(1976 Code, § 111/2-127) Secs. 15-38-15-45. (Reserved) ARTICLE IV. COM3~3-NrrY DEVELOP. MENT ADVISORY COMMISSION Sec. 15-46. Created; Composition: There is hereby created a Community Devel- opment Advisory Commission whose primary purpose shah be to provide for citizen participa- tion in the development and evaluation of the City of Dubuque's Community Development Block Grant ("CDBG") program. The Commission shall consist of nine (9) members; five (5) of which shall be residents of one of each of the five (5) census tracts with the lowest median household income as determined by the U.S. Department of Commerce, Bureau of the Census; three (3) of which shall be resi- dents of the cor-,~unity at large; and one of which shall be a member of the Housing Com- mission designated by the Housing Com,~ission. (Ord. 83-92, 11-2-1992; Ord. 88-95, § 5, 12-18-1995, elf. 1-1-1996) Sec. 15-47. Application And Appointment Process: The process of appointment to the Commis- sion by the City Council shall include at least the following elements: (1) Submission of an application form con- raining the requested information on the qualifications and expectations of the applicant; and (2) Notice to and an opportunity for the general public to comment, in writing, on the qualifications of each applicant; and (3) A formal interview by the City Council to determine the applicant's qualifications and ability to serve effectively on the Commission. Individuals who, by their professional or personal experience or interest, are knowledge- able of the development needs of the community at large and of low and moderate income per- sons in particular shall be considered qualified to serve on the Commission, subject to City Council review and consideration of other appli- cable information. (Ord. 83-92, 11-2-1992) Sec. 15-48. Term; Filling Of Vacancies; Compensation: The term of office for a Commission member shah be three (3) years except as set forth be- low. The initial terms of the Commission shall be as follows: (1) For each of the five (5) residents of the five (5) census tracts with the lowest median household income as determined by the U.S. Department of Commerce, Bureau of the Census; one shall be ap- pointed for an initial term of one year, two (2) shall be appointed for an initial term of two (2) years; two (2) shail be appointed for an initial term of three (3) years. (2) For the three (3) community at large residents; one shall be appointed for an initial term of one year, one shall be appointed for an initial term of two (2) years, and one shall be appointed for an initial term of three (3) years. (3) For the one member of the Housing Com- mission designated by the Housing Com- mission, the initial term shall be one year. A Commission member may be removed at any time with or without cause by a vote of two- thirds (2/3) of all members of the City Council. CITY ZONE~G 414.4 Zoning regulations, district bounda- ries, amendments. The council o£ the ciey shall provide for :he man- ner in which the re~latious and restrictions and the boundaries of the districts shall be determined, as- toblished, and enforced, and from time to time amended, supplemented, or changed. However, :he regulation, restriction, or boundary shall not become effective until after a public hearing at which parties in interest and citizens shall have an opporamity to be heard. The notice of the time and place of the hearing shall be published as provided in section 362.3, except that at least seven days notice must be given and in no case shall the public hearing be held earlier than the neat regularly scheduled city council meeting following the published notice. The re/ulatious, restzictious, and boundaries may, from time to time, be amended, supplemented, chon§ed, modified, or repealed, Notwithstanding section 414.2, as a pan of an ordinance changing land from one zoning district tn another zoning dis- trice or an or~i-~,ce approving a site development plan, a council may impose conditions on a property owner which are in addition tn existing regulations if the additional conditions have been agreed to in writing by the property owner before the public hear- ing required under this section or any adjournment of ~he hearing. The conditions roust be reasonable and imposed to satisfy public needs which are direct- ly caused by the requested change. In case, however, ora written protest against a change or repeal which is filed with the ciq~ clerk and signed by :he owners of twenty percent or more of the area of the lots in- cluded in the proposed change or repeal, or by the owners of twenty percent or more of the property which is located within ~wo hundred feet o£the exte- rior boundaries o£the properW for which the change or repeal is proposed, the change or repeal shall not become effective except by the favorable vote of at least three-fourths of all the members of the council. The protest, if filed, must be filed before or at the public hearing. The provisions of section 414.4 rela- tive to public hearings and official notice apply equally to ali changes or amendsnents. In order to avail itself of the powers conferred by this chapter, the council shall appoint a commission, to be known as the zoning co*-,~ission, to recom- mend the boundaries of the various original districts, and appropriate regulat/ons and restrictions to be enforced therein. The council shall provide for the appointment of a board of adjustment and in the regulatious and re- strictions adopted pursuant to the authority of this chapter shall provide that the said board of adjust- ment may in appropriate cases end subject to appro- priate conditions and safeguards make special ex- ceptions to the terms of the ordinances in harmony with its general purpose and intent and in accor- dance with general or specific rules therein con- rained end provide that any property owner ag- grieved by the action of the council in the adoption of such regulations and rastr/ctians may petition the said board of adjustroent direct to modify regula- tions and restrictions as applied to such property The council may provide for its review of vari- ences granted by the board of adjusu~ent before their effective date. The council may reroend a deci- sion to grant a variance to the board of adjustment for further study. The effective date of the variance is delayed for thirty days from the date of the re- mand. The board shall adopt rules in accordance with the provisions of any ordinance adopted pursuant to this chapter. Meetings of the beard shall be held at the call of the chairperson and at such other times as the beard may determine. Such chairper- son, or in the chairperson's absence, the acting chairperson, may administer oaths and compel the attendance of witnesses. All meetings of the board shall be open to the public. The beard shall keep r~im~tes of its proceedings, showing the vote Of each member upon each question, or ff absent or fulling to vote, indicating such fact, and shall keep records of its er~-atious and other official ac- tions, all of which shall be ~r. mediatoly flied in the office of the board and shall be a public record. Appeals to the board of adjustment may be taken by any person aggrieved or by any officer, depart- mant~ beard, or bureau of the mtmicipality affected by any decision of the a~m~-~trative officer. Such appeal shall be tsken wi~l~, a reasonable time us provided by the rules of the board by 6lin g with the officer from whom the appeal is taken and with the beard of adjustment a notice of appeal specifying the grounds thereof. The officer from whom the peat is taken shall forthwith transmit to the board all the papers constituting the record upon which the action appealed from was taken. [C24, 27, 31, 35, 39, §6461; C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, 81, §414.10] 414.11 Effect of appeaL An appeal stays all procee~!nEs in furtherance of the action appealed from, unless the officer from whom the appeal is taken ce~fies to the board of adjustment affcer the notice of appeal shall have been flied with the officer that by reason of facts stated in the certificate a stay would in the officer's opinion cause ir~mlnant peril to life or property. In such case proceedings shall not be stayed other- wise than by a rest~inlnE order which may be 32~0 granted by the board of adjustment or by a court of record on application on notice to the officer from whom the appeal is taken and on due cause shown. To hear and decide appeals where it is al- leged there is errorin any order, requirement, deoi- sion, or determination made by an administrative official in the enforcement of this chapter or of any ordinance adopted pursuant thereto. 2. To hear and decide special exceptions to the terms of the ordinance upon which such board is required to pass under such ordinance. 3. To authorize upon appeal in specific cases such variance from the terms of the ordinance as will not be contrary to the public interest, where owing to special conditions a literal enforcement of the provisions of the ordinance will result in unnec- essary hardship, and so that the spirit of the ordi- nance shall be observed end substantial justice done. [C24, 27, 31, 35, 39, §6463; C46, 50, 54, 58, 62, 66, 71, 73, 75, 77, 79, 81, §414.12] 414.13 Decision on appeal In exercising the above-mentioned powers such board may, in conformity with the provisions of this chapter, reverse or affirm, wholly or partly, or may modify the order, requirement, decision, or de- termination appealed from and may make such order requirement, decision, or determination as ought to be made, and to that end shall have all the powers of the officer from whom the appeal is tnkem [C24, 27, 31, 35; 39, §6464; C46, ~0, 54, 58, 62, 66, 71, 73, 75, 77, 79, 81, §414.13] 414.14 Vote required. The concurring vote of three members of the board in the case of a five-member beard, end four members in the case of a seven-member beard, shall be necessary to reverse eny order, require- ment~ decision, or detarm~-atiou of any such ad- mlni~fxative official, or to decide in favor of the ap- plicant on any matter upon which it is required to pass under any such ordinance or to effect any variation in such ordinence.
