OFFICIAL NOfiICE OF THE PROPOSED ANNUAL
BUDGET PREPARED SY THE CITY MANAGER AND
CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA,
FOR THE FISCAL YEAR, 1938.1939.
Notice is hereby given that the City Manager of
the City of Dubuque has prepared a budget on the basis
of estimates of the expenses of the various departments
of said City for the fiscal year beginning Aprit 1, 1935,
and ending March 31, 1939, and such departmental es-
timates show expenses of each department for the pre-
ceding year in addition thereto, the City Council has
caused to be prepared a budget for said fiscal year on
the basis of estimates of the expenses of the several
departments of said City, such estimates showing there-
in not only the purpose for which the consolidated tax
levy authorized by Section G217 of the Code of Iowa 193b
is to be used, but in addition thereto, the purpose for
which all other tax levies heretofore made are to be
used, including revenues for miscellaneons sources, the
apportionment of the consolidated tax levy having here-
tofore been determined by said Council and incorporated
in a resolution for such purpose. This budget will be
considered for final adoption by the City Council at a
special meeting to be held in the Council Chamber at
the City Hall on the 22nd day of March, 1938, at 7:30.
o'clock p, m. Any taxpayer objecting thereto or pro,
testing to the same, or to any item thereof, or any
omission therefrom, shall present his objections to said
Council on or I~efore that date.
This notice is given pursuant to the direction of
the City Council.

ing is called for the purpose of con-
sidering the Annual Budget for the
fiscal year of April 1st, 1938, to
March 31st,, 1939,

Gentlemen: In accordance with
the provisions of law, as City Man-
ager, Ihave prepared an anhua]
budget for the fiscal year April 1,
1938 to March 31, 1939, based upon
estimated income and expenses far
the various departments of the City
of Dubuque, including certain chang-
es as were approved ands authorized
by the City Council. These esti•
mates show departmental appropri-
ations for each department for the
preceding year (1937-38) and also
the increases or decreases, as were
determined for the ensuing year
(1938-39).
This budget is submitted to the
City Council for tentative approval
and the same will be published
as required by law in order that
objections, thereto, may be made
before final action is taken on this
budget by the City Council.

County Auditor,
The millage for 1937-38 operation was 19.976 mills
on a taxable valuation (100%„ of assessed value) of
617.00 amounting to $644,166.00, plus Moneys and

caused to be levied a consolidated

Whereas, the City Manager has
caused to be prepared a budget on
the basis of estimates of the ex-
penses of the various departments
of the City of Dubuque for the fis-
cal year- beginning April 1, 1938,
and ending March 31, 1939, and
such departmental estimates show
the expenses.of each department
for the preceding year, and the
same has been submitted to this
Council as a basis for the prepar•
aeon of the annual budget required
by law to be prepared by the City
Council of said City; and
Whereas, this Qouncil bas exam-
ined such budget and from the in-
formation therein contained has
prepared its budget for said fiscal
year on the basis of estimates of
the expenses of the several de-
partments of such City, such esti•
mates showing therein not only the
purpose far which the consolidated
tax authorized by Section 6217 of
the Code of Iowa 1936 is to be used,
but iri addition thereto, the pur-
poses for which all other levies
heretofore made are to be used
and including therein also the esti-
mated revenue from miscellaneous
receipts and the purposes for~,vhieh
the same are to be used, so that
said budget shows all of the pro-
posed expenditures for the ensuing
fiscal year: Now, therefore,
Be it resolved by the City Coun-
ril of the City of Dubuque:
That the Manager's budget be
and the same is hereby approved
and the City Clerk is hereby di•
rected' to cause the budget pre-
pared by tht, City Council for the
fiscal year beginning April 1, 1938,
and ending March 31, 1939,. to be
published in the -official newspaper
of this City at least once, said
publication to be at least two
weeks.in advance of the date set
herein for final hearing thereon
and adoption thereof.
Be it further resolved that this
Council meet on the 22nd day of
March, 1938, at 7;30 o'clock p, m.
in the Council Chamber at the City
Hall for the purpose of conducting
a hearing upon said budget, at
which time any taxpayer of said
City will be given full opportunity
to be heard upon any objections
or protests made thereto, or to any
item or items thereof, or to any
omission therefrom, and after all
parties have been hearda said bud-
get will be amended or adopted as
proposed.
This resolution being deemed ur-
gent and in the preservation of
peace, health, safety and public in-

Whereas,. as of the first day of
February, 1938, there was a cash
balance in the Consolidated Fund
of $4,272,14 and no balance at all
in the Street•cleaning and Main
Sewer Funds; and
Whereas, there is now in the
hands of the City Treasurer and
accredited to the Emergency Fund
the sum of $13,523.9f, which is
available for transfer to the funds
above referred to; and
Whereas> there has been repaid
to the Bonded Debt Sinking Fund
from the Consolidated Fund during
the fiscal year, 1937.38, the sum of
$19,112.35, being the balance due
such Bonded Debt Sinking Fund on
account of a transfer heretofore
made therefrom to the Consolidat-
ed Fund ands because of such pay-
ment, adeficiency has resulted in
such fund; and
Whereas, the Street cleaning
Fund has become exhausted be-
cause of extraordinary weather
conditions resulting in streets and
sidewalks being covered with sleet
ice and rendering the same danger-
ous to vehicular and pedestrian
travel, thereby nechssitating the
use of street crews by day and
night; and
Whereas, the tax levy for the
Main Sc~vver Fund was inadequate
to provide for the maintenance and
repairs of the maia sewer system
of said City; and
Whereas, in order to be able to
carry on the various functions and
activities of said City as represent-
ed by the above funds to the end
of the present fiscal year, it will
be necessary to make transfers to
such funds from the Emergency
Fund in the following amounts:
(a) to the Consolidated Fund,
$6,623.96; (b) to the Street-clean-
ing Fund', $5,000.00; (c) to the
Main Sewer Fund, $2,000,00; and
Whereasy before any transfer can
be made from the Emergency Fund
to any other fund, an application
must be made to the State Comp•
troller for authority to make the
transfer and his approval secured
thereon; Now, therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that,
subject to the approval of the State
Comptroller, there be and therb is
hereby transferred from the Emer•
gency Fund of the City of Dubuque
(a) to the Consolidated Fund the
sum of $6,523.96; (b) to the Street•
cleaning Fund' the sum of $5,000,00;
and (c) to the Main Sewer Fund

said petition having been referred
to the Planning and Zoning, Com-
mission by City Council on Febru-
ary 7th, the Planning and Zoning
Commission begs to recommend to
City Council vacation of the alley
requested. The diagonal course of
the alley thrpugh the block forma
irregular shaped lpts which are npt
entirely suitable for building pur-
poses.
The. Commission recommend fur,
then that the vacation of aa}d alley
be conditioned upon payment of, a
price which City Council may deem

ed fairly in the distribution of the

23rd, and asked me to report to
yeti that in addition to their, recom-
mendation, made to the City Coun~
cil on the petition of the Mettel
Realty and Investment Company,
they Peel that the offer of $50.00
far the vacation of the alley men-
tioned iu the request is not ade•
quote.
The vacating of this alley will
mean that all adjacent property
holders can make three saleable
lots out of four parcels of land
which are, at present, not in eon•
formitY with the requirements of
the Zoning Ordinance. They feel
this is the logical. step to take, but
are of the opinion that. the area
of the vacated alley is worth more
than $5.0,00• They also feel that
the cost of printing and of trans•
ferring the title will amount to
almost $50.00, and. the least that
shpuld be asked would be $50.00,
plus the necessary Cost of vacating
and transferring.
An investigation of the sewers
shows a 20 inch storm sewer in
the alley which they wish vacated,
A plat and profile of this storm
sewer is attached, and' I would re-
commend that.if this alley is va-
cated by the City Council that an
easement shpuld be obtained for. a
permanent right of .way of this
storm sewer. It might be well to
mention that the depth of this
storm sewer varies, from four feet
to six feet and might interfere
with the construction on the lots
involved.
A private sanitary sewer is also
shown on the attached plat which
was constructed by the owner of
Lot 166, Finley's Addition, The
profile of this sewer is also shown,
and it would be well to me-anon
to the prospective purchaser that
this is a private sewer, and ar•
rangements would have to be made
with the owner before using it for

north. Since that time Mrs. Sliam-
bough, the owner of Lot 11 of Stew-
arCs Subdivision, has asked that
the alley remain unopened or be
vacated.
At the present time Mr. B. M.
Graf contemplates the purchase of
the easterly 50 feet of Lot 12 of
the same subdivision, which also
fronts on the alley, and is only
interested in the purchase of this
property provided the alley be va-
cated,
I would recommend that the City
Council view the grounds at the
earliest opportunity in order to
have a proper basis for their de-
cision,

Paragraph 648, Section 2, It is
understood and provided that such
right, license and permission is sub-
ject to the continuous control of the
City Council of this City, reserving
the right to impose restrictions or
conditions upon the enjoyment there-
of as may be reasonably necessary for
the protection of the public interests,
including the right to revolve and
rescind such permission if at any time
the public interests should require
such revocation. If and when such
permit, right and license is revoked
by the Council, said Frank C, Luther,
his successors and assigns, shall re-
move such canopy at his own expense
and restore such part of the sidewalk
as has been occupied thereby to the
same condition it was in prior to the
construction of such canopy.

Gentlemen;
I wish to bring to your attention
the sublect of contagious disease
control. The necessity of eliminat-
ing the V. N. A. has produced a
problem of considerable import-
ance to your Health Department,
for example, if conditions similar
to January and February of 1936
were to occur today there would be
practically a complete break down
in our work. To be specific, 3333
of the 6,756 cases reported in 1935
were iu January and February. At
that time we had a staff of 13 Visit-
ing Nurses, 4 school nurses, 3 WPA
nurses, 4 WPA clerks, besides the
Health Director and the Health De•
partment stenographer.
At the present time, unless extra
help was to be employed during a
severe epidemic, we would have
only 4 School nurses, 1 WPA clerk,
besides the Health Director and
stenographer to cope with the situa~
tion. The amount of clerical wont
necessary on each case of commun-
icable disease fa considerable. Usu-
a]]y the gaae is reported by tele-
phone to the Health Department;
then the clerk reports the case by
phone to the V. N. A. office, The
visiting nurse then visits the home
and obtains a complete history of
the case. When the card is returned
to our office, the clerk sends a
notice of gparantine to the school
anti makes' a coht~lete record in bur
books. She then makes out a his-
tory card`to lib sent to the State
Department of Health. At the
end Of the week she makes out
curds for the State Health Depart-
ment and U. S. Public Health Ser•
vice, when the case is dismissed
she sends a notice of release to the
school, We estimate that each case
means from 3 to 4 telehpone calls.
In 1985 it vas necessary to have
an extra phone installed. These
details are brought to youx atten•
tion to illustrate' how it would be
impossible for either the office help
ot• the 'school nurses to do the
neeessary work as in 1935. As a
matter of fact, if the nurses had to
d0 all the placarding ttiey would
have very little time to spend in
the schools inspecting children for
contagious disease;
Another very important problem
Confronting us is the fact that the
nurses orb only employed for 10
months, and unless proper provi-
sion is made we would have no
nurses on duty during July and
August,
It is quite true that I have cited
conditions which fortunately do not
exist every year. However, this
city will probably experience an
epidemic of Measles this year, the
last ono occurring in 1935. Measles
usually occur in 3 year cycles.
I therefore recommend for your
consideration that the $1,200.00
formerly paid to th0 V. N. A. be
appropriated for Health Depart-
ment purposes to be aced in em•
ploying extra help either clerical
or nursing when the need arises,

Nurse Association; and
WHEREAS, it is deemed neces•
sary and advisable by the Council
to make provision in and budget for
such purpose, but in order to do so
it is necessary to correct said bud-
get, as heretofore proposed and
published, in order that said ontit•
ted expenditures may be l~rovideci
fot• therein: Now, therefore,

cil of the City of Dubuque that the

OFFICIAL NOTICE OF THE PROPOSED ANNUAL
BUDGET PREPARED BY THE CITY MANAGER AND
CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA,
FOR THE FISCAL YEAR, 1938.1939.
Notice is hereby given that the City Manager of
the City of Dubuque has prepared a budget on the basis
of estimates of the expenses of the various departments
of said City for the fiscal year beginning April 1, 1938,
and ending March 31, 1939, and such departmental es-
timates show expenses of each department for the pre-
ceding year in addition thereto, the City Council has
caused to be prepared a budget for said fiscal year on
the basis of estimates of the expenses of the several
departments of said City, ouch estimates showing there-
in not only the purpose for which the consolidated tax
levy authorized by Section G217 of the Code of Iowa 1936
is to be used, but in addition thereto, the purpose for
which all other tax Levies heretofore made are to be
used, including revenues for miscellaneous sources, the
apportionment of the consolidated tax levy having here-
tofore been determined by said Council and incorporated
iu a resolution for such purpose. This budget will be
considered for final adoption by the City Council at 'a
special meeting to be held in the Council Chamber at
the City Hall on the 22nd day of March, 1938, at 7:30
o'clock p. m. Any taxpayer objecting thereto or pro-
testing to the same, or to any item thereof, or any
omission therefrom, shall present his objections to said
Council on or before that date.

Wd3EREA~S, this Council has pre•
pared its budget of proposed ex-
penditures for the fiscal year be-
ginning April 1, 1938, and ending
March 31, 1939, wherein estimates
of the expenses of the departments'
and purposes are shown, including
the estimates for which the con-
solidated tax levy and all other
levies heretofore made, ,receipts
from moneys and credits and mis•
cellaneous sources are to be used,
and said budget shows all of the
proposed expenditures for the en-~
suing fiscal year, and the same was
published as provided by law and
an opportunity was given all who
might wish to file objections or
protest to the same or to any omis•
sions therefrom, and the time for
final action thereon having been
fixed as the 22nd day of March,
1938; and
WHEREAS, subsequent to the
preparation and publication of such
budget, this Council has deemed it
necessary and advisable to amend
the same by incorporating therein
the proposed expenditure in ~tke
Health Department for the control
of contagious diseases, and in order
to create funds for said appropria-
tion, it was necessary to amend
certain amounts shown in said bud-
get under the caption of "Emer-
gency and Reserve"; all of said
proposed changes having been here-
tofore provided for in a resolution
adopted by this Council on the
22nd day of March, 1938; and
WHEREAS, no objection's have
been filed to said budget: NOW,
THEREFORE,
Be it resolved by the City Coun-
cil of the City of Dubuque that said
budget of proposed expenditures
for the fiscal year beginning April
1, 1938, and ending March 31, 1939,
as heretofore prepared, and as
amended, as herein stated, be and
the same is hereby adopted and
approved.

ing the right to impose restrictions
or conditions upon the enjoyment
thereof as may be reasonably neces-
sary for the protection of the pub-
lic interests, including the right to
revoke and rescind such permission
if at any time the public interests
should require such revocation. ]f
and when such permit, right and
license is revolted by the Council,

designating this ordinance as 'The
Zoning Ordinance of the City oP Du-

filling stations and public garages be

the following is enacted as a substi-
tute therefor:
"(d) No filling station or public
garage shall hereafter be erected, and
no existing building shall hereafter
be used or remodeled for use as a
filling station or public garage in
zones wherein such structures are
permitted herein, within 200 feet of
any lot upon which is located a
church, hospital, school, institution,
theater, or publio assembly hall, nor
shall such station or garage, in any
case, be located within 50 feet of
any boundary line of any Residence
District."
PARAGRAPH 657. Section 2. That
the definitions of public garage and
storage garage as contained within
Article X of said ordinance Ue and the
same is hereby repealed and the
following is enacted as a aubstitute
therefor:
"A public garage is a building or
portion thereof wherein motor vehi-
cles are repaired or serviced for com-
pensation, with or without storage
facilities or sales rooms.
"A storage garage is a building or
portion thereof which is used for the
storage of motor velilcles for tom-'
pensation and where no repair or
servicing facilities are maintained.
"A sales room is a building or por-
tion thereof which is used for the
sale of motor vehicles and where no
repair or servicing facilities are maih-
tained."
PARAGRAPH 668. Section 3. That
this ordinance shall be in force and
effect ten (10) days from and after
its final adoption by the City Council
and publication as provided by law.

be used for the payment of the ex-
penses oP such departments and pur-
poses in the sums herein shown.
Paragraph 663. Surplus. Section 6.
Any surplus not specifically allocated
for a definite purpose in the budget
and which may exist 'in either the
General Fund or miscellaneous rev-
enues account shall be and the same
is hereby appropriated and set apart
to be applied as contingencies arise
or may be used for such proper pur-
poses as the Council may determine
upon. Any surplus not specifically dis-
tributed in the budget and remaining
in funds created by the Levy of spe-
cial taxes shall be and the same is
hereby appropriated for any proper
purpose incident to such funds. Any
surplus remaining in any fund at the
close of the fiscal year 1937-1938 (ex-
cept taxes which have been levied for
special purposes) shall be transferred
into and became a part of the Gen-
eral Fund. ATOthing herein contained
shall authorize the transfer of funds
realized from special taxes to a fund
or purpose for which any special tax
levy has been made, except only with
the approval of the State Comptroller.
Paragraph 664. Receipts from swim-
ming pool. Section 6. All receipts from
the operation of the swimming pool
shall be allocated to a special fund to
be used only for the redemption of
outstanding genera] fund warrants
and the payment of interest thereon.
Paragraph 666. Emergency Fund.
Section 7. Transfers of money may be
made from the Emergency Fund to
any other fund far the purpose of
meeting deficiencies in any such fund
arising from any cause; provided,
however, that no such transfer shall
be made except upon the written ap-
proval of the State Comptroller and
then only when such approval is
unanimously requested by the City
Council.
Paragraph 666. Delinquent taxes.
Section 8. Delinquent prior years tax-
es shall be allocated to the respective,
funds entitled to the same when and
as the same are received by the City
Treasurer.
Paragraph 667. Distribution. Section
9. That the distribution and division
oY the within appropriation shall be
made in accordance with the budget
oP the City Council adopted on March
22, 1938, which budget is made a part
of this ordinance by reference thereto
and shall be considered in connection
with the expenditures of said appro-
priations.
Paragraph 668. Emergency clause,
Section 10, This ordinance, in the In-
terest of the preservation of public
peace, health, safety and the general
welfare of the City of Dubuque and
the inhabitants thereof being deemed
urgent and of immediate necessity,
shall be in Force and effect from and
after its final passage, adoption and
approval by the City Council and pub-
lication as provided by )aw, and the
appropriations herein provided for
shall be available when transferred to
their respective funds.
