Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the location of the property and
that only Unit 1 within the commercial condominium is requested for rezoning to OC
Office Commercial. The applicant reviewed the proposed use as a school of private
instruction, and noted the space was ideal for use as classroom space with plenty of
available parking.
Staff reviewed the staff report, noting surrounding zoning and land use, reviewed the
area of the building to be rezoned and that the site is well removed from any actual
industrial uses. Staff reviewed why typically, Heavy Industrial Districts do not list
schools as permitted uses, but Kerper Boulevard did not develop with industrial uses
that involve processes that create smoke, noise and odors.
There was one public comment in support of the request by a representative of Four i
Oaks, indicating that the subject facility is the only one available in the community that �
offers the space necessary for the needed classroom and office space.
The Zoning Advisory Commission discussed the request, reviewing available parking
and potential for bus service. The Commission felt the request was appropriate, as it
was limited to just the portion of the building to be used for private instruction.

Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council �
approve the request. i
A simple majority vote is needed for the City Council to approve the request.

Property History: The subject property is a part of the Kerper Blvd. Industrial Park that
was created out of dredged materials in the 1960s. The original W.C. Brown Company
facility was built at this location in 1971 and several expansions occurred the last being
in 1994. After Brown Publishing vacated the building it was leased to other publishers
and now much of the existing building space is vacant or has been converted to office
space.
Physical Characteristics: The subject property is a level approximately 16-acre campus
with 980 feet of frontage along Kerper Blvd., 600 feet of frontage along Hamilton Street
and 1,300 feet of frontage along Kilgore Street. The subject property accommodates a
7-acre building complex with over 300 off-street parking spaces with its primary access
taken from Kerper Blvd.
Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote
mixed-use development and recommends buffering non-compatible uses from each
other. The City's Future Land Use Plan identifies this area as industrial.
Impact of Request on:
Utilities: All City utilities are available to the property.
Traffic Patterns/Counts: IDOT 2013 Traffic maps indicate 5,400 average daily trips
along Kerper Blvd. just south of the subject property.
Public Services: Existing public services are adequate to serve the site.

Environment: Staff does not anticipate any adverse impact to the environment as
the site is fully developed.
Adjacent Properties: The adjacent properties are engaged in mostly light-industrial
activity and are physically separated from the proposed school space within the
subject lot. The nearest adjacent industrial building is separated by the Hamilton
Street right-of-way and is approximately 175 feet from the proposed school space.
Because access to the property is taken from the 4-lane divided Kerper Blvd. into a
large surFace parking lot, there should be little traffic conflict between the proposed
use and the adjacent industrial users. The proposed rezoning should have little
impact on the adjacent properties.
Staff Analysis: The applicanYs request is to rezone a 21,000 square foot space within
a 7-acre building complex located on an approximately 16-acre campus that formerly
housed a publishing company from HI Heavy Industrial district to OC Office Commercial
district. The applicant intends to locate a school of private instruction in a condominium
space within the building complex. The proposed school space is located on the
southwest section of the building complex in an area that is primarily office use. There
are over 300 parking spaces on the north side of the subject property with direct
pedestrian access to the proposed school space. It appears that there would be little
conflict between traffic along Kerper Blvd. or within the complex and the pedestrian and
vehicular traffic associated with the school.
The adjacent properties are engaged in mostly light-industriai activity and are physically
separated from the proposed school space in the subject lot. The nearest adjacent
industrial building is separated by the Hamilton Street right-of-way and is approximately
175 feet from the proposed school space. The remaining building area within the
complex has a small office component and a large, currently vacant, warehouse space.
The proposed rezoning should have little impact on the adjacent properties.
The City's 2017 Comprehensive Plan encourages creation of mixed-use developments;
however, the Future Lan Use map identifies the Kerper Blvd. corridor as industrial and
the Plan cautions that industrial users can generate noise, smoke, dust and odors that
may render them incompatible with most other land uses. Although schools are not
permitted within the HI Heavy Industrial district it is important to note that licensed child
care facilities are allowed as a Conditional Use. This means that, given the right set of
circumstances, the Zoning Board of Adjustment can permit day care and preschools in
direct association with industrial activity.
Staff recommends the Commission review the criteria established in Chapter 9-2 of the
Unified Development Code regarding granting a rezoning.

ORDINANCE NO. 9-18
AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 2460 KERPER
BOULEVARD FROM HI HEAVY INDUSTRIAL DISTRICT TO OC OFFICE
COMMERCIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter described
property from HI Heavy Industrial District to OC Office Commercial District, to wit:
As shown on Exhibit A, in the city of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided
by law.
