Howard, Needles, Tamen & Burgen-
doff, engineers of the City of Dubuque
Bridge Commission, copy of which is
now on file in the office of the City
Clerk and the City Manager of the
City of Dubuque, Iowa, presented and
read. Councilman Wharton moved
that the rules be suspended for the
purpose of allowing any one present
in the Council Chamber, who wishes
to do so, to address the Council. Mr.
Charles Landon, Chairman of the City
of Dubuque Bridge Commission, ad-
dressed the Council in support of the
petition and requested that the Coun-
cil give the petition their early atten-
tion and action. Councilman Wharton
moved that the petition be referred to
the City Solicitor for investigation and
report. Seconded by Councilman
Schueller. Carried by the following

dering, directing and requesting the In-
terstate Power Company to remove and

for Bridge and Approach across and
along certain Streets, Alleys, Levee
and Public Property in the City of
Dubuque, Iowa, including the right to
obstruct passage at certain Street In-
tersections and the right to cross oth-
er Streets, Alleys, Levee, Dock, Dock
Property and other Public Prop-
erty, and the granting of per-
mission to build a highway
Bridge and an Approach thereon
and the right to place all necessary
piers, footings, pilings, and other struc-
tures necessary therefor in the Streets,
Alleys, Levee, Dock and Dock Board
Property, and providing for change of
grade on Dodge and Locust Streets
near the Intersection of said streets in
the City of Dubuque, Iowa, and grant-
ing the City of Dubuque Bridge Com-
mission, its Agents, ]mployees and
Contractors the right to use Dodge
Street during construction of said
Bridge and its Westerly Approach for

Petition of J. V. Keppler requesting
that the application of Ferd Nesler for

abutting property presented and read.

I herewith return to you the Appli-
cation of Thomas T. Kohl for suspen-
sion of taxes for the year 1940 on
Lots 33-34, A. Stines Addition to
the City of Dubuque.
The application shows that the peti-
tioner is purchasing this property un-
der contract from the Anchor In. Co.
It appears that the Anchor In, Co. is
the owner of this property and not the
petitioner. In this case, I am of the
opinion, that the petitioner, not being
the owner of the property, that the pe-
tition should not be approved, and
thtat the Board of Supervisors should
be notified of the action of the Council.

Gentlemen:
At the session of the City Council
held April 29th, 1941, the petition of
the American Legion Drum and Bugle
Corps requesting permission to use the
Municipal Athletic Field on each Fri-
day evening from May 2nd through
the mouth of August for the purpose
of holding drills was referred to the
City Manager and Recreation Direc-
tor to make arrangements for the hold-
ing of such drills.
The scheduling of baseball is now
completed, and we find that Friday
evening is available. ~Ve, therefore,
recommend that the petition be grant-
ed, with the proviso that should any
major civic event require the use of
the field at such tithe that the drill be
postponed.

held April 29th, 1941, the petition of
t:.e Perfection Oil Company request-
ing permission to place gasoline tanks
under the sidewalk at West Third and
Locust Streets was referred to the
City Manager for investigation and
report.
The Building Commissioner and I
have investigated the matter, and dis-
cussed the situation with the petition-
ers. `The Perfection Oil Company has
concluded to place the gasoline stor-
age tanks on their own property be-
cause of the hazards that would Ue in-
volved in filling them from tank trucks
from the street. I, therefore, recom-
mend that their petition be received
and filed.

pavement is badly worn and broken
and, in my opinion, should be recon-

Street.

CITY COUNCIL, OF THE CITY
OF DUBUQUE:
1. That the lVtayor and City Clerk
of the City of Dubuque, be, and they
are hereby authorized and empowered
to execute for and on behalf of the
City of Dubuque, a contract with the
National Youth Administration giving
to said National Youth Administration,
the use of
Lots No. 9, 10 and 11 of Industrial
Subdivision No. 2, City of Du-
buque, Iowa,
for a period of 25 years, said use to be
for the purpose of carrying out their
program; said National Youth Admin-
istration further to have the privilege
of placing thereon buildings and im-
provements. Said contract is to fur-
ther provide that at any time the Na-
tional Youth Administration program
is discontinued, this contract is to be
null and void, and to be of no force
and effect, at which time, the National
Youth Administration is to remove
from said property any and all build-
ings and/or improvements thereon
within ninety (90) days from the dis-
continuance of the National Youth Ad-
ministration program.
Within ninety (90) days after the
termination of the 25 year period the
National Youth Administration is to
remove from said property any and
all buildings and improvements there-
on.
If the buildings or improvements on
said real estate is abandoned, or is fail-
ed to be used for IQ.Y.A. Purposes for
a period of six months, then this con-
tract is to be null and void and no
longer of any force or effect.
2. In the event said buildings and/or
improvements placed thereon, or any
part thereof, are not removed within
a period of ninety (90) days after this
contract is no longer m force and ef-
fect, then and in that event, and all
of the buildings and/or improvements
on said real estate are to become the
absolute property of the City of Du-
buque, Iowa. '?'he authorization and
execution of a contract hereunder by
the City is the only contribution to be
given to this program by the city.

on the proposition of issuing bonds
to the amount of $120,000 for city
hall purposes.
Whereas, It appears expedient and
to the best interests of the City of Du-
buque, Iowa, that a city hall be pur-
chased and remodeled in and for said
City as provided by Chapter 319 of
the Code of Iowa, as amended; and
Whereas, It is estimated that the
purchase and remodeling of a city hall
will necessitate the expenditure of
$120,000, for which purpose it will be
necessary to borrow money and issue
bonds of said City; and
Whereas, Before a city hall can be
purchased and remodeled and before
money can be borrowed or bonds of
said City can be issued to cover the
expense thereof, the question must be
lireseuted to the qualified voters of
the City for their approval:
Now, Therefore, Be It Resolved by
the City Council of the City of Du-
buque, Iowa, as follows:
Section 1. That a special election
is hereby called and ordered to be
held in and for the City of Dubuque,
Iowa, on June 9th, 19-11, at which
there shall be submitted to the voters
of said City the proposition of purchas-
ing and remodeling a city hall, as pro-
aided in Chapter 319 of the Code of
Iowa, as amended, and issuing bonds
in the sum of $120,000 to cover the
expense of the same. For said elec-
tion the City shall be divided into fif-
teen election precincts, the boundaries
of which shall be as delimited by Or-
dinance Number 159 of said City. Tile
polls shall be kept open iron seven
o'clock in the morning until eight
o'clock in the evening and the polling
places within the respective election

of Dubuque, Iowa, and of general cir-
culation therein, said newspapers be-
ing the official newspapers of said City.
Such notice shall be published in said
newspapers once each week for three
consecutive weeks, and the last of such
publications shall not be less than five
nor more than twenty days before the
elate fixed for said election. Such no-
tice shall be in substantially the fol-

Mayor Van Duelman read the call
and stated that service thereof had been
duly made and that this meeting is
called for the purpose of considertng
for adoption Resolution hTo. 46-41. A
resolution authorizing and empower-
ing the Mayor and City to execute for
and on behalf of the City of Dubuque,
a contract with the National Youth
Administration giving to the said Na-
tional Youth Administration the use
of hots No. 9, 10, and 11 of Industrial
Subdivision No. 2, and acting on an}*
other business as may properly come
before a regular meeting of the City
Council.

previous action taken by the City Coun-
cil at its Adjourned Regular meeting
of May 13th, 1941, in which Resolu-
tion No. 44-41 was adopted, be res-

\~'hereas, The National Youth Ad-
ministration of the Federal Govern-
ment is carrying out a certain program
and requests the use of certain real es-
tate owned by the City of Dubuque,
said real estate being described as:
Lots I`TO. 9, 10 and 11 of Industrial
Subdivision No. 2, City of Dubuque,
Iowa; and
ZVhereas, The City of Dubttque,
IO~ya, is the owner of said real estate;
and
Whereas, the said National Youth
Administration desires to use said
property in the furtherance of their
program and desires to place buildings
and improvements thereon; and
Whereas, It is deemed advisable by
the City of Dubuque that the said Na-
tional Youth Administration should be
permitted to use said real estate and
to place improvements thereon for use
in their program for a period of 25
years;
Now, Therefore, Be It Resolved By
The City Council of the City of Du-
buque:
1. That the 1\layor and City Clerk
of the City of Dubuque, be, and they
are hereby authorized and empowered
to execute for and on behalf of the
City of Dubuque, a contract with the
National Youth Administration giving
to the said National Youth Administra-
tion, the use of Lots No. 9, 10 and 11
of Industrial Subdivision No. 2, City of
Dubuque, Iowa, for a period of 25
years, said use to be for all purposes
connected with and related to the Na-
tional Yottth program, including the
right to erect upon said reap estate all
necessary buildings and to install all
necessary machinery and equipment
essential to the carrying out of said
program; the title to all buildings
erected upott said real estate and all
machinery and equipment installed shall
be and remain in the Federal Govern_
ment with full right and authority
vested in the Federal Government to
remove the same from said real es-
tate.
It is further understood and agreed
that the rights granted hereitt shall ex-
tend to any other Federal Agency en-
gaged in a program similar to the pro-
gram of the National Youth Adminis-
tration, if the purpose and program of
said substituted agency is practically
the same as the program of the Na-
tional Youtit Administration.
It is further provided that if the Na-
tional Youth Administration be discon-
tinued and no other Federal Agency
of like purpose or program be substi-
tuted therefor, or if the program of the
National I'outh Administration, or
other agencies be abandoned in the
City of Dubuque and no further use
of said buildings, machinery and equip-
ment is necessary for the carrying on
of said program, then this resolution
and contract and all rights granted
thereby shall be terminated. If, for
either of said reasons this contract is
terminated, the National Youth Admin-
istration or the authorized agency of
the Federal Government having the
authority to remove and/or dispose of
said buildings, machinery and equip-
ment, shall remove or dispose of the
same within a reasonable time and re-
store to the City of Dubuque this real
estate.
