Rules and Regulations Covering
Use of Municipal Athletic Field
1-General supervision and man-
agement of the Municipal Athletic
Field is hereby vested in the Play-
ground and Recreation Commission
of the City of Dubuque, and the
active management thereof shall
be exercised by the recreational
director,
All persons or organizations
desiring the use of the Municipal
Athletic Field must make apljlica-
tion therefor to the Playground and
Recreation Commission upon an ~',
approved form of application em• ~
bodying these rules and regulations
which application shall be filed
with the recreational director,
3-For the use of said Municipal
Athletic Field, all persons or organ•
izations other than as hereinafter
specified, desiring the use of said
field far baseball or football games
for which the public is charged an
admission fee, shall, at the time of
making application therefor, pay as
a rental fee for the use of said
field:
For baseball games, daytime,
$lo.oo.
For baseball games, night-
time, $12.00 plus a deposit to
cover cost of lighting the field.
For football games, daytime,
$12.00.
For football games, night
time, $15,00 plus a deposit to
cover cast of lighting the field.
The playground commission shall
have the right, in lieu of the above
rental fees for the use of said field
for baseball and football, to cal-_
lect as rental therefor, an amount
equal to 10 per cent of all paid ad-
missions to said games.
4-For the use of the Municipal
Athletic Field for all other events
or activities, other than baseball
or football, not provided for under
Rule 3, the Playground and Recrea-
tion Commission shall have the
right to determine the rental foe
to be paid for the use of said field,
and the manner of payment of the
same,
5-In consideration of t h e i r
granting to the Playground and Re-
creation Commission the right to
continued use of their a t h l e t i c
fields far the activities and pur-
poses of the Playground and Re•
creation Commission ae heretofore
given by them, Columbia College
and Academy and the University of
Dubuque shall not be required to
pay a rental fee for the use of
said field far athletic events of an
interscholastic nature, excepting
that said organizations will be re-
quired to Pay a cost of lighting
said field when necessary,
6-In consideration of the finan-
cial assistance extended to the
Playground and Recreation Com-
mission by the Independent School
District of Dubuque, and the right
to the continued use of their play-
grounds for the activities and pur-
poses of the Playground and Re•
creation Commission as heretofore
given by them, the Independent
School District of Dubuque shall
not be required to pay a rental fee
for the use of said field for athletic
events of~an interscholastic nature.
7-No change or alteration of
any character shall be made in
eithet• the Athletic Field itself, or
in the grandstands, bleachers or
other appurtenances unless per-
mission in writing to make said
change shall have been granted by
the Playground and Recreation
Commission at the time of filing
the application for the use of said
field, and any such change or
changes shall be made under the
supervision of the recreational
director,
8-All persons or organizations
to whom the use of the Municipal
Athletic Field is granted upon pro•
per application shall, within twelve
hours after such use, put the field
and grandstands in the same con-
dition as when said field was taken
over for such use. The recondi•
tinning of said field and grand-
stands shall be under the super-
vision of and subject to the inspec-
tion and approval of the recrea-
tional director.
9-Said Municipal Athletic Field
shall not, at any time, or under
any occasion, be used by any ap-
plicant for any unlawful purpose,
and the use of said field shall at
all times be subject to the provi•
sinus of all police and fire regula-
tions of the City of Dubuque, Iowa,
and in compliance therewith.
10-The custodian in charge of
said Municipal Athletic Field under
the direction of the Playground and
Recreation Commission, shall, with
all necessary assistants, have ac-
cess to said field at all times in the
performance of his or their official
duties.
11-If, in the opinion of the Re•

creational Director the Municipal
Athletic Field, because of climatic
or weather conditions, cannot be
used by an applicant for said use,
the Recreational Director shall
have the right and privilege of
substituting for said period a like
period of similar duration at a la-
ter date, and if such substitution
in his opinion is not feasible, and
cannot be met, he shall have the
right to refund to said applicant
the fee paid at the time of making
said application together with any
deposit made therewith.
12-The Playground and Recrea-
tion Commission and Recreational
Director shall have the right, with-
in seaenty-two (72) hours prior to
the beginning of the period far
which an application is made, to
cancel said application, and to re•
fund to said applicant the amount
of said application fee, together
with any deposit made therewith.
13-The Playground and Recrea-
tion Comtission shall have the
right to lease, from year to year,
the concession privilege of said
park, including al] concession priv-
ileges or rights excepting admis-
sions,

conditions upon the rights granted
by this ordinance; providing far the
continuance in effect of all of the
provisions of the franchise ordinance
of said Interstate Power Company
not inconsistent herewith; and re-
quiring an acceptance of the provi-
sions hereof,' as amended by Ordi-

Gentlemen: At. the meeting of
the City Council held March 7,
1938, the petition of H, T. Bertsch
for additional lights on Sunset
Ridge was referred to me for in•
vestigation and report.
I have examined the original plat
of Sunset Ridge filed in the County
Recorder's office under the date of
February 27, 1926, and find that the
Sunset Ridge driveway has never
been dedicated as a street. The
dimensions indicated for the vari-
ous lots presumably run to the
edge of the 20 foot paved drive-
way and it is my opinion that the
title to the paved driveway is in
the names of the heirs to the Har-
riet Guthrie estate.
It is my recommendation that no
further lights be installed for the
reason that the' Sunset Ridge drive-
way is not a city street.

Gentlemen: At the session of
the City Council held May 2, 1938,
the petition of Mrs. Minnie' Zogg,
et al, requesting a reduction in the
special assessments levied against
their property for the improvement
of Roosevelt Street was referred to
me for investigation and report.
I find from the examination of
the records that Roosevelt Street
was improved at a total cost of
$23,466.04, toward the payment of
which a Federal Grant of $6,835.65
was secured, and that an assess-
ment was levied against the bene-
fitted property on March 27, 1934,
for the balance. Objections were
heard to this assessment and on
June 5, 1934, the- City Council lev-
ied arevised assessment which
raised the City's share of the total
improvement to $4,776.39.
It would appear from the record
that the assessment was legally i
levied in the amounts which the
Council, in 1934, felt were equit-
able and just.

Health of the City of Dubuque,
Iowa, that the General Insulating
and Manufacturing Company of the
City of Dubuque, Iowa, be notified
to stop and cease operating their
plant until such time as said com-
pany complies with the recommen-
dations of the Department of
Health of the State of Iowa, and
the orders of the Health Depart-
ment of the City of Dubuque, Iowa,
by the installation of proper appar-
atus for the remove] of poisonous
gases from the vapors or gases
emitted from said plant during its
operation presented and read.
City Manager Rhomberg recom-
mended that the Board of Health
defer action on the resolution and
that the General Insulating and
Manufacturing Company be allow-
ed areasonable time to comply
with the provisions of the resolu-
tion.

Paragraph 679 Section 2.
It is understood and provided that
such right, license and permission
to use such alley is subject to the
continuous control of the City Coun-
cil of the City of Dubuque, reserving
the right to impose restrictions or
conditions upon the enjoyment there-
of, as may be reasonably necessary
for the protection of the public in-
terests, including the right to revoke
and rescind such permission, if at
any time the public interest should
require such revocation. If and when
such permit, right and license is
revoked by said City Council, said
owners, lessee, and sub-lessee, their

remove such unloading platform at
their own expense, and restore such
part of the alley as has been occupied

approval by the City Council, and
publication as provided by law, and
the rights hereunder shall accrue to

the indebtedness evidenced by said
judgment by the issuance of Fund-
ing Bonds of said city, and
Whereas, before proceedings are
instituted for the issuance of said
Funding Bonds it is necessary that
notice of such proposed action be
given to the taxpayers of said city;
