Mayon Van Duelman stated that this
is the regular monthly meeting of the
City Council for the purpose of acting
upon such business as may properly
come before the meeting.

Gentlemen-I hereby certify that the
work of constructing a six-inch vitri-
fied the sanitary sewer in Plum Street
frotn the manhole in Rttsh Street two
hundred and eighty feet northerly un-
der the contract bearing date of October
14, 1941, by and between James F. I,ee
and the City of Dubuque, has been
completed according to the terms, con-
ditions and stipulations of said contract,
and in every way complies with the
same and with the plans and specifica-
tions for said improvement.
I further certify that said improve-
ment as constructed embraces the fol-
lowing materials and work:
280 lineal feet of 6" vitrified the

Resolution No. 150-41. A resolution
accepting the improvement for the con-
struction of a six (6) inch vitrified the

tion to levy special assessments as re-
quired by lacy presented and read.

Gentlemen-With reference to the
Resurfacing of pavement on West
Third Street from Burch Street to Al-
pine Street, Dubuque, Iowa, we have
inspected the materials and mixtures
used in this resurfacing work and wit-
nessed its construction during its prog-
ress from November 8th to November
14th, 1941.
Our control tests showed no serious
deviations from the specifications and
corrections were made promptly wher-
ever possible. The workmanship was
skilfully performed. We therefore re-
gard this work as done within substan-
tial compliance with the specifications
therefor.

Resolution and Application for Perma-
atent Transfer of Funds.
\Vhereas, An emergency tax levy
was trade by the City Council of the
City of Dubuque for use in supple-
menting the fund required for debt ser-
vice during the fiscal year beginning
April 1, 1941, and ending March 31,
1942, upon authority and approval of
the State Comptroller; and
Whereas, as of the 1st of November,
1941, there were cash balances in the
Grading Fuud of $4,707.43 and in the
Improvement Fund of $10,703.74; and
Whereas, There is now in the hands
of the City Treasurer and credited to
the Emergency Fund the sum of $23,-
580.62, which is available for transfer
to the Grading and Improvement
Funds above referred to for debt ser-
vice; and
Whereas, On i\Tovember 1, 1941,
Grading Bonds in the amount of $10,-
000.00 and Improvement Bonds in the
amount of $30,000.00 matured and
Grading Bond Interest in the amount
of $1,800.00 plus Improvement Bond
Interest in the amount of $3,487.50 be-
came clue and payable; and
Whereas, In order to pay the obliga-
tions due it is necessary to make trans-
fers of $10,000.00 from the Emergency
Fund to the Grading Fund and of $13,-
487.50 from the Emergency Fund to
the Improvement Fund; and
Whereas, Before any transfer can he
made from the Emergency Fund to
any other fund, an application must be
made to the State Comptroller for au-
thority to make the transfer and his
approval secured thereon; Now, There-
fore, Be It
Resolved, By the City Comtcil of the
City of Dubuque, that subject to the
approval of the State Comptroller,
there he and there are hereby trans-
ferred from the Emergency Fund the
sum of $1Q000AO to the Grading Fuud
and the sum of $13,487.50 to the Im-
provement Fund, and the State Comp-
troller is hereby petitioned to authorize
and approve such transfers; and Be It
Further
Resolved, That upon the approval of
such transfers the Auditor of the City
of Dubuque is directed to adjust his
books accordingly and to notify the
Treasurer of such transfers, and such
notification shall be accompanied by a
cnpv of this. resolution and the record
of its adoption.
The resolution vas passed, adopted
and approved by unanimous action of
the City Council of the 21st day of No-
vember, 1911, and all members thereof
signed their names thereto.

Resolution and Application for Perma-
nent Transfer of Funds
Whereas, On November 1, 1941, Im-
provement Bonds in the amount of
$20,000.00 matured and Improvement
Bond Interest in the amount of $3,-
487.50 become due and payable; and
Whereas, There is no«= in the hands
of the City Treasurer and credited to
the Improvement Fund the sum of
$10,70.3.74 which is to be supplemented
by a transfer of $13,487.60 from the
emergency Fund; and
Whereas, As of the 1st day of No-
vember, 1941, there were balances of
$67,735.45 in the Water Works General
Fund and of $104,765.40 in the Water
Works Sinking Fund; and
Whereas, No tiVater Works Bonds
or Interest are due and payable during
the remainder of the current fiscal year
and $32,000.00 in bonds and $3,565.00
in interest become due and payable
during the succeeding year and, there-
fore, the requirements of Section 6151.1
of the Code have been fully met; and
Whereas, In order to pay the obliga-
tions due, it is necessary to make a
transfer of $20,000.00 from the Water
Works General Fund to the Improve-
ment Fund; and
Whereas, Before any transfer can be
made from the Water Works Gg~teral
Fund to any other fund, an application
must be made to the State Comptroller
for authority to make the transfer and
his approval secured thereon; Now,
Therefore, Be It
Resolved, By the City Council of the

at their next meeting which will be
held December 12Th, 1941.
Mr. Frank Keeseclcer addressed the
Council, requesting Council to take ac-
tion on his tax matter which has been
pending for Council consideration. Mr.

by the City Council to amend the Zon-
ing Map of the City of Dubuque as pro-
vided by Ordinance No. 3-34, desig-
nated as "Zoning Ordinance of the
City of Dubuque" so as to change to
"Multiple Residence District" certain
territory hereinafter described, now de-
limited as "Two Family Residence
District"; and
WHEREAS, notices of such pro-
posed change have been published as
provided by law and an opportunity
afforded to any and all interested par-
ties and citizens to object thereto at a
public meeting held at 7:30 P. M., No-
vember 21st, 1941, in the Council Cham-
ber in the City Hall; and,
WHEREAS, no objections have been
filed or made to the proposed change;

Section 1. That the Zoning Map and
Zoning Ordinance of the City of Du-

By changing from a "Two Family
Residence District" to "Multiple Resi-
dence District" the area described as
follows: The area bounded by the cen-
ter line of 3rd Street on the south; cen-
ter line of 6th Street on the north; the
center line of Locust Street on the east;
and the center line of Bluff Street on
the west.
Section 2. This ordinance shall be
in force and ffect from and after its
final passage, adoption, approval by the
City Council and publication as by law
provided.

claim filed by William Hammerand for
$31.28 for recovery of Special Assess-

paid in June, 1925, there is no authority
in the law for the return of this money
paid for taxes, and I would, therefore,

Whereas, The City Administration,
through the City Council and the Plan-
ning and Zoning Commission, has here-
tofore caused to be prepared and has
adopted a comprehensive Master City
Plan and co-related ordinances, which
plan contemplates general and specific
improvements of the river front, includ-
ing the area commonly known as Ham's
Island.
Whereas, This particular area is
practically all subject to overflow dur-
ing high stages of the river, thus auto-
matically bringing such property under
the jurisdiction of the Dock Board, ap-
pointed by the Council and acting un-
der the provisions of Chapter 303 of the
Code of Iowa.
Whereas, The Dock Commission has
realized for a long time that in order
to carry out the TTaster City Plan,
which involves the construction of a
barge canal between the mainland and
Ham's Island, as well as the construc-
tion of wharves, railroad sidings, roads
and other improvements and facilities,
it is necessary that the municipality he
the fee owner of all lands in the path
of and adjacent to any proposed canal.
Whereas, One of the properties most
vital in carrying out the contemplated
improvements, as provided for in the
Master Plan, is the property known as
the Papin Farm on Ham's Island, com-
prising Mineral hots No. 301, No. 301A
and No. 302 in the City of Dubuque,
Iowa.
Whereas, The Administrator or Trus-
tee of the Papin estate has been au-
thorized by a Court Decree to sell this
property to the City of Dubuque for
the sum of Five-thousand ($5,000.00)
Cash, and it is the unanimous opinion
of the members of the Doclc Commis-
sion that the City should avail itself of
the opportunity to acquire this property
at this very reasonable figure; There-
fore, Be It

and stated that service thereof had been
duly made and that this meeting is
called for the purpose of conducting a
public hearing upon the notice of levy
of special assessments and intention of
the City Council to issue bonds for the
construction of a six (6) inch vitrified
the sanitary server in Plum Street from
the present manhole in Rush Street to
two hundred and eight (280) feet nor-
therly, also upon the notice of levy of
special assessments and intention of the
City Council to issue bonds for the re-
surfacing of West Third Street from
the East property line of Btrrch Street
to the Nest property line of Alpine
Street South and acting on any other
business as may properly come before
a regular meeting of the City Council.

Special Session, December 26th, 1941.

hereinafter described, has been com-
pleted and said improvement has been
accepted by the City Council of said
City and the City engineer has com-
puted the cost and expense thereof to
be $435.89, and
Whereas, Public notice as provided
by law, has been published by the City
Clerk stating the intention of the City
Council to issue bonds to pay the cost
of said improvement and a public hear-
ing has been held pursuant thereto, and
all objections filed thereto have been
considered and determined; Now,
Therefore, Be It
Resolved, By the City Council of the
City of Dubuque that to provide for the
cost of the construction of a six (-6)
inch vitrified the sanitary sewer in Plum
Street from the manhole in Rush Street
two hundred eight feet northerl}*, there
be issued Sewer Bonds to the amount
of $435.89. Said bonds shall be issued
under the provisions of Chapter 311 of
the Code of Iowa, 1939; shall bear the
date of the 26th day of January, 1942,
shall be in denominations of $100.00,
except that there shall be one bond to
the amount of $35.S9. They shall be
numbered from 3757 to 3761 inclusive
and shall be divided into five series, of
which the bond numbered 3757 shall
constitute the first series and shall he
payable the first day of April, A. D.
1947, the bond numbered 375 shall
constitute the second series and shall
be payable the first day of April, A. D.
1948, the bond numbered 3759 shall
constitute the third series and shall be
payable the first day of April, A. D.
1949, the bond numbered 3760 shall
constitute the fourth series and shall
be payable the first day of April, A. D.
1950, the bond numbered 3761 shall
constitute the fifth series and shall be
payable the first day of April, A. D.
1951.
Said bonds shall bear interest at the
rate of six per cent per annum, which
interest shall be payable semi-annually,
in accordance with the terms of the
coupons thereto attached; and said
bonds shall be payable out of the pro-
ceeds of the special assessment levied
for said improvement.
Both principal and interest shall be
payable at the office of the City Treas-
urer in tl?e City of Dubuque. Said
bonds shall he substantially in the fol-
lowing form:

The City of Dubuque in the State of
Iowa promises to pay as hereinafter
mentioned to the bearer hereof, on the
first day of April, A. D. 19____; or any
time before that date at the option of
the City, the sum of One Hundred
Dollars ($100.00) with interest thereon
at the rate of five per cent. per annum,
payable on the presentation and sur-
render of the interest coupons hereto
attached, both interest and principal
are payable at the office of the City
Treasurer in the City of Dubuque in
the State of Iowa. This bond is issued
by the City of Dubuque pursuant to
and by virtue of Chapter 311 of the
Code of Iowa, 1939, and in accordance
with a resolution of the City Council
of said City, duly passed on the __
day of December, 1941. This bond is
one of a series of 5 bonds, 4 for $100.00
numbered from 3757 to 3760 inclusive,
and one for $35.89, numbered 3761, all
of like tenor and date, and issued for
the purpose of the construction of a
six (6) inch vitrified the sanitary sewer
in Plum Street from the manhole in
Rush Street two hundred eighty feet
northerly, and described in said reso-
lution; which cost is assessable to and
levied along said improvement, and is
made by law a lien on all abutting or
adjacent property, and payable in ten
annual installments, with interest on all
deferred payments at the rate of six
per cent. per annum, and this bond is
payable only out of the money derived
from the collection of said special tax,
a.nd said money can be used for no
other purpose. And it is hereby certi-
fied and recited that all the acts and
conditions and things required to be
done precedent to and in the issuing
of this series of bonds, have been done,
happened and performed in regular and
due form as required- by said law and
resolution; and for the assessments,
collections and payment hereon of said
special tax, the faith and diligence of
said City of Dubuque are hereby ir-
revocably pledged.

buque by its City Council has caused
this bond to be signed by its Mayor
and countersigned by its City Clerk,

Whereas, The contract heretofore en-
tered into by the City of Dubuque for
the improvement of West Third Street,
hereinafter described, has been com-
pleted and said improvement has been
accepted by the City Council of said
City and the City engineer has com-
puted the cost and expense thereof to
be $18,539.45; and
Whereas, Public notice as provided
by law, has been published by the City
Clerk stating the intention of the City
Council to issue bonds to pay the cost
of said improvement and a public hear-
ing has been held pursuant thereto, and
all objections filed thereto have been
considered and determined; Now,
Therefore, Be It
Resolved, By the City Council of the
City of Dubuque, that to provide for
the cost of resurfacing West Third
Street from the east property line of
Burch Street to the west property line
of Alpine Street South there be issued
Improvement Bonds to the amount of
$18, 539.45.
Said bonds shall be issued under the
provisions of Chapter 311 of the Code
of Iowa, 1939, which shall bear the date
of the 26th day of January, A. D. 1942;
shall be in denominations of $500.00
except that there shall be one bond to
the amount of $39.45. `T'hey shall be
numbered from 3762 to 3799 inclusive
and shall be divided into ten series of
which the bonds numbered 3762-3763-
3764-3765 shall constitute the first se-
ries and shall be payable the first day
of April A. D. 1943; the bonds number-
ed 3766-3767-3768-3769 shall constitute
the second series and shall be payable
the first day of April A. D. 1944; the
bonds numbered 3770-3771-3772-3773
shall constitute the third series and
shall be payable the first day of April,
A. D. 1945; the bonds numbered 3774-
3775-3776-3777 shall constitute the
fourth series and shall be payable the
first day of April A. D. 1946; the bonds
numbered 3778-3779-3780-3781 shall
constitute the fifth series and shall be
payable the first day of April, A. D.
1947; the bonds numbered 3782-3783-
3784-3785 shall constitute the sixth se-
ries and shall be payable the first day
of April, A. D. 1948; the bonds num-
bered 3786-3787-3788-3789 shall consti-
tute the seventh series and shall be
payable the first day of April, A. D.
1949; the bonds numbered 3790-3791-
3792' shall constitute the eighth series
and shall be payable the first day of
April, A. D. 1950; the bonds numbered
3793-3794-3795 shall constitute the
ninth series and shall be payable the
first day of April, A. D. 1951; the bonds
numbered 3796-3797-3798-3799 shall
constitute the tenth series and shall be
payable the first day of April, A. D.
1952.
Said bonds shall bear interest at the
rate of five per cent. per annum which
interest shall be payable semi-annually,
in accordance with the terms of the
coupons thereto attached; and said
bonds shall be payable out of the pro-
ceeds of the special assessment levied
for said improvement.
Both principal and interest shall be
payable at the office of the City Treas-
urer in the City of Dubuque. Said
bonds shall be substantially in the fol-

bond is issued by the City of Dubuque
pursuant to and by virtue of Chapter
311 of the Code of Iowa, 1939, and in

This bond is one of a series of 38 bonds,
37 for $500.00, numbered from 3762 to
3798 inclusive, and one for $39.45 num-
bered 3799, all of like tenor and date,
and issued for the purpose of the im-

provement of West Third Street from
the east property line of Burch Street
to the west property line of Alpine
Street south and described in said reso-
lution; which cost is assessable to and
levied along said improvement, and is
made by law a lien on all abutting or
adjacent property, and payable in ten
annual installments, with interest on all
deferred payments at the rate of six
per cent. per annum, and this bond is
payable only out of the money derived
from the collection of said special tax,
and said money can be used for no
other purpose. And it is hereby certi-
fied and recited that all the acts and
conditions and things required to be
done precedent to and in the issuing of
this series of bonds, have been done,
happened and performed in regular and
due form as required by said law and
resolution; and for the assessments,
collections and payment hereon of said
special tax, the faith and diligence of
said City of Dubuque are hereby ir-
revocably pledged.

of $150.00 on the unexpired por-
tione of his beer permit, present-
ed and read. Councilman Thomp-
son moved that the requests be granted
and the City Auditor to be instructed
to draw a warrant in the amount of
$50.00 in favor of Milton J. Kalmes to
cover refund on the unexpired portion
of his cigarette license, said license to
be returned for cancellation on or be-
fore December 31st, 1941, and also to
draw a warrant in the amount of $150.00
in favor of Milton J. Kalmes to cover
refund on the unexpired portion of his
beer permit, said beer permit to be re-
turned on or before February 16th,
1942, for cancellation. Seconded by

nance having been passed upon first
and second readings on December 12th,

Railroad Co. be and it is hereby or-
dered and directed to provide, install
and operate modern, approved, elec-
