Gentlemen: As per the instruc-
tions from the City Council of Oc-
tober 26, a wire was seat to Mr.
W. E. Galligan, Professor of Sani•
tation of Iowa State College at Ames,
on October 28. Mr. Galligan had
been in Kansas attending a Water•
Conference and returned to Ames
October 28, Our wire included a re-
quest for him to come to Dubuque
to outline a general plan for the
analysis of the Mississippi River
water, above and below our sewage
discharge locations. The aim of this
proper and modern system of tests
is to secure definite information, pri-
or to the completion of any dour and
lock below Dubuque, so that after
our river rate of flow is reduced
from 31~L miles to ~ mile per hour,
that all possible provisions shall be
available to eliminate any necessity
to provide a Sewage Disposal Plant
at the City's expense.
Mr. Galligan arrived in Dubuque
Friday evening and spent Saturday
morning in viewing the river loca-
tions and outlining a set of tests
to be under his control. Said tests
shall be made by the Engineering
Department and local Milk Inspector,
This study consists of-
(a) Determining the capacity of
the Mississippi River for disposal of
sewage from the City of Dubuque at
several various river stages.
(b) To ascertain the polutional
load discharged by this City.

(c) To determine what effect the
polutional load has upon the river,
as said river flows south from our
area, and where the polution ends
by natural river action on sewage.
Mr. W. E. Galligan outlines a set
of extra costs for two years, as fol-
lows:

Certain of the above mentioned
equipment will be of great advantage
to the local Health Department in

ploy Mr, W. E. Galligan, as a con-
sultant, far two years in his total
fee of $350.00 for complete deter-
mination of this condition and also
that such equipment and chemicals,
as he suggests, be provided as
needed.

before a regular meeting of the City
Council.
Petition of the Retail Merchants
Bureau making the following re•
quests: Permission to have a par-
ade on Friday, November 27th, two
motorcycle policemen are requested
to escort the parade and as many
other policemen as are necessary
to guard the parade at the various
intersections, also that all parking
be eliminated on Main Street from
early in the morning until after the
parade is over and that the- streets
be roped off: Permission to block
off a portion of Seventh Street be-
tween Locust and Bluff Streets for
the location of a cabin to house
Santa Claus and that two policemen
be stationed at the cabin to help
control crowds; permission for the
operation of a loud speaker with
electricity on top of Roshek Build•
ing and that the City assume the
cost of current for this loud speaker
and that the City Electrician ba pt•o-
vided to place a fuse block connec-
tion at or near the location of the
cabin at Washington Park; permis-
sion for the erection of Christmas
lighting decorations at intersections
on Main Street front Fourth Street
to Tenth Street, inclusive, and on
Eighth Avenue from Iowa to Bluff
Streets, inclusive, and that the City
assume the cost of current for the
extra lights to be placed in the
business district from Thursday,
November 26th, to Friday, January
1st, presented and read.

Gentlemenr At the informal meet-
ing of the City Council held Satur•
day, November 7th, information was
submitted in regard to the necessity
for immediately providing a room
for the new Clinic for treatment of
venereal diseases.
The City Council viewed the small
room, listed as "Recreational Di-
rector;' just southeast of the main
room of the Administration Depart-
ment on the second floor and also
the east portion of the east room
now used by the Police Department
for temporarily jailing boys in the
Matron's quarters in the second
floor,
The decision of the Council on
November 7th was that the best
location for the clinic would be by
using the approximately east 9 ft.
width of the present large boys' jail
roam; that a wall should be erect-
ed from the floor to the ceiling;
that in the clinic room a new heat-
ing radiator, new water sink, new
gas pipe and burner, new electric
light, etc., should be provided.
Mr. Henry Schuckert advised the
writer on November 10th,. 1936, that
on Monday, November 9th, the Su-
pet•visors again appointed Dr. Strib-
ley as the physician to control the
clinic; that the room at the City
Hall should be quickly prepared for
this service; that the clinic would
be open only on Saturday afternoon
and also in the evening- of either
Tuesday or Wednesday of each weak.
He also advised that the Clinic is to
start Saturday of this week.
However, today estimates have
been received and to include the new
wall, replacement of the steel on the
new wall, new radiator, new light-
ing, new water sink and new gas
connection and stove, it is deter-
mined that the costs will ba at least
$250.0:0 to $300.00.
Again a report was made today
from the Police Department that the
necessary number of boys could not
be jailed, as in the past, in a small
room with only one window and no
emergency door in case of fire. It
is feared that the yearly inspection
of the Police quarters would result
in condemnation of this room for
jailing boys in case the same were
made smaller and less safe than at
present.
It is the writer's recommendation
that the authority of the Council
on November 7th to use part of
the Boys' Jail room for the Clinic
be, at least, temporarily denied. We
can use the small t•oom, designated
Special Session, November 10th, 1936 287
as "Recreational Dit•ectot•," tempor-
arily, and can get sufdcient equip-
ment, etc-, by Saturday of this weelt
to provide at least a temporary room
for this Clinic operation at very lit-
tle cost.

November 7th considered the request
filed on June 30th fm• tha erection
and operation of a new "Stop and
Go" signal at Central Avenue and
22nd Street,, as filed by Geo. Back,
et al.
The decision of the Council ou
November 7th was that no funds
were at present available for such
an additional signal system. Ac•
cordingly, the petition was denied.
However, instructions were given
to the Street Department to provide
a new Stop sign . on both sides of
Central Avenue, north and south of
22nd Street and instructions to the
Police Department to enforce stop-
ping of all traffic approaching this
intersection from all four directions.
This type of traffic stopping for pro-
tection is authorized and enforced
in many other larger cities than
Dubuque. Curbs shall be Painted
15 feet along Central Avenue from
each new Stop sign so that park-
ing of cars will not interfere with
drivers seeing these new Stop signs.

large Petition was filed with the City
Council requesting that a "Stop and
Go" signal systeTn be purchased, in-
stalled and operated by the City at
8th Street and Central Avenue. This
was signed by J. L. Meyers and
many other citizens,
The decision of the City Council
on November 7th was that no funds
were at present available .for this
additional signal system. According-
ly, the petition was denied~
Instructions were given in connec-
tion with this particular intersection
that the Street Department shall
provide and erect a Stop sign on
Csatral Avenue north and south of
8th Street and instructions were sub-
mitted to the Police Department to
enforce stopping of all traffic ap-
proaching the intersection of 8th
Street and Central Avenue from all
four directions. This similar type of
providing all stopping, rather than
fast driving on one street at a busy
intersection, is used by many oth-
er larger cities. The curbs shall be
painted along Central Avenue for
15 feet beyond each new stop sign
so that parking will not interfere
with drivers seeing these new stop
signs.

At present there is a 600 C. P.
overhead light at Julien Avenue
and Stewart Street; east from this
light nearly 575 feet there is an•
other 400 C. P, overhead light at
Julien Avenue and Wood Street; al-
so on Nowata Street, north from
Julien Avenue, there is another 400
C. P. overheadl light about 250 feet
from the center of Julien Avenue.
The present house on Lot 2 of Pine-
hut•st's Sub., located at the north-
east corner of Julien Avenue and
Nowata Street, blocks any lighting
from the Nowata Street present 400
C. P, unit to the alley area.
The hazard on Julien Avenue is
due to an alley that enters Julien

The City Manager was instructed
to visit Mr., Welp and obtain an off•

ingly, an November 5th Mr, Welp
made tha statement that about two
years ago he paid to the City $25,00
for• a 10'x 10' triangular area south
of Lot 1 and now ho would offer
another $25.00 fot• this same area
south of Lot 2.
On November 7th the City Council
viewed this site and the decision at
that time was to accept the $25,00

owner to pay these delinquent prin-

able and close to the highest rated
areas of the City and the partial
amounts of the assessments were
still due to the City, the decision
of the City Council on November
7th was to deny the appeal of can-

mitted to the Council by the writer
in regard to a request made Sep-
tember 24th, 1936, by Mr, Marmis
of the Marmis & Solomon Iron &
Steel Salvage Company, which com-
pany is now located at 75 South
Locust Street, as to whether or not
the City Council would determine
to sell to Marmis & Solomon a por-
tion of Subs. 2 and 4 of Bloclt "D"
of the City Industrial Snb. This
matter was- referred to the Council
to view the site.
On November 7th, 1936, four mem-
hers of the City Council did view
this area. It was determined that
the requested location was south of
the three small lots recentiy sold
to the Flynn Ofl Company; that only
100 feet of the land along Locust
Street was desirs~d and that said de-
sired area would reach to Harrison
Street. The decision of the City
Council on November 7th was not
to sell such a small area of this
large industrial land as lilzely some
large industry might, in the near
future, desire a much larger area of
land. Accordingly, this petition of
Mr. Marmis was denied.

8th, 1936, by Mr. Frank E. Smith,
to name the alley west of Fremont
Avenue between Dodge and Marion
Streets,
This alley is approximately 800
feet long and is 20 feet wide. Due
to the fact that nearly 400 feet of
land is both east and west of this
alley, between Fremont Avenue and
Stetmore Street, and no otter al-
leys are included between these
stt•eets except this one alley, it was
apparent to the Council, that since
also houses were at present facing
this unnamed alley, the same should
be now named. Accordingly, the
names were considered by the Coun-
cil and the decision on November
7th by the Council was that this
20 foot wide alley was to be named
"Meadow Lane;' also that the 50
foot width of an unnamed street,
extending south of this alley and
lying between St. Joseph and Marion
Streets, was also to b'e named as
"Meadow Lane,"
Authorization was made to pro-
vide and erect signs on this alley
and street at intersections of Dodge,
St. Joseph and Marion Streets and
maps shall be corrected as quickly
as is possible regarding this new

Gentlemen: A petition from the
City Recreation Commission was
submitted to the City Council on
September 14th, 1936, for the right
to use more parts of Rafferty Slough
for a definite period of years for
recreation activities. This was re-
ferred to the Council to vises the
area.
On November 7th Mr, Carl Grabow
accompanied the City Council to this
area. Mr, Grabow advised that a
request was constantly being made
to the Recreation Department to
provide new tennis courts and a
shelter house and also tc keep the
present ball ground in proper use
at this portion of the city. Mr.
Grabow made a request to be able
to use land, including the entire
Block "F;' which is now partially
used for ball games, and also to be
able to improve and use, in addition,
Sub. 1 and 4 of Block "E" and also
Camp Street from Locust to Har-
rison Streets for• the new tennis
courts and shelter house.
A serious question arose with the
Council as to whether any definite

period could be authorized for use
of this land, which land was pur•
chased and improved by a bond is-
sue on the basis of selling said pro-
perty to industrial owners at such
time as a request was made to the
Council and the same was approved
and authorized for sale.
The only decision, as mado by the
Council on November 7th, was that
at this time the Recreation Commis-
sion could improve the above men-
tioned areas and could use the same
until a definite provision would arise
to sel•1 said areas to new industries.
However, all W. P. A. projects
for improvements are based on the
condition that, if the U. S• Govera-
ment spends certain funds for tennis
courts, etc., said land must be avail-
able for this use for a period of at
least ten years after completion of
the Project,
Apparently there is still a question
to be determined by the Council in
regard to whether a definite period
for use of this land can be author-
ized.

ditions of street lighting on Melrose
Terrace between Alpine and Pau-
lina Streets, was viewed and con-

Melrose Terrace is approximately
630 feet lang. Pt•esent street lights
include one 000 C. P.. light about
150 feet east of Alpine Street and
one 600 C• P, light at the intersec-
tion of Paulina Street. Those two
lights are about 500 ft. apart. The
heavy trees near the middle of this
stt•eet block proper lighting on tho
side~valks. Thefts have resulted in
homes on this street in this last
summer- and various violations have
resulted by persons parked is cars
on this stt•eet. Again no present
street light is installed at the in-
tersection of Melrose Terrace and
Alpine Street. The Alpine Street
lights at West Third and Wost 5th
Streets are approximately 680 feet
apart.
The decision of the City Council
on November 7th was that the
present 600 C. P. light on Melrose
Terrace, about 150 feet east of Al-
pine Street, tivas to be removed and
that the present 600 C. P. light at
the intersection of Melrose Terrace
and Pauline Street was also to be
removed. In order to provide bet-
ter lighting service, three new 250
C. P. overhead lights were to be in-
stalled, including:
(a) 1 new 250 C. P. light at the
intersection of Alpine Street and
Melrose Terrace,
(b) 1 new 25,0 C. P. light at the
intersection of Melrose Terrace and
Paulina Street,
(c) 1 new 250 C. P, light on Mel-
t•ose Terrace approximately half-way
between Alpine Street and Paulina
Street.

C. P. lights is $100.00 per year, The
new cost of the authorized new three
250 C. P, lights will be $105.00, total

Louis Oberhoffer, owner of a house
and lot at 911 High Bluff Street, to
extend the city wall on the east
side of High Bluff Street, About
five years ago a concrete wall was
erected by the city north of the
area, east of Mr. Oberhoffer's home,
to protect High Bluff Street. The
wall was not built west of Mr. Ober-
hoffer's house due to the condition
that his house extended as far west
as the city line of High Bluff Stt•eet.
This house had been previously pro-
tected by a stone wall near this
street,
Now the owner is objecting to sur-
face water entering his first floor
which is approximately 10 feet be•
low the level of High Bluff Street.
He agrees to remove the portion of
his home next to this street so that
a wall of approximately 13 feet in
length can be installed to protect
both High Bluff Street and his
home.
The decision of the- City Council
on November 7th was that due to
the cold weather now coming, at pre-
sent no itnpravement could be pro-
perly made, but next spring, after
the lame was partially removed by
the owner and the necessary lumber
was provided by the owner, that
then the Cit}~ should erect the wall
fot•ms and furnish and place the ad-
ditional 13 feet plus length of con-
crete wall.

dangerous and unused, but now this

another building is to replace this

443, including Fund No. 879 for pav-
ing of Central- Avenue. Delinquency
on this particular lot includes 1/10
of principal=$42.20 due 3/31/35 and

later; or a total of $84.40 of special

The appeal by Mrs. Elfmann is

Mrs. Helen L, Elfmann, of 1096 Lo•
cust Street, made a request for a
revision on the decision of the Coun-
cil on a special assessment payment,
On Segttember 21, 1936, request
had been made by Mrs. Elfmann in
connection with Fund No, 927 for
the paving of Locust Street, part
of City Lots 159 and 160, The re-
quest at that particular time was
to pay the 1/10 of principal equal
to $41.08 which was listed at that
time as duo March 31, 1936, This
particular assessment was levied De•
camber 14, 1931 and the request was
to pay the principal due on the basis
of 5% interest and pay the advertis-
ing costs at the Court House. This
was approved and authorized by the
Couucil. However, when an attempt
was made to pay this at the Court
House, the County officials advised
that there were three delinquent in-
stallments of principal due. This
was checked at the City Hall and
it was discovered that $41.08, which
is 1/10 of principal, was due March
31, 1934, and the same amount was
due in each of the following two
years, or a total of principal due to

Gentlemen: In August, 1936, the
manager of the Maizewood Insula-
tion Co., Mr. H. A, Hauptli, made
a request to the City Council far
additional street lighting service at
his .plant. This matter was refer-
red to the writer to see where and
why. .additional street lights were
desired. Last week I met with Mr..
Hauptli and he advised that a new
street light was desired at the south-
west corner of his plant at Salina
and Camp Streets about 450 feet
south of the 400 C. P. light installed
early in 1936 and also that another
light was needed at the southwest
corner of the same plant at Camp
and Harrison Streets, which loca-
tion would be:about 400 feet west
of Salina Street. Mr. Hauptli de-
sires street lights at the east and
west corner of the single block of
Came Street, which city street was
recently surfaced and made available
far delivery of large loads of corn
stalks now stored at the southwest
side of the plant. Mr. Hauptli also
stated that these additional lights
were needed to prevent thefts from
parked cars in evenings and also to
protect materials stored outside of
his building.
In case the Council will approve
of these two new lights, it is sug•
Bested that inasmuch as two new
lights will be not aver 400 feet and
450 feet apart, that the type of two
new lights be each 250 C: P. over-
head lights costing $35.00 each, per
pear.

Gentlemen: On October 5th the
City Council heard Mrs, Magd. Pier
Millin discuss a question of special
assessments levied on a lot awned
by her, including Sub. Lot 23 of
Out Lot 710, said lot being located
north of Quigley Lane and being
the last lot facing the east end of
said Quigley Lane.
This question was referred to the
City Engineer and City Manager for
an investigation and report. Accord
ingly, on November 6th Mrs. Millin
agreed and went to this location
with Messrs. Cullen and Evans, This
Lot 23 of Out Lot 710 is 85 feet wide
along the north side of Quigley Lane.
Tho depth of said lot varies from
36 feet on the East to 78 feet on the
west side. This lot slopes down
very rapidly from Quigley Lane tc-
ward West Locust Street.
The special assessments on Lot 23,
as assessed to Mrs. Millin, have nev-
er been paid in any amount. These
assessments include:
(1) Pund No, 897 for sanitary
sewer, levied 11/28/30, including ot•-
iginal principal of levy=$78.03.
(2) Fund No. 900 far paving of
Quigley Lane, levied 12/22/30, in-
cluding original principal of levy=
$168.51,
Apparently no complaint was filed
by Mrs. Millin in regard to the sew-
er assessment. However, an appeal
was made on March 3, 1930, by Mrs.
Millin to not pave Quigley Lane
as the paving would be of no value
to her lot at the end of the street
and that no outlet east of her lot
could be provided. She further stat-
ed that her lot valuation of 1930
(25%o) was $45.00. No decision was
tnade by the Council in 1930 to t•e-
duce said assessments on this lat.
On November 6th, 1936, Mrs, Mil•
lin said she had been paying taxes
on this steep lot for years but that
sho is now determined not to try to
secure a reduction in the city spe-
cial assesstents. She stated that
we were to advise the City Council
that she intended to allow the City
or County to take over this lot for
delinquent specie] assessments and
no attempt would be made by here
to later secure the same.
This question was mentioned to
four of the City Council members
November 7th and these members
vievred this lot.

authority by the State Comptroller
of Iowa to make a tempm•ary trans-
fer of $75,000,00 from the Bond Sink-
ing Fund to the Consolidated and
Fite Maintenance Funds of said city,
of which amount $55,000.00 was
transferred to the Consolidated Fund
and $20,000.00 to the Fire Mainten-
ance Fund; and
Whereas, in April, 1936, there was
repaid to said Bond Sinking Fund by
the Consolidated Fund the sum of
$13,750.00 and by the Fire Mainten-
ance Fund the sum of $5,000.00, mak-
ing a total of $18,750.00 or an
amount equal to 25% of the sum so
transferred, leaving a balance un-
paid amounting to $56,250.00, of
which $41,250.00 is owing by the
Consolidated Fund and $15,000.00 by
the Fire Maintenance Fund; and
Whereas, the tax levy for the fis-
cal year 1936-7 for the Consolidated
Fund was estimated to produce the
sum of $231,668.00, all of which has
been appropriated for the uses and
purposes of said fund; and
Whereas, the tax levy for the fis-
cal year 1936-7 for the Fire Mainten-
ance Fund zr=as estimated to produce
the sum of $100,659.00, all of which
has been appropriated fot• the uses
and purposes of said fund; and
Whereas, due to the failure in the
collection of taxes, each of said
funds will suffer a shm•tage of at
least 10%, resulting in a deficiency
in estimated receipts under estim•
ated expenditures in the Consol-
idated Fund of $23,166.00, and in the
Fire Maintenance Fund of $10,065.00;
and
Whereas, said deficiency, when
added to the repayments made to
the Bond Sinking Fund by said Con-
solidated and Fire Maintenance
Funds, as stated, will cause a grass
shortage to excess in said Consol-
idated Fund of $3G,916.00 and in said
Fire Maintenance Fund of $15,065.00;
and
Whereas, it appears impassible to
return to the Bond Sinking Fund
during this fiscal year the snm of
$41,250.00, the amount owing said
fund by the Consoidated Fund
which, if required, would result in
a gross shortage therein of $78,165:

and advisable, in view of the fore-
going statement of the financial con-
dition of the Consolidated and Fire

ity of using money from such funds
to repay the temporary transfer to

ruary 1, 1937, or before the end of
this fiscal year, and that said Bond'
Sinking Fund will cease to exist on
and after February 1, 1937, and the
detriment to result to public health,
life and property of the people of
said city, to make application to the
State Comptroller of Iowa for an
order declaring thetemporary trans-
fer of funds heretofore made a per-
manent transfer:
Now, Therefore, be it resolved by
the City Council of the City of Du-
buque that the State Comptroller of
Tows, be and he is hereby petitioned
and requested to enter an order de-
claring the temporary transfer of
,$56,250.00 (the balance remainingun-
paid) from the Bond Sinking Fund
to the Consolidated and Fire Main-
tenance Funds permanent, thereby
relieving the City of Dubuque From
repaying said sums from the Con-

that the Council on November 10th
determined to submit to the Com-
mittee for investigation.
Attached is an outline of repairs
and elimination of certain of the
upper story of the former school
building owned by the Sisters of the
Holy Ghost at St. Ambrose and
Rosedale Streets. This provision of
making the building safe was start-
ed one year ago and now a contract
has been submitted for the repairs
and the plan to make the building
safe and to possibly, in the future,
use the same part of the building
for a new construction for definite
use as a school. It is suggested that
this building be NOT condemned at
present,
Two other cases are included in a
letter from Mt•: Bartels, stating that
the owner, Agnes McDonald, has
made an application to the Building
Commissioner for repairs, painting
and complete improvement of the
two small houses on Locust Street
at No. 47, as was submitted to the
Council, and No. 45, which the Coun-
cilmen themselves determined to al-

Gentlemen: License Ordinance
No. 4-33 lists the following under the
heading of Shooting Galleries:
"SHOOTING GALLERY LICENSE
The license far Shooting Gal-
leries shall be $2.00 per day,
$5.00 per week, $10.00 per
month,"
Under date of October 25th Rob-
ert D, Barton secured a license for
one mouth to operate a shooting gal-
lery at 429 Main Street. Today Mr.
Barton called at my office and stated
that he contemplated operating the
above business during the entire
winter, possibly fm• a year. He
stated that he considered the pay-
ment of a $10.00 per month license
to be excessive for that particula~~
class of business.
I note that practically all classes
of businesses licensed under our or-
dinance provides that a yearly lic-
ense may be obtained. I therefore
recommend that the ordinance be
amended by adding a yearly license
fee of $50.00 for operating a shoot-
ing gallery.

vember 16th in regard to the deci-
sion made ,by all of the five Council•

Treasurer to accept special assess-
went delinquent payments on the
same basis as has been authorized
by the City Council in the past two
months,
Kindly note that the extension of
this general condition, whereby indi-
viduals do not have to make an ap•
pea] to the Council, is to November

to :try to outline this condition up
to December 15th but the Court
House officials advised the writer
this afternoon that they would pre-
fer to have it only unbil November
30th and that if after November 30th
this condition could still be author-
ized, the City Council could make an
additional statement as to when pay-
ments could be made on the elimin-
ation of certain penalties and in-
terest to a certain definite period.
It is suggested that this be filed
in the Council records inasmuch as
the members of the Council infor-
mally approved the same.

Gentlemen: In connection with
the extension of time for special
assessments to be paid at the Court
House, the writer suggests that the
Council consider- and authorize, if
possible, an extension from Novem-
ber 30, 1936, to December 16, 1936,
for the right of property owners to
pay delinquent special assessments
on the general conditions of paying
principal, only, and advertising costs
on delinquent special assessments
an Funds 344 to 726, inclusive,. which
were levied prior to November 1,
1926. Also on other funds levied
after November 1, 1926, that delin-
quent special assessments can be
paid on the basis of the amounts
due to March 31, 1936, plus 5% in-
terest per year on the total assess-
ment principal not paid as yet, plus
advertising costs at the Court
House.
Information is received today from
the Treasurer's office that the Coun•
ty Treasurer would agree to an ex-
tension of this same condition to
and including December 16, 1936.

Gentlemen: On November 9th the
writer submitted a letter to the City
Council in regard to the decision,
as made by the Council on Novem-
ber 7th, to putchase a small tri•
angle on Lot 13 at the corner of
Hill Street and South Grandview
Avenue owned by Eldo and Mabel
Block.
This is to advise that an error
occut•red in the letter dated Novem-
ber 9th due to the fact that four
years of delinquent assessments
were outlined and now the County
officials have determined that five
years were delinquent, or, in other
tivords, the delinquent principal, in-
stead of being $168.80 cu Fund 874,
Paving of Hill Stret, is now $211.00.
This question was taken up today
with the Gity Solicitor and it was
his opinion that a check should be
issued far the delinquent principal
_ $211.00 and also for the penalty
and interest charged at the Court
House = $141.30. The total of these
two sums will be returned to the
City because of the scavenger sale
elimination on this property for both
special assessments and taxes that
were delinquent. It is our under-
standing that this $352.30 is to be
taken from the Consolidated Fund
and accordingly we have charged
the same Ito the city improvements.
The reasou for this error of $42.20
was due to the fact that the city
records showed five years of delin-
quency and the Court House showed
four years, but the Court House rec-
ords since our analysis of special
assessments was made at the first
portion of this year have now de-
Cermined that five years' delin-
quency was due.

Gentlemen: You have. requested
my opinion and suggestions as to
the control of vehicle traffic at the
intersection of Central Avenue with
East 22nd Street and at the inter-
section of 8th Avenue with Central
Avenue.
It must be recognized at the out-
set that while the city has the pow-
er generally to control traffic on its
streets, yet this power must be ex-
ercised so as not to interfere with
specific statutory enactments relat•
ing to traffic.. The law gives to the
city tht' power to provide for traf-
fic or crossing officers or devices,
to bring abo-ut the orderly passage
of vehicles and other users of public
highways. But this power is limit-
ed as will be shown herein.
CENTRAL AVENUE AND EAST
22ND STREET
Central Avenue is an arterial high-
way. East 22nd Street and Kauf•
mann Avenue intersect from the east
and west. Traffic on arterial high-
ways has the right of way over traf•
fic on any other highway, street or
alley intersecting therewith. (Sec-
tion 5799B2.) At intersections of
streets with highways,, the traffic on
such streets must come to a stop
before entering upon the arterial
highway. (Section 5079B3). Where
two arterial highways intersect the
State Highway Commission has the
power to determine which traffic
shall have the right of way. If, how-
ever, the arterial highway is inter-
sected by a boulevard or a heavy
traffic street, the Council may, sub•
ject to the approval of the State
Highway Commission, determine
that the arterial highway traffic
shall come to a stop, erect stop and
go signals, or adopt such other
means of handling the traffic as may
be deemed practical and proper.
(Section 5079C1). In the absence of
the approval of the Highway Com•
mission, it is made unlawful for the
City to erect or cause to be erected
or maintained any traffic sign or sig-
nal which affects traffic or arterial
highways- (Section 3079C2), An ex-
ception is made, however, in -the
case of stop and go signals. Any city
of four thousand (4,000) or more
may erect and maintain stop and go
signals on arterial highways where
the same are situated within a busi-
ness district, without the approval
of the Highway Commission. (Sec-
tion 5079C3). Consequently, stop and
go signals at this intersection can
be installed without the approval of
the Highway Commission. If any
other device is used which has for
its purpose the stopping of traffic on
Central Avenue at this point, the
approval of the Highway Commis-
sion must be secured therefor~
CENTRAL AVENUE AND 8TH
AVENUE,
Central Avenue is a boulevard,
and 8th Avenue is not. The traffic
on 8th Avenue must stop before
entering Central Avenue. Tt is de-
sirable that the traffic on Central
Avenue and 8th Avenue came to a
stop before traversing this inter-
section from all directions. In order
to accomplish this, the Central Ave•
nue boulevard should be broken at
the north line of 8th Avenue and
picked up again at the south end
of Sth Avenue. Then the 8th Avenue
boulevard should be extended east-
erly from its present terminus to the
west line of White Street. It should
be broken at the east line of Cen•
tral Avenue and picked up again at
the west line of Central Avenue. It
should be broken again at the east
line of Alain Street and picked up
again at the west line of Main
Street. It should be broluen again at
the east line of Locust Street and
picked up again at the west line of
Locust Street- By doing this the
8th Avenue and Centro] Avenue in-
tersection will be a free intersec•
tion and traffic can be controlled
by stop signs on the four corners.
It will also take care of the Iowa
Street intersection by stopping traf-
fic on Iowa Street, north and south,
and give the traffic on 8th Avenue
the right of way. The intersections
of 8th Avenue and Main Street and
8th Avenue and Locust Street will
be controlled by traffic stop and go
signals. To accomplish these chang-
es,. Ihave prepared an amendment
to the Traffic Code, and I am sub-
mitting the same herewith for adop•
tion,
