Petition of Midwest-Timmermann
Company et al requesting that they
be allowed to transfer the private
fire alarm bell system ennunciator
board from the 9th Street engine
house to then 18th Street alarm
headquarters, presented and read.
Councilman Kane moved to sus-
Pend the rules for the purpose of
allowing any one present in the
Council Chamber, who wishes to
do so, to address the Council. Sec-
onded by Councilman Murphy. Car-
ried by the following vote:

ance Agency informing the City
Council that Mrs. Ray Powers has
advised them that she does not
wish to have her Excavation Bond

Connell to authorize a letter of can-
cellation of liability as of the ef-
fective date which is August 5,
1937, presented and read.

the amount of $68.31, presented and
read.
Councihnan Kane moved that the
request be granted and that George
A. Eulberg be allowed to redeem
the Tax Sale Certificate No. 184
held by the City of Dubuque
against the westerly 150 feet of Lot
24 of Mineral Lot 149 upon the pay-
ment of the face value of the cer-
tificate plus 5°>o interest per aunutn,
the balance of penalties and in-
terest to be waived,, and the City
Treasurer to be instructed accm'd-
ingly. Seconded by Councilman

Dear Mr. Shea:
On September 4 the received
from you an application of the
City Council to transfer X6,500.00
from the Emergency Fund to the
Dock Maintenance Fund.
We have hesitated to approve the
transfer for the reason that during
the past few yi;ars receipts in the
Consolidated Fuud have beets inade•
quate to meet disbursements and
they have had to resot•t to various
means to meet expenses.
The present Emergency Fund
from which transfer is asked was
approved and levied to augment the
Consolidated Fund in case of neces•
sity and at this time the city has
not shown that the Cmnsolidated
Fund was in such condition that it
will not need the Emergency Fund
money before the close of the year,
This year an Emergency Tax of
less than .50 mills far 1938 collec-
tion was approved for the same
purpose as the previous year. It
has been the hope of this office
that the city could arrange its
finances so as to dispense with the
Emergency Tax altogether but so
long as it is being approved upon
the showing of necessity made by
the Council we do not believe the
money should be diverted other-
wise,
Our records also show that a
temporary transfer from the City
Bond or Sinking Fund to the Con•
solidated Fund has not been fully
repaid. This is another reason why
the money in question will no
doubt be needed in the Consoli-
dated Fund.
1Ve regret the delay in deciding
this question and also that we can•
trot cooperate tvitlt the Council and
Dock Board in approving the trans-
fet• but under the circumstances
we do not believe it advisable and
the papers are returned not
approved.

temporary transfers the ask that
you check your t•ecords and advise
if any have been returned recently
or when the money will be re-
turned.

Highway Commission calling the
attention of the City Council to
Section 324 of the Motor Vehicle
code, under which section, they
may establish speeds greater than
those provided by law, and advising
Council that the Iowa State High-
way Commission do not suggest the
stepping up of speeds in school and
business districts but that they
would suggest that in the outlying
sections of town where the houses
are 200 feet apart, which are now
marked as residence districts speed
limit 25 miles per hour, that the
municipalities enact an ordinance
establishing such districts as spe•
cial districts with a speed limit of
35 miles pet• hout• or as suburban
districts with a speed limit of 46
miles per hour and farther advising
Council that if an ordinance is
enacted establishing either of these
districts and furnishing the Iowa
State Highway Commission with a
copy of the same that they will be
glad to erect these special or subur-
ban district speed signs on the
primary road extensions without
cost to the City, presented and
read.

the City Manager to make a survey
and submit his report to the City

1~'HERIAS, there exists in the
City of Dubuque a Board of Dook
Commissioners which has jurisdic•
tier and control of dock property,

including the harbor and water-
fronts of said City; and
WHEREAS, for several years the
harbor has been filling up with silt
and mud so that it has become use•
less for the harboring of water
craft and other purposes incident
to the proper operation of the•
docks; and
WHEREAS, in order to clean out
and dredge said harbor and to
make other improvements related
to the operation of the docks at
Dubuque, the City of Dubuque pur•-
chased and caused to be built a
dredge at a cast of approximately
$30,000,00, which dredge is now
ready for use and operation; and
WHEREAS, competent engineers
have determined that to dredge the
harbor and make certain other con•
templated improvements, it will re-
quire several mouths of operation,
such work to continue until tine
river and harbor becomes frozen
over with ice; and
WHEREAS, the purchase of the
dredge and the doing of the work
herein described was not contemp•
toted when taxes were levied in the
year, 1938, and as a result no taxes
ware levied for the Dock Fund and
the Income from the operation of
the docks is wholly insufficient to
pay the expenses now required to
be paid for such purpose; and
WHEREAS, it is now evident
that unless funds are made avail-
able by transfer from the Water•
works Operation Fund to the Dock
Fttnd, it will be impossible to do
the work for which said dredge was
acquired and the investment of the
City in said equipment will be jeo•
pardized as there are no other
funds available which might be
used for such purpose; and
Whereas, there is now in the
Waterworks Operation Fund of
said City the sum of $49,810.01,
which, togetlrer with current rev
enues to be received will be more
than sufficient to pay the expenses
of the operation of the Waterworks
so that a transfer of $5,500,00 to
the Dock Fund can be made at
this time wtihout interfering with
the operation of said Waterworks,
said sum, however, to be repaid to
said Waterworks Operation Fund
on or before November 30, 1938;
and
Whereas, ,before any transfer
can be made from the Waterworks
Operation Fund to the Dock Fund,
an application must be made to
the State Comptroller for author-
ity to make the transfer and his
approval secured thereon: Now,
Therefore,
Be It Resolved by the City Coun-
cil of the City of Dubuque that,
subject to the approval of the
State Comptroller, there be and
there is hereby transferred from
the Waterworks Operation Fund of
the City of Dubuque to the Dock
Fund of said' City the sum of
$5,600,00 which is now in the
hands of the City Treasurer, and
the State Comptroller is hereby
petitioned to authorize such tr•ans-
fer•, said sum to be returned to the
Waterworks Operation Fund from
the Dock. Fund on ar before Na•
vember 30, 1938,
Be it further resolved that when.
such approval has been received
from said State Comptroller that

Whereasy at the time oP the plat-
ting of Finley Hame Addition in
the City of Dubuque, there was laid
out, established and dedicated an
alley 20 feet in width extending
northerly from College Street to
an alley running in an easterly
and westerly direction from Allison
Place to West 5th Street; and
Whereas, the southerly 110 feet
of said alley was vacated by the
City Council of the City of Du•
buque by an ordinance adopted by
said Council on the 28th day of
February, 1906, and the portion of
the alley so vacated was granted
to one E. A. Engler and J. J: Mur•
phy in exchange fora strip of
ground 20 feet wide extending from
the new southerly end of said a~•
ley between Allison Place and Col-
lege Street to College Street and
more particularly described on a
proposed plat of the subdivision of
Lots 10 and 11 of Finley Home Ad-
dition as the southerly 20 ,feet of
Lot 2 of the subdivision of Lots 10
and 11 of Finley Home Addition,
said strip of land to constitute a
continuation of said alley; and
Whereas, subsequent thereto and
on the 29th day of July, 1910, the
location of that portion of said al-
ley extending westerly from the
new. southerly end of said alley,
as established by the m•dinance
adopted on February 28, 1906, was
cnapged and,a new plat thereof
was made, which plat bore No.
