Katrina Circle Street Right of Way - Pine Knoll Subdivision
INTRODUCTION
The purpose of this memorandum is to seek acceptance of a Warranty Deed from Pine
Knoll Homeowners Association for a right-of-way to accommodate the newly
constructed roadway improvements in Pine Knoll Subdivision. This subdivision is
located south of Kane Street across from Wahlert High School.
BACKGROUND
The improvements for Katrina Circle were initially approved and constructed in 1999-
2000 as a private street. The street originally consisted of 27' wide colored concrete
pavement in a 40' wide easement. The water and sewer utilities in the development
have been accepted and are being maintained by the City. The home owner's
association has been pursuing options for repairing the damaged street improvements
(including street pavement, curb and gutter, sidewalks, and storm sewers) for several
years. In 2008 the City and the home owner's association had attempted to come to an
agreement whereby the City would design and build the street improvements and then
assess the home owners for the cost. At that time the home owner's association voted
against the proposal for the City to design, build and then assess the owners.
In 2013 the engineering department was again contacted by the Pine Knoll
Condominiums home owner's association on this issue. The Home Owners Association
(HOA) stated that there is association support for replacement of the street
improvements and dedication of the street improvements to the City for ownership and
maintenance. It is the City's general policy with some exceptions, to accept street
improvements in residential subdivisions if they are constructed or re-constructed to
current City Standards.
An agreement was executed by the City and the HOA in September of 2014. As a
condition of this Agreement, the Pine Knoll Homeowners Association was required to
instaii cer�ain improvem�nfs i�clu�i�g ��r����, sid��rv�lk�, �to�m catcti basins, and street
lighting and to dedicate these improvements to the City upon completion. The street
improvements will serve the existing and proposed townhome units in this residential
subdivision.
Reconstruction of the streets was started in 2014 and completed in 2015. In 2015 and
again in 2017 the public street improvements were inspected by City Engineering staff
and deemed to meet City Standards. Because the streets have been installed for over
three years with no signs of an issues the warranty period will be waived.
In 2015, the HOA initiated the process of dedicating the street right of way but was
unable to obtain consent from all property owners at that point in time. With some
changes in ownership, all property owners are now currently consenting, so the City
may accept dedication of the street and street right of way.
DISCUSSION
The Agreement also requires the HOA to dedicate the Katrina Circle Street right of way
(Lot A of Pine Knoll Subdivision) to the City of Dubuque via warranty deed.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the Warranty Deed from the
Pine Knoll Homeowners Association and dedicate Lot A of Pine Knoll Subdivision to the
public as street right of way.
ACTION TO BE TAKEN
I respectfully request adoption of the attached resolution accepting the Warranty Deed
from Pine Knoll Homeowners Association and dedicating Lot A of Pine Knoll
Subdivision to the public as street right of way.

A RESOLUTION ACCEPTING A CONVEYANCE OF PROPERTY (LOT A OF PINE
KNOLL SUBDIVISION IN THE CITY OF DUBUQUE, IOWA) FROM PINE KNOLL
HOME OWNERS ASSOCIATION AND DEDICATION OF PROPERTY AS PUBLIC
RIGHT OF WAY
Whereas, the City of Dubuque entered into an Agreement with Pine Knoll Home
Owners Association dated September 11, 2014 pursuant to which Pine Knoll Home
Owners Association agreed to convey Lot A of Pine Knoll Subdivision in the City of
Dubuque, Iowa as shown on the Final Plat of Pine Knoll Subdivision Document No.
2013-0016907 in the Dubuque County Recorder's Office; and
Whereas, Pine Knoll Home Owners Association has executed a conveyance of said
property; and
Whereas, the terms of the Agreement have been fulfilled.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts, and consents to the Warranty Deed from Pine Knoll Home Owners
Association, a copy of which is attached hereto, as required by Iowa Code Section
569.7.
Section 2. Lot A of Pine Knoll Subdivision in the City of Dubuque is hereby dedicated
to public as street right of way.
Section 3. The Mayor is hereby authorized and directed to execute and acknowledge
on behalf of the City of Dubuque any instruments in connection herewith.
Section 4. The City Clerk is hereby authorized to and directed to record this
resolution and the Deed with the Dubuque County Recorder.

We, as members of the PineKnoll Homeowners Association Street Acceptance Committee, are
submitting a request for the City to accept the reconstructed Katrina Circle roadway
improvements.
We request acceptance of the dedication of the Katrina Circle Street right of way (Lot A of Pine
Knoll Subdivision)to the City of Dubuque by Warranty Deed,
All improvements have been constructed and/or corrected to the City of Dubuque Standards.
Final inspection of improvements was completed by the Engineering Department In November
2017.
Attached are the meeting minutes of the Pine Knoll Homeowners Association where the Bylaws
required vote was taken. Subsequent Owners Consent signatures were obtained and have been
submitted to the Engineering Department.
The City has all required inspection notes and reports as required by the City of Dubuque as
completed by IIW Engineering Dubuque lowa. All conditions have been met in the agreement
that the Association signed with the City of Dubuque.
The 49 unitholders of the Pine Knoll Homeowners Association express their gratitude, and
commend the Engineering, Planning, and Legal Departments for all the assistance and support
given during this process.
