Council met at 8:10 P. M.

Mayor Chalmers stated that this
is the regular monthly meeting of
the City Council for the purpose o~
acting upon such business as may
properly come before the meeting.
Resolution No. 65-37
Whereas, the Board of Trustees
of Carnegie-Stout Public Library of
the City of Dubuque proposes to
enter into contracts for deeds of
real estate located within said City
and described as follows: north
seventeen Feet, two inches (N. 17
ft. 2 in.) of lot six hundred fifty-
eight (658) and south sixteen feet,
two inches (S. 16 ft. 2 in.) of east
half of lot six hundred fifty-nine
(659) in the Town (now City) of
Dubuque, said property being now
owned by the estate of J. J, Nagle,
deceased; and the south middle
thirty-two feet (32 ft.) of lot six
hundred fifty-eight (658) in the
Town (now City) of Dubuque, said
property being now owned by Cyril
D. Lagen, Louis J. Lagen and Jo-
seph T. Lagen; and
Whereas, such contracts have
been duly prepared and submitted
by said Board of Trustees to thia
Council for its approval; and
Whereas, it appears therefrom
that said property is needed for
the- purpose of enlarging the
grounds of said library: Now,
therefore,
Be it resolved by the City Coun-
cil of the City of Dubuque that the
contracts referred to in the pre-
amble hereof be and the same are
hereby approved, and the City
Clerk is directed to certify such
approval upon said contracts.

RESOLUTION AND APPLICA•
TION FOR TEMPORARY
TRANSFER OF FUNDS,
Whereas, the Board of Trustees
of Carnegie-Stout Public Library
deem it necessary and advisable to
enlarge ]ibrary property in order
to furnish adequate light and air to
existing library buildings and to
provide for future expansion and,
in order to do so, it is imperative
that certain adjoining property be
purchased; and
Whereas, a satisfactory price has
been agreed upon between the
Owners of said properties and said
Board of Trustees for the purchase
thereof; and
Whereas, in order to acquire
such properties it will be neces-
sary to make initial payments
thereon aggregating the sum of
$3,500,00, the whole of such pur-
chase price being $16,000.00 and
the same to be financed by a tax to
be levied in 1937 for.ths~ Library
Building Fund; and
Whereas, the City of Dubuque
has no available funds with which
to make such initial payments; and,
Whereas, the City Treasurer of
said City has on hand in the Water•
works Operation Fund a balance of
more than $40,000.00 received from
receipts in the operation of the
Waterworks and $3,500.00 of which
will not be needed in the conduct
of its business for a period of at
least ten (10) months and until
such amount is realized from such
special tax to be levied in 1937 for
the Library Building Fund; and
Whereas, it is proposed to repay
to the Waterworks Operation Fund
of said City the amount hereby
transferred front funds to be real-
ized from such special tax for the
Library Building Fund on or about
April 1, 1938: Now, therefore,
Be it resolved by the City Cohn-
cil of the City of Dubuque, subject
to the approval of the State Comp-
troller, that there be and there is
hereby temporarily transferred
from the Waterworks Operation
Fund to the Library Building
Fund the sum of $3,b00.00, and the
State Comptrollr is hereby peti-
tioned to authorize and approve
such transfer, the same to be re-
turned to said Waterworks Opera-
tion Fund on or about April 1,
1938.
Be it further resolved that, upon
the approval of such transfer, the
Auditor of the City of Dubuque is

The resolution was adopted and

BATHING POOL
This commission agrees to use
reasonable diligence in the opera~
tiara of this pool but will not be '
responsible in case of accident,
property loss or damage. Obey the
life guards at• all times, They are
here for your protection.
Rules
1, All patrons of the Municipal
Bathing Pool shall be required to
wear complete bathing suits,
Trunks alone will not be permitted,
No shorts will be allowed. Private
suits not properly laundered or
which fade will not be allowed in
the pool.
2. No persons, will be admitted
while under the influence of liquor
nor will the use of intoxicating
liquor be permitted on the prem•
ises.
3. Everyone using swimming
pool must take a thorough shower
bath using soap and water for at
least five (5) minutes with suite

4. No pe~•son shall be admitted
while suffering from colds, fever,
cough, inflamed eyes, skin diseas•
es, venereal disease, sores, scabs,
or whilE wearing bandage. Also
persons shall be prohibited from
using the pool if the Healtll Officer
or any Doctor states that their
health is such that they should not
enter.
5. Toilets and urinals should be
used before entering pool.
6. No disorderly conduct or un•
due roughness will be permitted.
This includes ducking, tagging,
pushing and holding. Complaints
should be reported to the manager
at the pool.
7. Chewing gum, tobacco in
any form, food, or drinks will not be
permitted except at the concession
stand or at areas specifically set
aside for that purpose.
8. SAitting in the pool, corridors,
walk or dressing rooms is pro-
hibited,
9, All persons renting towels,
suits, or basltets must return the
same to the attendant before leav-
ing. The loss or damage of the
rented equipment nnist be borne
by the individual,
10. No play equipment will be
allowed in the pool or on the
grounds except as approved by the
management.
11. The hours of operation of
this pool will be at the discretion
of the management but in no case
will it be open before 10:00 A, M,
or 'after 10:00 P. M. Pool will open
Sundays at 1:00 P, M. When clos-
ing time is signaled all persons will
leave the pool immediately.
12. Children under ten (10)
years of age will not be admitted
unless accompanied by a parent of
other adult who will be responsible
for the child.

An ordinance granting Klauer Manu-
facturing Company the right to con-
struct and maintain a car-loading
platform and canopy upon public pro-
perty subject to certain restrictions.
lte it ordained by the City Council
of the City of Dubuque:
Section 1, That Klauer Manufactur-
ing Company be and it is hereby
granted the right and authority to
construct and .tnaiutain a concrete
car-loading ptatYorm and canopy in
accordance with plans and specifica-
tions prepared therefor on East 10th
Street abutting premises owned' and
occupied by said company.
Section 2. That no rights of ease-
ment or interest in, to and over the
public property upon which such plat-
form and canopy are to be construct-
ed and maintained shall ever vest
in said company by reason of the
permission hereby granted, ahd said
company shall, whenever it is deem-
ed necessary and advisable by the
City Council of the City of Dubuque,
in the interest of pubic use and/or
convenience, cause such structures to
be removed at its own expense and
within thirty (30) days after it has
received written notice to remove the
same.
Sectign 3. This ordinance shall be
in force and effect ten (10) days from
and after its final passage and adop-
tion by the City Council and publica-
tion as provided by law.

Resolution to authorize the issue
of $149,000.00 Funding Bonds of
the City of Dubuque.
Whereas, the City of Dubuque, in
the County of Dubuque, and State
of Iowa, has outstanding legal, bind-
ing and subsisting indebtedness to
an amount of not less that}
$149,000.00 evidenced by a judg-
ment rendered against said City
in all respects duly,, properly and
legally issued by the proper court
and now outstanding; and
Whereas, there are no funds with
which to pay said judgment; and
Whereas, it is deemed for the
best interests of said City that thy,
indebtedness thereof, evidenced by
said judgment aforesaid, in the
amount of not less than $149,000.00

tended and funded, and that Fund-
ing Bonds of said City be issued
therefor; and
Whereas, notice of the proposed
action of this Council to institute
proceedings for the issuance of the
bonds hereinafter authorized- was

a newspaper of general circulation
within said City, as required by
Section 363, Chapter 23, Cade of
Iowa, and no petition objecting to
such proposed action was filed;

Be It Resolved by the City Coun-
cil of the City of Dubuque, in the
County of Dubuque, State of Iowa,
as follows:
Section 1. That for the purpose
of settling, adjusting, renewing, ex•
tending and funding said legal, bind-
ing and subsisting indebtedness of
said City now outstanding and evi-
den~ed by a judgment rendered
against said City to an amount of
not less than $149,000.00, there are
hereby authorized and ordered is-
sued the negotiable coupon bonds
of said City of Dubuque, in the
County of Dubuque, State of Iowa,
to the amount of $149,000.00.
Sec. 2, That the bonds hereby
authorized and ordered issued' be

dated June 1, 1937, be numbered
consecutively from one (1) to one
hundred forty-nine (149), both num•
hers included, be of the denomina-
tion of one thousand dollars

Centrifugal Pumping Unit for re•
placement of the approximately 23
year old, electric pump at the Kauf-
man Avenue Water Station. Full
information was then submitted to
several leading firms in the United
States. Bids were to be received
at 10:00 A. M. on June 7th, includ-

of this new equipment. The fourth
bid, from the DeLaval Steain Tur•
bine Company, includes the orig-
inal price at $431.00 higher than
the lowest offer. The cost of op-
eration of power for the DeLaval
Steam Company unit will be ap-
proximately 4.5% less than the
lowest priced unit costs. It would
take approximately 8 to 9 years to
eliminate this $431.00 of higher
costs if the DeLaval Steam unit
were purchased.
Accordingly; the analysis of
these complete bids, as made by
the Water Superintendent and City
Manager, includes our recommend,
ations that the lowest bid for the
complete equipment and install~~

Gentlemen: On May 3rd,an ap•
peal was made to the City Council
by Mr. F. P. Fuhrmann, who owns
the building at the northwest Cor-
ner of 9th and Central Avenue. His
request was to be authorizer to
eliminate the present 4' wide wood-
en steps from the second floor to
the sidewalk on the north SidB of
9th Street, near the alley west of
Central Avenue.
The decision by the City Coun•
cil on June 7th was that Mt•. Fuhr•
morn would have authority to re-
rnove the presertt wooden steps on
9th street and could install from
the second floor to the alley at
the rear of this building, a 3 foot
wide iron or steel set of steps.
This new set of steps must be over
the present steps that extend from
the alley to the basement,
The furthet• provision was that a
$5,000.00 bond must be filed with
the City Council in regard to these
two sets of steps in the city alley.
On June 8th Mr. Fuhrmann was
advised of this condition and he
called later, stating that he could
not afford to make a set of steel
steps and could not possibly pro-
vide for a $5,000.00 bond. Ac•
cordingly, his decision was that no
changes would. be made at present
on the existing four foot wide
wooden steps leading ft•om his sec-
ond floor to the 9th Street side-
wallr,

Gentlemen: On May 24th at tlfe
special Council meeting the letter
from the City Manager and the bill
from the Dubuquo Airways, InCor•
Oorated, was referred back to the
Manager. Attached are this same
letter and bill.
Since May 24th investigations
have been made several times at
the airport. Robert Swartze~l, a,
local young man, has been the li•
,tensed pilot for several months,
He is at the airpot•t in day time.
He has available two local planes.
One plane provides seats for the
pilot and one extra passenger. The
other plane provides for two extra
passengers. Both planes are now
operating, but both shall be seli•
arately checked and repaired, if
necessary, prior to July 1, 1937•
Mr, Edw. Tegeler, the President
of the Dubuque Airways, Incorpor-
ated, states that since the contract
was authorized last summer, they
have performed all duties as were
required at the airport.
The contract provides, in Section
III, that the City of Dubuque shall
pay $26Q.00 per each fall, winter
and spring; we must pay monthly
telepfione costs and pay for fire
insut•ance on the hangar; labor and
equipment must be furnished by
the City to cut grass and weeds
and smooth and roll the airport
runways.
The 16th Street road to the air,
port has been repaired and still
must be finished in regard to wid•
er areas and the replacement oP~
fences to protect trafec. The' grass
and weeds have been cut on the
airport area.
As of May 31, 1937, the cash
balance to the Airport Fund was
$552.44. Accordingly, it is the writ,

present there are only six Library
Board members. The ordinance
provides for seven (7) members.

TRANSFER OF FUNDS.
Whereas, the Board of Trusteed
of Carnegie•Stout Public Library
deem it necessary and advisable
to enlarge library property in order
to furnish adequate light and air
to existing library buildings and
to provide for future expansion
and, in order to do so, it is im-
perative that certain adjoining pro•
party be purchased; and
Whereas, a satisfactory price
has been agreed upon between the
owners of said properties and said
Board of Trustees for the purchase
thereof; and
Whereas, in order to acquire
such properties it will be necea•
nary to make initial payments
thereon aggregating the sum o1;
$3,500.00, the whole of such pur•
chase price being $16,000.00 and
the same to be financed by a tax
to be levfed in 1937 for the Library
Building ,Fund; and
Whereas, the City of Dubuque
has no available funds with which
to make such initial payments;
and
Whereas, the City Treasurer of
said City has on hand in the Wat-
erworks Operation Fund a balance
of more than $40,000.00 received
from receipts in the operation of
the Waterworks and $3,500.00 of
which will not be needed in the
conduct of its business for a per•

until such amount is realized from
such special tax to be levied in
1937 for the Library Building
Fund; and
Whereas, it is proposed to repay
to the Waterworks Operation Fund

Gentlemen: In past summer sea-
sons, when swimming was per•
formed in the river at Eagle Point;
the Milwaukee Railroad Company
furnished a guard at the railroad
mrossing on Beach Street, just
north of tho City Water Plant,
Now that the new Swimming
Pool is located south of Beach
Street, it is apparent that traffic
will use Hawthorne Street to ap-
proach the pool and likEly moat
of the traffic, after parking, will go
out and cross the tracTts at Beach
Street.
Mr. Box, of the Milwaukee Rail-
road Company, states that only one
guard can be Provided this sum-
mer. Due to the curve in the rail-
road Tracks, just north of Beach
Street, it is apparent that Beacb
Street is far more hazardous to
traffic than Hawthorne Street. The
guard has again started service at
the Beach Street crossing,
Possibly one provision to elim•
inate accidents at .the Hawthorne
Street crossing would be for the
City Council to authorize the pla~-
ing of a "Stop" Sign at both sideg
of Hawthorne Street at this cross
ing.

ery, a grocery store operator at
626 Central Avenue, submitted a
letter requesting the Council to
eliminate parking oY cars and
trucks in front of her stare. An
investigation was made by the
Iowa State Planning Board, which
group is making an analysis of traE•
flc conditions in Dubuque.

During 12 hours in day time of May
7th,. from 7:00 A. M, to 7:00 P. M.,
the analysis includes: Violations of

ing in the block between 6th and
7th Streets on Central Avenue and

Gentlemen: Dr. W. J. Connell
made an appeal to the City Coun-
cil on May 24th, 1937, to control
all possible dogs in this city. A
study was made at the County
Court House in regard to all city
owners of dogs. This total vlaS

listed as 2173 dogs. Immediately
information was submitted to all
these owners, except about 100
citizens who had already secured
and paid for licenses for their dogs
thus far, since April 1, 1937.
To June 23rd our 1937 total of
dog licenses is 490. In addition
to the $1,00 charge for a male dog
license, an 8% additional penalty
fa charged due to delinquency,
Starting on July 1, 1937, all other
dog licenses will be charged at a
10% penalty. The total fiscal rev,
enue for dog licenses to March 31,
1935 was. $156.23; to March 31,
1936=$134.77 and to March 31, 1937
=$634.77. Several licensee are paid
each day lately.
After June 30, 1937, it is appar-
ent that the Police Department
shall have to check all dogs lo-
cated on streets, sidewalks and
lots without fences to determine
that the same dogs have city li-
censes. Non-licensed dogs should
be caught by the Police and sub-
mitted to the Humane Society for
certain days of reserve.
Many citizens have stated that
their private dogs are not licensed,
but the same dogs are not per-
mitted to leave their homes or
their fenced lots in order to pos-
sibly bite or damage citizens.
A11• possible efforts should be
made to eliminate hundreds of dan-
gerous and cross dogs that are now
still not licensed and are still run,
ping on streets and alleys in the
city.
It is hoped that no rabies will
occur in this city. However, all
possible dogs that are not kept in
homes should be tied up or elim-
inated in case of no licenses.

ed this area on November 7, 193fi,
and authorized the request to be
performed. Unfortunately Mr. Con•
nolly died, but. his former property
is still damaged by this high
ground.
Thus far no opportunity hoe re•
suited in our Street Department be-
ing able to perform this work.

have been made, to have refunded
by the City Council extra penalties
and costs of certain property own-
ed by Mrs. Mary Fink. Mrs. Fink
lives at 1380 Reeder Street- The
fund is 826 for the sanitary sewer
in Reeder Street as levied on Aug-
ust 13, 1929, for Lot 14 Langwor-
thy a Add.
A payment was made on April
3, 1937, to redeem the- 1932, 1933,
1934, 1935 and 1936 special assess-
ments on this lot due as of March
31st each year. The amount due
March 31, 1937 has not yet been
paid. The actual money received
from the County Auditor and
Treasurer was $113.88, including
$68.15 for five yearly special as-
sessments and $45.73 for interest
and penalty- The total interest
due to March 31, 1937 on the
amounts that had not been paid
was $28.62• In other words, the
penalty as listed for scavenger sale
on this special assessment was
$17.11. Mrs. Fink is very desirous
of getting this refund.
Mrs• Fink is 80 years of age,
not in good health and she has no
available cash at present.

Gentlemen: At the August 3rd,
.1936 Council meeting an appeal
was .made to the City Council to
extend the city water main in
Sabula Street between Muscatine
.and Burlington Streets- Also a
second appeal was made to open
and extend Sabula Street between
these same two streets. This was
referred to the Manager.
Last fall the city water mains
were extended and now all local
'homes are furnished with water at
this area.
Sabula Street extends southwest
from Muscatine Street about 200
feet, but Mineral Lot 346, owned
by Mr. N. Grommersch, diagonally
extends over the possible intersec-
tion of Sabula Street and Burling-
ton Street- Mr. Grommersch's barn
is located on this possible inter-
section. Since Mr. N. Grommersch
has not agreed to donate a triangle
area to the city, including approxi-
mately 160 x SO feet, it has not
been passible to provide for these
extensions of Sabula and Burling-
tion Streets to arrange for the
proper intersection.
Accordingly, the water is pro,
vided, but the intersection could
not be provided without payment
by the city for this land and also
'the cost of moving the present
barn.

street area is not open for traffic.
The location is south of Mr. F. H.
Hying's home and possibly 300 feet
higher than East 32nd road.
This Elbow Street area was
checked and staked by the City
-Engineering Department, Signs
were Placed on the area for no
plowing .or no garden use- We
were advised later that a man, who
lives just north of the city area,
was starting to plow this area. He
was personally warned not to loos-
en this ground as it would cause
damage to Mr. Hying's property
if there was a heavy rain~
Thus far, to my knowledge, no
violation or damage has been done.

made a request to the Council on
March 29th that an effort be madq
to securs~ a Federal Grant to fi•
nonce many repairs to the various
local Fire Stations.
The W. P. A, officials were con,
tatted, but thus far no approval
of any repairs has been author-
ized. The Ninth Street Main Fire
Station has a very bad wooden
floor where the fire equipment is
stored- Other stations have also
bad main floors, broken doors and
many other difficulties that should
be improved.
If relief cannot shortly be pro,
vided, it would seem that your
1937-8 emergency fund could be al-
lotted to these improveurents on
the basis of from $5,000.00 to
$10,000.00 for these necessary im-
provements. Otherwise these floors
may fall and thus damage the
heavy fire equipment.

110 Southern Avenue, made a re-

small lots west of his home. These
lots are 9 and 10 of Randall'a Sub.
No, 2. The offer for purchase oY
both lots was $100.00. The Coun-
cil determined to view this area,
Tho investigation was made on
November 10th, 1936. Again at a
meeting of November 10th, 1936,
authorization was to sell these two
lots to Mr. Wyburn for $100.00 in
cash.
Mr. Wyburn was advised of this
decision- Mr. Czizek and Mr• Shea
provided a contract and deed for
this purchase. Thus far no pur=
chase has been made. Recently
Mr. Wyburn was contacted and
now he states that no mousy is
available for the purchase.
Accordingly, it would seem that
this sale should be cancelled.

Last fall this small street wa$
smoothed, gravelled and rolled by
the city. It is impossible to tar
or ail each year more than 5 to
10% of the unpaved city streets
at the expense of the general. fund.
Accordingly, Mr. Hoerner was
advised that if he could get some
used cil from any gasoline filling
station, the Street Department
would again smooth this street and
also spread the- used oil on' the
surface to prevent dust, This same

Gontlemen: Twelve citizens liv
ing within the 11th and 12th blocks
of Rosedale Avenue petitioned the
Council on June 21st to have Rose-
dale Avenue, from Weat Locust
Street west for three blacks, oiled
by the city,
Thus far to reduce the costs of
Street Department operation, no oil
or tar has been ordered by the
city. Possibly one carload must be
provided far repairing Dodge
Street and other steep sections
where traffic is heavy.
It is suggested, since Rosedale
Avenue is not steep, but that these
three blocks must be smoothed and'
rolled quickly, that used oil from
gasoline stations be secured by the
residents of Rosedale Avenue and
then the Street Department can
spread this ail to eliminate dust.
These residents do not favor as-
sessments for tarring or oiling the
street.

Gentlemen: Mr• C. E. Rhoades
of the Dubuque Auto Club made
certain requests to the Council on
June 7th, 1937.
The first was a statement that
numerous complaints were filed
with him that the one "Stop
and Go" signal, located at the mid-
dle of the intersection of West 14th
and Locust Streets, is too high.
The lowest portion of the signal is
14' above the top of the paving of
this intersection ae directly under-
neath said signal. This is the pro-
vision of the Iowa Code that 14'
must be the minimum where any
street light, signal, etc-, is above
any portion of a main street. Cer-
tain trucks, busses, etc., are ap-
proximately from 1 to 2 feet as
high as the 14:00 minimum of sig-
nals. Special- trucks, loaded by a
railroad car, etc-, have actually
been checked as they have operat-
ed on West Locust Street. Only
a few inches in reserve were
available to prevent no damage to
the city traffic signal. It is the
Manager's opinion that NO low-
ering of this Locust and 14th
Street signal, or any other traffic
signal, can be legally or safely
made.
Mr. Rhoades also suggested that
three diamond shaped warning
signs be provided and installed,
each 30D feet from this intersec•
lion, including 300' south, 300'
north on Locust Street and 300'
east on West 14th Street, where
the Federal Highways are oper•
sled. These three signs were to be
placed between the sidewalks and'
curbs- Readings on the signs
would be "Stop Sign 300' Ahead:'
The distances of 300' from this
signal on these three directions
could NOT possibly be used. On
West 14th Street, east of Locust
Street, 300' would actually occur in
Main Street- Again north and south
of West 14th Street on Locust
Street these propoeed signs would
also be in both of the 15th and 13th
Street intersections. The distance
of 300' must be either increased to
beyond the intersection, or de-
creased to about 250' so that the
extra signals would' be within the
blocks approaching the present
"Stop and Go" signal. Said three
warning signals, if provided, should
also be erected ahead of any large
trees so that traffic could see the
warning signal, also the signals
should-be placed at or very near
the division between lots in order
that said signals would not inter-
fere with citizens getting out of
their cars to their sidewalks, or
homes.
Another opinion is that a "Slow,
Sign," painted on the right side of
each of these three street paving
approaches to the Traffic Signal,
would be more efficient and would'
be cheaper.

ed new conaretie wall at the rear
of Mr. l7berhoffer's home, 911 High
Bluff Street, was also studied and
approved by the Council. Instruc-

Department should' extend this
wall, at city coat, for approximate-
I~ 13 feet in length and over 10
feet in heighth, as quicltly as pos-
sible, in the summer of 1937.
Nothing yet has been done on
this wall to protect traffic on
'Phomas Street.

the side hill is very steep. Water
runs onto the street and also runs
off the street toward the north
into private property on Chappel
Court,
Instructions have been given to
the Street Superintendent includ•
,ing: to widen the driving area of
Klingenberg Terrace in order that
two cars can pass; to malts a ditch
on the south side of the driviug
area in order that water running
onto this street from the south-will
not flaw over the street into 'the
northern private 'property; to
stone, smooth and 'roll the driving
area; and if necessary, to install
some raclt north of the driving
area to eliminate future possible
washouts at .private dots, -in order
that all surface water will flow
along Klingenberg Terrace toward
the east and then flow down -Kleine
Street to Kaufmann Avenue when
the largo storm sewer is installed.

cluded the fact that odors were
coming into the Fourth Street Ath-
letic Park due to dumping of ref-
use, bad fruits, orange peeling, etc.,
northwest of this location.
Efforts have been made since
then to eliminate all odors. Re-
cently Mr. Grabow states that no
odors are now at the Athletic Park,
Last year and this spring instruc-
tions were made to eliminate all
dumping of refuse material near
the East Fourth Street area.
