Mayor Jaeger stated that this is
the regular monthly meeting of the
City Council for the purpose of act-
ing upon such business as may pro•
perly come before the meeting.

September 30, 1936.
To the Honorable Mayor and City
Council, Dubuque, Iowa.
Gentlemen; An appeal was made
to the City Council prior to the
meeting of September 14th in con-
nection with Fund No. 553, Paving
of Garfield Avenue, which was lev-
ied September 15, 1924. The appeal
was from the Anna M, Ring Estate
in regard to the S. 1/z of Lot 5,
Coop's Add., which includes the 9th
payment-$15.91 due March 31, 1932,
and the last payment due one year
later, or $31.82 as principal due
March 31, 1933,
Tha authorization by the City
Council on September 14th was that
this 2/10 of the principal could be
paid on the basis of 5% interest, ,
plus advertising costs at the Court
House,
On September 30th another appeal
was made in this connection in
which the owner of this 1 of can-
not afford to pay the interest
which would be due on approxim-
ately $32.D0 or 5r/z years. This re-
vision in the appeal includes the
request that the Council authorize
the payment of the principal, only,
and the advertising costs by the
County and the elimination of the
penalty and interest of the remain-
ing portions still due.

property owned by Elizabeth K.
Hubbard, Fund No, 628, for the pav-
ing of Francis Street, levied June
22, 1925, Tivoli Add., Lot 25, includ-
ing 1./10 of principal = $12.87 due
,March 31, 1933, and the last 1/10 of
principal in the same amount due
one year later, or a total principal
due on this levy = $25,74,
The appeal was that due to other
payments of special assessments,
the only possible way to pay this
principal, only, by November 15,
1936, was to have the penalty and
interest eliminated.

tal assessment was $90.05 and was
originally assessed to Mr. Fred CVag-
ner. No payment to date has been
made on the principal,

Gentlemen: A epecial appeal was
made by Mr. John Stempfle, 903
Kirkwood Street, including Fund No.
567 for the Paving of Kirkwood
Street, levied October 20, 1924. This
was originally assessed to Mr, A. L.
Rhomberg, but was taken over and
paid by the present owner, Mr. Jolm
Stempfle, on the basis of principal
and interest, including 1931.
The lot includes Union Ave. Sub.,
Lot 20, Delinquency = 1/10 of prin-
cipal = $26.85 due March 31, 1932,
and the last 1/10 of principal=$26,85
due one year later, or the total prin-
cipal due in the amount of $53.70.
The appeal is that due to the situa-
tion of the owner, who has been
without work fm' years, that he be
allowed to pay the principal, only,
by November 15, 1936, and that the
penalty and interest be eliminated.
He will also agree to pay the adver-
tising costs at the Court House.

Street, levied October 13, 1924, Cox's
Add„ Lots 84 and 85, including the
last 1/10 of ,the principal = $41.48
due March 31, 1933.
Mr, Gielleson will attempt to pay
this by November 15, 1936, and will
also pay any charges for advertis-
ing charged by the County.

Gentlemen: Mr. Carl J. Schneider,
880 Kirkwood Street, made a special
appeal to the Council on September
25th in regard to paying the full
amount of principal, only, on two
lots including the following;
Fund No. 567, Paving Kirkwood
Street, levied October 20, 1924, as•
sessed to A. L, Rhomberg but now
owned by Carl J, and Alberta
Schneider, Sub. 73 and 74 of A. P.
Wood's Add., Lot 2, including the
last 1.10 of principal on the two
portions of said lots=$29.11.
The records indicate that these
two portions of said lots have been
taken over by the City. Mr. Schnei-
der makes an appeal to be author-
ized to pay the principal, only, and
any advertising costs at the Court
House in order that he may redeem
his property. For years he has been
unable to work, but during the last
several months he has finally saved
sufficient money to -pay this prin-
cipal.

Gentlemen; An appeal was made
by Mr. Emil Machinek at 347 West
8th Avenue an September 22, 1936•
The appeal applies to Davis Farm
Add., West 170' of Lot 321, The de•
linquent assessments on this partic-
ular lot were sent to the Mid•Con-
tinent Petroleum Corporation. To-
day Mr. Machinek states that he
had never been advised previously
that he owed delinquent assess-
ments on these two lots which he
has owned far years, but through
some error said lots have been list-
ed to the above named company as
owner.
It is impossible for him to pro-
vide for paying this delinquent prin-
cipal until February 20, 1937, includ-
ing Fund No. 738 for the paving of
White Street, the amount of delin-
quency on the West 170' of Lot 321
=$1G.75 due each year for four
years, total $67.00, and also Fund
No. 917 for the paving of Central
Avenue on the same portion of said
lot the yearly principal = $18.28 due
each year for four years, or $73.12,
or a total of delinquent principal on
said lot = $140.12.
The appeal to the Council is on
the basis that the owner now pay
the principal by February 20, 1937,
and 5% interest on the unpaid prin-
cipal and any costs of advertising
that may be charged,on this lot, No
possible provision can be secured
far paying prior to this date,

in West Dubuque District, levied
December 22, 1930, Finley, Waples
& Burden's Add., Lot 136, of
which 1-10 of principal = $11.17
which was due March 31, 1933,
and the same amount due in 1934,
1935 and 1936, or a total amount
due to March 31, 1936=$44.68•
(a-2) Same project, Lot 137 of the
same addition, including 1-10 of
principal = $8.62 due March 31,
1933, and the same amount due in
1934, 1935 and 1936,•or a total of
delinquent principal due March 31,
1936 = $34.48.
(b-1) Fund No. 938, Paving of ]Penn-
sylvania Avenue, levied December
5, 1932, Finley, Waples & Burden's
Add., Lot 136, the total principal,
of which none has been paid-
$137.25.
(b-2) Same Project, Lot 137 of the
same addition, of which the total
principal, of which none has been
paid-$51.03.
Mr. Trewin states that Mr. Ed-
ward Stoltz is unable at present to
pay any portion of these delinquent
assessments, but to attempt to keep
this property in the hands of the
owner, a request is made that the
City Council seriously consider
granting authority for Mr. Trewin to
pay this on the basis of the prin-
cipal due to March 31, 1936, with the
elimination of penalty and interest,
but that 'any advertising costs at the
Court House will also be paid.

wife, Mrs. Loretta M• Cunningham.
(a) Fund No• 525, Paving of Sum•
mitt Street, levied June 26, 1924,
Prospect Bill Addition, Lots 25
and 26, including the ninth 1-10 of
principal = $30.11 due March 31,
1.932, and the last similar amount
due the following year, or a total
of principal due=$60.22. The ap-
peal on this project is to be able
to pay the principal, only, by No-
vember 15, 1936, with the elimina-
tion of penalty and interest, but
the agreement that Mr. Cunning-
ham will pay any advertising
costs, also.

(b) Fund No. 790, Paving of Wilson
Street, levied December 18, 1928,
Cain's Sub., Lot 6, 1-10 of prin-

$75.60. The appeal on this levy is
that Mr. Cunningham be author-
ized to pay the principal by No•

House.

ments can be paid by November 15,
1936, and also advertising costs on

attached hereto.

To the Honorable Mayor and Gity
Council, Dubuque, Iowa.
Gentlemen: An inquiry `vas made
on September 24th by Mr. Marmis
of the Marmis & Solomon Iron &
Steel Salvage Company, now located
at 75 South Locust Street, as to
whether or not the City Council
would consider selling a portion of
the Industrial Sub. on South Locust
Street, Mr. Marmis requests consid-
eration far the purpose of a 100'
wide section of the north portion of
Lot 2 and Lot 4 of Block D. In oth-
er words, he desires to purchase
100' width of the present land own-
ed by the City of Dubuque imme-
diately south of the Flynn Oil Com-
pany area.
A rough calculation of the area
of this 100' tividth is estimated at
30,000 square feet. The price list-
ed on this land in the past has been
at 10c per square foot or the ap-
proximate price of this land would
be $3,000.00. In addition to this lOc
per square foot cost, there is also
a certain paving levy that was paid
by the City on the south portion of
Lot 2 on Locust Street. This paw
ing lovy is approximately $192.00.
Mr. Marmis stated that he desires
to increase his present operation,
which now empl~yea 20 men, by se•
curing a larger area, including a
non•wood office erection about 20'
from Locust Street-and a high fence
around the whole eastern area of
the portion of Lots 2 and 4 to pro•
tect his equipment. The purpose of
this industry is to operate a Steel
& Iron Salvage Company.
In case it is authorized by the
Council for him to purchase this por-
tion of ]-and, he desires to know
on what basis the payments on the
total amount of land and special as•
sessments would be authorized.,

Gentlemen: On July 7, 1936 the
petitibn of Mary Cleaves requesting
that the Zoning Map be amended in
order that her property located on
the southwest corner of Fifth and
Locust Streets be rezoned to a busi-
ness district was referred to the
Planning and Zoning Commission
for their recommendation. After con-
siderable discussion it was decided
by the Planning and Zoning Com-
mission that as Mary Cleaves is the
only person requesting the change,
and as no apparent endeavor has
been made to interest or develop
sentiment in the section affected by
the proposed change to advise the
City Council that the matter be
dropped until such time that there
should develop a more wide-spread
desire for the change to business
district by the residents in the area
affected by the proposed change,

Gentlemen: At a meeting of the
Planning and Zoning Commission
October 6, 1936, the letter and peti-
tion for a change from residence
district to local business district for
Mr. Frank Kissel] at 1394 West
Third Street, and a counter petition
referred to the Planning and Zoning
Commission objecting to the change
in the district were discussed at con•
siderable ]ehgth by this body, and
it was the decision that the Plan-
ning and Zoning Commission recom-
mend to the City Council that the
petition of Frank Kissell be denied
since the Commission can see no
good reason to rezone this district
over the protest of such a large
group of property owners in the
neighborhood.

ferred by your honorable body to
the Planning and Zoning Commis•
sion from approximately 90 citizens
living in the neighborhood of the
new water tower at West Third and
College Streets suggesting that the
lots east of the water tower adja-
cent to College Street be acquired
by the Gity and parked to beautify
the site of the water tower.
At the meeting of the Commission
on October 6, 1936, it was decided
that as long as this petition with
this item in it was referred to the
Commission, the Gommissian wishes
to advise the City Council they are
in sympathy with the suggestion and
hope that same will be carried out
in the near future.

Gentlemen: An appeal was made
by Mr. Earl Scharry on October 7th
in regard to property owned by his
uncle, Mr. Peter Griner, 568 West
7th Street, on which special assess-
ments are delinquent. The projects
include the following:
(a) Fund No. 629, Paving of West
14th Street, levied June 22, 1925,
including 4 yearly payments that
are delinquent on Lots 15, 14 and
13, Pinehurst Sub., as follows:
Lot 15=$23.36; Lot 14=$10.88, and
Lot 13=$6.28. The basis of the
request is that the principal, only,
can be paid, with the elimination
of interest and penalty, except the
advertising costs at the Court
House. No bands are outstanding
on this particular fund now.
(b) Fund No. 808, Sanitary Sewer
in Nowata Street, levied March
13, 1929, including the request to
pay the principal due to March 31,
1936, on the basis of 5% interest
