The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the location of the property, the proposed use of the property as an IDOT maintenance garage, and access to the property. Staff reviewed the staff report, noting that the Plat of Survey is being reviewed by the Zoning Advisory Commission and City Council because the plat creates more than two new lots and is considered a minor final plat. Staff noted the submitted Plat of Survey is in compliance with the Unified Development Code. There were no public comments. The Zoning Advisory Commission discussed the request, and found it appropriate. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. The lowa Department of Transportation (IDOT) has selected the subject site for construction of a new maintenance facility south of Olde Davenport Road. BACKGROUND In 2014, the City's Unified Development Code was amended to include Fringe Area Development Standards and Pre-Annexation Agreement Requirements in Chapter 11: Land Subdivision. The "fringe area" is land to be subdivided within the City's two-mile extraterritorial jurisdiction as provided in lowa Code section 354.9, that is closer to Dubuque than another city. New subdivisions in the fringe area are required to have a pre-annexation agreement approved by the City Council. The City Manager may waive a pre-annexation agreement upon a showing of good cause. A developer may appeal to the City Council to waive the pre-annexation agreement upon a showing of good cause, if the City Manager does not grant a waiver. DISCUSSION The City Council has authorized the Zoning Advisory Commission to review and approve preliminary and final subdivision plats in the city limits and in the fringe area. The Commission has recommended approval of the Plat of Survey O'Rourke Farms Addition. They have no jurisdiction over pre-annexation agreements; therefore, this information was not included in the staff report to the Commission on the subject plat. Enclosed is the February 13, 2018 email correspondence with the IDOT for City Council's information. As shown in the enclosure, the City Manager granted the waiver of a pre-annexation agreement for the Plat of Survey O'Rourke Farms Addition upon a showing of good cause as follows: "In the interest of the public safety attributes of this new site related to IDOT operations serving the needs of local residents..." IDOT operations for timely snow and ice control and pavement repair on major roads is vitally important to the safety of the traveling public as well as freight traffic. The IDOT believes that this will be the most efficient and effective site to deliver those public safety services. The IDOT believes the pre-annexation agreement requirement may prevent them from purchasing the subject property. The location I am referring to is a 33-acre tract of the O'Rourke Farm located just south of Olde Davenport Road.The lowa Department of Transportation (DOT) is proposing to construct a new Maintenance Facility. At the present time, the City is requiring Mr. 0'Rourke to sign a 130-acre pre-annexation agreement which he is not wishing to do. With thirty years in State government I appreciate the black and white clarity of policies and laws, but I also understand there are exceptions to those rules. Mr. 0'Rourke did not contact the DOT and offer to sell us land. It was our local employees wishing to keep a new maintenance facility in the Dubuque area that found this location and I initiated negotiations to acquire the property. This is not a local citizen asking to plat their land for a private endeavor.This is the State of lowa who is working with County and City Government to complete the required Zoning, Platting, etc.,to complete this acquisition. I respectfully request for your consideration to grant Mr. 0'Rourke a waiver of the Pre-annexation Agreement. This , would remove a large issue that may prevent us from purchasing the property. Kritz, Associate Planner �° 7• x• SUBJECT: Plat of Survey of O'Rourke Farms Addition DATE: February21, 2018 INTRODUCTION The submitted Plat of Survey of O'Rourke Farms Addition resubdivides four parcels of land to create a parcel that will be sold to the lowa Department of Transportation for the construction of a future maintenance facility. The subject property is south of the new interchange that is under construction for the Southwest Arterial and U.S. 61/151. The submitted Plat of Survey is being reviewed by the Zoning Advisory Commission as it constitutes a Minor Final Plat. No public infrastructure or roadways are being constructed as part of this plat. DISCUSSION The submitted Plat of Survey of O'Rourke Farms Addition resubdivides four existing parcels owned by O'Rourke Farms, Ltd. On the south side of the city of Dubuque. The subject property is located within Dubuque County, and is being jointly reviewed by both the City and County of Dubuque. The submitted Plat of Survey constitutes a Minor Final Plat as it involves more than two lots. The Plat is in compliance with the City of Dubuque Subdivision Regulations meeting both lot area and frontage requirements. The Plat notes that Lots 2, 3 and 4 may be accessed from the Southwest Arterial frontage road constructed as part of the new interchange. RECOMMENDATION Planning staff recommends that the Plat of Survey of O'Rourke Farms Addition be approved as it is in compliance with the City of Dubuque Unified Development Code.
