such vacated ground, approximately

Mr. George Roepsch addressed the
Council expressing his opposition to
both Rafferty Slough and Comisky
Field sites for the building of the
swimming pool and stating that he
was opposed to any move to abo]-
ish the municipal beach at Eagle
Point even though a pool is con-
structed. Msgr: A. Boeding express-
ed his opposition to Comisky Field
as the site for the swimming pool
and stated that he favored a river
beach more than an artificial pool,
Mr. B. A. Ruegnitz expressed himself
as being in favor of the Eagle Paint
Beach,

3, also described as Mineral Lot 305a
in the Southeast Quarter (S. E. i/4)
of fractional Section 7, Township 89,
N. R. 3E of 5th P. M.; more par-
ticularly described as follows:
All that part of Lot 1 of Lot 1

305a lying between the easterly
right-of-way of Chicago, Milwaukee,

of easement be and the same is
hereby authorized to be executed by
the Mayor and Clerk on behalf of
the City of Dubuque conveying to
the Dubuque and Wisconsin Bridge
Co., i'ts successors and assigns, a
'right of easement in perpetuity over
and across the real estate herein
described for the purpose of main-
taining aportion of its bridge in its
present location, and so as not to
interfere with the use and occupancy
of said real estate except to the ex-
tent hereby authorized,

the Tax Sale Certificates held by
the City of Dubuque against the
C. L. Sheffield property known as
Lots 19 and 20 Grandview Heights
Addition be allowed to be redeemed
upon payment of the face value of
the certificates plus 5% interest and
the City Treasurer be instructed ac-
cordingly and also that the City
Treasurer be instructed to accept
payment of the special assessments'
levied against Lots 19 and 20 Grand-
view Heights Addition for the con-
struction of the sanitary sewer in
Grandview Heights Addition in the
original amounts as levied plus 6%

and up to, or on March 31, 1935 in

for want of funds" bearing interest
at the rate of Four and One Quarter
(4i/4%) Per Centum per annum,

Icwa, said City agrees to liquidate
such indebtedness on or about April
1st, 1935 in either of the following
methods as selected by you and writ-
ten notification of such selection
mailed to the Mayor not later than
April 1st, 1935.
FIRST METHOD. In exchange far
a like amount of said indebtedness
of said City, the City agrees to de-
liver to you on or about April 15th,
1935, legally issued 4% Funding
Bonds of said City in an amount
equal to the amount of City indebt-
eduess you hold, said bonds to ma-
ture as mutually agreeable.
SECOND METHOD. The City
agrees to sell at a public sale on
or about April 1st, 1935, funding
bonds of said City in an amount
equal to said indebtedness you hold
and to apply the proceeds to such
an amount as will liquidate said in•
debtedness or to retire said indebt-
edness out of other funds available
for such purpose or to retire said
indebtedness from bond proceeds of
such bonds as may be sold and from
other funds available for such pur•
pose so that said indebtedness will
have been retired in full.
If you select the first method
above mentioned, then prior to ex•
change of said indebtedness for
said bonds, the City agrees to furn-
ish you with a certified transcript
of proceedings pertaining to the evi•
deuce of said indebtedness and per•
taining to said bond issue which
shall show their legality to the satis•
faction of Attorneys, Chapman and
Cutler, and furnish such other legal
proceedings as they may require for
this purpose. The City agrees to
furnish the printed bonds and the
approving opinion of said Attorneys
and lend full co-operation in•tarry
ing out the suggestions of said at•
torneys in the issuance of said bands
and to defray any local expense in-
cident thereto, including the fees of
local counsel if such counsel be re•
quired by said attorneys.
It is hereby understood, however,
that we reserve the right of retiring
warrants issued prior to April 1st,
1935, providing we have cash in the
various funds received from taxation
that can be used to pay warrants
issued between July 1st, 1934 and
March 31st, 1935.

Gentlemen: The request has been
made to the writer, through a local
Dubuque industrial firm, to ascertain
from the City Council whether or
not a sale would be authorized on
the south 75' width of Lot 1, Block
D, of the Industrial Subdivision des-
ignated Rafferty Slough.
This particular area desired faces
on South Locust Street for a dis-
tance of 75.63' and extends eastward~
ly to Lot 3 of said block 184.05'.
Charter Street abuts this property
on the south.
The price used for the sale of oth•
er sections in this Industrial Subdi-
vision has been approximately 10c
per sq. ft. The approximate area
of this 75' x 185' section is 13,941
sq. ft., which, at lOc, would make a
minimum price of $1,394.00. In ad-
dition to this, there is a paving as-
sessment on Lot 1, Block D, equival-
ent to $1,037.49 of which the pra•
portionate share applicable to the
south 75' of said block would be ap-
proximately $416.00, making a total
amount involved in City cost of ap•
proximately $1,810.00.

Gentlemen: The writer recently
conferred with 112r. Frank Wester-
camp at East 17th Street and Cen-
tral Avenue in connection with the
City Council's decision upon his re-
cent request. As you remember, the
Council determined that permission
be granted Mr. Westercamp to elim~
intte the upper 12" or more of the
present stone curb north of his prap•
erty between Central Avenue and
the alley directly east thereef. A
step was to be installed at the "'top
of the lower portion of the curb to-
ward the property line from the
present face of the curb. The work
was to be done at the expense of
Mr. Westercamp and under the su-
pervision of the City Engineer.
After explaining this decision to
Mr. Westercamp, he advised that
this was not practical and he did
not desire any such form of con-
struction. He pointed out the curb
west of Central Avenue on West
17th Street and said that tivas the
type of construction desired and ask-
ed that the writer advise the City
Council of his secondat•y request and
to assure the City Council that, in
his opinion, this would be a safer
arrangement than the step into the
present curb.
Inasmuch as the new curb would
prevent cars .from driving too close
to the 2' high curb and damaging
fenders and running boards and pre-
vent passengers in the car from
opening the car doors, and inasmuch
as this curb would start at Central
Avenue and run cleat• to the alley,
anti traffic going eastwardly from
Central Avenue would see the.curb
the entire distance of the block, the
writer believes that this is the safer
method. Accordingly, your decision
on this desired method is again re-
quested. The entire construction of
this curb would be done at Mr.
Westercamp's expense.

the Zoning Ordinance, namely Jan-
uary 29, 1934, or the publication of
the same a few days later.
Accordingly, the owner of said ice
cream stand, Mr. Thomas D. May,
was potified to immediately cease op-
eration of the ice cream stand. This
notice was served on Mr. May Sat-
urday, June 16th. Upon his inquiry
and investigation, it was determined
that he could appeal to the Board
of Adjustment as to the Building
Commissioner's decision in connec-
tion with the operation of the Zon-
ing Ordinance.
The Board of Adjustment holds its
regular meeting the third Monday
of each month so that in the after-
noon of June 18th this question was
considered and Mr. May had been
previously advised of the meeting.
The question was introduced and
considered by the Board of Adjust•
ment and after discussion by Mr.
May, the owner of the stand, and
objectors of the stand, namely
Messrs. Falkenhainer, Kruse,
Fluetsch and Baumhover, Mr. Smith
advised that the Board of Adjust-
ment was interested only in deter-
miniug as to whether or not the ice
creaur stand at Julien and Mt. Pleas•
ant was a violation of the present
Zoning Ordinance.
Mr. May stated that he had a
lease on the property until June of
1936 and paid rental on said location
the entire year regardless of wheth•
er he was open in summer only. He
further stated that his equipment
had been stored in a building
throughout the winter and that his
business at this particular location
was similar to a skating rink or
other use where only certain por•
tions of the year could be used.
After the general discussion of the
question, the Board of Adjustment
requested that the original copy of
the lease be presented to them for
study and consideration. The lease
was presented to the Board of Ad-
justment and at their regular month-
ly meeting of July 16th it was de•
termined that the location and use
was not in violation of the Zoning
Ordinance due to the fact that this
particular business had been in oper-
ation prior to the passage of said
ordinance. Attached is a copy of
the decision of the Board of Ad•
justment permitting the continuation
of the ice cream stand at this por-
titular location. Accordingly, the
writer sees no other method of re-
course to remove the ice craem
stand at this location. However, it
has been pointed out to Mr. May
that there are serious objections to
his operation at this particular loca-
tion and it may be possible that he

Gentlemen: At the special Coun-
cil meeting held July 10th a letter
from the writer was presented ad-
vising of a request to the Council to
sell to the Flynn Bros. of Dubuque
the southerly 75.63' section of Lot
1 of Block D of the Industrial Sub•
division of Rafferty Slough. The
requested area desired was approx-
imately 75'x 184' along the north
side of Charter Street. This matter
was referred to the Council to view
the ground.
Accordingly, on Thursday after-
noon, July 12th, Mayor Kane, Coun-
cilmen Schiltz and Jaeger viewed
this site and after careful deter•
urination made the decision that it
was not practical to sell a portion
of Lot 1 of Block D which faced
Locust Street and on the side was
adjacent to Charter Street as this
wculd quite likely involve a detri•
went to the sale of Block D. The
request was denied.
The members of the Council pres-
ent were then shown a triangular
section fronting on South Locust
Street north of this particular loca-
tion, designated Lot 1 of 6, 2 of 6
and 3 of 6 of City Lot 551. The
frontage on Locust Street of this
particular triangle is approximate:
ly 150', with a depth to Harrison
Street of approximately 264' on the
north line and approximately 287'
on the south line. The approximate
area of this triangle is 19,000+
sq, ft.
After viewing this particular tri-
angle and ascertaining that it was
at the north end of the entire Raf-
ferty Slough property owned by the
City and that the sale of this pro-
perty would not injure any adja-
cent property, the Council deter-
mined that the property should be
offered for sale at the general rate
of lOc per sq. ft. which has applied
to other properties sold in Rafferty
Slough, with a slight reduction be-
cause of the triangular area in-
volved and the fact that practically
no front exists at the rear of the
lot abutting Harrison Street. Ac-
cordingly, the price set on this pre•
posed triangle was $1,900.00. The
Flynn Bros. were advised of this
decision and it is their request that
the property designated by the
above description be authorized to
be sold to them at once for $1,900.00.
The City Engineer has made a
careful survey of the entire area
south and north of this particular
triangle and the determination has
been that the frontage on Locust
Street has been slightly decreased.
The corners of the entire area have
been staked and the property is still
desired by the Flynn Bros.

the City of Dubuque, Iowa, accord-
ing to the United States of Commis-

Resolution No. 75-34.
Whereas, representatives of the
Chicago, Milwaukee, St, Paul & Pa-
cific Railroad Company have satis-
fied the members of this Council
that said railroad company has an
opportunity of securing a substantial
industry or industries for the City of
Dubuque to be located upon a por-
tion of the railroad shops property,
but the officials of said industry de-
mand an assm•ance of the City of
Dubuque that they hill not be dis-
turbed in their possession and occu-
pancy of said premises due to cer•
tain conditions, reversions and con-
siderations contained within a deed
of conveyance from the City of Du-
buque to the Chicago, Miwaukee &
St, Paul Raihvay Co., its successors
and assigns, dated March 14, 1881,
and in certain ordinances vacating
parts of streets, alleys and public
places, before they decide to locate
upon said promises: and
Whereas, this Council deems it
necessary for the best interests of
the City of Dubuque and its inhab=
itants that such industry or indus-
tries be secured as quicltly as pos-
sible; Now, Therefore:
Be It Resolved by the Council of
the City of Dubuque, that the pro-
posed location and establishment of
said industry m• industries upon a
portion of the property and buildings
of said railroad company and va-
toted streets, alleys and public
places be and the same is hereby
approved and said company is auth-
orized to permit the use of so much
of said property and buildings by
said industry or industries, as will be
reasonably necessary for their pres-
ent establishment and future expan-
sion, and it is hereby expressly de-
clared that such use of said prem-
ises will not be construed at any
time by the City of Dubuque as con-
stituting abreach of the terms and
conditions of said deed of March 14,
1881, or vacation ordinances so as
to afford said City the right to en-
force the reversionary provisions
thereof.

provided for, shall not be considered
as an abandonment of the establish-

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-
of, on the first day of April, A, D,
193....; or any time before that date
at lire option of the City, lire sum of
$500.00 (Five Hundred Dollars) with
interest thereon at the rate of five
per cent per annum, payable on the
presentation and surrender of the
interest coupmrs hereto attached
both interest and principal are pay-
able at the office of the City Treas-
urer in the City of Dubuque in the
State of Iowa. This bond is issued
by the City of Dubuque pursuant to
'and by virtue of Chapter 311 of the
Code of Towa, 197.7, and in accord-
ance with a resolution of the City
Council of said City, duly passed on
the 30th day of July, 1934. This
bond is one of a series of 95 bonds,
94 for $500.00 numbered from 3550
to 3643 inclusive, and one far $151.48,
numbered 3644, all of like tenor and
date, and issued for the purpose of
the paving of Main Street and South
Itlain Street forty-one (41) feet wide,
including curbs, from the north prop-
erty line of Charter Street to the
south property line of West Seven•
teenth Street, Section No 2, Jones
Street to West Thirteenth Street,
and described in said resolution;
which cost is assessable to and lev-
ied along said improvement, and is
made by law a lien on all abutting
or adjacent property, and payable in
ten annual installments, with in-
terest on all deferred payments at
the rate of five per cent, per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said
money can be used for no other
purpose. And it is hereby certified
and recited that all the acts and
conditions and things required to be
done precedent to and in the issuing
of this series of bonds, have been
done, happened and performed in
regular and due form as required by
said law and resolution; and for the
assessments, collections and pay-
ment hereon of said special tax, the
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.
In Witness Whereof, the City of
Dubuque by its City Council has
caused this band to be signed by its
Mayor and countersigned by its City
Clerk, with the seal of said City af-
fixed this 30th day of July, 1934, and

9, 1934, was presented to the City
Council on July 19th, 1934, signed
by W. A. Franzen, et al, requesting
that the parking regulations pn the
east side of Iowa Street from 11th
to 13th Streets be changed to a diag•
anal angle system, Cpmplalnt was in-
cluded, stating that except during
market hours in the morning, a seri•
ops hardship was encumbered on
property owners, tenants and custom-
ers by reason of the required park-
ing system, parallel to the curb.
This matter was referred to the
City Manager for investigation and
report.
Accordingly, the following data is
presented from Chief Giellis, Mr, Mc•
Carthy and the writer.
For years the farmers and huck•
stets have been allowed to park at
right angles to the east curb of Iowa
Stl•eet from 11th to 13th Streets,

condition. The siding is partly
pulled off, ratted and exposed.
The large openings would permit
a spark to ignite any storage
materials within. Either the en-
tire alley side walls should be
rebuilt, or the entire shed re-
moved. This shed is north of the
brick two story building occu-
pied by O'Hearn's Meat Market.
Proper Council action should be
taken on Items 1, 3 and 4 to auth-
orize the necessary procedure of
eliminating these three hazards and
improving conditions.
