Van Milligen, City Manager SUBJECT: Acceptance of Street Improvements in Pine Knoll Subdivision DATE: April 30, 2018 City Engineer Gus Psihoyos recommends City Council acceptance of the public improvements that the owners, Pine Knoll Homeowners Association, have recently completed in Pine Knoll Subdivision. The improvements for Katrina Circle were initially approved and constructed in 1999- 2000 as a private street. The street originally consisted of 27' wide colored concrete pavement in a 40' wide easement. The water and sewer utilities in the development have been accepted and are being maintained by the City. The Homeowner's Association has been pursuing options for repairing the damaged street improvements (including street pavement, curb and gutter, sidewalks, and storm sewers) for several years. It is the City's general policy, with some exceptions, to accept street improvements in residential subdivisions if they are constructed or re-constructed to current City Standards. An agreement was executed by the City and the Homeowner's Association in September of 2014. As a condition of this Agreement, the Pine Knoll Homeowners Association was required to install certain improvements including streets, sidewalks, storm catch basins, and street lighting and to dedicate these improvements to the City upon completion. The street improvements would serve the existing and proposed townhome units in this residential subdivision. Reconstruction of the streets was started in 2014 and completed in 2015. In 2015 and again in 2017, the public street improvements were inspected by City Engineering staff and deemed to meet City Standards. Because the streets have been installed for over three years with no signs of an issue, the warranty period will be waived. The City is accepting the streets, sidewalks, storm catch basins and street lighting which serve the existing and proposed townhome units in this residential subdivision. In conjunction with the acceptance of the street improvements, the Home Owners Association is dedicating the Katrina Circle Street right-of-way via warranty deed. The existing storm water detention basin facility will continue to be owned and maintained by the Homeowners Association, and the Homeowners Association will maintain, in perpetuity, the public sidewalk along the south side of Kane Street adjacent to the Katrina Circle right-of-way and also all newly constructed public sidewalks along Katrina Circle. This subdivision is located south of Kane Street across from Wahlert High School. BACKGROUND The improvements for Katrina Circle were initially approved and constructed in 1999- 2000 as a private street. The street originally consisted of 27' wide colored concrete pavement in a 40' wide easement. The water and sewer utilities in the development have been accepted and are being maintained by the City. The home owner's association has been pursuing options for repairing the damaged street improvements (including street pavement, curb and gutter, sidewalks, and storm sewers) for several years. In 2008 the City and the home owner's association had attempted to come to an agreement whereby the City would design and build the street improvements and then assess the home owners for the cost. At that time the home owner's association voted against the proposal for the City to design, build and then assess the owners. In 2013 the engineering department was again contacted by the Pine Knoll Condominiums home owner's association on this issue. The Home Owners Association (HOA) stated that there is association support for replacement of the street improvements and dedication of the street improvements to the City for ownership and maintenance. It is the City's general policy, with some exceptions, to accept street improvements in residential subdivisions if they are constructed or re-constructed to current City Standards. An agreement was executed by the City and the HOA in September of 2014. As a condition of this Agreement, the Pine Knoll Homeowners Association was required to install certain improvements including streets, sidewalks, storm catch basins, and street lighting and to dedicate these improvements to the City upon completion. The street improvements would serve the existing and proposed townhome units in this residential subdivision. In conjunction with the acceptance of the street improvements, the agreement also requires the HOA to dedicate the Katrina Circle Street right of way (Lot A of Pine Knoll Subdivision) to the City of Dubuque via warranty deed. In 2015, the HOA initiated the process of dedicating the street right of way but was unable to obtain consent from all property owner� at that point in time. With some changes in ownership, all property owners are now currently consenting, so the City may accept dedication of the street and street right of way. DISCUSSION The Unified Development Code requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On June 29, 2015, the owners requested City's acceptance of the roadway improvements in Pine Knoll Subdivision. Upon inspection by the City and IIW PC Engineers, it was determined that the public improvements required by said agreement have been completed in accordance with plans approved by the City Staff and in conformance with City specifications. Reconstruction of the streets was started in 2014 and completed in 2015. In 2015 and again in 2017 the public street improvements were inspected by City Engineering staff and deemed to meet City Standards. Because the streets have been installed for over three years with no signs of an issues the warranty period will be waived. RECOMMENDATION I would, therefore, recommend that the City Council accept the public street improvements as described above. Prepared by Nate Kieffer, PLS RESOLUTION NO. 120-18 ACCEPTING PUBLIC ROADWAY IMPROVEMENTS IN PINE KNOLL SUBDIVISION IN THE CITY OF DUBUQUE, IOWA Whereas, pursuant to Agreement dated September 11, 2014, certain public roadway improvements including streets, sidewalks, storm catch basins, and street lighting, were installed by the Pine Knoll Homeowners Association in Pine Knoll Subdivision in the City of Dubuque, Iowa; and Whereas, the roadway improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public roadway improvements in Pine Knoll Subdivision be and the same is hereby accepted. Section 2. That the existing storm water detention basin facility will continue to be owned and maintained by the Pine Knoll Homeowners Association. Section 4. That the Pine Knoll Homeowners Association will maintain, in perpetuity, the public sidewalk along the south side of Kane Street adjacent to the Katrina Circle right of way and also all public sidewalks fronting on the Katrina Circle right of way in Pine Knoll Subdivision. Section 5. That the Pine Knoll Homeowners Association will complete public sidewalk installation along the frontages of Lots 3, 4, and 5 in Pine Knoll Subdivision at the time that building construction on each lot is completed or no later than twenty-four months after the effective date of this Acceptance of Street Improvements Resolution. Section 6. That the Pine Knoll Homeowners Association designates parking on one side only with appropriate signage as directed by the City. Section 7. That the Pine Knoll Homeowners Association agrees to not hold the City of Dubuque responsible for snow that is plowed onto sidewalks by city crews. Because existing conditions would only allow for a narrow street right of way, no parkway between the sidewalk and curb was able to be included in the street reconstruction design.
