used for agricultural or horticultural

The untimely and tragic death of
Senator Louis Murphy startled the
nation. He wa.s sumxttoned to his
eternal reward at a moment when
ltis value as a statesman was begin-
. ning to be realized, He was recog•
nized among his associates in the
Legislative Halls of Congress as a
,ntan of high intellectual attain-
ments, of sterling .character and
ability, possessing a deep under-
standing of the complex problems
affecting- the people of this country
in all wants of life, and at al] times
devoting his energies for their com-
fort and relief.. As time passes, his
efforts and accomplishments as a
United States senator will be bet-
ter understood and realized.
The people of Dubuque knew Sen-
ator Murphy from childhood. He
teas born here. His life was lived
here. He was intimately associated
with all civic and public achieve-
ments. His popularity was evi•
dented by the unanimous support
Which he received from all of our
people at the' election of 1932, re•
gardless of creed or. political affilia-
tions. He rewarded the confidence
reposed in him by faithful and cour-
ageous service.
While the- nation has lost a great
and promising statesman,, and there
has been removed from this com•
munity a splendid citizen, there re.
mains the consolation that his life
has not been lived in vain and his
name will remain indelibly engraved
upon the tablets of memory pro-
claiming him as a statesman, a man
and an honorable citizen, which the
passing of time will never cause to
grow dim.
The City Council, as the govern-
ing body of the City of Dubuque
and on behalf of all of its citizens,
desires to give expression to the
sorrow which has been caused by
the death of Senator Murphy and to
extend to his family the sympathy
of all of the citizens of this com-
munity.
Be it, therefore, resolved by the
City Council of the City of DubuquE
that this tribute, weak and inex-
pressive as it may be, be spread
upon the public records of this Coun-
cil and that a copy thereof be de-
livered by the City Clerk, in person,
to his widow and family.

automobile tine caused in striking
an excavation in the street opposite
the Towa Dairy Company on Central
Avenue, presented and read.

Gentlemen: In connection with
the James F. Lee contract for pav-
ing Bluff Street from West Third
to West Eighth Streets, the City
Council did extend this time of com-
pletion from July 1st to July 31st.
However the entire project was not
completed by July 31st- A delay
was caused to Aug. 5th, 1936.
Accordingly, to provide this exten-
sion for the PWA officials, it is re-
quested that the City Council auth-
orize now by motion one additional
week more, or to Aug. 6th, 1936, for
the Bluff Street Paving completion.
While, as above stated, this pav-
ing contract was finished on Aug.
5th, there is still a controversy be-
tween Mi•. Lee, our City Engineer-
ing Department and the local PWA
officials. As yet it has not been pos-
sible to determine the actual addi-
tional costs of certain extra work
on this jab. An attempt was made
to get this question settled today,
but dtte to Mr. Walter Cullen's moth-
er's unfortunate death and her fun-
eral this afternoon it was not pos•
sible to make a definite- statement
to the.Council for acceptance.

Gentlemen: On August 3rd a peti-
tion signed by Mrs. G, V. N. Jaeger
requesting the authority to erect and
operate a rear wooden stairway on
the city alley was referred by the
Council to the City Manager for a
report.
This question was investigated by
the Building Inspector and City
Manager today. The location of the
building is at the southwest corner
of Main and West 5th Streets on
part of City Lot 65. The build-
ing is three stories in height and
the rear of said building is at the
east line of the 30 ft. wide alley
west of Main Street. The width of
this three story brick building is
approximately 44 ft.
At Present there is an open cel-
lar-way on the alley at the reap of
this building. Poles along the East
side of this alley are approximately
five ft. from the building,
On May 13th, after an investiga-
tion of this location by the Fire,
Building and Health authorities of
this city, a written report was suli-

mined to Mrs. Jaeger, as the agent
for Ella Bassermann, owner, who
lives in California. Copy of this
report is attached hereto.
In connection with the request to
have authority to erect a wooden
stairway from the third floor level,
also including 1be second floor level
and then to the alley, it is not in
compliance with Iowa Housing Law.
Stairways on the outside of a build•
ing and fire escapes, as are require
must be of fire-resistive materials,
including iron or steel.
In the past, certain limited wood-
en stairways have been approved liy
the' City Council, but these wooden
constructions have only applied to
one story. In case of a fire, a wood-
en stairway to the third floor would
be a serious hazard.
The .State Fire Escape Law, as
included in the 1935 Iowa Code, re-
quites by: Section 1662-"Fire Es-
capes fot• All Three Story Buildings"
and Section 1664-B-"Outside Fire
Escapes or Ladders" that same shall
be of steel or wrought iron.
Accordingly, we see no possible
authorization from the City Council
to approve a three story wooden
fire escape stairway on a city alley.

the statement to bidders we agreed
not to hold the checks over 45 days
if no award was made on any equip-

After discussing these various
bids with the W, P. A. officials, it
now seems that definite changes
must be made on practically all
specifications in order to keep with-
in the $60,000.00 limit.
Inasmuch as quite a few of the
vatiotts outlined portions of the bids
will now be fut•nished by the W.
P. A, organization, it is the writer's
suggestion that all of the bids, as
received on July 6th, be cancelled
and authorization be made by the

Standardization is Recommended
The National Board of Fire Un-
derwriters recommend that each
City Firo Department be supplied
with pumping equipment from one
company. Their criticism is based
on the purchasing of a number of
similar fire Pumps from diEereni
companies. The aim is to have sev-
eral pieces of apparatus from the
same builder so that repair parts
are interchangeable and a stock of i
repair parts can he safely and am_
ply provided. The Underwriters al• I
so advise the purchase of apparatus
for fire service that fs built, as cony
pletely as nessible, in the factory of
the one firth selling the same. The
experience of many Fire Depart-
ments has been, that where assem•
bled apparatus had been in service
for several years, it became difficult
to secure repair parts of the same
where some of the manufacturers
had gone ottt of business. Accord-
ingly, it is advisablo to purchase
fire equipment that is fully m~nu~
factored by one company, providing
said company is responsible and well
financed.

These three companies, that have
built and furnished our present
equipment, still furnish all neces-
sary repair parts for the same up-
on orders and payments from the
City.
Accordingly, from the recommend-
ations of the National Boat•d of Fire
Underwriters and also from the lo-
cal experience of our operators and
mechanics, it would seem that stan-
dardization of fire equipment is es-
sential.
Conclusion
Due to the fact that the Ameri-
can La France Company now has
four pieces of fire equipment in our
department, that even the oldest 22
year pump is still in regular ser-
vice,, that this company has sold
more fire apparatus for many years
than all combined competitors, it is
the reconmtendation that this award
be made to this company. Both
the six and twelve cylinder Ameri-
can La France modern major ap-
paratus is now fully built in their
factory. The price as offered for
the six cylinder machine is a total
of $12,500.00, while the more mod-
ern 12 cylinder machine price total
is $13,675.00, or only $1,175.00
more. The 12 cylinder motor and
pump, as manufactured by this com-
pany, has given satisfactory service
for over five years. The additional
water capacity in the 12 cylinder
machino varies from 25% to 50%
over the maximum six cylinder ca-
pacity. Waterloo purchased a new
12 cylinder American La France en-
gine in 193G, after a complete in•
vestigation of other standard maltes.
There are now in operation in larg-
er and smaller cities, than Doboque,
over 400 additional 12 cylinder
pumps as made by the the American
La France Co.
In addition to this statement of
prices, H. P, of motors,, e'tc., an-
other comparative outline of all ma-
jor items is now available, as .pre-
pared after the analysis of the com-
plete specifications as submitted by
each bidder. We greatly appreciate

In the study of 1-a, page 1, of Mr.
Gilloon's letter, of August 19th, the
following is suggested:
Quoting: "All planes, no matter by
whom owned m' operated, shall at
all times have the privilege, without
charge, of landing on parking and
taking off from the airfield;"
The word underscored, °on," is a
question. Apparently this w o r d
should be eliminated. All planes,
etc., shall have privilege, etc., of
landing, Parking and taking off, etc.,
is the meaning of this outline.
In the second sentence of 1=a, quot-
ing: "Providing further, that nothing
herein shall prevent planes operat-
ing from bases outside the City of
Dubuque from discharging passen-
gers destined to Dubuque and taking
on passengers destined for points
outside of Dubuque," a very appar-
ent omission is made. We are now
desirous of securing out-of-city
planes that will daily provide far de-
livery of mail and certain materials
into and from Dubuque, in both
North-South and East-West direc-
tions. hr the above quoted sentence
the delivery of "passengers" should
also include additional "mail and
materials."
In Item 2 on page 1 of Mr. Gil-
loou's proposed lease the city appro-
priation of $300.00, as mentioned, is
apparently to provide assistance in
winter periods for the licensed pilot.
This spring Mr. Tegeler, president of
the Dubuque Airways, Incorporated,
made a request to the Council to con-
sider acontribution from the City
of $10.00 per week, For six months,
in the winter periods, to assist fin-
ancing the pilot when practically no
flying service would be .performed,
but when occasionally a plane might
laud and a pilot should be available
in entire daytime. A tentative ap•
proval by the Council was made to
provide for this assistance. The to-
tal sum from October 1 to March 31,
equal to 26 weeks, would be $260.00,
not $300.00.
The City total Airport fund levy
for 1935-6 is $660.00. The 1936 levy
Yor next year is also $660.00. Pres-
ent costs at the Airport include year
ly Fire Insurance, $3,000.00, in the
Hangar, casting $126.60 per year;
yearly Liability Insurance $50,000.00
maximum, on the Airport, costing
$68.00 per year; montlily telephone
service, equal to approximately $5.00
per month, or $60.00 per year; and
grass and weed cutting will likely
cost $100.00 or more per season. If
the $260.00 is authorized by the
Council for the contribution to the
airport pilot, then the remaining bal-
ance, equal to approximately only
$45.00, will have to provide for scrap-
ing, rolling and repairing the run-
ways, etc. An amount of $300.00 is
not yet available for any pilot
contribution.
In Section 2, of page 2, of Mr. Gil-
loon's outline of the conditions, it is
also suggested that a definite sched-
ule of rates and charges for the fel-
lotiving service, including:
(a) Storage of planes in the
hangar.
(b) Delivery of one, or more per•
sons, on a single or return trip to
any location beyond this City by a
plane owned by the Dubuque Air•
ways, Incorporated.
(c) Any other service to be per-
formed by the Dubuque Airways, Tn-
corpm•ated, etc., should be included.
Either these prices and rates, as
to be charged by-the Dubuque Air-
ways, Incorporated, should be stated
in the '5•Year Contract; or after the
contract is approved, the definite
schedule of rates should be approved
by the City Council and made pub-
lic. These rates should be of a stan-
dard basis and in comparison to
charges made by other similar air-
port operators in this section of the
country.
Another paint suggested for can-
sider•ation by the City Council is
that possibly next year, or later, a
large aviation company may deter-
mine to land daily on our Airpm•t.
To accomplish this, we may have to
agree to store a Plane free, for
emergency, or Provide 'a place for a
mechanic to be located far service,
or other necessary provisions. It is
suggested that if any such requests
be presented that the Council and
the Airway Corporation make every
possible Provision to secure this im-
portant service. Regular planes are
now flying from 200 to 300 miles per
hour. Many of our busy citizens de•
sire such air way service from
Dubuque.
In the future, prior to the end of
the 5•Year Contract, it will lflzely be
necessary to make certain additional
provisions between the City and the
Corporation, in order to Properly
operate the new project. The con-
tract should provide for said addi-
tional conditions, if necessary.
Mr. Dudley Withers, of the Bureau
of Air Commerce, 1318 South Alich•
igan Avenue, Chicago, was here last
Special Session, August 21st, 1936 205
Friday. He advised that at present
his opinion was that no airport lights
vvere necessary. He further stated
that lights should be but a few in-
ches above the level of the ground;
and that due to our own flooding
condition that lights and under-
ground wiring for the lights would
be damaged by any 14-foot flood
stage. He further stated that no
posts could be installed to Provide
the location of lights 'above the
maximum flood stage. We still be-
lieve that wiring far lights can be
provided by use of water-proof cable

Another question discussed with
Mr. Withers was in regard to many
local complaints from citizens, where
planes were flying over the city on
a too low basis for Safety. Mr. With-
ers advised that a definite provision
should be made by ordinance, or
]ease, that planes flying over the
business and residence sections of
the City should be at least 2,000
feet above the roof of nay building.
Planes starting to fly from the air••
port Should head north, or south,
and gain the proper heighth, prior
to flying over the thickly settled city
areas. In case a plane is 2,000 feet
above a roof and the engine should
fail, or stop, this 2,000•foot heighth
will provide a possible reserve to
safely glide the plane and finally
land it at the airport without use
of the motor.
Accordingly, it is suggested that
in either the lease, or an ordinance,
that all places should be prohibited
from flying from om' airport to areas
in our business, industrial and resi-
dence districts until the minimum of
2,000 foot heighth, above our high-
est roofs, has been reached.
Another paint should be provided,
possibly, by a City Ordinance is the
requirement of obstruction lights in
all high smoke stacles, highline tow-
ers and other hazardous obstruc-
tions.
It is suggested that a contract,
Basel on the determined conditions
by the Council, should be made with
the Dubuque Airways, Incorporated.
Their cooperation should definitely
make our flying conditions more ben•
eficial. Officials of this corporation
have been interested and active in
flying for many years. The fact that
this corporation will provide for air-'
plane service, if granted a 5-year
]ease, should benefit our city.
In case a bond ~rrere filed by the
Corporation, guaranteeing to comply
with all conditions of the contract,
it might require considerable time
to eliminate any provisions that
were not entirely agreed upon. On
the other hand, if the entire agree•
went were not compiled with by the
Cm•paration, the Council could quick-
ly correct any defects by cancelling
the contract.

It was determined that the pos-
sible excavation location where this
accident occurred was on Central
Ave. leading to the Iowa Dait•y
Plant, south of 22nd St. The plumb-
ers that did this work were Seubert
& Fesler, located at 1827 White
St. Mr. Seubert was contacted and
advised of the claim. A letter was
sent to Mr. Samuel Alba advising
hitn to stop at Seubert & Feslei's
Plumbing Shop and explaining also
that Mr. Seubert had agreed to try
to settle this claim with Mr. Alba.

Gentlemen: On August 14th, 1936,
there was presented to the City
Cotmcil, a requeat from Mr., Carl
C. Krakow to reduce the assessment
on his property, including lots 29
and one half of lot 30 of Finley
Home Addition, located on West 3rd
Street, south of Finlay Hospital.
As basis of request was due to
objections in regard'to the pastur-
ing of sheep, the burning of ashes
and the odot•s, etc., from the Fin-
ley Hospital, this question was re-
ferred to the City Manager for an
investigation and report.
In regard to the keeping of sheep
within the city, it is quoted from
Article 2-Section 4 of the Dubuquo
Zoning Ordinance: "The keeping of
sheep, rabbits, goats, or cattle is
prohibited except on premises con-
taining over one acre, and except
tivithin an inclosure distance of at
least fifty feet from any side lot
lice or ahy street line
Mr. Fred Lattner, of Finley Hos-
pital, was contacted in regard to this
question and it is known iu the past
that the sheep were practically graz-
ing and standing on the entire pro-
perty within but a few feet from
the alley north of Mr. Cat•1 C. Krar
kow's lot.
Now Mr. Lattner has been advised
and has agreed to move this fence
at least fifty feet not•th of the north
side of this alley. The Finley Hos-
pital property contains approximate-
ly four acres of land, and in ac-
cordance with the ot•dinauce they
are entitled to use sheep in any
case where property used for graz-
ing is over- one acre. Mr. Lattner
advised that it is necessary to keep
the sheep at or near the hospital
as they are used for laboratory pur-
poses.
In regard to the other complaints,
it has been determined that the
manure from the sheep is now to be
collected at least twice a week, and
the manure is to be stored in a can,
and spread on the garden of the
hospital.
The hospital officials have now
agreed to use shavings or straw in
the barn for bedding of the sheep.
This will also be changed often and
will not become dirty.
No rags or cotton are to be burned
in the open, and we ate advised that
in the recent periods, at least, all
such materials have been disposed .
of in the incinerator located south
of the hospital.
In regard to the serious complaint
of the burning of cinders on the hos•
pital land,, we have discovered that
this summer and in past periods,
for weeks at a time, these cinders
have been burning and smoking. We
have advised Mr. Lattner that if the
cinders are burning at any time, the
officials of the hospital are to elim-
inate the fire, or they are to call
the City Fire Department or they
are to provide chemicals to prohibit
burning in accordance with the
agreements that have been now pro-
vided, for tho betterment of the com-
plaints of the people living on West
3rd Street. It world now seem that
very little interference would result
in the using of the West 3rd St.
properties.
In case the present outline of
changes- and improvements a.re not
efficient and satisfactory, 1ve shall
have to contact the Finley Hospital
officials for even greater coopera-
tion.

as to the dumping of dead auimals,
chicken feathers, and other refuse
that creates odors at the area west
of the East 4th St. Bal] Park. Cer-
tain organizations of the City were
advised and stopped front damping
~ any odorous materials there now and
in the future.
The City is still dumping the reg-
ular ash and can service, on certain
days of the week, at this location.
We shall always attempt to prevent
Special Session, tlugust 21st, 1936 Zpy
odors. The reasons for City use of
this area for out- dumping is to fill
up the area west of the ball park
to protect the bleachers and due
to the fact that this area is closer
to our heavy section of rubbish col-
lection'and this location saves costs
of hauling a mile or more in farther
directions.
The Health Department Inspector
is instructed to eliminate any odors
at this site.

tion adopted by the City Council of
the City of Dubuque at a special
meeting of said Council held on Au-
gust 26, 1936, said resolution having
i been unanimously adopted and ap-

mission for the holding of a parade

Departments to participate in the
Labor Day parade, presented and
read.

join in the parade accepted if pos•
sible, Seconded by Councilman
