Council,
Dubuque, Iowa.
Gentlemen: The petition of the
Klauer Manufacturing Company re-
lating to the subject oP rates for
electric energy charged by the In-
terstate Power Company to large in-
dustrial power users was referred
by the City Council to the writer
for investigation and report on Oc-
tober 1, 1934. In reporting thereon,
I beg leave to advise you as fol-
lows:
By action of the City Council in
Regular Session, J
August, 1934, the Manager was in•
strutted to investigate and report
on all present, local power rates of
the Interstate Power Company, here-
tofore filed with the City Council,
and those rates, not so filed. The
writer was also instructed in August
to secure a written statement from
the officials of the Interstate Power
Company including accurate inform
ation regarding receipts, expendi-
tures, valuations and earnings, as
is included in the provisions of the
electric franchise.
This infm•mation was secured and
submitted to the City Council. Af-
ter due consideration by the City
Council, an ordinance including all
local power- rate schedules, includ-
ing availability thereof for each
schedule, conditions pertaining to
each schedule, and penalties for vio-
lations thereof, was prepared and
has been considered and adopted by
the City Council.
An examination of the Klauer peti-
tion shows that the petition contains
three distinct divisions, each refer-
ring to separate subjects.
The first division is based on a
statement that the Interstate Power
Company "is exacting excessively
high and discriminatory rates° from
the Klauer Company and from other
users of electricity for light and
power purposes, and the. petition re-
quests that the Council examine the
rates being charged to the said

As heretofore stated, all the rates
of said Power Company at•e embod-
ied in the ordinance which definitely
fixes the rates to be charged for
all types of service and this ordin-
ance will prevent any discrimination
among users of electricity, either of
light or power, and imposes a pen-
alty for the violation of any of its
provisions.
The second division relates to the
subject of establishing meters on the
primary side of a transformer and
allowing a discount of 5% where
such practice is so engaged.
The ordinance pertaining to the
subject of light and power, as
passed, is plain and provides that
the matter of primary metering is
optional with the customer, so that
he has an election as to whether
he wants primary metering or not.
If the customer decides in favor of
primary metering, the Power Com-
pany is required to allow him a dis•
count of 6% for all transformer
losses.
The third division of the petition
refers to a claim in the matter of
damages. It is alleged that higher
voltage was supplied to the equip-
ment of the Klauer• Manufacturing
Company than was proper. It ap-

pears from the petition that a con-
troversy arose between the petition-
er and the Power Company. over
this matter and that an adjustment
has been made. It is apparent that
this condition rests entirely with
those two parties in interest and
that the City in no manner could
be involved therein.
Concluding, the petitioner request-
ed that the City Council require the
Interstate Power Company to fur-
nish the Council with an itemized
statement of receipts and expendi-
tures incidental to its distributing
system in the City of Dubuque and
also afford the Council access to the
books and recm•ds of the Power
Company for the purpose of secur-
ing accurate information regarding
its receipts, valuations and costs,
preliminary to the passage of a rate
ordinance.
As was stated in the first part of
this report, upon the Council in-
str•uctions of August, 1934, request
for a complete power, light and
transportation report concerning rev-
enue, costs, valuation and earnings
was made; and the data was com-
piled and submitted to the City
Council over two months ago. Offi-
cials of the Power Company did also
agree to furnish to the City Council
data that may be desired at any
time and also at any requested per-
iod•they have agreed to open their
records fot• authorized examination
The City Council has already de•
termined, in accordance with the
franchise, that complete reports be
furnished to the Council, at ]east
semi-annually, hereafter, in regard
to all revenue, costa, valuations and
earnings, and fur•ther• conditioned
that such reports shall be itemized
and in such form as to be readily
ttnderataod.
In view of the fact that the City
Council has now incorporated all
light and power rates, conditions,
availability and penalties for non-
compliance therewith in the Ordin-
ance No, 18, and in view of the
fact that the City Council has re-
ceived and studied the report filed
on recent power, light and trans-
portation finances prior to the pass-
age of Ordinance No, 18, and since
it has been expressed by the City
Council that it is their intention to
continue to receive, at least semi-
annually from the Interstate Pow-
er Company, complete reports on
finances, it would seem that the re-
quest of the Klauer Manufacturing
Company's petition has been com-
plied with.

was $40,324.08; total number of calls
713, by which eliminating false and
ottt of city calls, the actual fires
were 680. The average fire loss as
per call was $59.30. The per capita
loss was $.97 per year.
(B)-Shows the comparative year-
ly fire losses since 1911, with a corn-
. putation of the average losses for
the last 14 years to be $359,088,33
less than the average loss of a 10
year period from 1911 to 1920,
(C)-Monthly Summary of Traffic
' Accidents.
(D)-Shotivs the classification, an-
alysis and comparison of traffic acci-
dents in 1934. In all cases, fatal
accidents, injuries and property
damage have been decreased since
last year.
(E)-Shows the comparison for
A. the last three years of arrests and
convictions on traffic violations. This
w report shows to you efficient oper-
ation of the Police Court on serious
offenses.

Whereas, every organization
which has studied the problem of
motoring taxation has agreed that
as soon as the primary roads of any
state are completed, a portion of
the motoring taxes should be allot-
ted to the cities wherein those taxes
are raised for the maintenance, up-
keep, and construction or recon-
struction of streets used by all mo•
torists; and
Whereas, the use of motoring tax-
es for purposes other than highway
construction, maintenance and safe-
ty in the state of Iowa would fur-
ther delay the tittre at which a por-
tion of motoring taxes could be used
to reduce or eliminate special as•
sesstnents far the construction or
re-construction of pavement; and
Whereas, even the Congress of
the United States has incorporated
into the law of the United States a
definite statement to the effect that
it is unfair to use motoring taxes
for any pm•pose other than highway
construction, maintenance, and safe-
ty;
Therefore, we, the Council of the
City of Dubuque, do hereby endorse
the campaign of the A. A. A. Motor
Chrbs of iowa to bring about an
amendment to the constitution of
the State of Iowa to permanently
require that all motoring taxes must
be used for highway construction,
maintenance and safety; and
Be it further resolved that a copy
of this resolution be sent to each
representative of Dubuque County in
the General Assembly, with a letter
from this Council, urging our as-
semblymen to `vork and rote for
the adoption of properly worded
amendments to require that all mo-
toring taxes be used for highway

RESOLUTION PROPOSING A SUP•
PLEMENTAL ESTIMATE OF
GRADING FUND TAXES.
Whereas, the City of Dubuque, in
the County of Dubuque and State of
)owa, heretofore pursuant to and in
strict compliance with all laws ap-
plicable to said City, lawfully ordr
ered the construction of cet•tain
grading improvements in said City,
the cost thereof to the amount of
Forty Thousand ($40,000) Dollars to
be borne by the City of Dubuque,
and to be paid from a tax to be
levied on all the taxable property
within said City; and
Whereas, it is now advisable to
make provision for the payment of
said costs to be borne by said City
from the City Grading Fund and to
make a supplemental estimate for
taxes future years pursuant to the
provisions of Chapter 24 of the Code
of Iowa, 1931, such provision hav-
ing not yet been made, said City
being a City of the first class and

Whereas, no other indebtedness or
obligations are payable from the tax-
es authorized by Section 6211, Sub-
division 1, Code of Iowa, 1931, to be
collected for the City Grading Fund
with the levies for the year 1935
(for collection during the year 1936)
or any subsequent levies, except on
bond issue of $100,000.00 dated July
15, 1924, the first series thereof
maturing in 1939 and the last in
1944, the interest rate thereof being
41/z% Per annum, for which issue
there has been pledged for the pay-
ment of principal and interest an
annual tax levy of not to exceed two
(2) mills on the dollar upon the tax-
able property within said City, one
mill, or so much thereof as may be
necessary to be levied upon all the
taxable property within said City
(subject to such taxes) for the years
1924 to 1938, both inclusive, to pay
the interest upon said bonds and a di-
rect annual tax of not exceeding two
mills on the dollar, or such portion
thereof as may be necessary, upon
the taxable property within said
City (subject to such taxes) for the
years 1939 to 1944, both inclnsive,
to pay principal and interest upon
said bonds as they mature, which
issue of bands will be ret-fired serial-
ly, the first series of $10,000 coming
due in 1939, the second $1.0.000 in
1940, the third of $10,000 in 1941,
the fourth of $10,000 in 1942, the
fifth of $30,000 in 1943, and the sixth
of $30,000 in 1944, and except one
bond issue of $76,000 dated July 1,
1926, of which issue there remains
outstanding $45,000 of which $15,000
matm•es on July 1, 1936, $15,000 on
July 1, 193fi, and $16,000 on July 1,
1937, for which issue there has been
pledged for the payment of principal
and interest an annual tax levy of
not to exceed three (3) mills an the
dollar (or so much thereof as may
be necessary) upon the taxable pro-
perty within said City (subject to
such taxes); and
Whereas, only a portion of the
authorized tax is needed for the pay
ment of principal and interest of all
outstanding bonds, and there re-
mains asufficient portion of the
authorized tax to pay principal and
interest, as the same respectively
mature, of the bonds herein provid-~
ed for, and the City h'as at no time
done anything to prevent the collec-
tion and application of such tax at
this time, and the full amount of
said annual taxes stand free from all
pledges, except as hereinbefore
§tatetl; and
Whereas, during all the time that
the bonds herein provided shall be
outstanding, one-half (~) mill of
the authorized tax upon the assessed
value of the taxable property within
said City will be available for the
payment of principal and interest
thereof, said one-half mill, or so
much thereof as may be necessary,
may be pledged for the payment of
principal and interest of these
bonds; Now, Therefm•,
Be it resolved by the City Coun-
cil of the City of Dubuque:
Section 1, That a supplemental
estimate for the levy of taxes for
each of the years 193b to 1941 in-
clusive be made as follows:
That in pursuance of Section 6211,
Subdivision 1, Code of Iowa 1931,
as amended, there shall be levied,
assessed and collected a direct an-
nual tax of one-half (t/Z) mill on
the dollar of assessed valuation (or
such portion thereof as may be nec-
essary) upon all the taxable proper-
ty within said City for each of the
years 1935 to 1941 inclusive, suffi-
cient to produce the net annual sums
as hereinafter provided for the pay-
ment of principal and interest upon
said bonds as they mature.
Section 2. Said taxes shall be col-
lected each year at the same time
and in the same manner as, with
and in addition -to all other taxes
in and far said City, and when col-
lected shall be converted into a spe-
cial fund to be known as "City
Grading Fund, February 1, 1935:'
Section 3. That this Council meet
on the 21st day of January, 1935,
at the Council Chamber in the City
Hall, within said City at 4:00 o'clock
P. M., at which tune and place any
person subject to such tax shall be
heard in favor of or against the
same or any part thereof.
Section 4. That the Mayor and
City Clerk are hereby directed to
give notice of said supplemental
estimate setting forth the time when
and the place where Said hearing
will be held, by publication at least
ten days before said hearing in the
Telegraph-Herald and Times-Journal,
a newspaper published in said City,
which supplemental estimate shall

20th Street and Central Avenue on
East 20th Street and Rhomberg Av-
enue to the junction of Rhomberg
Avenue and Lincoln Avenue-a dis-
tance of 1,995 miles and,
Whereas the Council has informed
itself as to said improvement, and
has examined said plans therefore.
Now therefore be it resolved by
the Council of Dubuque:
1. That the said Council of Du-
buque hereby consents to the pro•
posed improvement of the extension
of Primary Road No. 61 within the
City of Dubuque, and,
2. That the plans for said pro•
posed improvement as now on file
in the office of the Clerk of said
City are hereby approved, and,
3. That said Council will take
such legal steps, and institute and
prosecute to a conclusion such legal
proceedings as are required by law
to establish grade lines of said

transmission line with all necessary
appurtenances thereto in exchange
for the surrender of all rights and
interest in and to Mineral Lots 298,
299, 300, commonly known as "Mu-
nicipal Airport;' and declaring an
emergency, said ordinance having
been passed upon first and second
readings on Januaty 7th, 1935, pre-
sented and read a third time.

~~hereas, The Interstate Power
Company is the owner of an ease-
ment in perpetuity over and across
D4ineral Lots No. 298-299-300, in the
City of Dubuque, and uses the same
far the maintenance and operation
of its electric transmission line;
and
Whereas, the City of Dubuque has
acquit•ed said lots for the purpose of
establishing and operating an Air-
port thereon, and the continued
maintenance of said transmission
line with its poles and wires upon
said lots, constitute a hazard to the
operation of said Airport; and
Whereas, said Interstate Power
Company has agreed to the abandon-
ment of the operation of said trans-
mission line across said lots and, by
quit claim deed convey to the City
of Dubuque all of its tights, interest,
and title thereto, and to re-establish
and re-locate said transmission line
upon publicly owned property, as
herein described, at its own ex-
pense; and
Whereas, this Council, in consid-
eration of the abandonment of said
ttansmiasion line on and across said
lots, and the ~ onveyance of all of its
interest in and to the same to the
City of Dubuque and the reestablish-
ment of said transmission line at
the place and places hereinafter de-
scribed at the sole expense of said
Interstate Power Company, deems it
advisable to grant sand convey to
said Interstate Power Company, its
successors and assigns, a right of
easement over and across the
streets, alleys, and public lands here-
in described, tivith the right to con-
sttvct, maintain and operate al] nec-
essary poles, wires, and towers in,
over, and across the same:
Now, Therefore,
Be It Ordained by the Council of
the City of Dubuque:
Section 1. In consideration of the
matters and things more particulat-
]y set forth in the preamble hereof
to be done and performed by the
Interstate Power Company, that
there be, and there is hereby given,
granted and conveyed to said Inter-
state Power Company, its successors
and assigns, a right of easement
over the streets, alleys and public
lands herein described, for the pur-
pose of construction, maintaining
and operating an electric transmis-
sion line thereon together with the
necessary appurtenances thereto be-
longing, said easement being more
particularly described a5 follows:
Beginning at a point in Lot 593-
Ham's Addition to the City of Du-
buque, Iowa-said point being 150'
Northwesterly from the Westerly
Line of Prescott Street and also ap-
proximately on the Center Line of
Whittier Street if extended North-
westerly through said Lot No. 593;
thence Southeasterly for a distance
of 150' across the Southeasterly 150'
thereof to the Westerly Line of
Prescott Street; thence along or
near the Center Line of Whittier
Street and in a Southeasterly direc-
tion to a point 44' Southeast of the
Easterly Line of Garfield Avenue
wlrere a steel tower with foundation
dimensions 25' x 25' may be erected
and maintained.
,Again beginning at the point of
intersectien of the West Meander
line of Lake Peosta, said points .be-
ing approximately midway between
Hamilton and Whittier Streets in
Ham's Addition to the City of Du-
buque, Iowa; thence in an irregular
but generally Southerly course, East-
erly from the West Meander Line
to Lake Peosta, which is City-awned
property, to a point of intersection
of the East Line of Lot 626 in East
Dubuque Addition Nc. 2 to the City
of Dubuque, Iotiva, all of which is
substantially shown by map attach-
ed designated as Exhibit "A," same
being a part hereof.
The City of Dubuque, Iowa,, here•
by grants permission to construct,
own and operate an electric trans-
mission line over all streets, alleys
and public ]ands designated on Ex-
hibit "A," irrespective of the voltage
thereof or the limitatio^ of voltage
provided for under franchise, said
project extending from Lot 1 of 1 of
1 of 1 in Mineral Lot No. 304 at the
north, thence in a general Southerly
direction to the present site of the
Special Session, January 21st, 1935 19
substation of the Interstate Power
Company in Lot 1 of Lot 1 of Lot 1
of Lot 1 of Congressional Lot 8 in
the City of Dubuque, Iowa.
Sec. 2. That all rights of ease•
ment herein granted to said Inter-
state Power Company, its success-
ors and assigns, shall become in
force and effect when said Inter
state Power Company slrall, by quit
claim deed, convey all of its interest
in and to Mineral Lots Nos. 298.299•
300 to the City of Dubuque, and,
when this ordinance shall have been
adopted and approved as herein pro-
vided.
Sec. 3. This ordinance being
deemed urgent and in the interest
of public health, safety 'and conven-
ience, shall become effective upon
its final passage, adoption, and ap-
proval by the City Council and pub-
lication as provided by law.

Gentlemen: In connection with
the petition filed October 19th by
Rlrs. Theresa Witter and Mr, Wm.
Witter to have a reduction made in
the paving assessment on Roosevelt
Street an Lot 2, Sub. 2 of 1 of 2 of
2 of Min. Lot 307, this petition was
referred to Council to view the
ground and make a definite decision
following said view.
Accordingly, at about 4:30 P. M.,
January 11th, Councilmen Andel-
finger, Roberts and Schiltz met with
Mr. Wm. Witter at the site of this
particular tract. Explanation was
made that the original paving assess•
ntent amounted to $1,293.70; that the
credit of 30% was applied to this
due to the Government grant, which
reduced the assessment to $906.59;
that the basis of making assess-
ments on Roosevelt Street was in
accordance with }/4 actual value of
the property prior to paving, which,
in this case, was listed at $300.00,
plus '/~ of the actual paving costs of
the 70% assessment which increased
the i~ valuation and the r/4 new
value of paving to $526.00. Accord-
ingly, the assessment was originally
levied at $526.00 and the City as-
sumed $379.59,
Mr. Witter was advised by the
Councilmen that no possible reduc-
tion could be made in his tract with-~,
out making reductions on all tracts.
Accordingly, the petition was denied,

Gentlemen: Relative 'to petition
of Lena Merkes, which was referred
to me for investigation and report,
beg to report that at a tax sale,
September 7, 1931, the City of Du-
buque purchased the undivided ~ of
West 27' of E. 60' of N. 1.5 of Lot
440 in the amount of ,$73.72 and the
City E. 33' of E. 60' of.N, 1.5 of 440
in the amount of $88.64.
Therefore, there are uo unpaid as-
sessments for the improvement of
Central Avenue against this prop•
erty,
I also find, upon further investiga•
tion, that the 1932 regular tax of
$44.92 and the 1933 regular tax of
$7G.33 and the regular tax of 1934
of $79.99, together with penalties
and advertising, remain unpaid on
the records of the County Treasurer.
I do not find any street assess-
ments against this property for the
improvement of 18th Street, except
that portion which is assessed for
Central Avenue.

Gentlemen: I am advised today
that the request for tax suspension
presented to City Council by Miss
Rosins Durand and discussed by the
City Council on December 13th was
denied. I regret exceedingly that
this action was taken in the case of
this particularly old and deserving
lady. Had the writer been familiar
with this particular claim, I would
have recommended that suspension
be grouted,
For your information, the taxes on
Miss Durand's property have bean
suspended every year since 1928,
with the exception of two years.
