Resolution and application for
authority to levy an emergency tax
Tor the City of Dubuque.
Whereas, the City Council of the
City of Dubuque has made a com-
pilation of the expenses which will
be incurred during the fiscal year
beginning April 1, 1939, and ending
March 31, 1940, including the pay
went of principal and interest upon
outstanding indebtedness, and tax
levies for the various funds and
purposes have been determined;
and
Whereas, a serious effort has
been made to keep operating costa
as low as is consistent with good
government; and
Whereas, in the past bonds have
been issued in anticipation of some
of the taxes embraced in the con-
solidated tax levy and therevenuea
derived from such taxes are pledged
to the Payment of such bonds, as
to principal and interest; and
Whereas, payments of $4fi,000.00
in principal, and of $17,475.00 in
interest are to be made during the
fiscal year beginning April 1, 1939
and ending March 31, 1940, from
the fmids embraced in the conso]i•
dated tax levy; and
Whereas, the inadequacy of the
revenues for ordinary purposes re-
maining after the payment of such
principal and interest constitutes
an emergency which requires the
levy of an emergency tax a.nd this
Council considers the levy of an
emergency tax of one (1) mill to
be absolutely necessary; Now,
Therefore,
Be R Resolved by the City Coun•
cil of the City of Dubuque that the
.State Comptroller be and he is
hereby requested to authorize and
approve the levy of an emergency
tax in the year 1938 to be approx-
imately $34,235,00, the same to be
used in supplementing the funds
required for debt service and in
the manner provided by law,
The foregoing resolution was
adopted at an adjourned regular
meeting of the City Council of the
City of Dubuque on the 5th day of
July, 1938.

cilmen Van Duelman and Wharton,
Mayor Clark read the call and
stated that service thereof had
been duly made and that this meet-
ing is called for the purpose of con-
sidering any objections which
,might be filed by taxpayers to the
proposed action of the City Coun-
cil to issue $55,000 Funding Bonds
and if no objections are filed, then
there will be introduced a reso-

mills. Approval of this levy is also
subject to any subsequent reduc•
tion in city levies due to an appeal
of taxpayers.

WHEREAS, a request has been filed
with the City Council of the City of
Dubuque to vacate that portion of

lots, which request has been sub-
mitted to the Planning and Zoning
Commission for its recommendation
or approval; and,
WHEREAS, said Planning and Zon-
ing Commission has filed its recom-
mendation with the Council wherein
it recommends the granting of the ~
request; and,
WHEREAS, there has been installed
and exists in said alley a storm sewer
installed at a depth from four (4) to
six (G) feet, the continued existence
and maintenance of which is neces-
sary for the proper drainage of the
surrounding district; and,
WHEREAS, this Council finds no
objection to said vacation of said por-
tion of said alley with the reserva-
tion of an easement for the right of
way for said storm sewer, and right
of access to the same for the main-
tenance thereof, as said alley serves
no other public purpose than as a
right of way for said storm sewer,
and that in all probability will never
be needed or useful as a public thor-
oughfare for any other purpose;
NOW, THEREFORE, be it ordained
by the City Council of the City of
Dubuque:

It is understood and provided that
such right, license and permission to
use such alley is subject to the con-
tinuous control of the City Council
of the City of Dubuque, reserving
the right to impose restrictions or
conditions upon the enjoyment there-
of, as may be reasonably necessary
for the protection of the public inter-
ests, including the right to revoke and
rescind such permission, if at any
time the public interest should re-
quire ouch revocation, If, and when
such permit, right and license is
revoked by said City Council, said
owners, and lessee, their heirs, suc-
cessors and assigns, shall remove such
unloading platform at their awn ex-
pense, and restore such part of the
alley as has been occupied thereby,
to the same condition it was in prior
to the construction of such platform.

This ordinance shall be in force,
and effect ten (10) days from and
after its final passage, adoption and
approval by the City Council and
publication as provided by law, and
the rights hereunder shall accrue to
said C. A, Voelker Estate, owner;

cessors and assigns, when the provi-
sions hereof shall have been accepted

Be it ordained by the City Council

PAR. 691, Section 1. That the
Trausch Baking Company, a co•
partnership, consisting oP John P.
Trausch, Arthur Trausch, and Wil-
liam M. Clemens, their heirs and as-
signs, be, and they are, hereby au-
thorized to build, install and main-
tain an underground coal unloading
hopper and coal storage bin in Sa-
litta Street, in the rear of, and adja-
cent to Lot Four (4), Black 11, of
Dubuque Harbor Company's Addition
to the City of Dubuque, said coal
storage bin to be sixteen feet (16') in
length, and extending out into Salina
Street, and under the surface of the
street for a distance of six (6) feet,
attd said coal unloading hopper to ex-
tend out from said coal storage bin
into Salina Street and under the sur-
face of said street a distance of eight
(8) feet, and to be eight (8) feet in
width.
PAR. 692. Section 2. Said coal
storage bin shall be constructed and
built oP reinforced concrete of suffic-
ient strength and constructed and
maintained in such a manner as to
make travel upon and over Salina
Street perfectly safe and as to pre-
serve the condition of said street as
perfectly as though no such storage
bin existed,
PAR. 693, Sectinn 3. Said coal un-
loading hopper shall be constructed
and built of reinforced concrete and
steel plate and plank top, and shall
be constructed and maintained in
such manner as to make travel upon
and over Salina Street perfectly safe
and as to preserve the condition of
said Salina Street as perfectly as
though no such unloading hopper ex-
isted.
PAR. 694, Section 4. Said under-
ground coal unloading hopper and coal
storage bin shall be constructed under
the supervision of the building com-
missioner of the City of Dubuque, and
shall be constructed and maintained
in accordance with the Provisions
of the ordinances of the City of Du-
buque relating thereto. Should the
City of Dubuque at any time deem
said underground coal unloading hop-
per, or coal storage bin unsafe, or
for any other reason deem its removal
necessary or advisable, said Ctty Wray
order the immediate removal of the
same, and the restoration of the
street in question to its proper condi-
tion, within a reasonali]e time after
said order is given, and, upon the
refusal of said co-partnership, or the
members thereof to remove the same,
the City of Dubuque pray do so, at
the expense of said company.
PAR. 695, Section 5. Said Trausch
Bolting Company, and the individual
members of said co-partnership, shall
agree, as a condition to the granting
of this privilege, and shall guarantee
by the acceptance oP the terms hereof,
to fully protect and save the City of
Dubuque harmless as to any claims,
damages, or liabilities of any kind
which may arise because of the con-
struction and maintenance of said
underground coal unloading hopper,
and coal storage bin, and any and all
claims, damages or liabilities that
may arise or be incurred by reason
of the grant of the privileges herein
made, and in any suit rvltich may
arise because of said underground
coal unloading hopper, or coal storage
bin, said co-partnership, and the in-
dividual members thereof shall, at the
direction of said City of Dubuque,
make all necessary defense to said
suit, and fully indemnify said City
far any expenses or liabilities to
which said City of Dubuque may be
subjected, because of said suit.
PAR. 696, Section 6. That this or-
dinance shall be in force and effect
ten (10) days from and after its final
passage and adoption by the City
Council, and publication as provided
by law.

tank.in Salina Street, in the rear of
and adjacent to Lot One (1) of Lot

Company's Addition to the City of Du-
buque, with certain conditions, obli-
gations nod restrictions regarding the
same:
Be it ordained by the City Council
of the City of Dubuque:
PAR. 697. Section 1. That the
Trausch Baking Company, a co-
partnership consisting of Sohn P.
Trausch, Arthur Trausch, and Wil-
liam M. Clemens, their successors
and assigns, be, and they are
hereby authorized to build, install
and maintain an underground gaso-
line storage tank in Salina Street in
the rear of and adjacent to Lot One
(1) of Lot One (1) of Lot (1) of Lat
Three (3), Block 11, of Dubuque Har-
bor Company's Addition to the City
of Dubuque, with pipe connections to
the building of said Trausch Baking
Company located upon said lot, said
underground storage tank to be ap-
proximately ten (10) feet in diameter,
and twenty (20) feet long with con-
nections to the building on said lot;
the top of said tank to be at least
three (3) feet below the grade or sur-
face level of said street; said tank
to be anchored to a concrete base of
sufficient weight to properly hold and
maintain the same in place, and said
connections from said tank to said
building to he encased in concrete.
PAR. G98, Section 2. That the in-
stallation of said tank and connec-
tions for same will be built or in-
stalled under the supervision of the
Building Commissioner of the City of
Dubuque, and iu accordance with the
underwriter's specifications for same,
and all ordinances of the City of Du-
huque relating thereto, and said stor-
age tank shall be built and installed
in such a manner as to make travel
upon and aver Salina Street perfect-
ly safe, and in such manner as to
preserve the condition of said street
as perfectly as though no such stor-
age tank were installed.
PAR. 699. Section 3. That should
the City of Dubuque at any time deem
said underground storage tapir un-
safe, or for any other reason deem
its removal necessary or advisable,
said City may order the immediate
removal of the same, and the restora-
tion of the street in connection to
its proper condition, within a reason-

Trausch Baking Company, and the

shall guarantee by the acceptance oP
the terms hereof, to fully protect
and-save the City of Dubuque harm-
less as to any claims, damages or
liabilities of any hind which may
arise because of the construction and
maintenance of said underground stor-
age tapir, and any and al] claims,
damages or liabilities that may arise
or be incurred by reason of the grant

any suit which may arise because of

cil held on March 7, 1938, the peti
tion of the Perfection Oil Company
for permission to construct a silt
track over and across part of Kim
ball Street and part of the alley
first east of Rhomberg Avenue
lying between Lincoln Avenue any
Kimball Street was referred to the
Council to view the grounds. Thy
Council did so view the grounds of
two occasions, the last being a
July 8th after the proposed cor
struction was staked out. The de-
cision of the Council was that the
request of the Perfection Oi] Com-
pany be granted on the conditions
that the Company donate a like
amount of land on the easterly side
of the present road, put the re-
located roadway in substantially
the same condition as the present
one and pay for the cost of tho
necessary relocation of the exist-
ing fire hydrant to a suitable point.
I recommend that the decision of
the Council be confirmed.

Gentlemen:
I have heretofore discussed in•
formally with the ruembers of tho
Council, the matter of revision of
the city ordinances and the com-
pilation or codification of all exist•
ing ordinances now in force.
I find that the ordinances of our
city have not been codified or com-
piled since the 22nd day of July,
Special Session, July 12th, 1938 151
1919, prior to the adoption of the
City Manager Form of government.
The change in the form of our city
,government made by the adoption
of the City Manager form neces-
sarily abrogated many of the pro-
visions of the existing ordinances
regulating the administrative
affairs of the city, and necessitated
the repeal of many ordinances and
changes by amendment of many
others. Since the change in our
form of city government, which
was made in the year 1920, the pro-
ceedings of the Council have been
published in book form, one vol-
ume for each year including the
year 1920, in all eighteen different
volumes each averaging about five
hundred pages of double column
type,
Due to the fact that no codifica-
tion or compilation has been made
of the ordinances since 1919, it is
now necessary, in order to ascer-
tain the exact present situation
relative to any mattet• or situation
covered by ordinances to first as-
certain whether any ordinance cov-
ering the situation is contained in
the revised ordinances of 1919,
and then whether any change has
been made in any such ordinance,
or any othet• ordinance adopted
since then, by thumbing through
the entire eighteen volumes of the
council proceedings printed since
that time. This is a very burden-
some task and does not make for
efficiency, particularly when one
is asked for a prompt or hurried
opinion on the matter of whether
a particular situation is covered
by ordinance.
I have made some preliminary in-
vestigation of the matter and find
that it may be possible to have a
revision and compilation of all of
the ordinances of our city made,
and have the work done as a WPA
project, under the sponsorship of
the city, and under proper legal
supervision, in which project the
Federal Government would pay Far
all of the clerical help, and the
only expense to which the city
would be put would be the furnish-
ing of quarters for the doing of the
work, and materials used in doing
the work.
I firmly believe that this is a
matter of urgent need and for the
best interest of the city, and I
would respectfully request that you
authorize me to confer and nego-
tiate with proper officers of the
Works Progress Administration of
the Federal Government to the end
that our city ordinances may be
revised and codified as a WPA pro•
ject under proper supervision and
under the sponsorship by :he Pity
of Dubuque.

penalty and interest charges paid
on the redemption of the tax sale
certificates held by the City of Du-
buque against Lot 2 of Lot 1 of
City Lot 731 was referred to the
City Managet• and City Treasurer
for an investigation and report.
We find from the records that
the assessment levied for the im-
provement of Dodge Street, desig-
nated- Fund No. 323, was delinquent
in the amount of $76.99 on April
1, 1926A at which time the City ac-
gnired a tax sale certificate for
that amount. On May 4, 1938, St.
Joseph's Mercy I3ospital redeemed
from this tax sale certificate by
paying $136.90 of which the City
of Dubuque received $132.98.
We' recommend that the matter
be closed by granting a refund of
the difference between $132.98 and
5% Per annum interest charge from
April 1, 1926 to May 1, 1938, plus
advertising costs.

for an investigation and report,
We find that an assessment was
levied for the improvement on
Dodge Street on October 2, 1929 in
Fund No. 868 in the amount of
$1,406.21 on which payments were
made in 1930, 1931 and 1932 for a
total of $662.49, leaving a balance
at that time of $843.72. No further
payments were made and on Feb•
ruary 3, 1936, the property was sold
to Dubuque County at a public
bidder tax sale far $421.86, plus
interest to date of sale of $202.47,
plus 4% penalty of $24.97 on which
interest has accumulated front the
date of the sale, namely February
3, 1936, in the amount of $96.53,
or a grand total at the present time
of $745.83. Since the date of the
sale three installments remain de-
linquent and unpaid in the amount
of $421.86, plus penalties and in-
terest.
We recommend that the Dodge
Street assessment be settled by
two separate adjustments- Tha
first adjustment recommended is
that a refund be granted for the
difference between the amount nec-
essary to satisfy the scavenger sale
and $421.86, plus 5% per annum
from February 3, ].936, to the date
of the redemption, plus advertising
costa. The second adjustment rec•
ommended would be to have the
County Treasurer instructed to ac•
cept, in satisfaction of the install-
ments which have become delin-
quent since the date of this sale,
namely $421.86 at 5% per annum
from March 31, 1936, plus advertis•
ing costs.
We find that there was levied
against this property for the im-
provement of Main Street on March
27, 1934,, in Fund No. 945 an as•
sessment of $610.90 from which a
reduction in the amount of $153.27
was granted, leaving a net bal-
ance of $357.63. No payments were

made of interest or principal for
this improve-~nent• On February 3,
1936, Dubuque County bid the pro•
perty in for the delinquent inter-
est. Since that time two in~tall~
menu of principal of $51.09 each
have become delinquent and there

payments in the principal amount

We recommend that the Main
Street assessment be settled by the
owner dealing directly with the
County on the certificates held by

in the sale of February 3, 1936,
which amount is approximately
$45.19, and on the principal adjust-
meut arefund be granted follow-
ing the redemption of the property,
based on the difference of the
amount paid in and $357.63, plus
5% Per annum from April 1, 1936,

pursuant to such permits; restrict-
ing dancing and providing a licettso

Mr. Jos. J. Bertsch, owner of the
Merchants Hotel, addressed the
Council relative to the disturbance
being created from the dine and
dance permit being operated at
Norton's Tavern adjoining his ho-
tel and further stating that guests
after registering at the hotel are
compelled to leave due to the dis-
turbance being created at this dine
and dance tavern and further re-
questing that he be granted relief
from this disturbing of the peace.
Mr. Charles Adams addressed the
Council complaining of the disturb•
ante being created at the dine and
Banco tavern known as At•cade Tav
ern and further stating that min-
ors are employed at this tavern.
Councilman Murphy moved that
the complaints submitted to the
City Council relative to the nuis-
ance being created due to the is•
suance of dine and dance pet•mits
to beer taverns and also the loud
noises in taverns caused by the
playing of mechanical musical in-
struments in beer taverns be re-
ferred to the Police Department
with instructions that the City
Ordinances be enforced. Seconded
by Councilman Thompson. Carried
by the following vote:
