ORDINANCE NO. 65.53
An Ordinance granting D. W. Ernst
the right to constrttet a Sewer in
-Iarion Street; providing the terms
and conditions thereof; and providing
fora charge far connecting thereof,
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF DU-
BU(~UE:
Section 1. That D. W. Ernst be and
he is hereby granted the right to con-
struct an 8-inch vitrified file pipe
sanitary server in Marion Street from
the Present terminus of the sanitary
sen'er in said Street, easterly, a dis-
tance of 136 feet upon the following
terms and conditions:
(a) That grantee agrees to construct
said sewer within one Year from the
date hereof and to pay the entire
cost thereof, including cost of restor-
ing the surface of the street;
(b) That said server shall be con-
structed in accordance with plans ap-
proved bS' the State Department of
13ealth and the City Manager and un-
der the supervision and direction of
the City 11lanager and City Engineer;
(c) That grantee will enter into a
contract for the construction of said
server with a qualified contractor,
which contract will, among other
things, contain a clause requiring
the contractor to obtain all necessary
permits, including excavation permits,
required by the City of Dubuque, or
any other Governmental agency, a
clause obligating• the contractor and
his bondsmen to keep said sewer in
good repair for a period of not less
than two (2) years from the date of
the acceptance of the work, and a
clause requiring the contractor to
furnish a surety bond with the City
of Dubuque named as one of the ob-
ligees, guaranteeing the faithful per-
formance of said contract;
(d) That upon completion of said
sewer and the acceptance of the same
by the City Council said sewer shall
become a public sewer under the ex-
clusive charge and control of the City
of Dubuque and its free use as such
shall not be interfered with by the
grantee, his succesors ar assigns;
Section 2. After said steer has been
completed and the total cost thereof
has been paid by grantee, the g7•antee
herein shall file with the Cit3' Council
a certified statement, showing in de.
tail, all amounts paid out by him in
connection with the construction oP
said sewer, including engineering Pees
and the cost of restoring the surface
of the street. Thereafter, any person
or persons desiring to connect with
said sewer, escept the grantee herein,
shall first apply to the City Manager
for permission so to do and such per-
mission shall be granted upon condi-
tion that the applicant pay to the
City Treasurer, for the account of the
grantee herein, a connection charge in
an amount which will be fixed by
Resolution of the City Council at the
time of the acceptance of said sewer.
However, such connection charges
shall not be exacted for any extension
of said sewer made by the City of
Dubuque, or its permitees.
Section 3. That the authority grant-
ed herein shall terminate on Novem-
er 1, 1953, unless the terms and condi-
tions of this Ordinance are accepted
in writing by the grantee prior to that
date.
Section 1. This Ordinance shall he

its final passage, adoption and publi-
cation as provided by law.

vestigation and report. Claimant
sustained her injuries when she
fell on the sidowallt on the north
side of West 11th Street betv~een
the alley west of Main, behveen
Main and Locust Streets. She trip-
ped m? a raised portion cf the
sidewalk.
After due investigation by this
offie~e it appears that claimant
sustained the injuries complained
of, and that her claim for damages
is a justified one. It is therefore,
respectfully recommended that
said claim be allowed and that the
Treasurer be instructed to draw a
warrant in favor of Mrs. J. J.
Powers in the sum of $22.90 to be
delivered to her upon execution of

May 28, 1953. Claimant sustained
a fractured bone in her left foot
and is claiming damages for doctor

the City Clerk acknowledged serv-
ice of notice of an injury and claim
filed by Mathew Spielman. Said
claim is in the sttm of $900.00
and alleges that the claimant sus-
tained damages in that amount
when he fell on a defective rock
curb stone while walking in an
easterly direction on 8th Avenue.
Said claim was referred to this
office for investigation and re-
port.
After due investigation by this
office it appears that no negligence
existed upon the part of the City
of Dubuque which would render it

excessive speed of drivers who
use this street in going home from
work, was referred to the City
Manages- and Traffic Department
for immediate action and report.
Also included in this motion was
the matter of excessive speed of
drivers in the Sheridan Road and
Windsor Avenue Dists•icts,
Please be advised that officers
were assigned to patrol both the
Roosevelt District and the Sheridan
Road and Windsor Avenue llist-
ricts. This patrol will be maintained
in an attempt to keep down speed-
ers until results are obvious. Also,
patrols will be made periodically
thereafter in order to maintain
control of the speed in both these
areas,

In view of the traffic and park-
ing conditions existing on Dodge
Street between Main and Locust
Streets, an investigation has been
made by the Police Traffic Depart-
ment,
This investigation discloses that
recently new businesses have
started in this area and as a result
vehicles have been parking on both
sides of the roadway thereby
creating one-way traffic conditions.
It is recommended that Schedule
VT of Ordinance 33-49 be
amended by adding thereto a sec-
tion which would prohibit parking
on the south side of Dodge Street
between Main and Locust Streets,
including the areas north and
south of the bridge approach.

no1•th and south of the school prop-
erty warning motorists that they
are approaching a school district.
(2) That all weeds on both sides
of the roadway be cut down so as
to improve visibility at the school
area.
(3) That the school patrol be
alerted as to the traffic danger
and that they be instructed to re-
port all violations.

filed his certificate stating that the
same has been completed according
to the terms of the contract, plans
and specifications and recommends
its acceptance, now therefore,

that the recommendation of the
City Manager be approved and that
said improvement be and the same
is hereby accepted and the City
Engineer be and he is hereby di-
rected to prepare a plat and sched-
ule showing the lots or parcels of
real estate subject to assessment
for said improvement and file the
same in the office of the City
Clerk subject to public inspection
and said Clerk shall upon receipt
of such plat and schedule publish
the notice of the Council's inten-
tion to levy special assessments
therefor, as required by law.
Be It Further Resolved, that the

improvement of West Third Street
with Bituminous Concrete from
the East Property Line of Algona
Street to the West Property Line
of Grandview Avenue, under con-
struction by the Iowa Road Build-
ing Company of Fairmont, Min-
nesota, has been completed in ac-
cordance with the plans and spec
ifications.
I, therefore recommend the ac-
ceptance of the work.

has submitted his final estimate
showing the cost thereof including
the cost of estimates, notices, in-
spection, and preparing the as-
sessment and plat, now therefore,
Be It Resolved, by the City Coun-
cil of the City of Dubuque,
That the cost of said improve-
ment is hereby determined to be
$6,996.87,
That $6,651.62 of the cost there-
of shall be assessable upon private
property and $34525 shall be paid
from the Street Construction Fund
of the City of Dubuque.
